	<legis-body id="H2EE1E5B6130048F4BC1F63186B7A95AA" style="OLC">
 <section id="H283577AC48CD4EB8A37391F696EDBD5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP-Ed Fights Lead Act of 2018</short-title></quote>.</text> </section><section id="H02134C5D08BE4D238B75105E7A284DC4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
 <paragraph id="H1F55DA3EE2A9495AAE2E06FE9783F3E6"><enum>(1)</enum><text>The nutrition education and obesity prevention program carried out under section 28 of the Food and Nutrition Act of 2008 as amended by this Act (in this Act referred to as SNAP-Ed) is designed to improve the likelihood that individuals eligible to participate in the supplemental nutrition assistance program (popularly known as SNAP) will make healthy food choices within a limited budget and choose physically active lifestyles while supporting the role of SNAP in addressing food insecurity among low-income Americans.</text>
 </paragraph><paragraph id="H40DE0C9ED95344C4B235063E4BAB1F78"><enum>(2)</enum><text>Federal SNAP-Ed guidance encourages States to target their SNAP-Ed efforts to women and then children in households that participate in SNAP.</text>
 </paragraph><paragraph id="HEFBCDC40FFB44B6390E542786B86F80E"><enum>(3)</enum><text>The Secretary of Agriculture encourages States to develop SNAP-Ed policies and activities that address the highest priority nutrition problems and needs of the target audience.</text>
 </paragraph><paragraph id="HCA71073416D740FAA50BDCC819CDBB22"><enum>(4)</enum><text>Given its target audience, SNAP-Ed can play a role in reaching and mitigating the consequence of elevated blood lead levels in children who remain at the greatest risk for lead poisoning by educating individuals on a healthy diet that can help combat lead exposure.</text>
 </paragraph><paragraph id="H0159A5BF648844CA9EBCDFDEA3EF8E20"><enum>(5)</enum><text>According to the Department of Agriculture, foods rich in iron, calcium and vitamin C have been shown to help limit the absorption of lead by the body. Research indicates that the body absorbs lead faster when the stomach is empty.</text>
 </paragraph><paragraph id="H8D8A03B5D1D243CC9FB64532045E7098"><enum>(6)</enum><text>As part of its response to the lead crisis in Flint, Michigan, the Department of Agriculture promoted nutrition education messages through Federal nutrition program providers, community-based partner organizations and farmers’ markets on important foods to consume to mitigate lead absorption. However, more can be done to use SNAP-Ed to help children and their families who are affected by lead poisoning.</text>
 </paragraph><paragraph id="H3B0A9311EEE14191AE8DA73FACB8DC4E"><enum>(7)</enum><text>In 2014 the Centers for Disease Control and Prevention estimated that 535,000 children in the United States had blood lead levels at or above 5 micrograms per deciliter which is the measure used to identify children with blood lead levels that are much higher than most children’s levels. Of these, 150,000 had levels at or greater than 10 micrograms per deciliter. Low-income and minority children make up a disproportionate number of these cases.</text>
 </paragraph><paragraph id="HD049F7DCE5CA4052B0053DC0A69C1937"><enum>(8)</enum><text>It is critical that the Federal Government continue to promote the use of SNAP-Ed funding for activities that increase education about and access to foods rich in nutrients key to combatting lead exposure.</text>
			</paragraph></section><section id="H257C5B459C0E4FD29DE9AF0390255B35"><enum>3.</enum><header>Amendments</header>
 <subsection id="HFF2EAB6AA4A1476E9A0D68E20D5259A3"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">Section 28(b) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036a">7 U.S.C. 2036a(b)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6CFE0BAD9A8544CCAAF8C8D000A1A463" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The Secretary shall ensure that such program includes messaging and education about the foods that
			 can reduce the impact of elevated blood lead levels in children,
			 especially in areas where the health risk to children is highest.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H7FD16B2FEDCE40BC9784E9DDA9256ED3"><enum>(b)</enum><header>State nutrition education plan</header><text display-inline="yes-display-inline">Section 28(c)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036a">7 U.S.C. 2036a(c)(2)</external-xref>) is amended—</text> <paragraph id="H5A37A398D3254073A8130A0ABB378E78"><enum>(1)</enum><text>in subparagraph (B)—</text>
 <subparagraph id="HE182182D1C0849C8B4E1996B75540481"><enum>(A)</enum><text>by amending clause (i) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H8D1911E2C7DA4242AB0D9FD20456A497" style="OLC"> <clause id="HDD0A47D23BF742269AA6A4321C571E38"><enum>(i)</enum><text display-inline="yes-display-inline">present valid and data-driven needs assessments of the nutrition, physical activity, and obesity prevention needs of the target population;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H153556CAED7A48D6B6B383E545170A36"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii) by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="HA44B803D2C18475D9C04C00A07AEF778"><enum>(C)</enum><text>in clause (iii) by striking the period at the end and inserting a semicolon;</text>
 </subparagraph><subparagraph id="H11F22DD8D3E9458B87CF71C30EC263DF"><enum>(D)</enum><text>redesignating clauses (ii) and (iii) as clauses (iii) and (iv), respectively;</text> </subparagraph><subparagraph id="HA980F41414BD474CAA4E25B51BC08D74"><enum>(E)</enum><text>by inserting after clause (i) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H50C2F690492145A887D96EE0BF66DB4C" style="OLC">
 <clause id="H4FA3297F11E74F0782D9ACEE4404C752"><enum>(ii)</enum><text display-inline="yes-display-inline">identify the use of funding for evidence-based State or local projects that meet those needs;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph><subparagraph id="HBB4400520D3A4B9982C5D9ABDD399492"><enum>(F)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC713512581C342E49599896EA7E22124" style="OLC">
 <clause id="H1DBF3F1EC2424935AA9CF40255671C27"><enum>(v)</enum><text display-inline="yes-display-inline">demonstrate and follow evidence-based strategies for effective nutrition education and obesity prevention;</text>
 </clause><clause id="HCC5D68D3B5A2478AAD2CC4ECC2A728D7"><enum>(vi)</enum><text display-inline="yes-display-inline">include a comprehensive statewide community needs assessment, pursuant to Federal guidelines that include public comments, to ensure funded activities have the greatest impact on the targeted populations; and</text>
 </clause><clause id="HBDF496D9F5BC4BDEBD7590FDACBA7843"><enum>(vii)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, ensure that funds received under this section are expended and targeted to provide nutrition education and obesity prevention services in areas in the State in proportion to the population of eligible individuals residing in such areas.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H5E7284C38123453FA42B1C2CEAD0D6F7"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H06DF83392A584894AE568E96A252DC09" style="OLC"> <subparagraph id="H0F81ADFCA06C4715A944C1EF63F7FC4C"><enum>(D)</enum><header>Approval of nutrition education State plan</header><text display-inline="yes-display-inline">After conducting a thorough review of the State nutrition education plan, the Secretary shall have exclusive authority to approve or disapprove such plan if it satisfies the requirements of this paragraph. The Secretary shall approve such plan only if the Secretary determines that implementation of such plan will—</text>
 <clause id="H5922FCC1E7F54E79BA52745ADEA980E4"><enum>(i)</enum><text display-inline="yes-display-inline">advance the Federal purposes of SNAP-Ed to help targeted populations make healthy food choices, mitigate lead poisoning, and promote physical activity;</text>
 </clause><clause id="H9A227A4840AE49C482B444F1D55315B9"><enum>(ii)</enum><text display-inline="yes-display-inline">a substantial likelihood of achieving program objectives;</text> </clause><clause id="H540DC240784D418A8602F3708C64855B"><enum>(iii)</enum><text display-inline="yes-display-inline">require the funded projects to be age-appropriate, culturally appropriate, and linguistically appropriate for the target population;</text>
 </clause><clause id="H88DE2C4C402F446385C3319731BD5C47"><enum>(iv)</enum><text display-inline="yes-display-inline">satisfactorily measure, monitor, and evaluate the effectiveness of authorized projects;</text> </clause><clause id="H366FD2713FD3422586B9C4C6EE60C392"><enum>(v)</enum><text display-inline="yes-display-inline">use funds received to carry out such plan (and associated funds) to direct nutrition education and obesity prevention services to serve areas in the State that have the highest concentration of eligible individuals; and</text>
 </clause><clause id="H0A02BBCC74BC4DD5959C145F17FC51E8"><enum>(vi)</enum><text display-inline="yes-display-inline">effectively provide nutrition education and obesity prevention services through projects identified based on a thorough statewide community needs assessment that involves public and stakeholder feedback and that identifies areas and populations in the State with the greatest need for interventions.</text>
 </clause></subparagraph><subparagraph id="HE9C0989737E94654B724346C7C28EE26"><enum>(E)</enum><header>Transparency</header><text display-inline="yes-display-inline">Not later than 15 days after the Secretary approves a nutrition education State plan (or a modification of such plan), the Secretary shall publish the approved plan (or the approved modification of the approved plan), including the date of approval, on the website of the Department of Agriculture.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HEB710082C584428B8B102B278E237054"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Section 28(c) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036a">7 U.S.C. 2036a(c)</external-xref>) is amended—</text> <paragraph id="HD00D13F250E14CD69AE5C8C92159789B"><enum>(1)</enum><text>in the heading by inserting <quote><header-in-text level="subsection" style="OLC">, lead mitigation,</header-in-text></quote> and after <quote><header-in-text level="subsection" style="OLC">services</header-in-text></quote>; and</text>
 </paragraph><paragraph id="HC2D51114C2A24631993DB7785B22E35C"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)(A)(iii) by inserting <quote>including to address elevated blood lead levels in children</quote> before the period at the end.</text> </paragraph></subsection></section><section id="H3B94FA0E219442E9AF41960DD95481AB"><enum>4.</enum><header>Report by Comptroller General</header><text display-inline="no-display-inline">Not later than 90 days after the effective date of this section, the Comptroller General shall begin to conduct an assessment of how each of the States allocates funds received for projects under section 28 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036a">7 U.S.C. 2036a</external-xref>) and the extent to which such funds are currently used for lead mitigation activities. Such assessment shall include an evaluation of—</text>
 <paragraph id="H29CE6E5D434B4F26AE28F49A9E9FBFB9"><enum>(1)</enum><text display-inline="yes-display-inline">whether the State allocation of such funds to local projects aligns with geographic areas with the highest populations of low-income individuals and households that participate in SNAP;</text>
 </paragraph><paragraph id="H7D67DE0B1D914EF3BF83BC0F170D7595"><enum>(2)</enum><text display-inline="yes-display-inline">whether there is a substantial likelihood that the SNAP-Ed objectives of the State SNAP-Ed plan will be achieved with funds received for SNAP-Ed;</text>
 </paragraph><paragraph id="HE6385863D5C44CBFA1F4BB313D5213AE"><enum>(3)</enum><text display-inline="yes-display-inline">whether there is effective Federal oversight of implementation of such plan to ensure that Federal funds are being used to achieve such objectives;</text>
 </paragraph><paragraph id="H8B12AEA4E90D42CEA2370441D1EB1B44"><enum>(4)</enum><text display-inline="yes-display-inline">the extent to which such funds will be used under such plan to carry out lead poisoning mitigation and education projects and the extent to which SNAP-Ed benefits will be targeted to those at high risk for lead poisoning;</text>
 </paragraph><paragraph id="HE826AB5F8FBB42DE95879FA748055D40"><enum>(5)</enum><text display-inline="yes-display-inline">the extent to which funds are currently being used under section 28 of such Act to carry out lead poisoning mitigation and education projects and the extent to which program benefits are targeted to those at high risk for lead poisoning; and</text>
 </paragraph><paragraph id="H4479B9EBB76945EC80CBACB009321674"><enum>(6)</enum><text display-inline="yes-display-inline">the effectiveness of the process used by States to solicit public and stakeholder input into the development of the State agency plan, including how that input is used to ensure the plan addresses the most pressing nutrition education needs in the State.</text>
			</paragraph></section><section commented="no" id="H64D23655C78545BB96F6C49562D9895E"><enum>5.</enum><header>Effective dates</header>
 <subsection id="HEF11AE53AA6F4C25B6588540DA0FCF36"><enum>(a)</enum><header>General effective date</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act shall take effect 180 days after the date of the enactment of this Act.</text>
 </subsection><subsection id="HACB71D2D85CE4AC8B3CF5181D2F927CD"><enum>(b)</enum><header>Effective date of amendments</header><text display-inline="yes-display-inline">Section 3 shall take effect on October 1, 2020.</text> </subsection></section></legis-body></bill>
