			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit discrimination in higher education against certain undocumented students on the basis
			 of immigration status, and for other purposes.</official-title></form>
	<legis-body id="H009981FFF8454FFF95005BC3798B35CC" style="OLC">
 <section id="H5AEBE9E162E144B1A311357983F269B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Dream Act of 2018</short-title></quote>.</text> </section><section id="HD919F82BBADA49A884CCCE8F8B81E2DD"><enum>2.</enum><header>Higher education for dreamer students</header><text display-inline="no-display-inline">Part B of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011">20 U.S.C. 1011</external-xref> et seq.) is amended by adding at the end the following:</text>
			<quoted-block id="H003704F82789497382490961246F5909" style="OLC">
				<section id="H258E22675D794229B1C98C86B52BCE9D"><enum>124.</enum><header>Nondiscrimination against dreamer students in higher education</header>
 <subsection id="H9B040255C59C4FB2930AD2A3AB902C4A"><enum>(a)</enum><header>In general</header><text>An institution of higher education that receives Federal funds or financial assistance under any Federal program shall not discriminate or take adverse action against a Dreamer student on the basis of that individual’s immigration status.</text>
 </subsection><subsection id="HF83684A4F12B4E979DA0B60D8D8955B9"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">An institution of higher education that receives Federal funds or financial assistance under any Federal program shall not prohibit a Dreamer student from applying for admission, nor shall it prohibit a Dreamer student who is accepted to that institution from enrolling.</text>
 </subsection><subsection id="HA5630161FB4A4E27937BDC8E0E91FD95"><enum>(c)</enum><header>Admissions</header><text display-inline="yes-display-inline">An institution of higher education that receives Federal funds or financial assistance under any Federal program shall not discriminate against or penalize in the admissions process a Dreamer student who is otherwise qualified for admission to the institution, on the basis of that individual’s immigration status, nor shall such an institution differentiate in the admissions process on the basis of residency between a United States citizen applicant and a Dreamer student applying from the same State.</text>
 </subsection><subsection id="H1F9C2307BA02483EAD9C71860C4F1F3D"><enum>(d)</enum><header>Tuition rate</header><text>An institution of higher education that receives Federal funds or financial assistance under any Federal program shall not charge a greater rate of tuition than the rate charged for residents of the State in which the institution is located to a Dreamer student who, but for such individual’s immigration status, otherwise qualifies as a resident of the State in which the institution is located.</text>
					</subsection><subsection id="HA3B4892D8D6C4F32B9C6C155C7EFD025"><enum>(e)</enum><header>Confidentiality of information</header>
 <paragraph id="H7F229051A4FB4CB8AF992023366534EE"><enum>(1)</enum><header>Prohibition</header><text>No officer or employee of the United States, of a State, or of an institution of higher education that receives Federal funds or financial assistance under any Federal program to which a Dreamer student applies for admission or enrolls, may—</text>
 <subparagraph id="HF0E3E8235FFC4FA2852376818B19EB31"><enum>(A)</enum><text>use the information furnished by the Dreamer student to arrest, detain, or initiate removal proceedings against any person identified in that information;</text>
 </subparagraph><subparagraph id="HECA11C6B7E48415399E3C25E77570EFC"><enum>(B)</enum><text>make any publication whereby the information furnished by any particular Dreamer student can be identified; or</text>
 </subparagraph><subparagraph id="H429F9683FF7F43F6BAD517CC4B09B546"><enum>(C)</enum><text>permit anyone other than an officer or employee of the Federal Government or the institution of higher education to which a Dreamer student applies or enrolls, to examine any information provided by a Dreamer student relating to that individual’s immigration status or qualifications to be a Dreamer student.</text>
 </subparagraph></paragraph><paragraph id="H56BD63889FB54C7788867695ED270946"><enum>(2)</enum><header>Penalty</header><text>Whoever knowingly uses, publishes, or permits information to be examined in violation of this subsection shall be fined not more than $50,000.</text>
						</paragraph></subsection><subsection id="HF2C54054258748C8BE620736A8792EAE"><enum>(f)</enum><header>Definition of dreamer student</header>
 <paragraph id="H04E213290C394AD7A6AA75F1D82DEEA0"><enum>(1)</enum><header>In general</header><text>In this section, the term <quote>Dreamer student</quote> means an individual who—</text> <subparagraph id="H0597D8927CEB4490BFF50F886CB6D071"><enum>(A)</enum><text display-inline="yes-display-inline">as defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)—</text>
 <clause id="HE7147671E6784DC189BDD05A38C58E7A"><enum>(i)</enum><text>is not a national of the United States;</text> </clause><clause id="HF36B47617541414287DAE93C2B7590DD"><enum>(ii)</enum><text>is an immigrant;</text>
 </clause><clause id="HFAA456B1F1A640A29E18B650FBDF7998"><enum>(iii)</enum><text>maintains a residence in the United States; and</text> </clause><clause id="H306035AC14224DE7A9482763BC893070"><enum>(iv)</enum><text>does not possess a valid immigrant visa, a valid nonimmigrant visa, or equivalent document demonstrating a lawful immigration status in the United States;</text>
 </clause></subparagraph><subparagraph id="HEA4F78E41C3C478D82412FCD0F4DB0BB"><enum>(B)</enum><text>was younger than 18 years of age on the date on which the individual initially entered the United States;</text>
 </subparagraph><subparagraph id="H585BBB1405134F84AE0D71F4BABB4F18"><enum>(C)</enum><text>has provided a list of each secondary school that the student attended in the United States; and</text> </subparagraph><subparagraph id="H1BC7DF5DD5434C09A68983B5B3B7801D"><enum>(D)</enum> <clause commented="no" display-inline="yes-display-inline" id="HA2E3D2CE49584C4F94BD3E5E6FD64666"><enum>(i)</enum><text>has earned a high school diploma, the recognized equivalent of such diploma from a secondary school, or a high school equivalency diploma in the United States or is scheduled to complete the requirements for such a diploma or equivalent before the next academic year begins;</text>
 </clause><clause id="H01D6EF7B0FDE418AB2BDD0F400EFADB2" indent="up1"><enum>(ii)</enum><text>has acquired a degree from an institution of higher education or is enrolled in a program for a baccalaureate degree or higher degree at an institution of higher education in the United States;</text>
 </clause><clause id="H6BE36519EBC14DAFA7DE166884F2CC38" indent="up1"><enum>(iii)</enum><text>at any time was eligible for a grant of deferred action under—</text> <subclause id="HEC1F7E8D7DC74082938553E0F94E23F1"><enum>(I)</enum><text>the June 15, 2012, memorandum from the Secretary of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote>; or</text>
 </subclause><subclause id="H3AC253107E5D48BEAE9FA5817BECA7B3"><enum>(II)</enum><text>the November 20, 2014, memorandum from the Secretary of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children and with Respect to Certain Individuals Who Are the Parents of U.S. Citizens or Permanent Residents</quote>; or</text>
 </subclause></clause><clause id="H5B4BE2898D754B71B5C562AA24DA048C" indent="up1"><enum>(iv)</enum><text>has served in the uniformed services, as defined in section 101 of title 10, United States Code, for not less than 4 years and, if discharged, received an honorable discharge.</text>
 </clause></subparagraph></paragraph><paragraph id="H2E5AC3E8BFD64EF795132AED85C9DCC5"><enum>(2)</enum><header>Hardship exception</header><text>The Secretary shall issue regulations that direct when an institution of higher education shall waive the requirement of subparagraph (B) or (C), or both, of paragraph (1) for an individual to qualify as a Dreamer student under such paragraph, if the individual—</text>
 <subparagraph id="H3F7D21A50BF04227AC3340C64B62802F"><enum>(A)</enum><text>demonstrates compelling circumstances for the inability to satisfy the requirement of such subparagraph (B) or (C), or both; and</text>
 </subparagraph><subparagraph id="H2E2C454E9D6A4C86B6C1F83B519CDCF3"><enum>(B)</enum><text>satisfies the requirement of paragraph (1)(D).</text> </subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="HAB652B12239C45D38968E61EC0EEE978"><enum>3.</enum><header>Repeal of prohibition</header><text display-inline="no-display-inline">Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1623">8 U.S.C. 1623</external-xref>) is repealed.</text>
