			 providers and suppliers across State lines, and for other purposes.</official-title></form>
	<legis-body id="HEA6C86CC936A4A7F8E4F2137F242D193" style="OLC">
 <section id="H96187C9CBB994BBBB6792496E55ED9E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating Kids’ Access to Care Act</short-title></quote>.</text> </section><section id="H386843C8BB5346AD841F3DF3975288C6"><enum>2.</enum><header>Streamlined screening and enrollment process for eligible out-of-State Medicaid providers and suppliers</header> <subsection id="H73247E7FC58C4A5D910F1D971F3EF551"><enum>(a)</enum><header>In general</header><text>Section 1902(kk) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(kk)</external-xref>) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H8D9F9AF9943F4C888A7EFF86504B5A1F" style="OLC">
					<paragraph id="H0B4A2438B1114FF38DE0D5FE774C07FA"><enum>(10)</enum><header>Streamlined screening and enrollment process for eligible out-of-State providers and suppliers</header>
 <subparagraph id="HC96F3AF1AC194B688B3BED8534AA4FFD"><enum>(A)</enum><header>In general</header><text>Subject to subsection (a)(65), the State adopts a streamlined screening and enrollment process for eligible out-of-State providers and suppliers.</text>
 </subparagraph><subparagraph id="HAEA83E7C7B2A451480CD075AF8B73713"><enum>(B)</enum><header>Streamlined screening and enrollment process</header><text>For purposes of subparagraph (A), the term <term>streamlined screening and enrollment process</term> means a process that enables an eligible out-of-State provider or supplier to enroll as a provider or supplier in the State plan on a simplified and streamlined basis in accordance with the requirements of subparagraph (D).</text>
 </subparagraph><subparagraph id="H08CDBC5E0A714413A2D4DA4B68B30F33"><enum>(C)</enum><header>Eligible out-of-State provider or supplier</header><text>For purposes of subparagraph (A), the term <term>eligible out-of-State provider or supplier</term> means a provider or supplier of medical or other items or services furnished to a child for which payment is available under the State plan under this title that is located in another State and with respect to which the Secretary has determined there is a limited risk of fraud, waste, or abuse for purposes of determining the level of screening to be conducted under section 1866(j)(2)(B).</text>
 </subparagraph><subparagraph id="HDC5B90A0C52C4E02B3ECC7CC094D6486"><enum>(D)</enum><header>Requirements</header><text>For purposes of subparagraph (B), the requirements of this subparagraph are the following:</text> <clause id="H7F3E9C35B7D84AF884EEF50857AE8B34"><enum>(i)</enum><text>An eligible out-of-State provider or supplier that elects to be and is enrolled in the program established under this title in accordance with the process established by the Secretary under section 2(b) of the <short-title>Accelerating Kids’ Access to Care Act</short-title> is enrolled in the State plan under this title without being subject to any additional screening and enrollment activities required by the State.</text>
 </clause><clause id="H35185E5FA4514038BD31EF4F320A4DE5"><enum>(ii)</enum><text>An eligible out-of-State provider or supplier that is enrolled in the State plan through the streamlined screening and enrollment process shall be enrolled for a period of 5 years before being required to obtain revalidation.</text>
 </clause><clause id="H2BE590756B8C45758A3286EA53113B3C"><enum>(iii)</enum><text>An eligible out-of-State provider or supplier that is enrolled in the State plan through the streamlined screening and enrollment process shall be permitted to order all clinically necessary follow-up care, including with respect to the prescribing of medications.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HB5C652A6601F4BBABFE5EB61CE27AFA3"><enum>(b)</enum><header>Coordination with Medicare</header><text>The Secretary shall establish a process for permitting a provider or a supplier, as the case may be, the option when enrolling in the program established under the Medicare program under title XVIII of the Social Security Act pursuant to subpart P of part 424 of title 42, Code of Federal Regulations (or any successor regulation), to elect, at the same time, to enroll in the Medicaid program under title XIX of such Act for purposes of all State plans under such title XIX. The Secretary may utilize the Medicare Provider Enrollment, Chain and Ownership System (referred to as <term>PECOS</term>), or another national, standardized, and widely accessible platform to establish such process.</text>
			</subsection><subsection id="H88C4EE03525240B0ABC4BC4F584AB5FC"><enum>(c)</enum><header>Conforming amendments</header>
 <paragraph id="HA36797B52CCD41EC84EFF099FB690A1C"><enum>(1)</enum><text>Section 1902(a)(77) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(77)</external-xref>) is amended by inserting <quote>enrollment,</quote> after <quote>screening,</quote>.</text> </paragraph><paragraph id="H70EF092F74B5437BB200BC30B9EF4F0C"><enum>(2)</enum><text>Section 1902(kk) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(kk)</external-xref>), as amended by subsection (a), is further amended—</text>
 <subparagraph id="H2AE5CF297D4541C393D53733A654660C"><enum>(A)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">Enrollment,</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Screening,</header-in-text></quote>; and</text> </subparagraph><subparagraph id="HA1172067ACD74C61947730DA553913CA"><enum>(B)</enum><text>in paragraph (9), by striking <quote>Nothing</quote> and inserting <quote>Except as provided in paragraph (10)(D)(i), nothing</quote>.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H16AF1677A00D49D293989C732E5FB46E"><enum>(3)</enum><text>Section 2107(e)(1)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)(G)</external-xref>) is amended by inserting <quote>enrollment,</quote> after <quote>screening,</quote>.</text> </paragraph></subsection><subsection id="H2F3B5F6A5087402B84E080F38BC186B0"><enum>(d)</enum><header>Effective date</header> <paragraph id="HA0E32A8BFD824BB4AE924B134221E718"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section take effect on January 1, 2019.</text>
 </paragraph><paragraph id="HD25EBB0E59074E10829FB15C66E41623"><enum>(2)</enum><header>Exception for State legislation</header><text>In the case of a State plan for medical assistance under title XIX of the Social Security Act or a State child health plan under title XXI of such Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments made by this section, such State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet these additional requirements before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text>
