			 available for the compensation of interns, and for other purposes.</official-title></form>
	<legis-body id="H2F30C380ED91484380035211505661A1" style="OLC">
 <section id="H8364B4202DF64A53A9E1A319D0076832" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>House Intern Pay Act of 2018</short-title></quote>.</text> </section><section id="HED64D20F67974DF8988F24F33706AF7C"><enum>2.</enum><header>Allowance for compensation of interns in House Member offices</header> <subsection id="H71BC71CD674946DCBB02E57410025A86"><enum>(a)</enum><header>Establishment of allowance</header><text display-inline="yes-display-inline">There is established for the House of Representatives an allowance which shall be available for the compensation of interns who serve in the offices of Members of the House of Representatives during a calendar year.</text>
			</subsection><subsection id="H026AEB394B7D4CF0A18C53E4733FAEBD"><enum>(b)</enum><header>Amount per office; allocation of unused allowances among other offices</header>
 <paragraph id="HCEA5513275AB48BDB89308A6960518E7"><enum>(1)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of the allowance under this section with respect to the office of a Member of the House of Representatives for a calendar year shall be established by the Committee on House Administration of the House of Representatives, and (subject to the allocation described in paragraph (2)) shall be an equivalent amount for all such offices.</text>
				</paragraph><paragraph id="HF10F725E0AB44713A06931D33CBE622E"><enum>(2)</enum><header>Allocation of unused allowances</header>
 <subparagraph id="H84FECF8567CF4F9EB994D3D951976B23"><enum>(A)</enum><header>In general</header><text>If, by not later than the applicable deadline described in subparagraph (B), an office of a Member of the House of Representatives does not certify to the Committee on House Administration that the office will use the entire amount of the allowance established for the office under this section with respect to a calendar year, the Committee may allocate the unused portion of such office’s allowance among the allowances established for other offices of the House for such calendar year.</text>
 </subparagraph><subparagraph id="H6CA7954D81D64BCAA8E08DD5276516FF"><enum>(B)</enum><header>Applicable deadline</header><text>The applicable deadline described in this subparagraph with respect to a calendar year is such date established by the Committee on House Administration which is not earlier than January 31 of the year and not later than June 30 of the year.</text>
					</subparagraph></paragraph></subsection><subsection id="HA6322AE01AAA4DA480C02FF34C779C9E"><enum>(c)</enum><header>Minimum compensation rate</header>
 <paragraph id="H653CB49B4A004AFB8C309A137C09C0E6"><enum>(1)</enum><header>Requirement</header><text>Each intern who is compensated under the allowance under this section shall be paid for each pay period at a rate which is equal to or greater than the minimum compensation rate for the pay period.</text>
 </paragraph><paragraph id="H1461A18E362E42C1A4A0B00C0E48826C"><enum>(2)</enum><header>Definition</header><text>In paragraph (1), the <quote>minimum compensation rate</quote> for a pay period is equal to—</text> <subparagraph id="H01CF26B032EE4CC1A3CF15DED0502B09"><enum>(A)</enum><text>in the case of pay periods occurring during fiscal year 2019, $15 per hour; and</text>
 </subparagraph><subparagraph id="H3F7C03455DF040EFBC9CE8C57B0491A4"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of pay periods occurring during fiscal year 2020 or any succeeding fiscal year, the rate applicable under this paragraph for pay periods occurring during the previous fiscal year increased by the estimated percentage change in the Consumer Price Index for All Urban Consumers (as published by the Department of Labor) for the most recent fiscal year preceding such fiscal year.</text>
 </subparagraph></paragraph></subsection><subsection id="HD23B7C35376E4A75BF30036083921925"><enum>(d)</enum><header>Benefit exclusion</header><text display-inline="yes-display-inline">Section 104(b) of the House of Representatives Administrative Reform Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/2/5321">2 U.S.C. 5321(b)</external-xref>) shall apply with respect to an intern who is compensated under the allowance under this section in the same manner as such section applies with respect to an intern who is compensated under the Members’ Representational Allowance.</text>
 </subsection><subsection id="HB7F42F4D197A4D889C608642AFD0ABB8"><enum>(e)</enum><header>No effect on payment of interns under Members’ Representational Allowance</header><text display-inline="yes-display-inline">Nothing in this section may be construed to affect the use of the Members’ Representational Allowance for the compensation of interns, as provided under section 104 of the House of Representatives Administrative Reform Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/2/5321">2 U.S.C. 5321</external-xref>).</text>
 </subsection><subsection id="H2FF8A6A486D14C038A0ED260364FCFE3"><enum>(f)</enum><header>Regulations</header><text>This section shall be carried out in accordance with regulations promulgated by the Committee on House Administration of the House of Representatives, including regulations to establish the timing and procedures for the allocation of amounts of unused portions of allowances under subsection (b)(2).</text>
 </subsection><subsection id="H45C7FAFCAA6D4CE1BEF5F9BE599BE8F8"><enum>(g)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="HFBC3DCD48A094D0D8AEFAE33FA71811C"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>intern</term> has the meaning given such term in section 104(c)(2) of the House of Representatives Administrative Reform Technical Corrections Act (<external-xref legal-doc="usc" parsable-cite="usc/2/5321">2 U.S.C. 5321(c)(2)</external-xref>); and</text>
 </paragraph><paragraph id="H8B0392630831475DA2412D0BB7B6960C"><enum>(2)</enum><text>the term <term>Member of the House of Representatives</term> means a Representative in, or a Delegate or Resident Commissioner to, the Congress.</text> </paragraph></subsection></section><section id="HE8AB1AB72F674AE7AB5A68AA08D70775"><enum>3.</enum><header>Authorization of appropriations</header> <text display-inline="no-display-inline">There are authorized to be appropriated to carry out this section—</text>
 <paragraph id="H4AB45D09EF5D4F42B0FCB74EAF70B7F2"><enum>(1)</enum><text>for fiscal year 2019, $13,759,200; and</text> </paragraph><paragraph id="H732ECEAC4E354AC3AFDF69F4FC27179D"><enum>(2)</enum><text display-inline="yes-display-inline">for fiscal year 2020 and each succeeding fiscal year, the amount authorized under this section for the previous fiscal year increased by the estimated percentage change in the Consumer Price Index for All Urban Consumers (as published by the Department of Labor) for the most recent fiscal year preceding such fiscal year.</text>
 </paragraph></section><section id="H7DFC02A59A4541FDB3B1CD7EBB2903B1"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall apply with respect to fiscal year 2019 and each succeeding fiscal year.</text>
