			 for other purposes.</official-title></form>
	<legis-body id="HECAEAE3F1E8B4BBA903BB7D58CD5A160" style="OLC">
 <section id="HB9E64BF5C6C74B5CA77D92B97AD1447C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Untraceable Firearms Act of 2018</short-title></quote>.</text> </section><section id="H8163482392EB4C5D801B3FE1916BF7BE"><enum>2.</enum><header>Requirement that all firearms be traceable</header> <subsection id="HAD0625ED369D47669426AFC4A158541B"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended—</text>
 <paragraph id="HA7D1FC062E1D4713BF5F2003351FE737"><enum>(1)</enum><text>in paragraph (3)—</text> <subparagraph id="HF35FC81A01E24CD8BC5F8D2E4056F750"><enum>(A)</enum><text>by inserting <quote>, including an unfinished frame or receiver</quote> after <quote>such weapon</quote>; and</text>
 </subparagraph><subparagraph id="H858BC0292E8C4FD9BDB71251D816D40D"><enum>(B)</enum><text>by striking <quote>or (D) any destructive device</quote> and inserting <quote>; (D) any destructive device; or (E) any combination of parts designed or intended for use in converting any device into a firearm and from which a firearm may be readily assembled</quote>;</text>
 </subparagraph></paragraph><paragraph commented="no" id="HFE362C29217D4FCB8071F98C2D28F857"><enum>(2)</enum><text>in paragraph (10), by adding at the end the following: <quote>The term <term>manufacturing firearms</term> shall include assembling a functional firearm from a frame or receiver or molding, machining, or 3D printing a frame or receiver, and shall not include making or fitting special barrels, stocks, or trigger mechanisms to firearms.</quote>;</text>
 </paragraph><paragraph commented="no" id="HB2EFB4C614D74176B1C58313FBBFA1E8"><enum>(3)</enum><text>by inserting after paragraph (29) the following:</text> <quoted-block display-inline="no-display-inline" id="H1787CE4F46374D36A4B189B42B5BFDCB" style="OLC"> <paragraph id="HFBE51B53FA9041B382AB0D418FD72777" indent="up1"><enum>(30)</enum><text>The term <term>frame or receiver</term>—</text>
 <subparagraph id="H3F216F0AE0194D2BBB645A8DA50B0382"><enum>(A)</enum><text>means the part of a firearm that can provide the action or housing for the hammer, bolt, or breechblock and firing mechanism;</text>
 </subparagraph><subparagraph id="H823E9B319B574EF582F29ADB6D8F001E"><enum>(B)</enum><text>includes a frame or lower receiver blank, casting, or machined body that requires further machining or molding to be used as part of a functional firearm, and which is designed and intended to be used in the assembly of a functional firearm; and</text>
 </subparagraph><subparagraph id="H713790E1DFAB42E684B517617D6CDFC4"><enum>(C)</enum><text>does not include a piece of material that has had—</text> <clause id="HC5C9855CABA64518BB16C7FF522A3BED"><enum>(i)</enum><text>its size or external shape altered solely to facilitate transportation or storage; or</text>
 </clause><clause id="H27A59F6B1E53485E91654219F62E16D9"><enum>(ii)</enum><text>solely its chemical composition altered.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" id="HEFDB749C352E4FAC8CC8FFEDD75BAE54"><enum>(4)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFDA05ED1732742A2A1FA2E1F0939D441" style="OLC">
 <paragraph id="H5602AC50C1EB4AB484569694638E6DF0" indent="up1"><enum>(36)</enum><text>The term <term>ghost gun</term>—</text> <subparagraph id="H69CCD86A3302499BB5117F770CEBD0F4"><enum>(A)</enum><text>means a firearm, including a frame or receiver, that lacks a unique serial number engraved or cast in metal or metal alloy on the frame or receiver by a licensed manufacturer or importer in accordance with this chapter; and</text>
 </subparagraph><subparagraph id="H79F34F0F888B42A78212681157FF0B14"><enum>(B)</enum><text>does not include a firearm that has been rendered permanently inoperable.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection commented="no" id="H4693869CB8B44728A86A7968270204A6"><enum>(b)</enum><header>Prohibition; requirements</header><text>Section 922 of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2AE275AC3BEE40EB924019294869C9D6" style="OLC">
					<subsection id="H89545DB393684F849B99A0C0D130DB16"><enum>(aa)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H44B3836A22E34B1FA012AE2A18EEF574"><enum>(1)</enum><text>The Congress finds and declares the following:</text> <subparagraph id="H5E94E4F438B049D58A0DE430DCEE74B0" indent="up1"><enum>(A)</enum><text>Firearms tracing is the systematic tracking of the movement of a firearm recovered by law enforcement officials from the first sale of a firearm by the manufacturer or importer through the distribution chain (including the wholesaler and retailer) to the first retail purchaser.</text>
 </subparagraph><subparagraph id="HFB9C00BAFCD449BF8C271602E6C55380" indent="up1"><enum>(B)</enum><text>Law enforcement agencies across the country work with the Bureau of Alcohol, Tobacco, Firearms, and Explosives to trace firearms and thereby obtain investigative leads in the fight against violent crime and terrorism.</text>
 </subparagraph><subparagraph id="H950DAD27CC5B467E9902902663D84245" indent="up1"><enum>(C)</enum><text>The ability of law enforcement agencies to trace a firearm is dependent on the serial number or other marks on the firearm that identify the manufacturer or importer who manufactured or imported the firearm and that are unique to the firearm.</text>
 </subparagraph><subparagraph id="HA4F4E32C8D1E4DA68FB3548512FF37E1" indent="up1"><enum>(D)</enum><text>Interstate gun trafficking interferes with lawful commerce in firearms and significantly contributes to gun crime. Of the 211,384 firearms traced by the Bureau of Alcohol, Tobacco, Firearms, and Explosives in 2016, 60,936 of those firearms were originally sold by a licensed firearms dealer in a State other than the State where the firearms were recovered. These guns made up 28.8 percent of all firearm recoveries in 2016.</text>
 </subparagraph><subparagraph id="H05DFC759EC6948E58ADC54B098D64062" indent="up1"><enum>(E)</enum><text>Even before the sale of a firearm, the gun, its component parts, and the raw materials from which they are made have considerably moved in interstate commerce.</text>
 </subparagraph><subparagraph id="HBCFA0143CDB840BD912635458EDA00DB" indent="up1"><enum>(F)</enum><text>If unserialized and untraceable firearms may be constructed and transported freely from State to State, ordinary citizens and foreign visitors may fear to travel to or through certain parts of the country due to concern about violent crime and gun violence, and law enforcement agencies may be unable to address it.</text>
							</subparagraph></paragraph><paragraph id="H03D0E557C35E43B491FEFD0D586BD523" indent="up1"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HB2A7EA4E68A348A3A8B425628CF0310E"><enum>(A)</enum><text>Except as provided in subparagraph (B), it shall be unlawful for any person to manufacture, sell, offer to sell, transfer, purchase, or receive a ghost gun in or affecting interstate or foreign commerce.</text>
 </subparagraph><subparagraph id="H891CF05724884091B1D76E0A40AFE86C" indent="up1"><enum>(B)</enum><text>Subparagraph (A) shall not apply to—</text> <clause id="H010F078D593B462B8246B3659580C851"><enum>(i)</enum><text>the manufacture of a firearm by a licensed manufacturer if the licensed manufacturer complies with section 923(i) before selling or transferring the firearm to another person;</text>
 </clause><clause id="H4A28BF36A6F4482496A9DBF1E157601E"><enum>(ii)</enum><text>the offer to sell, sale, or transfer of a firearm to, or purchase or receipt of a firearm by, a licensed manufacturer or importer before January 1, 2020; or</text>
 </clause><clause id="HE50930E104AF46BDB457356C2CCD43E9"><enum>(iii)</enum><text>transactions between licensed manufacturers and importers on any date.</text> </clause></subparagraph></paragraph></subsection><subsection id="H92E78B1DFFE642128362DFAE6EAE6A02"><enum>(bb)</enum><text>It shall be unlawful for a person other than a licensed manufacturer or importer to engrave or cast a serial number on a firearm in or affecting interstate or foreign commerce.</text>
 </subsection><subsection id="H0E88ABB793934284A2C031D2B6A11460"><enum>(cc)</enum><text>Beginning on January 1, 2020, it shall be unlawful for any person other than a licensed manufacturer or importer to possess a ghost gun in or affecting interstate or foreign commerce with the intent to sell or transfer the ghost gun with or without further manufacturing or to manufacture a firearm with the ghost gun.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="H5F8BD5BA35C2490A825F1F9875E02D31"><enum>(c)</enum><header>Requirements</header><text>Section 923(i) of title 18, United States Code, is amended by adding at the end the following: <quote>The serial number shall be engraved or cast in metal or metal alloy and sufficient to identify the firearm and the manufacturer or importer that put the serial number on the firearm.</quote>.</text>
 </subsection><subsection commented="no" id="HFF06A74701904F57B1F4245D92A95D8B"><enum>(d)</enum><header>Penalties</header><text>Section 924 of title 18, United States Code, is amended—</text> <paragraph id="HE106CC7D4DAB420FBF774B05FFD612F3"><enum>(1)</enum><text>in subsection (a)(1)(B), by striking <quote>or (q)</quote> and inserting <quote>(q), (aa), (bb), or (cc)</quote>; and</text>
 </paragraph><paragraph id="HDF53C13B6328410BAA9C4732832B6497"><enum>(2)</enum><text>in subsection (d)(1), by striking <quote>or (k)</quote> and inserting <quote>(k), (aa), (bb), or (cc)</quote>.</text> </paragraph></subsection></section><section id="H8BE1B8519F144EA4A54EDEE38C1DB55D" section-type="subsequent-section"><enum>3.</enum><header>Modernization of the prohibition on un­de­tect­able firearms</header><text display-inline="no-display-inline">Section 922(p) of title 18, United States Code, is amended—</text>
 <paragraph id="HE106FC9654AC465987B143F3C49A9118"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>any firearm</quote>;</text> </paragraph><paragraph id="H5A3E0474393F43D6AF0857B882FC50D4"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
 <subparagraph id="H557F998CB7664F0A825BB12518204EEA"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HBCC89D7AE842463EA21A206193C62478" style="OLC"> <subparagraph id="H5E40528F156544FCB9D2BFF29B8EEFE9" indent="up1"><enum>(A)</enum><text>an undetectable firearm; or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H8A1D21AF1B3F4BA8A2CDDECEB1B1C81B"><enum>(B)</enum><text>in subparagraph (B), by striking <quote> any major component of which, when subjected to inspection by the types of x-ray machines commonly used at airports, does not generate</quote> and inserting the following: <quote>a major component of a firearm which, if subjected to inspection by the types of detection devices commonly used at airports for security screening, would not generate</quote>;</text>
 </subparagraph></paragraph><paragraph id="HE63370B229EC4AF984996F236A2D3E27"><enum>(3)</enum><text>in paragraph (2)—</text> <subparagraph id="HF2B6FD0850BB4ED2A3DFD80E2E703102"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HB020655F09434F0DB6F65D2CCA5DBC0B" style="OLC">
 <subparagraph id="H216A5A0DD97746DF9B65D45FE6468BB0" indent="up1"><enum>(A)</enum><text>the term <term>undetectable firearm</term> means a firearm, as defined in section 921(a)(3)(A), of which no major component is wholly made of detectable material;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H5843A63CD5CB4D5DAB141F956E2CCBB1"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HC522E70C8C4243458A4411A76385A53F" style="OLC"> <subparagraph id="HD4C13AD1A9324CCF9E814DD4A99C9280" indent="up1"><enum>(B)</enum><text>the term <term>major component</term>, with respect to a firearm—</text>
 <clause id="H946777ECE62E4F7C830891DCA440B44E"><enum>(i)</enum><text>means the slide or cylinder or the frame or receiver of the firearm; and</text> </clause><clause id="H11CDF608E7644554977ACA43B930D580"><enum>(ii)</enum><text>in the case of a rifle or shotgun, includes the barrel of the firearm; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H578662AA8CBB43249CA411745F0E2A81"><enum>(C)</enum><text>by striking subparagraph (C) and all that follows through the end of the undesignated matter following subparagraph (C) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD1B987D6AAEB4027AC3D8CF3994EE228" style="OLC">
 <subparagraph id="HF12DA6456D0241DAA78563E199AD32E3" indent="up1"><enum>(C)</enum><text>the term <term>detectable material</term> means any material that creates a magnetic field equivalent to or more than 3.7 ounces of 17–4 pH stainless steel.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HDFCECC3E54CC4F7C85ECECD84EE9D0A1"><enum>(4)</enum><text>in paragraph (3)—</text> <subparagraph id="H946B948883104DC086BE186847998D65" indent="down1"><enum>(A)</enum><text>in the first sentence, by inserting <quote>, including a prototype,</quote> after <quote>of a firearm</quote>; and</text>
 </subparagraph><subparagraph id="H1657D5089CAE4CB6B1ED7E0F5DD1EE5B" indent="down1"><enum>(B)</enum><text>by striking the second sentence; and</text> </subparagraph></paragraph><paragraph id="HE99A25C23E1C4130AA156F9086B13FD1"><enum>(5)</enum><text>in paragraph (5), by striking <quote>shall not apply to any firearm which</quote> and all that follows and inserting the following: “shall not apply to—</text>
				<quoted-block display-inline="no-display-inline" id="H4ECDA8D0069548959DD5FF05EB624D46" style="OLC">
 <subparagraph id="H49CDBCDE012347D98C1733E782B69795" indent="up1"><enum>(A)</enum><text>any firearm received by, in the possession of, or under the control of the United States; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71A78A96899D4F03AFADFE75900DE67E" indent="up1"><enum>(B)</enum><text>the manufacture, importation, possession, transfer, receipt, shipment, or delivery of a firearm by a licensed manufacturer or licensed importer pursuant to a contract with the United States.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
