			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit private antitrust damages against occupational licensing boards, to promote beneficial
			 reforms of State occupational licensing, and for other purposes.</official-title></form>
	<legis-body id="H2F64615BCA004BFF8E56A860D860EB04" style="OLC">
 <section id="H845D4693C25D4B669D22FD5CA9788A54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Occupational Licensing Board Antitrust Damages Relief and Reform Act of 2018</short-title></quote>.</text> </section><section id="H7FB3ED814429462A81637591CF6343A7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H25238DB26CF945D7BA5B0159A0562191"><enum>(1)</enum><header>Certification</header><text>The term <term>certification</term> means a voluntary program under which—</text> <subparagraph id="H6537BE1C3FE541C0AFCB603D3C3D229D"><enum>(A)</enum><text>a private organization (in the case of private certification) or the government of a State (in the case of government certification) authorizes an individual who meets certain personal qualifications to use <quote>certified</quote> as a designated title with respect to the performance of a lawful occupation; and</text>
 </subparagraph><subparagraph id="HFC0B32EC90A541BAA54A59A22AF6174B"><enum>(B)</enum><text>a noncertified individual may perform the lawful occupation for compensation but may not use the title <quote>certified</quote>.</text>
 </subparagraph></paragraph><paragraph id="HBC09676023FD4ACE9CD6444138623B0D"><enum>(2)</enum><header>Member, officer, employee, or agent</header><text>The term <term>member, officer, employee, or agent</term>, with respect to an occupational licensing board, means an individual appointed by, to, or employed by the occupational licensing board.</text>
 </paragraph><paragraph id="H19BB256699FF49C1A4FD775404C1F282"><enum>(3)</enum><header>Occupational license</header><text>The term <term>occupational license</term> means a nontransferable authorization under law for an individual to perform a lawful occupation for compensation based on meeting personal qualifications established by the State government.</text>
 </paragraph><paragraph id="HE9BDB52A05D745FF8786A2C892B24112"><enum>(4)</enum><header>Occupational licensing board</header><text>The term <term>occupational licensing board</term> or <quote>board</quote> means an entity established under State law—</text> <subparagraph id="H3083AD89FD5144AB84FD2A5FD5C6FDCF"><enum>(A)</enum><text>the express purpose of which is to regulate the personal qualifications required to engage in or practice a particular lawful occupation; and</text>
 </subparagraph><subparagraph id="HD68C1844ECBA446DB0FC49A7FCD8EE10"><enum>(B)</enum><text>that has authority conferred by State law to interpret or enforce the occupational regulations of the State.</text>
 </subparagraph></paragraph><paragraph id="H20D47A82DD554B13AEF042C90018C11A"><enum>(5)</enum><header>Occupational regulation</header><text>The term <term>occupational regulation</term>—</text> <subparagraph id="HE8CCC1DE72B842B89DF2BB856D0E1DC4"><enum>(A)</enum><text>means a statute, rule, regulation, practice, policy, or law that sets educational, examination, training and/or experience requirements to authorize an individual to work in a lawful occupation;</text>
 </subparagraph><subparagraph id="HAD5DC7A346C341A5B1EA65BD6F58D8D4"><enum>(B)</enum><text>includes any statute, rule, regulation, practice, policy, or law requiring certification or an occupational license; and</text>
 </subparagraph><subparagraph id="H1DA5D3EBC75143BAA508002B6A968D89"><enum>(C)</enum><text>does not include a business license, facility license, building permit, or zoning and land use regulation except to the extent that such a requirement or restriction substantially burdens an individual’s ability to work in a lawful occupation.</text>
 </subparagraph></paragraph><paragraph id="HA126DEC7D0F94AFA9F7151FD50CF6AC2"><enum>(6)</enum><header>Widely regulated occupation</header><text>The term <term>widely regulated occupation</term> means an occupation in which forty (40) or more States require an occupational license to engage in such occupation.</text>
 </paragraph><paragraph id="H7D907FD0FAB547FFBF29DD5EA378EE47"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and any territory or possession of the United States.</text>
			</paragraph></section><section id="H450988F91EF84D6890EE1C22FE924A55"><enum>3.</enum><header>Private antitrust damages</header>
 <subsection id="H56EB23B7E1B24C9A88B904B5AD0B8A7C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No damages, or interest on damages, may be recovered under section 4, 4A or 4C of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/15">15 U.S.C. 15</external-xref>, 15a, or 15c) by any person, except for any State, instrumentality of a State, or employee of a State or instrumentality of a State acting in his or her official capacity, from an occupational licensing board, or any member, officer, employee, or agent of a board, acting in their official capacity, if—</text>
 <paragraph id="HD52FAF3C6D6C4A4BB113C56E18DCC802"><enum>(1)</enum><text>the State—</text> <subparagraph id="H3B5330267A6C43F4B0AB4DA1982EAE4B"><enum>(A)</enum><text>has enacted a law requiring an occupational license to practice the lawful occupation regulated by the occupational licensing board;</text>
 </subparagraph><subparagraph id="H6134FABDA0C4477FAEE833D362C4A131"><enum>(B)</enum><text>has set forth criteria outlining any personal qualifications necessary to obtain an occupational license and has required that licensees adhere to standards of practice and ethical standards in the performance of regulated lawful occupations; and</text>
 </subparagraph><subparagraph id="H9985214A5E1F42218ACB8A944170B506"><enum>(C)</enum><text>has found that—</text> <clause id="HEB3315E996084C9A86A5B78BDD4AC6DA"><enum>(i)</enum><text>the public needs, and can be reasonably expected to benefit from, occupational licensing of the lawful occupation; and</text>
 </clause><clause id="H7F49C2DC30C0416A868AA41DA931DFFA"><enum>(ii)</enum><text>the unlicensed conduct of the lawful occupation would harm or endanger the health, safety, or welfare of the public;</text>
 </clause></subparagraph></paragraph><paragraph id="HABE3F11DF4DC4779AE56035B0628C45E"><enum>(2)</enum><text>an occupation licensed by an occupational licensing board—</text> <subparagraph id="H814C0FE2AAD44494840ED5AC19D6C3C1"><enum>(A)</enum><text>is a widely regulated occupation; or</text>
					</subparagraph><subparagraph id="H8B929FF4B0BE4286A3103A9542328B1D"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H675CCDAB725447BFAA88F158490939A0"><enum>(i)</enum><text>is not a widely regulated occupation and the State has implemented a periodic sunset review process of the occupational licensing board with regard to that occupation; and (ii) if previously unregulated by the State, the State has implemented a sunrise review process of the occupational licensing board with regard to its regulation of that newly-licensed occupation;</text>
 </clause></subparagraph></paragraph><paragraph id="HE5017C15DA824CA2AC5E7D2D267A0F25"><enum>(3)</enum><text>the chief executive, legislature, or other elected officer of the State—</text> <subparagraph id="HF2A4F25746E449E4A590B2F90E7845BD"><enum>(A)</enum><text>has appointed all members of the occupational licensing board; and</text>
 </subparagraph><subparagraph id="H0E19E5735541429A928100284099A955"><enum>(B)</enum><text>has required public representation on the occupational licensing board; and</text> </subparagraph></paragraph><paragraph id="HF0F645524D4949F88EEA281052CAA43C"><enum>(4)</enum><text>the State or the occupational licensing board has established a mechanism under which any person aggrieved by an action of the occupational licensing board has the right to—</text>
 <subparagraph id="H56C4241F70D04FBF867772F0DCEFFCA9"><enum>(A)</enum><text>contest such action at a hearing before the occupational licensing board at which the individual may provide evidence, argument, and analysis;</text>
 </subparagraph><subparagraph id="HEEBBEBBA78994AED8C09C3F33F3874C7"><enum>(B)</enum><text>review, at a reasonable time before the hearing, all evidence that the occupational licensing board has gathered relating to the contested action;</text>
 </subparagraph><subparagraph id="H1C88CBE44E9444788029CA0539ABF195"><enum>(C)</enum><text>receive a final reasoned decision in writing from the occupational licensing board within a reasonable period after the hearing; and</text>
 </subparagraph><subparagraph id="HC3A898087C9F4D9891B8A73EAD25C1B1"><enum>(D)</enum><text>appeal an adverse decision of the occupational licensing board to an independent adjudicator, including judicial review.</text>
 </subparagraph></paragraph></subsection><subsection id="HD6BAEB2EC3B04109BAB7A68CED8CF637"><enum>(b)</enum><header>Applicability</header><text>This section shall not apply to any case commenced before the date of enactment of this Act, unless it would be inequitable not to apply this section to a pending action.</text>
 </subsection><subsection id="H1F2C9FF8A7C243EA867F204861308726"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to modify or impair the applicability or availability of—</text> <paragraph id="H581FD8EF0C44410A9BEEECF8A14D5C47"><enum>(1)</enum><text>relief pursuant to section 4A or 4C of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/15a">15 U.S.C. 15a</external-xref>, 15c);</text>
 </paragraph><paragraph id="H09D28524A990484092210769BADA9CE4"><enum>(2)</enum><text>injunctive relief pursuant to section 16 of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/26">15 U.S.C. 26</external-xref>);</text> </paragraph><paragraph id="H50B8DD66EA7944FCA4C7B655DFDFB83E"><enum>(3)</enum><text>equitable monetary or injunctive relief pursuant to section 13(b) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/53">15 U.S.C. 53(b)</external-xref>); or</text>
 </paragraph><paragraph id="HFA48637CF28F4200B2FE69FB5A7AB5F1"><enum>(4)</enum><text>the ability of any person to recover the cost of the suit, including a reasonable attorney’s fee, under section 4 of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/15">15 U.S.C. 15</external-xref>).</text>
 </paragraph></subsection><subsection id="H9AA21847CB9C4FC19C3B6F38F4398C82"><enum>(d)</enum><header>Savings clause</header><text>The immunity from damages, or interest on damages, that is provided to members, officers, employees, or agents of an occupational licensing board of a State under subsection (a) shall not apply to any action unrelated to their official capacity, such as implementing rules governing minimum prices or fees.</text>
 </subsection></section><section id="H6C5948DCA1924863A6A9F245FA258790"><enum>4.</enum><header>State licensing studies to be conducted</header><text display-inline="no-display-inline">Not later than 120 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on—</text>
 <paragraph id="H2DFBCD6C16684BD68BC1970856FC4324"><enum>(1)</enum><text>how States can best address occupational licensing reform, particularly for those occupations that are not directly related to protecting the health, safety, or welfare of the public, including recommendations on how States can weigh the costs and benefits of occupational licensing against those of less restrictive alternatives, such as certification and other approaches;</text>
 </paragraph><paragraph id="H419885C60BDE41E5B722756B1514313E"><enum>(2)</enum><text>how States can conduct comprehensive cost-benefit assessments of occupational regulations and occupational licensing boards through sunrise reviews and periodic sunset reviews;</text>
 </paragraph><paragraph id="HEB644F638250447CBB00E8F353F23D3B"><enum>(3)</enum><text>how States can implement policies to support occupational licensing uniformity and occupational license portability, including streamlined licensing portability programs for veterans and military service members and spouses; and</text>
 </paragraph><paragraph id="H43571ED009C7482AA6BCF23DC97C6047"><enum>(4)</enum><text>how occupational licensing requirements affect low-income workers, the unemployed, immigrants with work authorizations, and individuals with criminal records.</text>
 </paragraph></section><section id="H82E17C663B60420BA248E87C4088CCBB"><enum>5.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Except as provided in section 3, nothing in this Act shall be construed to modify or impair the applicability or the enforcement of the antitrust laws, as defined in the first section of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12</external-xref>).</text>
