<official-title display="yes">To direct the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office, in consultation with the Administrator of the Small Business Administration, to study and provide recommendations to promote the participation of women, minorities, and veterans in entrepreneurship activities and the patent system, to extend by 8 years the Patent and Trademark Office’s authority to set the amounts for the fees it charges, and for other purposes.</official-title>

<section id="H3873CE075A4449B494EC743761DC79DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Study of Underrepresented Classes Chasing Engineering and Science Success Act of 2018</short-title></quote> or the <quote><short-title>SUCCESS Act</short-title></quote>.</text> </section> <section id="H6B1F25DA18A24A3BB5065389003ED093"><enum>2.</enum><header>Findings; sense of congress</header> <subsection id="HF3C4931E5DEE4A0F8D9EA9E311623C99"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H13518FF78F0D4D389381FF1855777648"><enum>(1)</enum><text>Patents and other forms of intellectual property are important engines of innovation, invention, and economic growth.</text> </paragraph> <paragraph id="H811256ECF2E94ECF851393C9D636D712"><enum>(2)</enum><text>Many innovative small businesses, which create over 20 percent of the total number of new jobs created in the United States each year, depend on patent protections to commercialize new technologies.</text> </paragraph> 
<paragraph id="HC8D009DCDB434F5AAFDBD068AAB52D19"><enum>(3)</enum><text>Universities and their industry partners also rely on patent protections to transfer innovative new technologies from the laboratory or classroom to commercial use.</text> </paragraph> <paragraph id="H83C43F7193894957AE5D55689C162C18"><enum>(4)</enum><text display-inline="yes-display-inline">Recent studies have shown that there is a significant gap in the number of patents applied for and obtained by women and minorities.</text> </paragraph></subsection> 
<subsection id="H2122CC3361E541B291FFFB3F060E4EF6"><enum>(b)</enum><header>Sense of congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the United States has the responsibility to work with the private sector to close the gap in the number of patents applied for and obtained by women and minorities to harness the maximum innovative potential and continue to promote United States leadership in the global economy.</text> </subsection></section> <section id="H35ACD817DFA3407A859114A8CF3A3E72"><enum>3.</enum><header>Report</header> <subsection id="H6CC240E1B5CB4D8FB3E4BECB37FEE5B1"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Director, in consultation with the Administrator and any other head of an appropriate agency, shall conduct a study that—</text> 
<paragraph id="HCC3193BCADE248EB81793C46B37EA1F8"><enum>(1)</enum><text display-inline="yes-display-inline">identifies publicly available data on the number of patents annually applied for and obtained by, and the benefits of increasing the number of patents applied for and obtained by women, minorities, and veterans and small businesses owned by women, minorities, and veterans; and</text> </paragraph> <paragraph id="HB7B144859D604410923B3AA01058464F"><enum>(2)</enum><text>provides legislative recommendations for how to—</text> 
<subparagraph id="HFF8E6963828E41C6875DE32E3A1A989B"><enum>(A)</enum><text display-inline="yes-display-inline">promote the participation of women, minorities, and veterans in entrepreneurship activities; and</text> </subparagraph> <subparagraph id="HD280151C3A4D4160BC892C9992D83A29"><enum>(B)</enum><text display-inline="yes-display-inline">increase the number of women, minorities, and veterans who apply for and obtain patents.</text> </subparagraph></paragraph></subsection> 
<subsection id="H5B873338F45B411A92C9EF8926D9CC8C"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Director shall submit to the Committees on the Judiciary and Small Business of the House of Representatives and the Committees on the Judiciary and Small Business and Entrepreneurship of the Senate a report on the results of the study conducted under subsection (a).</text> </subsection></section> <section display-inline="no-display-inline" id="H280D27D3CEB44C859A0A50626950FC2A"><enum>4.</enum><header>Extension of fee-setting authority</header><text display-inline="no-display-inline">Section 10(i)(2) of the Leahy-Smith America Invents Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/29">Public Law 112–29</external-xref>; 125 Stat. 319; <external-xref legal-doc="usc" parsable-cite="usc/35/41">35 U.S.C. 41</external-xref> note) is amended by striking <quote>7-year</quote> and inserting <quote>15-year</quote>.</text> </section> 
<section id="HD5663E752CCA4183B313AA750FA5E9C3"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H3C3DA1380A034235B446EE653CAA02A9"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text> </paragraph> 
<paragraph id="H790FFC98EF3549F8A5DB4BFD95FC73D1"><enum>(2)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> means a department, agency, or instrumentality of the United States Government.</text> </paragraph> <paragraph id="H821B54B74B8B45B0A47D918B22FD9071"><enum>(3)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</text> </paragraph></section>
