			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide for coverage under the Medicare program
			 of certain mental health telehealth services.</official-title></form>
	<legis-body id="H494BD28F3FD14CDEAF782C1343F4779C" style="OLC">
 <section id="HA9E6DD88F7BC4D469A22F2A5A12A755E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mental Health Telemedicine Expansion Act</short-title></quote>.</text> </section><section id="HE6B4C23706CE42439F1571823ADE1A46"><enum>2.</enum><header>Medicare coverage of certain mental health telehealth services</header><text display-inline="no-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/42">42 U.S.C. 42</external-xref> U.S.C. 1395m(m)) is amended—</text>
 <paragraph id="H0F67DA99C03B41E9B1979477C79CDAD2"><enum>(1)</enum><text>in paragraph (4)(F)(i), by inserting <quote>services identified by CPT codes 90834 and 90837 (and as subsequently modified by the Secretary),</quote> before <quote>and any additional service</quote>; and</text> </paragraph><paragraph id="HB7E15870024F4499A63AB76E6A373074"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HE377338A7F91463FA8EF16E9319BF6F0" style="OLC">
					<paragraph id="H872E39D2354C46A6BA7A16576E9EB48B"><enum>(7)</enum><header>Treatment of mental health telehealth services</header>
 <subparagraph id="H1DE40B8E61024408B75A40F067F86DFA"><enum>(A)</enum><header>Non-application of originating site requirements</header><text display-inline="yes-display-inline">The requirements described in paragraph (4)(C) shall not apply with respect to telehealth services furnished on or after January 1, 2020, that are mental health telehealth services. Nothing in the previous sentence shall waive any applicable State law requirements.</text>
 </subparagraph><subparagraph id="HF3ED00C969EA49049E03C7496573C081"><enum>(B)</enum><header>Inclusion of certain sites</header><text>With respect to telehealth services described in subparagraph (A), the term <term>originating site</term> shall include the home of the eligible telehealth individual at which the individual is located at the time the service is furnished via a telecommunications system.</text>
 </subparagraph><subparagraph id="H620F8382B24C40359B69C517E00ED1AB"><enum>(C)</enum><header>No originating site facility fee</header><text>No facility fee shall be paid under paragraph (2)(B) to an originating site with respect to a telehealth service described in subparagraph (A) if the originating site does not otherwise meet the requirements for an originating site under paragraph (4)(C).</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H296CFE3A1BF14B788A95B206B79CA3D9"><enum>(D)</enum><header>In-person assessments required</header><text>Payment may not be made for mental health telehealth services under this paragraph (if such payment would not otherwise be allowed under this subsection without application of this paragraph) furnished to an eligible telehealth individual unless—</text>
 <clause id="H56E3D147597F4EE8AF43AAAA996737B7"><enum>(i)</enum><text>prior to the provision of such mental health telehealth services, a physician or practitioner furnished an in-person assessment of the needs of such individual for such services; and</text>
 </clause><clause id="HC42ECD72F93544CC99C0F559E135E51F"><enum>(ii)</enum><text>a physician or practitioner furnishes a reassessment of the needs of such individual for such services at a frequency specified by the Secretary.</text>
 </clause></subparagraph><subparagraph id="HE344E7B7789A405C8BBF44C6C69D56EB"><enum>(E)</enum><header>Mental health telehealth services defined</header><text>For purposes of this paragraph, the term <term>mental health telehealth service</term> means services identified by CPT codes 90834 and 90837 (and as subsequently modified by the Secretary).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
