			 enrollment programs offering career and technical education, and for other
			 purposes.</official-title></form>
	<legis-body id="H0D86121835844545A8794710F0D4250C" style="OLC">
 <section id="H535748211CDD4DD0AFA69493407D6FA6" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access to the Workforce Through Dual Enrollment Act of 2018</short-title></quote>.</text> </section><section id="H72222D4C57174E0BAC9D06C0A697F7E5"><enum>2.</enum><header>Grant Program</header> <subsection id="H6F6A80BA736A4C25BDB6675E69F6738A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated under subsection (h), the Secretary of Education shall provide grants to eligible entities for the purposes of establishing, expanding, or supporting dual or concurrent enrollment programs offering career and technical education.</text>
 </subsection><subsection id="H203936FBC7704D2CAF4EF8092AEAFF89"><enum>(b)</enum><header>Amounts</header><text display-inline="yes-display-inline">The total grant amount made to an eligible entity under this section may not exceed $1,000,000.</text> </subsection><subsection id="H7BEDE3AC439145348266530C47DB0260"><enum>(c)</enum><header>Use of Grants</header> <paragraph id="H6212A02BB8CA4E4C974E1C4E2E373FC5"><enum>(1)</enum><header>Required Use of Grants</header><text>An eligible entity that receives a grant under this section shall use such grant for a program described in subsection (a) that carries out the following requirements:</text>
 <subparagraph id="HF45BA50B00EB427FA57BC76C830FFF25"><enum>(A)</enum><text>A State that is a partner in such eligible entity shall establish a policy to ensure that any postsecondary credits earned though the program will be recognized throughout the system of public higher education of the State in which such program is located.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H5132B808D858480ABA1BA615227F6E56"><enum>(B)</enum><text display-inline="yes-display-inline">Each local educational entity that is a partner in such eligible entity—</text> <clause id="HADB02BAF957E4386A6E91A43ECE94907"><enum>(i)</enum><text display-inline="yes-display-inline">shall prioritize establishing, expanding, or supporting such program at secondary schools—</text>
 <subclause id="H1B0F4FD415E540E7A9AC9A295120F7B9"><enum>(I)</enum><text display-inline="yes-display-inline">serving students not less than 50 percent of whom are eligible for the free or reduced-price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.);</text>
 </subclause><subclause display-inline="no-display-inline" id="HB7F4FB9794A34C5CA520069ED28E71A6"><enum>(II)</enum><text display-inline="yes-display-inline">whose most recent four-year adjusted cohort graduation rate is below the national four-year adjusted cohort graduation rate, as determined by the Secretary using the most recent data submitted to the National Center of Education Statistics for the calculation of such national rate; and</text>
 </subclause><subclause id="H718203DB7D71473885A457814A929BA7"><enum>(III)</enum><text display-inline="yes-display-inline">whose most recent immediate college enrollment rate is below the national immediate college enrollment rate, as determined by the National Center of Education Statistics; and</text>
 </subclause></clause><clause display-inline="no-display-inline" id="HC80099A2C2BB4AB19DCA60E7C8F0AC3C"><enum>(ii)</enum><text display-inline="yes-display-inline">shall prioritize selecting students for the program who are from a family whose taxable income for the proceeding year did not exceed 90 percent of the amount equal to the median income for a family of the size involved within the State as determined by the Bureau of the Census.</text>
 </clause></subparagraph><subparagraph id="HBA39E57ED5934481998BA13C7606DBB1"><enum>(C)</enum><text display-inline="yes-display-inline">Each public institution of higher education that is a partner in such eligible entity shall provide such program—</text>
 <clause id="H94306AF77FA649F0ABA932E95C98BBA7"><enum>(i)</enum><text display-inline="yes-display-inline">assistance with curriculum development;</text> </clause><clause id="HB73F88DB0257467FAE52D70732BD25B1"><enum>(ii)</enum><text display-inline="yes-display-inline">access to faculty for the instruction of courses;</text>
 </clause><clause id="H6E1A8DF8B2C04283B59ECAD33417EC55"><enum>(iii)</enum><text display-inline="yes-display-inline">access to facilities on the campus of such institution of higher education, including for the purpose of instructing courses; and</text>
 </clause><clause id="H8DB750CBA42E4D01AB916113D7A2767F"><enum>(iv)</enum><text display-inline="yes-display-inline">access to advisors from such institution of high education for the purposes of advising students enrolled such program.</text>
						</clause></subparagraph><subparagraph id="HCE28A84A77974E1F87696B4849E68402"><enum>(D)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H147C5BB2A72D426AB9CBEC94FF057B12"><enum>(i)</enum><text>Each private sector entity that is a partner in such eligible entity shall provide such program with at least two of the forms of assistance described in clause (ii), which shall include at least one of the forms of assistance described in subclause (I), (III), or (IV) of such clause.</text>
 </clause><clause id="H23A2D361557D4689A970C9FDC3414420" indent="up1"><enum>(ii)</enum><text>The forms of assistance described in this clause are as follows:</text> <subclause display-inline="no-display-inline" id="H8CC2A768E66B4EEBB32E8442AADFEDA5"><enum>(I)</enum><text display-inline="yes-display-inline">Internships approved by the Secretary or registered apprenticeship programs for students enrolled in such program.</text>
 </subclause><subclause display-inline="no-display-inline" id="HDF20E4FC3FFA47E284BD24425EF1365A"><enum>(II)</enum><text display-inline="yes-display-inline">Funds in an amount equal to not less than 10 percent of the total costs of administering such program.</text>
 </subclause><subclause id="H29EB454ADE89483FB6FC240643AE2E89"><enum>(III)</enum><text>Assistance with curriculum development.</text> </subclause><subclause id="HA5AE2983B35841779A5C8C265F137145"><enum>(IV)</enum><text>Mentoring for students enrolled in such program.</text>
 </subclause><subclause id="H229A19B1540449BBB38D3D3E1344349E"><enum>(V)</enum><text display-inline="yes-display-inline">Individuals employed by the private sector entity for the instruction of courses.</text> </subclause><subclause id="H46829D9B59204C1686F8D0C1443B509C"><enum>(VI)</enum><text display-inline="yes-display-inline">Equipment and facilities for the purposes of on-site instruction.</text>
 </subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE6AAC1C77D84320BE6DEE89BF7DDE31"><enum>(2)</enum><header>Authorized Use of Grants</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section may use—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC9AC98E5324C475F8594EBD4EBCEBC0A"><enum>(A)</enum><text>not more than 50 percent of the grant to—</text>
 <clause commented="no" id="HE32612F0F3BB42F2B330D300BF22D203"><enum>(i)</enum><text display-inline="yes-display-inline">cover expenses, including tuition costs and textbook fees, incurred by students enrolled the program established, expanded, or supported with the grant; and</text>
 </clause><clause commented="no" id="H41093BB9BB394D768FB95EC8AA78CAA4"><enum>(ii)</enum><text display-inline="yes-display-inline">offer courses for credit or not-for-credit to supplement such program to—</text> <subclause commented="no" id="H64C7FAA2519940309F85E94969E27DB1"><enum>(I)</enum><text>improve the financial literacy of students; and</text>
 </subclause><subclause commented="no" id="H99E45A6074D44FBAA8198E11A6A67330"><enum>(II)</enum><text>teach skills, including resume and interviewing skills, that will prepare students for postsecondary career and technical education;</text>
 </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE1CAAD87CE7E4B3EB7591E6CA1E0779C"><enum>(B)</enum><text display-inline="yes-display-inline">not less than 10 percent and not more than 30 percent of the grant to train or hire educators; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD3BD057B9A6F4AFCB025F4AE4609241B"><enum>(C)</enum><text display-inline="yes-display-inline">not more than 20 percent of the grant to pay for the cost of transporting (including by school bus, private transportation company, or public transit) students enrolled in the program to the public institution of higher education or private sector entity that is a partner in the eligible entity to receive instruction through a course offered under such program.</text>
 </subparagraph></paragraph></subsection><subsection id="H8428FD2A67184F06AEED57F4190B9008"><enum>(d)</enum><header>Application requirements</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary determines, which shall include an assurance that each partner in the eligible entity will comply with the requirements of subsection (c)(1).</text>
 </subsection><subsection id="HC52CB3DC68DF48E58104EF9DC030FA6D"><enum>(e)</enum><header>Supplement, not supplant</header><text display-inline="yes-display-inline">Federal funds made available under this section shall be used so as to supplement the level of Federal, State, and local public funds that, in the absence of such availability, would have been expended for dual enrollment programs and in no case to supplant such Federal, State, and local public funds.</text>
			</subsection><subsection id="H47185D2FD46D4CCD9F14955A639410C1"><enum>(f)</enum><header>Financial Aid and Enrollment Status</header>
 <paragraph id="H307E0F8341F54158AA44D5C6C5595A34"><enum>(1)</enum><header>Financial Aid</header><text>A student’s participation in a program funded under this section shall not be taken into account in determining the need or eligibility of the student for assistance under the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1000">20 U.S.C. 1000</external-xref> et seq.).</text>
 </paragraph><paragraph id="H8B1EF9274E2B43CB916FE1088C9854C8"><enum>(2)</enum><header>Enrollment Status</header><text>A student enrolled in such program shall not be considered a first-time student of any institution of higher education without regard to postsecondary credits earned under the program.</text>
				</paragraph></subsection><subsection id="H3E863E99116949E48FDED6710AE0A4FC"><enum>(g)</enum><header>Report</header>
 <paragraph id="HB4D27625136D4806A19868F0F9C51B43"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall submit to the Secretary a report on—</text>
 <subparagraph id="H4269A192A536473D97775B25049B4717"><enum>(A)</enum><text>the activities supported by the grant;</text> </subparagraph><subparagraph id="H6A8537D6E9B74D0C9DFDB176C808D6A7"><enum>(B)</enum><text display-inline="yes-display-inline">the number of students participating in the activities supported by the grant;</text>
 </subparagraph><subparagraph id="H5B03585FC898453A969071B71DFA2C50"><enum>(C)</enum><text display-inline="yes-display-inline">any progress made in achieving the goals of the program supported by the grant; and</text> </subparagraph><subparagraph id="H8EC37C7984774169A7868A7B6136D668"><enum>(D)</enum><text display-inline="yes-display-inline">such other information as the Secretary determines to be appropriate.</text>
 </subparagraph></paragraph><paragraph id="H3FDD1F61DBA34459A25B265E77210CB2"><enum>(2)</enum><header>Timeline for submission of report</header><text display-inline="yes-display-inline">The report under paragraph (1) shall be submitted to the Secretary not later than 180 days after the date on which the eligible entity concludes the activities supported by the grant under this section.</text>
 </paragraph></subsection><subsection id="H0C1FB0AAEB154A17BB5725254813B69E"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $150,000,000 for each of the fiscal years 2019 through 2023.</text>
 </subsection></section><section id="HED0D6033DDDA42B3A0AAE2948E9F880D"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H3184155F3A0644A18A21E8425CD9C9B0"><enum>(1)</enum><header>Career and Technical Education</header><text>The term <quote>career and technical education</quote> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text>
 </paragraph><paragraph id="HE38A89373445415B976350DBD260C3B6"><enum>(2)</enum><header>Dual or Concurrent Enrollment Program</header><text display-inline="yes-display-inline">The term <quote>dual or concurrent enrollment program</quote> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), except that the postsecondary courses of such program shall offer career and technical education.</text>
 </paragraph><paragraph id="H26071FA2B9A64162907D71A526AD3CB8"><enum>(3)</enum><header>Eligible Entity</header><text>The term <quote>eligible entity</quote> means a partnership among the following:</text> <subparagraph id="H27E6B48C160C4CDB80CAC3E4A0A6BDB5"><enum>(A)</enum><text>A State.</text>
 </subparagraph><subparagraph id="HDABA9C5783B84B97B358362E5343E4B7"><enum>(B)</enum><text>One or more local educational agencies.</text> </subparagraph><subparagraph id="H5F705A570D034B3D964AEDC2BBC9ADD1"><enum>(C)</enum><text>One or more public institutions of higher education.</text>
 </subparagraph><subparagraph id="H4DC36C0A3CB64200A1961D01598143A3"><enum>(D)</enum><text>One or more private sector entities.</text> </subparagraph></paragraph><paragraph id="H1B572FD353BC40CEAE250B15D9D0892F"><enum>(4)</enum><header>First Generation College Student</header><text display-inline="yes-display-inline">The term <quote>first generation college student</quote> has the meaning given the term in section 402A(h)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11(h)(3)</external-xref>).</text>
 </paragraph><paragraph id="HF0A30F40378741BE8D4165F19951053C"><enum>(5)</enum><header>Four-Year Adjusted Cohort Graduation Rate</header><text display-inline="yes-display-inline">The term <quote>four-year adjusted cohort graduation rate</quote> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </paragraph><paragraph id="HD72BD727BCA0479DBC9108613F72D1D2"><enum>(6)</enum><header>High School</header><text display-inline="yes-display-inline">The term <quote>high school</quote> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </paragraph><paragraph id="H4087E280F96F401DAA0742B46972D612"><enum>(7)</enum><header>Immediate College Enrollment Rate</header><text display-inline="yes-display-inline">The term <quote>immediate college enrollment rate</quote> means the percentage of individuals ages 16 to 24—</text> <subparagraph id="H3DB269A30D0A453E9F3075D2020E5A9F"><enum>(A)</enum><text>who graduate from high school or complete a graduate educational development test prior to October of a calendar year; and</text>
 </subparagraph><subparagraph id="H57811F95C2934A498642554F0ABE9F18"><enum>(B)</enum><text>who enroll in two- or four-year colleges in the fall of such calendar year.</text> </subparagraph></paragraph><paragraph id="H57649FE061104E08A93CCDF1716DC83A"><enum>(8)</enum><header>Institution of Higher Education</header><text>The term <quote>institution of high education</quote> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text>
 </paragraph><paragraph id="HC6E29FB8B6DE4DF799D0E21827A6FBA1"><enum>(9)</enum><header>Local Educational Agency</header><text>The term <quote>local educational agency</quote> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </paragraph><paragraph id="H0F7F8CCE6C3F4FF7805B81369E9190CA"><enum>(10)</enum><header>Mentoring</header><text display-inline="yes-display-inline">The term <quote>mentoring</quote> means a structured, managed program in which children are appropriately matched with screened and trained adult volunteers for one-on-one relationships, involving meetings and activities on a regular basis, intended to meet, in part, the child's need for involvement with a caring and supportive adult who provides a positive role model.</text>
 </paragraph><paragraph id="H6E4B578A0E064DE1BA85C8A6AFDD35D7"><enum>(11)</enum><header>Private Sector Entity</header><text>The term <quote>private sector entity</quote> means an entity owned, controlled, and managed by a private individual or enterprise, including a for-profit business, nonprofit organization, charity, or labor organization.</text>
 </paragraph><paragraph id="H19F120A101A842A0A00A3A952BC4A966"><enum>(12)</enum><header>Registered apprenticeship program</header><text display-inline="yes-display-inline">The term <quote>registered apprenticeship program</quote> means an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.).</text> </paragraph><paragraph id="H7A4408CD9CB1488CA3C79D0326451850"><enum>(13)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Education.</text>
 </paragraph><paragraph id="H4788D5ABC61E43D0820680CEE08DA3AC"><enum>(14)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> has the meaning given the term in section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text>
