			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Farm Security and Rural Investment Act of 2002 to advance carbon utilization
			 technologies, and for other purposes.</official-title></form>
	<legis-body id="HD69CE46D29734DDE8EB2A9C52DD92B50" style="OLC">
 <section id="HCA4CD84A15E44C46AD8903E391F3CA9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Carbon Utilization Act of 2018</short-title></quote>.</text> </section><section id="HC1207D099DA444B285ABE0CDAF5DBD0E"><enum>2.</enum><header>Biorefinery, renewable chemical, and biobased product manufacturing assistance</header><text display-inline="no-display-inline">Section 9003(b)(3) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8103">7 U.S.C. 8103(b)(3)</external-xref>) is amended—</text>
 <paragraph id="H0E551B74FB6C40AD95ECF77188EFE751"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>produces an advanced biofuel; and</quote> and inserting the following:</text> <quoted-block display-inline="yes-display-inline" id="H46CD27CD4BCB40CFA0AB9B6D8837770C" style="OLC"> <text>produces any 1 or more, or a combination, of—</text><clause id="HE21C4B4BD574485A80156601C2E8D019"><enum>(i)</enum><text>an advanced biofuel;</text> </clause><clause id="H0038F49AD2AE431A9ADA51C4E7C27885"><enum>(ii)</enum><text>a renewable chemical; or</text>
 </clause><clause id="H49AC62E7B6ED4B3CA46F613F6C1690DD"><enum>(iii)</enum><text>a biobased product</text></clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="H75ECEB65F7724664810972337EDA5D02"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>produces an advanced biofuel.</quote> and inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="HEA1635B332B949D7835DAAAA9DAFF325" style="OLC">
 <text>produces any 1 or more, or a combination, of—</text><clause id="HF19A49690C8A47578D6A69FF69E5F4F0"><enum>(i)</enum><text>an advanced biofuel;</text> </clause><clause id="HCC6499C35855441390449F07ABC4B7D9"><enum>(ii)</enum><text>a renewable chemical; or</text>
 </clause><clause id="H95CE22AEB10C49A1933046E6E50189F1"><enum>(iii)</enum><text>a biobased product; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="HA593A944F50C4A4EA9DDC4F99224C543"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block id="HF97922A546574CF5999972FB7FB60865" style="OLC">
 <subparagraph id="H6CB4B6E518684444A8C9A4955AEC05BD"><enum>(C)</enum><text>a technology for the capture, compression, or utilization of carbon dioxide that is produced at a biorefinery producing an advanced biofuel, a renewable chemical, or a biobased product.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="HE48D7A4B161D49F6B066A819A00FC30B"><enum>3.</enum><header>Biomass research and development</header><text display-inline="no-display-inline">Section 9008 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8108">7 U.S.C. 8108</external-xref>) is amended—</text> <paragraph id="H196CDFB5E9884EC88E81AC759DAC0BBB"><enum>(1)</enum><text>in subsection (a)(1)—</text>
 <subparagraph id="H2FA22977A30A45539C8D119D7130BC55"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text> </subparagraph><subparagraph id="HC497064EF24C449B8D801A03F9A8B66E"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph id="H449934C28A1E49C58A20E6D811C55BF6"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="HDC0EB04F80974EFE811E08CFB9B70506" style="OLC"> <subparagraph id="H6B1965788DA44CAC8368E3D8278DCEB9"><enum>(C)</enum><text>carbon dioxide that—</text>
 <clause id="HF8713A66B1B2490ABCBD51876089BADB"><enum>(i)</enum><text>is intended for permanent sequestration or utilization; and</text> </clause><clause id="H57E331F199824467B1D361F0E0F7EFA1"><enum>(ii)</enum><text>is a byproduct of the production of the products described in subparagraphs (A) and (B).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HB9CB63E0E4B5492D8AEDC38648F1BB21"><enum>(2)</enum><text>in subsection (d)(2)(A)—</text> <subparagraph id="H607270BF07574EA880476777C9317619"><enum>(A)</enum><text>in clause (xii), by striking <quote>and</quote> at the end;</text>
 </subparagraph><subparagraph id="HF014F24497CE41F1A68B0FBEC6709796"><enum>(B)</enum><text>by redesignating clause (xiii) as clause (xiv); and</text> </subparagraph><subparagraph id="H23C9588283644D66983AC46847FE29AD"><enum>(C)</enum><text>by inserting after clause (xii) the following:</text>
					<quoted-block id="HE89E620BB12F4222896B5695282D1CC1" style="OLC">
 <clause id="HC23E145955324EA99C99973E23799C8E"><enum>(xiii)</enum><text>an individual with expertise in carbon dioxide capture, utilization, and sequestration; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H84D16793B04F4934B684D85D6223E004"><enum>(3)</enum><text>in subsection (e)—</text>
 <subparagraph id="HF6C1316A09D94A59A5144DA4D95F66FA"><enum>(A)</enum><text>in paragraph (2)(B)—</text> <clause id="HE67F613174D2467EAFB3E0D18907819F"><enum>(i)</enum><text>in clause (ii), by striking <quote>and</quote> at the end; and</text>
 </clause><clause id="HBC636BC08B974111A99984F02F20BCA5"><enum>(ii)</enum><text>by adding at the end the following:</text> <quoted-block id="H4B2229A3126644158EA98D7E1E767CE0" style="OLC"> <clause id="HB390DB218E954301B28C83748A7C2D1A"><enum>(iv)</enum><text>to permanently sequester or utilize carbon dioxide that is produced as a byproduct of the production of biobased products; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H2B1FB56960224C68870E2A23777323B7"><enum>(B)</enum><text>in paragraph (3)(B)—</text> <clause id="H18F03AC5D99A4D13A26AE958538973B4"><enum>(i)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text>
 </clause><clause id="H078443CC7C3A44078929F1957D64A0E5"><enum>(ii)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text> </clause><clause id="H2453DBC56E514AEEA9AD34EE19AD4150"><enum>(iii)</enum><text>by adding at the end the following:</text>

 <clause id="H3DA47114CE804EACBF2B25F1919026D0"><enum>(iii)</enum><text>the development of technologies to permanently sequester or utilize carbon dioxide that is produced as a byproduct of the production of biobased products.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph></section><section id="H67CB3322789543F3AD9810913C7EBFB9"><enum>4.</enum><header>Biogas research and adoption of biogas systems</header><text display-inline="no-display-inline">Title IX of the Farm Security and Rural Investment Act of 2002 is amended by inserting after section 9011 (<external-xref legal-doc="usc" parsable-cite="usc/7/8111">7 U.S.C. 8111</external-xref>) the following:</text>
			<quoted-block id="H6D1CC8EC6CD045B781F07FCC2CDEF198" style="OLC">
				<section id="H7CFDE611ADBB423DB1EABD6F137561FE"><enum>9012.</enum><header>Biogas research and adoption of biogas systems</header>
 <subsection id="H0A2CC46E3207461A8CD675253271E6F4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC67681E0E78649F4B22AAEF391BC3AA1"><enum>(1)</enum><header>Anaerobic digestion</header><text>The term <term>anaerobic digestion</term> means a biological process or series of biological processes—</text>
 <subparagraph id="H2A7B48B19D5241F5ACD4BF0756971076"><enum>(A)</enum><text>through which microorganisms break down biodegradable material in the absence of oxygen; and</text> </subparagraph><subparagraph id="H196568C2E93F423AB896266DB41FDD93"><enum>(B)</enum><text>the end products of which are biogas and digested materials.</text>
 </subparagraph></paragraph><paragraph id="H4A6E1924E7DB4D62A084DD1F9A933AE6"><enum>(2)</enum><header>Biogas</header><text>The term <term>biogas</term> means a mixture of methane and carbon dioxide produced by the bacterial decomposition of organic materials in the absence of oxygen.</text>
 </paragraph><paragraph id="H223B0E0B79C34BEFB5825CF41FD8229F"><enum>(3)</enum><header>Biogas processing</header><text>The term <term>biogas processing</term> means the process by which water, carbon dioxide, and other trace compounds are removed from biogas, as determined by the end user.</text>
 </paragraph><paragraph id="H5816573A9F0241D99E78A81A52F5F0BC"><enum>(4)</enum><header>Biogas system</header><text>The term <term>biogas system</term> means a system—</text> <subparagraph id="H2A76E738924847E6A7D186555F1F1241"><enum>(A)</enum><text>with the potential to capture and use biogas, including biogas from organic waste, including animal manure, food waste, waste from landfills, and wastewater; and</text>
 </subparagraph><subparagraph id="HE678FB141E294B7FBBB89BD44DCE4266"><enum>(B)</enum><text>that includes—</text> <clause id="H2CBE7D71AB294B25941B31C7D938E9C7"><enum>(i)</enum><text>the infrastructure necessary to manage the organic waste referred to in subparagraph (A);</text>
 </clause><clause id="HC3C34385A5214D2EBBF4EAE58EB8FD83"><enum>(ii)</enum><text>the equipment necessary to generate—</text> <subclause id="H64D822365AB94078B0FEB15BCD5551BB"><enum>(I)</enum><text>electricity, heat, and fuel; and</text>
 </subclause><subclause id="H834227812A60426A89A844E1D80037D6"><enum>(II)</enum><text>biogas system co-products; and</text> </subclause></clause><clause id="H1D1C816D96A24188A3FB31F40168DEB1"><enum>(iii)</enum><text>the equipment necessary for biogas processing.</text>
 </clause></subparagraph></paragraph><paragraph id="HE3A4FB8F1CCF432E99A508CADA6C5D01"><enum>(5)</enum><header>Biogas system co-product</header><text>The term <term>biogas system co-product</term> means a nonenergy biogas system product produced from digested material, including soil amendments, fertilizers, compost, animal bedding, and feedstock for plastics and chemicals.</text>
 </paragraph><paragraph id="HFBF0A7F04C7E4BEEBE30EFB1EF8B1860"><enum>(6)</enum><header>Digested material</header><text>The term <term>digested material</term> means solid or liquid digested material—</text> <subparagraph id="HEC24143131D64A2E9FD569617DD1A511"><enum>(A)</enum><text>produced by digesters; and</text>
 </subparagraph><subparagraph id="H553CD8044BB54637886024C543D2149E"><enum>(B)</enum><text>that contains nutrients and organic carbon.</text> </subparagraph></paragraph></subsection><subsection id="H5C9A5EA9A268484C949787DE6C849F26"><enum>(b)</enum><header>Interagency biogas opportunities task force</header> <paragraph id="HD682B9E4036248DBABC719F52BDF80A2"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>Carbon Utilization Act of 2018</short-title>, the Secretary, acting jointly with the Secretary of Energy and the Administrator, shall establish an Interagency Biogas Opportunities Task Force (referred to in this subsection as the <quote>Task Force</quote>) that shall coordinate policies, programs, and research to accelerate—</text>
 <subparagraph id="H4C478DE5BE67402AAD619F4731EABA6C"><enum>(A)</enum><text>biogas research; and</text> </subparagraph><subparagraph id="H31B475AC4BEB460BB8FE6AF5BE78D28C"><enum>(B)</enum><text>investment in cost-effective biogas systems.</text>
 </subparagraph></paragraph><paragraph id="H1E2E9DD328AE4D8DBC31A002A98B754D"><enum>(2)</enum><header>Membership</header><text>The Task Force shall be composed of—</text> <subparagraph id="H2F1DFC04C4244FFFB267FD6E574FFDDB"><enum>(A)</enum><text>the head of each Federal office responsible for biogas research or biogas system financing (or a designee), including a representative from the Department of Agriculture, the Department of Energy, and the Environmental Protection Agency;</text>
 </subparagraph><subparagraph id="H94C400C766424512A59A75302149DD48"><enum>(B)</enum><text>1 or more representatives of State or local governments, as determined by the Secretary, the Secretary of Energy, and the Administrator; and</text>
 </subparagraph><subparagraph id="H39392609FA6C4993B2C1525F60645DCD"><enum>(C)</enum><text>1 or more nongovernmental or industry stakeholders, including 1 or more stakeholders from the dairy and biogas industries, as determined by the Secretary, the Secretary of Energy, and the Administrator.</text>
 </subparagraph></paragraph><paragraph id="HFE9063A4F8FE41698694E692945AB23B"><enum>(3)</enum><header>Duties of the task force</header><text>In carrying out paragraph (1), the Task Force shall—</text> <subparagraph id="HC6A90D108F91452990383C48A2209C12"><enum>(A)</enum><text>evaluate and improve the coordination of loan and grant programs of the Federal agencies represented on the Task Force—</text>
 <clause id="H716E6089E104418EAD8F203587515B09"><enum>(i)</enum><text>to broaden the financing options available for biogas systems; and</text> </clause><clause id="H41C530CDAA044B8A85AE5C0C07937AD6"><enum>(ii)</enum><text>to enhance opportunities for private financing of biogas systems;</text>
 </clause></subparagraph><subparagraph id="H00B160C397DE4474827C0E4538FD4B23"><enum>(B)</enum><text>review Federal procurement guidelines to ensure that products of biogas systems are eligible for and promoted by applicable procurement programs of the Federal Government;</text>
 </subparagraph><subparagraph id="H7E844C6F572844E79C93B889DF08824E"><enum>(C)</enum><text>in coordination with the Secretary of Commerce, evaluate the development of North American Industry Classification System and North American Product Classification System codes for biogas and biogas system products;</text>
 </subparagraph><subparagraph id="H921DF495F2DC4419BFE0BC987667F515"><enum>(D)</enum><text>review opportunities and develop strategies to overcome barriers to integrating biogas into electricity and renewable natural gas markets;</text>
 </subparagraph><subparagraph id="HC9800906E5B8419BA22280EEF68F26F2"><enum>(E)</enum><text>develop tools to broaden the market for nonenergy biogas system products, including by developing best management practices for—</text>
 <clause id="H7F21860FA3964E82983088B8C321DBDD"><enum>(i)</enum><text>the use and land application of digestate; and</text> </clause><clause id="HADD55EF3181D4C9D81F8F8358568519D"><enum>(ii)</enum><text>the use of carbon dioxide from biogas processing;</text>
 </clause></subparagraph><subparagraph id="H25E948D1DDB44753AFCAF8E389A51007"><enum>(F)</enum><text>provide information on the ability of biogas system products to participate in markets that provide environmental benefits;</text>
 </subparagraph><subparagraph id="HE254854F316E4F5399E7A0B2988AF599"><enum>(G)</enum><text>identify and investigate research gaps in biogas and anaerobic digestion technology, including research gaps in environmental benefits, market assessment, and performance standards;</text>
 </subparagraph><subparagraph id="H321A57D6E77C41D0A4A0B656CD403C11"><enum>(H)</enum><text>assess the most cost-effective voluntary investments in biogas to reduce waste and methane emissions; and</text>
 </subparagraph><subparagraph id="HFE0391C3835242E4A2214DFC742F1691"><enum>(I)</enum><text>identify and advance additional priorities, as determined by the Task Force.</text> </subparagraph></paragraph><paragraph id="H6EB6C103DBF947938A562C348A6D1BB3"><enum>(4)</enum><header>Report</header><text>Not later than 18 months after the date of the establishment of the Task Force, the Task Force shall submit to Congress a report that—</text>
 <subparagraph id="H5BB7E1A4AAB1457E829ABAC8F77E209E"><enum>(A)</enum><text>describes the steps taken by the Task Force to carry out the duties of the Task Force under paragraph (3); and</text>
 </subparagraph><subparagraph id="H4DBF8629047842C582187C421812820A"><enum>(B)</enum><text>identifies and prioritizes policies and technology opportunities—</text> <clause id="HFF2715C8EF574D5697967161CF95E68E"><enum>(i)</enum><text>to expand the biogas industry;</text>
 </clause><clause id="HF10D3CAB35484DA3907BB78327CE46D5"><enum>(ii)</enum><text>to eliminate barriers to investment in biogas systems in the landfill, livestock, wastewater, and other relevant sectors; and</text>
 </clause><clause id="HE0FCE2608F644B45AC947869A4ADD7E2"><enum>(iii)</enum><text>to enhance opportunities for private and public sector partnerships to finance biogas systems.</text> </clause></subparagraph></paragraph></subsection><subsection id="H9DDB36E52FBE48BDB3D183B7BA8047D7"><enum>(c)</enum><header>Advancement of biogas research</header> <paragraph id="H78A5377A3BBE4271ACA8147FE7312E9A"><enum>(1)</enum><header>Study on biogas</header> <subparagraph id="H5F1B9220563741A19890D60371538F17"><enum>(A)</enum><header>In general</header><text>The Secretary, in coordination with the Secretary of Energy and the Administrator, shall enter into an agreement with the National Renewable Energy Laboratory to conduct a study relating to biogas.</text>
 </subparagraph><subparagraph id="H0F2BDBCE025149368CCE62692731BA72"><enum>(B)</enum><header>Study</header><text>Under the agreement described in subparagraph (A), the study conducted by the National Renewable Energy Laboratory shall include an analysis of—</text>
 <clause id="HF3660BA897F7413BBA5DBF46523FE19A"><enum>(i)</enum><text>barriers to injecting biogas into existing natural gas pipelines;</text> </clause><clause id="H9EFEF359252348A0B1E88F73193E08FE"><enum>(ii)</enum><text>methods for optimizing biogas systems, including methods to obtain the highest energy output from biogas, including through the use of co-digestion;</text>
 </clause><clause id="H38E387DE735C43009B4F61F01EAF3EAE"><enum>(iii)</enum><text>opportunities for, and barriers to, the productive use of biogas system co-products, carbon dioxide from biogas processing, and recovered nutrients;</text>
 </clause><clause id="H4AD1261040A54FACAEAC03C404AC5B90"><enum>(iv)</enum><text>the optimal configuration of local, State, or regional infrastructure for the production of electricity, heat, or fuel from biogas, including infrastructure for the aggregation, cleaning, and pipeline injection of biogas; and</text>
 </clause><clause id="HA6F59E2A139347E4B39E1A4DE0A5D2D3"><enum>(v)</enum><text>any other subject relating to biogas, as determined by the Interagency Biogas Opportunities Task Force established under subsection (b)(1).</text>
 </clause></subparagraph><subparagraph id="H08460D8DF3DD4C75808DE6E996CAA774"><enum>(C)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of the <short-title>Carbon Utilization Act of 2018</short-title>, the Secretary shall submit to Congress a report on the study conducted under this paragraph.</text> </subparagraph></paragraph><paragraph id="H7E306FDB1FE549139032A1BA5A55F60D"><enum>(2)</enum><header>Collection of data for biogas markets</header><text>The Secretary, in coordination with the Secretary of Energy and the Administrator, shall identify, collect, and analyze environmental, technical, and economic performance data relating to biogas systems, including the production of energy of biogas systems, co-products, greenhouse gas and other emissions, water quality benefits, and other data necessary to develop markets for biogas and biogas system co-products.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H4F710FDF797D4A1DA125BAC3F771A664"><enum>5.</enum><header>Carbon utilization education program</header><text display-inline="no-display-inline">Title IX of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8101">7 U.S.C. 8101</external-xref> et seq.) is amended by adding at the end the following:</text>

				<section id="HC02AB2CE336B473A84918EC2D0974430"><enum>9014.</enum><header>Carbon utilization education program</header>
 <subsection id="H918B8D9FC78C4B6DB3EC274EF32C0119"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H424EEA21336F4BD9A29B7CDB5711A0F5"><enum>(1)</enum><header>Carbon dioxide</header><text>The term <term>carbon dioxide</term> means carbon dioxide that is produced as a byproduct of the production of a biobased product.</text>
 </paragraph><paragraph id="HA905277583074F138143678EB7E2A10B"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity that—</text> <subparagraph id="H512C97E27CF341AF8036A7E129682DD3"><enum>(A)</enum><text>is—</text>
 <clause id="HCD81F0E4C65B4242A8CC3E74A6495DC7"><enum>(i)</enum><text>an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code; or</text>
 </clause><clause id="H11866DC331274450B6BE644276A64056"><enum>(ii)</enum><text>an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>));</text>
 </clause></subparagraph><subparagraph id="H24A1BC575D0B4BE98A6DCF0173D19430"><enum>(B)</enum><text>has demonstrated knowledge about—</text> <clause id="H8BC8B2AB5261490EB07F9B13FBABF1AB"><enum>(i)</enum><text>sequestration and utilization of carbon dioxide; or</text>
 </clause><clause id="H06DA16A22F284D089023A11F6734FC2E"><enum>(ii)</enum><text>aggregation of organic waste from multiple sources into a single biogas system; and</text> </clause></subparagraph><subparagraph id="HFACD09325921462890835C7043857EB1"><enum>(C)</enum><text>has a demonstrated ability to conduct educational and technical support programs.</text>
 </subparagraph></paragraph></subsection><subsection id="H60DA5B7AA75D49DABB9F618633F908AB"><enum>(b)</enum><header>Establishment</header><text>The Secretary, in consultation with the Secretary of Energy, shall make competitive grants to eligible entities—</text>
 <paragraph id="H2F450A63E158484A955CB4387CF59DA3"><enum>(1)</enum><text>to provide education to the public about the economic and emissions benefits of permanent sequestration or utilization of carbon dioxide; or</text>
 </paragraph><paragraph id="HFEFDEDF32BA54CE3B5909A4891107937"><enum>(2)</enum><text>to provide education to biogas producers about opportunities for aggregation of organic waste from multiple sources into a single biogas system.</text>
						</paragraph></subsection><subsection id="HB0DF0C1126924F84ABF28F49C777611C"><enum>(c)</enum><header>Funding</header>
 <paragraph id="HF2F6B9646BF640EAB7D90DC251EC549B"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use for each of fiscal years 2019 through 2023—</text>
 <subparagraph id="HEF9A7C1ABB944A869B9D395AC8EFA1B3"><enum>(A)</enum><text>$1,000,000 to carry out subsection (b)(1); and</text> </subparagraph><subparagraph id="H7D702E6072D645F6B981982CD9868F32"><enum>(B)</enum><text>$1,000,000 to carry out subsection (b)(2).</text>
 </subparagraph></paragraph><paragraph id="HAE9C4F5FAD9847AA84B178E262FF3D3B"><enum>(2)</enum><header>Discretionary funding</header><text>There are authorized to be appropriated for each of fiscal years 2019 through 2023—</text> <subparagraph id="HBB0055725FC44733A7BB2F5B4CC132B3"><enum>(A)</enum><text>$1,000,000 to carry out subsection (b)(1); and</text>
 </subparagraph><subparagraph id="H5EF92CBDF6C5407C9D845B54A4AD0123"><enum>(B)</enum><text>$1,000,000 to carry out subsection (b)(2).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H4BC3E2DCCD9A4A0886186168C781A9D6"><enum>6.</enum><header>Carbon capture, utilization, and sequestration</header> <subsection id="H3510667CC5414F42B33782813EF62164"><enum>(a)</enum><header>General authorization</header><text>Notwithstanding any other provision of law (including regulations), in carrying out any program pursuant to this Act or an amendment made by this Act under which the Secretary of Agriculture provides a loan or loan guarantee, the Secretary may provide such a loan or loan guarantee for carbon dioxide capture and utilization facilities employing commercially demonstrated technologies.</text>
			</subsection><subsection id="HC30BD7738E4540FF93DB31B0EF0CC434"><enum>(b)</enum><header>Rural electrification assistance programs</header>
 <paragraph id="H0B13FAE92C2A4206B9C5EBB40CFBF51F"><enum>(1)</enum><header>General authority of the secretary of agriculture</header><text>Section 2(a) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/902">7 U.S.C. 902(a)</external-xref>) is amended by striking <quote>efficiency and conservation</quote> and inserting <quote>efficiency, conservation, and carbon dioxide capture and utilization</quote>.</text> </paragraph><paragraph id="HBEBE7AF34E2D49F1889952CA2AC04473"><enum>(2)</enum><header>Authorization of appropriations</header><text>Section 4(a) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/904">7 U.S.C. 904(a)</external-xref>) is amended—</text>
 <subparagraph id="H8D465DD2A29F4CF086BE73E01AEDEF91"><enum>(A)</enum><text>by inserting <quote>and related carbon dioxide capture and utilization facilities employing commercially demonstrated technology</quote> after <quote>generating plants</quote>; and</text>
 </subparagraph><subparagraph id="HDD903D5DF2764346ACA1A3410E520246"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>efficiency and conservation</quote> and inserting <quote>efficiency, conservation, and carbon dioxide capture and utilization</quote>.</text> </subparagraph></paragraph><paragraph id="H78CD060CF2F74833A14390D7E4FDA13E"><enum>(3)</enum><header>Energy generation, transmission, and distribution facilities efficiency grants and loans in rural communities with extremely high energy costs</header><text>Section 19(a) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/918a">7 U.S.C. 918a(a)</external-xref>) is amended, in paragraphs (1) and (2), by inserting <quote>(including carbon capture and utilization)</quote> after <quote>generation</quote> each place it appears.</text>
 </paragraph></subsection><subsection id="H73B5054BE603496CAE183824C84C735A"><enum>(c)</enum><header>Rural and remote communities electrification grants</header><text>Section 609(c)(3) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/918c">7 U.S.C. 918c(c)(3)</external-xref>) is amended by striking <quote>preference to renewable energy facilities.</quote> and inserting the following:</text>
				<quoted-block display-inline="yes-display-inline" id="H6E256645D4ED417AB8BFECBAA64E523B" style="OLC">
 <text>preference to—</text><subparagraph id="H1AD244F1C37A439780075727D3BD7067"><enum>(A)</enum><text>renewable energy facilities; and</text> </subparagraph><subparagraph id="H80F1051AD405460C9811623F5A30CDFA"><enum>(B)</enum><text>facilities for carbon capture and utilization.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="H3CF2EBE66C17417CAC8F2E76F6494C9B"><enum>7.</enum><header>Technical assistance for rural electrification loans</header><text display-inline="no-display-inline">Section 2 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/902">7 U.S.C. 902</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block id="H566D6C7BC52E4302BE03EB6610322D36" style="OLC">
				<subsection id="HEC875057FFB74E04AC867B9875E345B7"><enum>(c)</enum><header>Technical assistance</header>
 <paragraph id="H00AC10AE5C144BB1830D26FCF822E247"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Carbon Utilization Act of 2018</short-title>, the Secretary shall enter into a memorandum of understanding with the Secretary of Energy under which the Secretary of Energy shall provide technical assistance to applicants for loans made under subsection (a) and section 4(a).</text>
 </paragraph><paragraph id="H38CFFF84353C426D90CC573E6C6661CD"><enum>(2)</enum><header>Form of assistance</header><text>The technical assistance that the Secretary may request pursuant to a memorandum of understanding entered into under paragraph (1) may include—</text>
 <subparagraph id="H25CD0CA2224C448C9BD6EFCF0A0F2330"><enum>(A)</enum><text>direct advice;</text> </subparagraph><subparagraph id="H04A04DD8BECA4F87A0E9A9FFB194F21C"><enum>(B)</enum><text>tools, maps, and training relating to—</text>
 <clause id="H92718AA559154505BD48E82538F89988"><enum>(i)</enum><text>the implementation of demand-side management of electric and telephone service in rural areas;</text> </clause><clause id="H62F219A8910946CD856E5A640FEF0C86"><enum>(ii)</enum><text>energy efficiency and conservation programs; and</text>
 </clause><clause id="H2BB87357B68144CFA5549DD74B73B7AC"><enum>(iii)</enum><text>on-grid and off-grid renewable energy systems; and</text> </clause></subparagraph><subparagraph id="H719FEBD1D16141F5A94D287B5D81E67C"><enum>(C)</enum><text>any other forms of assistance determined necessary by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
