			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose sanctions relating to persons operating the Nord Stream 2 pipeline, and for other
			 purposes.</official-title></form>
	<legis-body id="HA8E42D602B794497BB511EA06DFF09AE" style="OLC">
 <section id="H6A8B41B68DAD447EAB011E7277A2B678" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Countering Russian Power Plays Act</short-title></quote>.</text> </section><section id="HCBF8601B92C14AB4B75D2B06D6BE38B6"><enum>2.</enum><header>Imposition of sanctions with respect to Nord Stream 2</header> <subsection id="H13ED865FFD79447582E8E82517483D39"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the United States—</text>
 <paragraph id="H585C3A32DE4B4755B206C2A9A1D56B30"><enum>(1)</enum><text>should stand by its allies in Europe in combating Russian influence and energy coercion;</text> </paragraph><paragraph id="HDF4FB3E6201B4E19816F485D5A9E6244"><enum>(2)</enum><text>opposes the Nord Stream 2 pipeline because of its detrimental impacts on—</text>
 <subparagraph id="H666902B06EF445A8B1A7C7728995B671"><enum>(A)</enum><text>the energy security of the European Union;</text> </subparagraph><subparagraph id="HCC307219B8034EDE82FCB7ACB17AD608"><enum>(B)</enum><text>the ability of the European Union to meet its renewable energy goals; and</text>
 </subparagraph><subparagraph id="H2BF710BA68C94C509C7105297776129C"><enum>(C)</enum><text>energy reforms in Ukraine;</text> </subparagraph></paragraph><paragraph id="H819794FBEB2F414598AE527EE9FF8487"><enum>(3)</enum><text>has a vested interest in the security, economic stability, and political security of Ukraine, and that reducing gas transfers through Ukraine by means of the Nord Stream 2 pipeline would risk destabilizing that country; and</text>
 </paragraph><paragraph id="H0116044C25BE4727B979A1E47E05DEA9"><enum>(4)</enum><text>notwithstanding its opposition to the Nord Stream 2 pipeline, recognizes the European Union’s proper and fundamental need to secure diverse, reliable energy sources, for which the purchase of Russian gas may be an unavoidable component.</text>
 </paragraph></subsection><subsection id="HDDB0DE9A7EC24F9CA187D9CB862EBC23"><enum>(b)</enum><header>Sanctions imposed</header><text display-inline="yes-display-inline">Subject to subsection (d), the President shall impose five or more sanctions described in section 235 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9529">22 U.S.C. 9529</external-xref>) with respect to each person described in subsection (c).</text>
 </subsection><subsection id="HDED7F65ED7154ECEAA5B3E778A51742A"><enum>(c)</enum><header>Persons described</header><text>The persons described in this subsection are each person the President determines—</text> <paragraph id="H8F3A50065597479E9F9FA56E8D728F3F"><enum>(1)</enum><text>operates the Nord Stream 2 pipeline or sells Russian gas to Europe through the Nord Stream 2 pipeline; or</text>
 </paragraph><paragraph id="H74A9A39E0F73470BBF001F3C1C2FF6CA"><enum>(2)</enum><text>engages in a significant transaction with the Nord Stream 2 pipeline.</text> </paragraph></subsection><subsection id="H6926155F7AB9425390D92334FE51E071"><enum>(d)</enum><header>Conditions; delayed application</header> <paragraph id="H645AFBE7C9394C7D95AAD5D7420A8C2C"><enum>(1)</enum><header>Conditions</header><text display-inline="yes-display-inline">The President shall impose sanctions with respect to persons described in subsection (c)(1) only if the President determines that—</text>
 <subparagraph id="H6907A214EB864B90AB92F9AD9D6D13DA"><enum>(A)</enum><text display-inline="yes-display-inline">average Russian gas flows through Ukraine to Europe over a period of 12 consecutive months beginning after the date of the enactment of this Act are less than 75 percent of the average annual Russian gas flows through Europe via Ukraine during the three-year period ending on the date of the enactment of this Act;</text>
 </subparagraph><subparagraph id="H2E32C5105C114440A847474B3E46FCE9"><enum>(B)</enum><text display-inline="yes-display-inline">Ukraine maintained a reasonable standard of operation of gas pipelines during such 12-month period;</text> </subparagraph><subparagraph id="H7EA4FD28ABF94990B18160C5EBA37755"><enum>(C)</enum><text display-inline="yes-display-inline">Ukraine has not raised transit fees by more than five percent in such 12-month period; and</text>
 </subparagraph><subparagraph id="H5EBE07A1F08F46DE8A52F32ECAF81B00"><enum>(D)</enum><text display-inline="yes-display-inline">there is no other good cause justifying for the reduction of gas flows through Ukraine during such 12-month period.</text>
 </subparagraph></paragraph><paragraph id="H1FC2744E6E3C42ED97074012B96C9119"><enum>(2)</enum><header>Delayed application</header><text>The President may not impose sanctions with respect to a person described in subsection (c)(2) before the date that is 180 days after the President imposes sanctions with respect to any person described in subsection (c)(1).</text>
				</paragraph></subsection></section><section id="HA50E95E0056D42C0A27717A13C666FE7"><enum>3.</enum><header>United States-European Union energy council</header>
 <subsection id="H887C13DD972E4855B3FE5EF1CED36758"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> <paragraph id="H75B0CE7D79D342BEA6E01BE03BAE7CCA"><enum>(1)</enum><text>The United States–European Union Energy Council (<quote>Council</quote>) was established in 2009 to deepen coordination on transatlantic energy matters, including research and development cooperation.</text>
 </paragraph><paragraph id="H12422EBB5CA74E75A76FA98AB566C214"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of State co-chairs the Council with the Secretary of Energy for the United States. The High Representative for External Affairs and the Vice President for Energy Union and Commissioner for Energy and Climate serve as co-chairs for the European Union.</text>
 </paragraph><paragraph id="H99E978E754C04BF1AE99D418E26D31F0"><enum>(3)</enum><text>The Council provides a high-level, bilateral method to address energy issues, including means to develop alternatives to Russian-supplied gas in Europe, in order to promote European security.</text>
 </paragraph></subsection><subsection id="H39F7AC47256A45D1BBECC6455BB48EA1"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the Secretary of State and the Secretary of Energy should convene, in coordination with the European Union co-chairs, a meeting of the Council on an annual basis, and that the next such meeting should occur not later than 180 days after the date of the enactment of this Act.</text>
 </subsection><subsection id="H6FD0771FB9AE44FEB432964B2DB630A5"><enum>(c)</enum><header>Report on energy support strategy</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in coordination with the Secretary of Energy, shall submit to Congress a report on the comprehensive strategy of the United States to support European energy security that also includes an analysis of each of the following:</text>
 <paragraph id="H0EA02588886C4CC19FDD714F0167A411"><enum>(1)</enum><text display-inline="yes-display-inline">Energy supplies that could be provided by the United States or other allies to European countries.</text> </paragraph><paragraph id="H275201D64BAD433C96301E5B1532774C"><enum>(2)</enum><text display-inline="yes-display-inline">Steps to reduce European reliance on Russian energy sources.</text>
 </paragraph><paragraph id="H5FDDF64ABEDD497EAAE6CD06D711EA03"><enum>(3)</enum><text display-inline="yes-display-inline">Methods to accelerate emerging energy sources or related technologies.</text> </paragraph><paragraph id="H22BA9D37ABE043BC8B0756EEA1009147"><enum>(4)</enum><text display-inline="yes-display-inline">Potential industrial partnerships, international financing arrangements, and trade agreements to bolster European energy security.</text>
 </paragraph><paragraph id="H436AA28D8E56425FB4A2B2A93040AB1B"><enum>(5)</enum><text display-inline="yes-display-inline">Legal and political considerations that could unnecessarily hinder the United States or allied countries from supporting European energy needs.</text>
