<legis-type>AN ACT</legis-type> 
<official-title display="yes">To require the Secretary of Homeland Security to conduct a threat and operational analysis of ports of entry, and for other purposes.</official-title>

<section id="H526C2938FC174C90A875021E7676647B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Ports of Entry Threat and Operational Review Act</short-title></quote>.</text></section> <section id="H1E85D71BD2364D5B9027163ED773007E"><enum>2.</enum><header>Ports of entry threat and operational analysis</header> <subsection id="H73E6104FDDE546B78DE7E95CF45E4CD3"><enum>(a)</enum><header>In general</header> <paragraph id="HFC13B7871A1C44B983647A298D76386D"><enum>(1)</enum><header>Requirement</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall submit to the Committee on Homeland Security and the Committee on Ways and Means of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on Finance of the Senate a threat and operational analysis of ports of entry.</text></paragraph> 
<paragraph id="H2249E81FEE3B463D8EE47A1ADF748C15"><enum>(2)</enum><header>Contents</header><text>The threat and operational analysis required under paragraph (1) shall include an assessment of the following:</text> <subparagraph id="HC06A11999BE04F44927A8160323F1CF1"><enum>(A)</enum><text>Current and potential threats posed by individuals and organized groups seeking—</text> 
<clause id="H74CC7DB56F43432893963A3734F3A1E5"><enum>(i)</enum><text>to exploit security vulnerabilities at ports of entry; or</text></clause> <clause id="H4AD6C3D04F2447C8A76770799BF7F752"><enum>(ii)</enum><text>to unlawfully enter the United States through such ports of entry.</text></clause></subparagraph> 
<subparagraph id="H251F416562F74476AAC248074A857651"><enum>(B)</enum><text>Methods and pathways used to exploit security vulnerabilities at ports of entry.</text></subparagraph> <subparagraph id="H4428E9476ABE4C118390D2044CF54DFE"><enum>(C)</enum><text display-inline="yes-display-inline">Improvements needed at ports of entry to prevent the unlawful movement of people, illicit drugs, and other contraband across the borders of the United States.</text></subparagraph> 
<subparagraph id="H098B4498A64444C591EFD3768AE6A52C"><enum>(D)</enum><text display-inline="yes-display-inline">Improvements needed to enhance travel and trade facilitation and reduce wait times at ports of entry, including—</text> <clause id="H09F6EC5DC69640A8B5E95B7910135DE4"><enum>(i)</enum><text>security vulnerabilities associated with prolonged wait times;</text></clause> 
<clause id="HBAE0FA01D11343339E7D1F153497B8B6"><enum>(ii)</enum><text>current technology at ports of entry that can be adapted to handle more volume, increase efficiency, and improve accuracy of detection efforts; and</text></clause> <clause id="H0191D725B22F4A32B040FC833786EA3D"><enum>(iii)</enum><text>infrastructure additions and upgrades.</text></clause></subparagraph> 
<subparagraph id="H435670E5A86D4D01B3E6597CAC9AE0D0"><enum>(E)</enum><text>Processes conducted at ports of entry that do not require law enforcement training and could be—</text> <clause id="HF7A5382864AB42CA91A3AE44E0D6269A"><enum>(i)</enum><text>filled with—</text> 
<subclause id="H88EC333B53B441858CEC196813E273D0"><enum>(I)</enum><text>non-law enforcement staff; or</text></subclause> <subclause id="H868C72322CB14542B94A123DC9A5EF6C"><enum>(II)</enum><text display-inline="yes-display-inline">the private sector, for processes or activities determined to not be inherently governmental (as such term is defined in section 5 of the Federal Activities Inventory Reform Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/270">Public Law 105–270</external-xref>)); or</text></subclause></clause> 
<clause id="H65EEBDDD645141D2B31CC8C80685203B"><enum>(ii)</enum><text>automated.</text></clause></subparagraph></paragraph> <paragraph id="H27F75987B5AB4D898D349627B6331ED4"><enum>(3)</enum><header>Analysis requirements</header><text display-inline="yes-display-inline">In compiling the threat and operational analysis required under paragraph (1), the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall consider and examine the following:</text> 
<subparagraph id="HB845528F690C4875B122F0294057011C"><enum>(A)</enum><text>Personnel needs, including K–9 Units, and estimated costs, at each port of entry, including such needs and challenges associated with recruitment and hiring.</text></subparagraph> <subparagraph id="HAAB0B7A6CA0F4F45B13883B297896ABA"><enum>(B)</enum><text>Technology needs, including radiation portal monitors and non-intrusive inspection technology, and estimated costs at each port of entry.</text></subparagraph> 
<subparagraph id="H780FD3F5042544CDBC8E1ACFADDA5A00"><enum>(C)</enum><text>Infrastructure needs and estimated costs at each port of entry.</text></subparagraph></paragraph></subsection> <subsection id="H7B6420F491F14BA9B50ED645A89A7DB0"><enum>(b)</enum><header>Ports of entry strategy and implementation plan</header> <paragraph id="HB8EAF543405E446D90EB2BED729DECBD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the submission of the threat and operational analysis required under subsection (a) and every 5 years thereafter for 10 years, the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection (CBP), shall provide to the Committee on Homeland Security and the Committee on Ways and Means of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on Finance of the Senate a ports of entry strategy and implementation plan.</text></paragraph> 
<paragraph id="HBB065DC359A54305824893E66368D8C9"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The ports of entry strategy and implementation plan required under paragraph (1) shall include a consideration of the following:</text> <subparagraph id="HC64FDE97B66F424F98E11214291CCF9A"><enum>(A)</enum><text>The ports of entry threat and operational analysis required under subsection (a), with an emphasis on efforts to mitigate threats and challenges identified in such analysis.</text></subparagraph> 
<subparagraph id="H0CBBB980E50E41B592CFD89AFD146730"><enum>(B)</enum><text display-inline="yes-display-inline">Efforts to reduce wait times at ports of entry and standards against which the effectiveness of such efforts may be determined.</text></subparagraph> <subparagraph id="H44CCF88E3FFC487085B14CAA7847ECCF"><enum>(C)</enum><text display-inline="yes-display-inline">Efforts to prevent the unlawful movement of people, illicit drugs, and other contraband across the borders of the United States at the earliest possible point at ports of entry and standards against which the effectiveness of such efforts may be determined.</text></subparagraph> 
<subparagraph id="HE6C50275D7D64A3B87AA496267B203D2"><enum>(D)</enum><text display-inline="yes-display-inline">Efforts to focus intelligence collection and information analysis to disrupt transnational criminal organizations attempting to exploit vulnerabilities at ports of entry and standards against which the effectiveness of such efforts may be determined.</text></subparagraph> <subparagraph id="HC2D341A343074F50BBDBA2869B005EE6"><enum>(E)</enum><text>Efforts to verify that any new port of entry technology acquisition can be operationally integrated with existing technologies in use by the Department of Homeland Security.</text></subparagraph> 
<subparagraph commented="no" id="H14AE4C99EAE94928BB5D869BD1B666C4"><enum>(F)</enum><text display-inline="yes-display-inline">Lessons learned from reports on the business transformation initiative under section 802(i)(1) of the Trade Facilitation and Trade Enforcement Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/125">Public Law 114–125</external-xref>).</text></subparagraph> <subparagraph id="HB9B15565BEFF4F52B7C1529FA602F8C3"><enum>(G)</enum><text>CBP staffing requirements for all ports of entry.</text></subparagraph> 
<subparagraph id="H907D93A12C7D4BA18E189C80B5A04B65"><enum>(H)</enum><text display-inline="yes-display-inline">Efforts to identify and detect fraudulent documents at ports of entry and standards against which the effectiveness of such efforts may be determined.</text></subparagraph> <subparagraph id="H40FF68FADADB43AD82D1D3455B491781"><enum>(I)</enum><text display-inline="yes-display-inline">Efforts to prevent, detect, investigate, and mitigate corruption at ports of entry and standards against which the effectiveness of such efforts may be determined.</text></subparagraph></paragraph></subsection> 
<subsection id="HEBFB09A2D5724059A1072FC733DB3D9D"><enum>(c)</enum><header>Ports of entry described</header><text>In this section, the term <quote>ports of entry</quote> means United States air, land, and sea ports of entry.</text></subsection></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
