 <section id="H368BC1ED708A4003BADBFD5295FE1B54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping America Re-Develop High-Quality Accessible Training Act</short-title></quote> or the <quote><short-title>HARD HAT Act</short-title></quote>.</text> </section><section id="HA67CADAA6EAB478C8F14E1880D9562C9" section-type="subsequent-section"><enum>2.</enum><header>Registered apprenticeship program requirement for certain contractors</header> <subsection id="HB7D8CCB199B242388AF9BB1610075D2E"><enum>(a)</enum><header>Registered apprenticeship program requirement for certain contractors</header> <paragraph id="HCA1CBEE0BA904061B406BA777ABA3310"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/63">Chapter 63</external-xref> of title 41, United States Code, is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H8319574FAF6B4E7D9717526045A12E2D" style="USC">
						<section id="HA2DA4702C76D47ABACC7894B60FE4188"><enum>6310.</enum><header>Registered apprenticeship program requirement for certain contractors</header>
 <subsection id="H04607E71AFA14FD281300061BBBF27ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An executive agency may not award a covered construction contract to a contractor, unless such contractor agrees to require at least 20 percent of the non-management employees of such contractor to complete, or be enrolled in, a registered apprenticeship program as of the date on which construction under the contract begins.</text>
 </subsection><subsection commented="no" id="HFB237E9E92924451BDC6E74FB0A25B9A"><enum>(b)</enum><header>Consideration for future contracts</header><text>In the case of an executive agency that awards a covered construction contract to a contractor that makes the agreement described in subsection (a), such agency shall, to the extent practicable, take into consideration the percentage of non-management employees of such contractor that complete a registered apprenticeship program pursuant to the agreement described in such subsection before awarding any subsequent covered construction contract to such contractor.</text>
 </subsection><subsection id="HAF5380ECA4374B44B0940379E329DD29"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HEFDADD1F8E97443FAFB431B068DD47A0"><enum>(1)</enum><header>Covered construction contract</header><text display-inline="yes-display-inline">The term <quote>covered construction contract</quote>—</text>
 <subparagraph id="HEC191771E65D4AFA82EE9B29EEFBFE95"><enum>(A)</enum><text>means a contract in an amount exceeding $1,500,000 for —</text> <clause id="HA3CEA712E83645219EBA9F7EC5633425"><enum>(i)</enum><text display-inline="yes-display-inline">the construction or resurfacing of highways, roads, streets, bridges, or railways; or</text>
 </clause><clause id="H0FCCFD7B46154D40BCFE919FE637B2BB"><enum>(ii)</enum><text>the construction of—</text> <subclause id="H519218198DBC4D07BDFFDB1E6A4BB48B"><enum>(I)</enum><text>tunnels or other subsurface structures;</text>
 </subclause><subclause id="HF3C3A24D53144BF3ACE74D33101D2159"><enum>(II)</enum><text>sewage and waste facilities;</text> </subclause><subclause id="H95C3ABF028FE4C85BA24E9C8924648E6"><enum>(III)</enum><text>waste treatment and storage facilities; or</text>
 </subclause><subclause id="H95184D3064BB45A38DA5F14E254FE4BD"><enum>(IV)</enum><text>public buildings (as defined in section 3301 of title 40); and</text> </subclause></clause></subparagraph><subparagraph id="HC0ECEAAFEA5D4B989458E5DD561BB8E5"><enum>(B)</enum><text>does not include any contract for construction or resurfacing outside the United States.</text>
 </subparagraph></paragraph><paragraph id="HB400F0D1A75D411BAF87B223ED7D9AEE"><enum>(2)</enum><header>Executive agency</header><text>The term <quote>executive agency</quote> has the meaning given that term in section 102 of title 40.</text> </paragraph><paragraph id="H31849DF52C8B4164BF54B0AC7076EAB1"><enum>(3)</enum><header>Registered apprenticeship program</header><text display-inline="yes-display-inline">The term <quote>registered apprenticeship program</quote> means a program registered under the Act of August 16, 1937 (commonly known as the National Apprenticeship Act; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H4B6498B5F64C4C7A91385297444BC698"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

 </paragraph></subsection><subsection id="H7820AB6CADA74F3D89E5642E87A27765"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a)(1) shall apply with respect to contracts awarded on or after the date that is 120 days after the date of the enactment of this Act.</text>
