			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish, fund, and provide for the use of amounts in a National Park Service and Public Lands
			 Legacy Restoration Fund to address the maintenance backlog of the National
			 Park Service, United States Fish and Wildlife Service, Bureau of Land
			 Management, and Bureau of Indian Education, and for other purposes.</official-title></form>
	<legis-body id="HB98B4D9A5A11459E9A804B50177F61EB" style="OLC">
 <section id="HAA5FE5FC40414930AC419ECB4E80F6AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore Our Parks and Public Lands Act</short-title></quote>.</text> </section><section id="H763E11D831F545DEB418CA7BE48A2570" section-type="subsequent-section"><enum>2.</enum><header>National Park Service and Public Lands Legacy Restoration Fund</header> <subsection id="HD1B94D8DB8994CD9922789BBF0749DE0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund, to be known as the <quote>National Park Service and Public Lands Legacy Restoration Fund</quote> (referred to in this section as the <term>Fund</term>).</text>
			</subsection><subsection id="H260D4F900FEC49759D5301D58E20AB92"><enum>(b)</enum><header>Deposits</header>
 <paragraph id="HD8197C9C4C9947F0AE567A45D524AB9F"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), for each of fiscal years 2019 through 2023, there shall be deposited in the Fund an amount equal to 50 percent of all energy development revenues due and payable to the United States from oil, gas, coal, or alternative or renewable energy development on Federal land and water that are not otherwise credited, covered, or deposited under Federal law.</text>
 </paragraph><paragraph id="H401B2F5A03C74B5DA1E4397376BD037D"><enum>(2)</enum><header>Maximum amount</header><text>The amount deposited in the Fund under paragraph (1) shall not exceed $1,300,000,000 for any fiscal year.</text>
 </paragraph><paragraph id="H05B72D19F655453AAC9DF34B0EF060B1"><enum>(3)</enum><header>Effect on other revenues</header><text>Nothing in this section affects the disposition of revenues that—</text> <subparagraph id="H7F5E23FE5FF74492B256533B417696DE"><enum>(A)</enum><text>are due to the United States, special funds, trust funds, or States from mineral and energy development on Federal land and water; or</text>
 </subparagraph><subparagraph id="HD76C566434A645C0AC4A5BF8A50E1188"><enum>(B)</enum><text>have been otherwise appropriated under Federal law, including the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/432">Public Law 109–432</external-xref>), the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.), and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2003">chapter 2003</external-xref> of title 54, United States Code.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="HCD615D9EC21444279FAF78F7234543AF"><enum>(c)</enum><header>Availability of funds</header><text>Amounts deposited in the Fund shall be available to the Secretary of the Interior without further appropriation or fiscal year limitation.</text>
			</subsection><subsection id="H0DC7BD64CC1348ED91468A1D1E2730BD"><enum>(d)</enum><header>Investment of amounts</header>
 <paragraph id="HF558923201974892817E19F9F9C425E0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior may request the Secretary of the Treasury to invest any portion of the Fund that is not, as determined by the Secretary of the Interior, required to meet the current needs of the Fund.</text>
 </paragraph><paragraph id="H35230A42162E4B5AAECF18627CA42511"><enum>(2)</enum><header>Requirement</header><text>An investment requested under paragraph (1) shall be made by the Secretary of the Treasury in a public debt security—</text>
 <subparagraph id="HF1FA61495B78490DA362E2A1198E3D77"><enum>(A)</enum><text display-inline="yes-display-inline">with a maturity suitable to the needs of the Fund, as determined by the Secretary of the Interior; and</text>
 </subparagraph><subparagraph id="HA0F6CE70F8DC41608F136F706EA7B391"><enum>(B)</enum><text>bearing interest at a rate determined by the Secretary of the Treasury, taking into consideration current market yields on outstanding marketable obligations of the United States of comparable maturity.</text>
 </subparagraph></paragraph><paragraph id="HA5458E2D61B048B0A2359DA50E616A43"><enum>(3)</enum><header>Credits to fund</header><text>The income on investments of the Fund under this subsection shall be credited to, and form a part of, the Fund.</text>
 </paragraph></subsection><subsection id="H0CBA55DC9FF642D2B6E1DA508D104FC2"><enum>(e)</enum><header>Use of funds</header><text>Amounts in the Fund shall be used as follows:</text> <paragraph id="H0470D5EE1FCC4869B754899615A3E516"><enum>(1)</enum><text display-inline="yes-display-inline">80 percent of amounts in the Fund shall be allocated to the Director of the National Park Service for high-priority deferred maintenance needs, as determined by the Director, of which—</text>
 <subparagraph id="HB5209BD30F8142B19640ED658E8909E2"><enum>(A)</enum><text display-inline="yes-display-inline">65 percent shall be allocated for projects that are not eligible for the funding described in clause (i) or (ii) of subparagraph (B) for the repair and rehabilitation of assets, including—</text>
 <clause id="HE1F46275577449FFA2B8D58B678662FB"><enum>(i)</enum><text>historic structures, facilities, and other historic assets;</text> </clause><clause id="HDDA43CB3CE6C4A5CBC5D39D8682D2F31"><enum>(ii)</enum><text>nonhistoric assets that relate directly to visitor—</text>
 <subclause id="H1CCB2B7B09394C9181354C0C3DC8675C"><enum>(I)</enum><text>access, including making facilities accessible to visitors with disabilities;</text> </subclause><subclause id="HE5EFDE5C4545416EA4D91A9AF283EBAF"><enum>(II)</enum><text>health and safety; and</text>
 </subclause><subclause id="H8AF8B599613045E09215743F98DE6AA9"><enum>(III)</enum><text>recreation; and</text> </subclause></clause><clause id="HDB0FC7C73C2C4277B312BE371A221F25"><enum>(iii)</enum><text>visitor facilities, water and utility systems, and employee housing; and</text>
 </clause></subparagraph><subparagraph id="HCC5ACAC0E01A4DB493A41D4FB0991FC0"><enum>(B)</enum><text>35 percent shall be allocated to road, bridge, tunnel, or other transportation-related projects that may be eligible for funding made available to the Director of the National Park Service through—</text>
 <clause id="H8EDC68E6684F4CF4B0DB3EB053F79CE4"><enum>(i)</enum><text>the transportation program under section 203 of title 23; or</text> </clause><clause id="H37C54FF6CCC0491ABF8702244B0528D7"><enum>(ii)</enum><text>any similar Federal land highway program administered by the Secretary of Transportation.</text>
 </clause></subparagraph></paragraph><paragraph id="HD1E5E26A47EA4E5389782E129B7D9C73"><enum>(2)</enum><text display-inline="yes-display-inline">10 percent of amounts in the Fund shall be allocated to the Director of the United States Fish and Wildlife Service for purposes of addressing the national wildlife refuge system maintenance backlog.</text>
 </paragraph><paragraph id="H091476A34E7349E8B5F17F95FCC97CA4"><enum>(3)</enum><text display-inline="yes-display-inline">5 percent of amounts in the Fund shall be allocated to the Director of the Bureau of Land Management for the purposes of addressing the public access and recreation backlog.</text>
 </paragraph><paragraph id="H4B8E51EF56D24A94937F9A7BB5006163"><enum>(4)</enum><text display-inline="yes-display-inline">5 percent of amounts in the Fund shall be allocated to the Assistant Secretary of the Bureau of Indian Affairs for the purposes of addressing the Bureau of Indian Education school construction and deferred maintenance backlogs.</text>
 </paragraph></subsection><subsection id="H71F6DFB388F24DBB807BE3821728A3FB"><enum>(f)</enum><header>Prohibited use of funds</header><text>No amounts in the Fund shall be used—</text> <paragraph id="HBD9B099242174782877F0900F612B327"><enum>(1)</enum><text>for land acquisition; or</text>
 </paragraph><paragraph id="H74B00FEA52F04F5AA1D3D2FBB805E646"><enum>(2)</enum><text display-inline="yes-display-inline">to supplant discretionary funding made available for the annually recurring facility operations, maintenance, and construction needs of the entities for which amounts from the Fund are allocated under subsection (e).</text>
 </paragraph></subsection><subsection id="H2E50D5F105064F54BA3F42D6A5B8F938"><enum>(g)</enum><header>Submission of annual proposal</header><text display-inline="yes-display-inline">As part of the annual budget submission of each entity for which amounts from the Fund are allocated under subsection (e), such entity shall submit a prioritized list of deferred maintenance projects or backlog projects proposed to be funded by amounts in the Fund during the fiscal year for which the budget submission is made to the Committee on Appropriations of the House of Representatives and the Committee on Appropriations of the Senate (referred to in this section as the <term>Committees</term>).</text>
 </subsection><subsection commented="no" id="H0F6E9589DBAC405FB72C8DF8C0032AF7"><enum>(h)</enum><header>Congressional approval</header><text display-inline="yes-display-inline">After review of each list submitted under subsection (g), the Committees may provide for the allocation of amounts derived from the Fund with respect to such list.</text>
			</subsection><subsection id="HE07E7B9EE9D24184ACCDAA6170E3B6DC"><enum>(i)</enum><header>Project approval</header>
 <paragraph id="H9ECCACAA702F4283AB8F8D15F9076121"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), if, before the beginning of a fiscal year, the Committees do not alter the allocation of funds proposed by the entity for that fiscal year, the list submitted under subsection (g) for that fiscal year shall be considered approved.</text>
 </paragraph><paragraph id="H74E0611A3ABE4335994CFAB492F14F3E"><enum>(2)</enum><header>Continuing resolution</header><text>If, before the beginning of a fiscal year, there is enacted a continuing resolution or resolutions for a period of—</text>
 <subparagraph id="H73296C755F3C4EF8AE176F21C08620FB"><enum>(A)</enum><text display-inline="yes-display-inline">less than or equal to 120 days, each entity for which amounts from the Fund are allocated under subsection (e) shall not obligate funds to any project contained in a list submitted under subsection (g) for that fiscal year until the date of enactment of a law making appropriations for such entity that is not a continuing resolution; or</text>
 </subparagraph><subparagraph id="H65228A176D424C909CC15DC343D8A3F8"><enum>(B)</enum><text>more than 120 days, each project contained in a list submitted under subsection (g) for that fiscal year shall be considered approved, unless otherwise provided in the continuing resolution or resolutions.</text>
					</subparagraph></paragraph></subsection><subsection id="HA0B72BE85DA54E1CBE81C7DB53AB6A1C"><enum>(j)</enum><header>Public donations</header>
 <paragraph id="H5B3D1ACB63F647838AD02772DDB6CAE9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior, the Director of the National Park Service, the Director of the United States Fish and Wildlife Service, the Director of the Bureau of Land Management, and the Assistant Secretary of Indian Affairs may accept public cash or in-kind donations that advance efforts—</text>
 <subparagraph id="H84B134262CFD4B8A8594E81474EAA212"><enum>(A)</enum><text display-inline="yes-display-inline">to reduce the deferred maintenance backlog of the National Park Service, the national wildlife refuge system maintenance backlog of the United States Fish and Wildlife Service, the public access and recreation backlog of the Bureau of Land Management, and the school construction backlog of the Bureau of Indian Education, respectively; and</text>
 </subparagraph><subparagraph id="H39B538680CB24ECCA6B6B1105E080BB5"><enum>(B)</enum><text>to encourage relevant public-private partnerships.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE6742E1726C415C8ADFEBE5784C0D9D"><enum>(2)</enum><header display-inline="yes-display-inline">Credits to fund</header><text display-inline="yes-display-inline">Any cash donations accepted under paragraph (1) shall be credited to, and form a part of, the Fund.</text>
 </paragraph><paragraph id="HF9314F546A814ADB962013B92F45C8B1"><enum>(3)</enum><header>Reporting</header><text display-inline="yes-display-inline">Each donation received under paragraph (1) that is used for, or directly related to, the reduction of the deferred maintenance backlog of the National Park Service, the national wildlife refuge system maintenance backlog of the United States Fish and Wildlife Service, the public access and recreation backlog of the Bureau of Land Management, and the school construction backlog of the Bureau of Indian Education, shall be included with the annual budget submission of the President to Congress.</text>
