			 for discharging petitions during such a backlog.</official-title></form>
	<legis-body id="H62F0B1C3A40F469AA00DF0ECEE145CCB" style="OLC">
 <section id="H294AFE7D59CC45D08DB7DB83D0CF618F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing ESA Timing Improvements That Increase Opportunities for Nonlisting Act of 2018</short-title></quote> or the <quote><short-title>PETITION Act of 2018</short-title></quote>.</text> </section><section id="H846E3D2AAB0B42918BCA80E550693557"><enum>2.</enum><header>Findings and purposes</header> <subsection id="H83B53C5FD8A3486789118562AA7F6F30"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
 <paragraph id="HED483610F1124758AAC0377A8931E0C0"><enum>(1)</enum><text>The number and type of species-listing petitions received by the United States Fish and Wildlife Service (in this Act referred to as the <quote>Service</quote>) during the last two decades under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) routinely outstrip the capacity of the agency to process all such petitions within the timeframes required by that statute, constituting a petition backlog.</text>
 </paragraph><paragraph id="H1B1EE676CCDA415E891580B653AD90C4"><enum>(2)</enum><text>A significant portion of petitions in the backlog would ultimately be rejected as having failed to contain substantial information, or containing substantial information but not meriting a listing of a species as an endangered species or threatened species, if the Service were to issue findings on them.</text>
 </paragraph><paragraph id="H9E9A8CF66E8A4432871ECEEB06552355"><enum>(3)</enum><text>The petition system has been overloaded with influxes of petitions submitted by well-funded petitioners with the express intention of creating a backlog that causes the Service to fail to adhere to timeframes established in the Endangered Species Act of 1973.</text>
 </paragraph><paragraph id="HD7734399871A40EAB57CDCFF4C55D781"><enum>(4)</enum><text>The deficit between total received petitions and petitions processed within statutory timeframes results in the Federal Government being exposed to legal liability on the basis of such a backlog, in accordance with such intention of petitioners.</text>
 </paragraph><paragraph id="H75CEA0DFE1074BDE9F1F53BCBF8F9C9A"><enum>(5)</enum><text>Ensuing litigation initiated by such petitioners results in the Service agreeing to or being court-ordered to adhere to adverse timeframes, listing decisions, and settlements.</text>
 </paragraph><paragraph id="H08AD7644B0BC4889B45253413C115CC9"><enum>(6)</enum><text>Such litigation secures listings for species and habitat designations for which the Service would otherwise not issue a positive finding on the basis of its regular, procedural evaluation of a petition.</text>
 </paragraph><paragraph id="H0188F7BEF6774A84813D4F39B02103C0"><enum>(7)</enum><text>Accordingly, such listings and designations are agreed or adhered to contrary to the public interest insofar as the public benefits from faithful execution of duly passed laws.</text>
 </paragraph><paragraph id="HB66C19BEF84E414FAB08FCE9085D7EF9"><enum>(8)</enum><text>A statutory remedy is necessary to address the backlog of the Service and to prevent such statutory abuse while maintaining proper open channels for qualifying species to be listed as threatened species or endangered species.</text>
 </paragraph></subsection><subsection id="H85224901575E494C974E42299E8AF62F"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are the following:</text> <paragraph id="H18D4ECF212B6468BA30346D0B3EC19AE"><enum>(1)</enum><text>To maintain safeguards and pathways to listing of species as endangered species or threatened species, along with all corresponding protections thereof, for any imperiled species.</text>
 </paragraph><paragraph id="H5B2F4A39108746C7893B1B5DEE25C8FD"><enum>(2)</enum><text>To limit unnecessary legal liability of the Federal Government arising from any backlog of petitions received under the Endangered Species Act of 1973.</text>
 </paragraph><paragraph id="HD8BB817C93BA4BE0BC53D2E5ABFDB6AD"><enum>(3)</enum><text>To prevent adverse court orders and settlements arising when such liability is exploited in litigation.</text>
 </paragraph><paragraph id="H7F1B3D197A5F4156A53E87A0196CBF52"><enum>(4)</enum><text>To accomplish all of the foregoing by reducing and eliminating the backlog of excess petitions received by the Service under the Endangered Species Act of 1973.</text>
 </paragraph></subsection></section><section id="H50870F76147F40119546E06D06E7CE0F"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref>) is amended—</text> <paragraph id="HBD6F26A3157D48E1AC01E78F9F6E63AB"><enum>(1)</enum><text>by inserting before the text the following:</text>
				<quoted-block id="HDB8E28FF4CE64E06BF417F67D1657908" style="OLC">
					<subsection id="HD15156643CAE448DB11A476EC534156D"><enum>(a)</enum><header>In general</header></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HAC0167CCA9C943A39AF93BF1F012F5D2"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H34ABC2C8B72F4670B59F0FFC930A23FD" style="OLC"> <subsection id="H671364A1373F4106B156EA61DFA7450A"><enum>(b)</enum><header>Definitions related to petitions</header><text>In this Act:</text>
 <paragraph id="H82F5EAE359EA493FA0D5D53D90541E76"><enum>(1)</enum><header>90-day petition backlog</header><text>The term <quote>90-day petition backlog</quote> means such a backlog declared by the Secretary under section 4(b)(3)(E).</text> </paragraph><paragraph id="H8820165E60434D11A33B4A7075070DEB"><enum>(2)</enum><header>12-month petition backlog</header><text>The term <quote>12-month petition backlog</quote> means such a backlog declared by the Secretary under section 4(b)(3)(E).</text>
 </paragraph><paragraph id="HD323C174E8A44B43B4390EBEBDD644AA"><enum>(3)</enum><header>Backlog schedule</header><text>The term <quote>backlog schedule</quote> means a comprehensive, regularly updated compendium of petitioned-for species that are the subject of a 90-day petition backlog or a 12-month petition backlog—</text>
 <subparagraph id="HA93E753437724DABA2788465B8B7310E"><enum>(A)</enum><text>that consists of—</text> <clause id="HECA57E7B5CD6477EAC96559F8E5EE733"><enum>(i)</enum><text>a list of petitions to add a species to a list of species under section 4(c), including petitions to move a species from the list of threatened species to the list of endangered species; and</text>
 </clause><clause id="H58CD3744E65D479C98FBBBABBBEAB8B3"><enum>(ii)</enum><text>a list of petitions to remove a species from a list of species under section 4(c), including petitions to move a species from the list of endangered species to the list of threatened species; and</text>
 </clause></subparagraph><subparagraph id="HD8F5198C7C054426A9912B4EE4B27C5D"><enum>(B)</enum><text>in which the petitions in each such list appear in the order in which the petitions were submitted to the Secretary.</text>
 </subparagraph></paragraph><paragraph id="HC18BE97203CB4A95B5644C76B01BCB03"><enum>(4)</enum><header>Backlog procedures</header><text>The term <quote>backlog procedures</quote> means the actions taken by the Secretary—</text> <subparagraph id="HBDC70FE6E2384034A2D699651B40ECF2"><enum>(A)</enum><text>under section 4(b)(3)(G) following the declaration of a 90-day petition backlog; or</text>
 </subparagraph><subparagraph id="H338B8C7A4F4045D0AD4BE4CCE3801497"><enum>(B)</enum><text>under section 4(b)(3)(H) following the declaration of a 12-month petition backlog.</text> </subparagraph></paragraph><paragraph id="H0E1C263D908E40AA9AEEE78B341FCAF7"><enum>(5)</enum><header>Petitioned-for species</header><text>The term <quote>petitioned-for species</quote> means a species that has been identified in a petition presented under subparagraph (A) or (B) of section 4(b)(3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5B7934FD8D1B4E97A3EBA5A5754313AE"><enum>4.</enum><header>Backlog declaration and procedures</header>
 <subsection id="H24FFD55E81744408B08E05089E7BACBD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4(b)(3) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(b)(3)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2712A43B06D0424FA1AB0ED3C6715E3A" style="OLC">
					<subparagraph id="HF5DE377D1CAA46C4BAFE3BCDEB4CBE58"><enum>(E)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H85C999D05F854A6D9835A9AB8B081EBB"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary shall—</text> <subclause id="H40FC1158335649A3BF0C428637F6C3A7" indent="up1"><enum>(I)</enum><text>declare a 90-day petition backlog at any time the total number of species for which a petition is presented to the Secretary under subparagraph (A) that has not been the subject of a finding by the Secretary within the timeframe established under such subparagraph exceeds 5 percent of the number of species for which such petitions have been presented during the preceding 15 years;</text>
 </subclause><subclause id="HCE247B246D214242BBF53789F3680D0A" indent="up1"><enum>(II)</enum><text>submit a backlog schedule for such backlog to—</text> <item id="H8827CBD093CC46C1AB3D3E4E1B9F09AF"><enum>(aa)</enum><text>the President;</text>
 </item><item id="H86173B1FA4B94AA18413A14BD7119966"><enum>(bb)</enum><text>the Chairman and ranking minority Member of the Committee on Environment and Public Works of the Senate; and</text>
 </item><item id="H21C113CAF908472985E73BD67422B136"><enum>(cc)</enum><text>the Chairman and ranking minority Member of the Committee on Natural Resources of the House of Representatives; and</text>
 </item></subclause><subclause id="HD06483B02C80418E91792F763F2E15B4" indent="up1"><enum>(III)</enum><text>comply with backlog procedures under subparagraph (G) during the period such backlog is in effect.</text> </subclause></clause><clause id="H8A40293795FF4EE3BD95108DA952B585" indent="up1"><enum>(ii)</enum><text>The Secretary shall—</text>
 <subclause id="H340E073B9D664BE58573D1E9A0B2D837"><enum>(I)</enum><text>declare a 12-month petition backlog at any time the total number of species for which a petition is being considered by the Secretary under subparagraph (B) that has not been the subject of a finding by the Secretary within the timeframe established under such subparagraph exceeds 5 percent of the number of species for which such petitions have been presented during the preceding 15 years;</text>
 </subclause><subclause id="H5D22DDD884C041A6831E4735D15DB445"><enum>(II)</enum><text>submit a backlog schedule for such backlog to—</text> <item id="HDDE0E2E0FA414CF997DA73132800324E"><enum>(aa)</enum><text>the President;</text>
 </item><item id="HE835D8297846490F9B548EF056213AB7"><enum>(bb)</enum><text>the Chairman and ranking minority Member of the Committee on Environment and Public Works of the Senate; and</text>
 </item><item id="H3445BB1EA06243939690EF7422835068"><enum>(cc)</enum><text>the Chairman and ranking minority Member of the Committee on Natural Resources of the House of Representatives; and</text>
 </item></subclause><subclause id="H889B67467C1B4B479DF12F5193BA6264"><enum>(III)</enum><text>comply with backlog procedures under subparagraph (H) during the period such declaration is in effect.</text>
 </subclause></clause><clause id="H13FF777B61464A4D9CC736DF6139AE6A" indent="up1"><enum>(iii)</enum><text>Not later than 90 days after declaring a 90-day petition backlog or 12-month petition backlog, and every 90 days thereafter during the period such backlog is in effect, the Secretary shall submit to the recipients under clause (ii)(II) and (iii)(II), respectively, an updated backlog schedule that contains—</text>
 <subclause id="H719A1E3D7C7E47729E9587C8C2E6617C"><enum>(I)</enum><text>a list of petitioned-for species for which a finding had been made since the last submission of the backlog schedule under such clause;</text>
 </subclause><subclause id="HB0FAA0A467E440DA80667529D866AB8F"><enum>(II)</enum><text>the outcomes of findings for all petitioned-for species for which a finding has been made since the last submission of the backlog schedule under such clause; and</text>
 </subclause><subclause id="H8AF1DFA6529649D1A4B72357F47140D4"><enum>(III)</enum><text>a summary of the bases of all findings for any petitioned-for species for which a finding has been made since the preceding submission of the backlog.</text>
 </subclause></clause></subparagraph><subparagraph id="HD73706C3EE7F4564933F0A3D0A2216FC"><enum>(F)</enum><text>The Secretary shall terminate a 90-day petition backlog or 12-month petition backlog at such time as the requirements for declaring such backlog under subparagraph (E)(i) or (E)(ii), respectively, are not fulfilled.</text>
 </subparagraph><subparagraph id="HFB63C68AF11446DE882E062771AFBE33"><enum>(G)</enum><text>During the effective period of a 90-day petition backlog—</text> <clause id="HDBB3A9FD7CFA43BDACB3D07D5E6DDA26"><enum>(i)</enum><text display-inline="yes-display-inline">the requirement under subparagraph (A) to make a finding within 90 days shall not apply with respect to any species that is the subject of a petition included in the list under section 2(b)(3)(A)(i);</text>
 </clause><clause id="H0E876D3E42254B8BAFD5B9A5FAB9E96A"><enum>(ii)</enum><text>except as provided in clause (iii), the Secretary shall not make any finding under subparagraph (A) with respect to any species included in the list under section 2(b)(3)(A)(i) in the applicable backlog schedule, until the earlier of—</text>
 <subclause id="H00787109C87E4920AE75AD5C47A4B182"><enum>(I)</enum><text>the date the Secretary terminates the backlog under subparagraph (F);</text> </subclause><subclause id="H54AC3C3D2CCA4DDF8E26EE7230AF539D"><enum>(II)</enum><text>the date the applicable backlog schedule consists of only the list under such section; or</text>
 </subclause><subclause id="HD2EF959725CD40B49CFC1F48AE151D2C"><enum>(III)</enum><text>the date the only petitioned-for species in the backlog schedule to which the Secretary has not devoted sufficient resources so as to issue such a finding within 90 days are those in the list under such section; and</text>
 </subclause></clause><clause id="H41C89E406754467ABD5955CA85F5621B"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary is deemed to have made finding under subparagraph (A) that each petition for a species included in the list under section 2(b)(3)(A)(i) in the applicable backlog schedule does not present substantial scientific or commercial information indicating that the petitioned action may be warranted, effective upon the expiration of the 180-day period beginning on the date the petition was submitted.</text>
 </clause></subparagraph><subparagraph id="H384D0AC62DAA4B85972BFD76C6BA5695"><enum>(H)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (I)—</text> <clause id="H2E1B75F50C3141E38D5A7EFC96C3549E"><enum>(i)</enum><text display-inline="yes-display-inline">after declaring a 12-month petition backlog under subparagraph (E)(ii) and before taking any actions under clause (ii) of this subparagraph, the Secretary shall assign each petition and petitioned-for species to be considered under such clause to one of the five priority bins referred to in the notice issued by the United States Fish and Wildlife Service entitled <quote>Methodology for Prioritizing Status Reviews and Accompanying 12-month findings on Petitions for Listing Under the Endangered Species Act (81 Fed. Reg. 49248 (July 27, 2016))</quote>; and</text>
 </clause><clause id="H33568C942FCE4728B6C98187BFE2A19D"><enum>(ii)</enum><text>during the effective period of such 12-month petition backlog under subparagraph (E)(ii)—</text> <subclause id="H2A7435B837EF4A36ADF716E4E5F9C695"><enum>(I)</enum><text display-inline="yes-display-inline">the requirement under subparagraph (B) to make a finding within 12 months shall not apply with respect to any species that is the subject of a petition included in the list under section 2(b)(3)(A)(i);</text>
 </subclause><subclause id="H3D61627E03284CE697C282ADC9CE5C8B"><enum>(II)</enum><text>the Secretary shall consider under this paragraph only petitions for species included in the list under section 2(b)(3)(A)(ii) in the applicable backlog schedule, that were submitted more than 12 months before the establishment of the backlog;</text>
 </subclause><subclause id="H1F2D907AC0F846F6B783D08C99F82F31"><enum>(III)</enum><text>except as provided in subclause (IV), the Secretary shall not make any finding under subparagraph (B) with respect to any species included in the list under section 2(b)(3)(A)(i) in the applicable backlog schedule, until the earlier of—</text>
 <item id="H0BF4E106B32646A580D6D3482E41B01A"><enum>(aa)</enum><text>the date the Secretary terminates the backlog under subparagraph (F);</text> </item><item id="H295CCFF708FB4B9B95EDF1B135FDB26B"><enum>(bb)</enum><text>the date the applicable backlog schedule consists of only the list under such section; or</text>
 </item><item id="H65A6FADA018B4F9699AAF850E09DBFC9"><enum>(cc)</enum><text>the date the only petitioned-for species in the backlog schedule to which the Secretary has not devoted sufficient resources so as to issue such a finding within 12 months are those in the list under such section; and</text>
 </item></subclause><subclause id="HC2EF6F03A873447E8980A4445B3EF73F"><enum>(IV)</enum><text>the Secretary is deemed to have made a finding under subparagraph (B)(i) for each species included in the list under section 2(b)(3)(A)(i) that the petitioned action is not warranted—</text>
 <item id="H6E162D6328B645AFBC58C51B8C0D90DC"><enum>(aa)</enum><text>effective upon the expiration of the 18-month period beginning on the date the petition was submitted, if the Secretary has not assigned the species to the <quote>Highest Priority—Critically Imperiled</quote>, <quote>Strong Data Already Available on Status</quote> priority bin or <quote>New Science Underway to Inform Key Uncertainties</quote> priority bin referred to in the notice referred to in clause (i); or</text>
 </item><item id="HE3E79EC4533A4B699D419DC5CA5F087E"><enum>(bb)</enum><text display-inline="yes-display-inline">effective upon the expiration of the 24-month period beginning on the date the petition was submitted, if the Secretary has assigned the species to the <quote>Strong Data Already Available on Status</quote> priority bin or <quote>New Science Underway to Inform Key Uncertainties</quote> priority bin referred to in the notice referred to in clause (i).</text>
								</item></subclause></clause></subparagraph><subparagraph id="H07487FC9F3DD472580AA8AABF077FDEF"><enum>(I)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HAF38FEF82CD6412D84FE7042FB4CE68A"><enum>(i)</enum><text>In the case of the first 12-month petition backlog under subparagraph (E)(ii)—</text> <subclause id="H30BF6603454C43B588BC3543F4519F2D" indent="up1"><enum>(I)</enum><text>item (aa) of subparagraph (H)(ii)(IV) shall be applied by substituting <quote>30-month</quote> for <quote>18-month</quote>; and</text>
 </subclause><subclause id="H42B16B926BBC43F587A780C5C05BC889" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">item (bb) of subparagraph (H)(ii)(IV) shall be applied by substituting <quote>36-month</quote> for <quote>24-month</quote>.</text> </subclause></clause><clause id="H6E8B88C61414426E9A6F740413817EC5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary may not under subparagraph (H)(i) change the assignment of a petition or petitioned-for species from one priority bin to another priority bin.</text>
 </clause></subparagraph><subparagraph id="HA6177D0F3D56410DB0BAA9683EB8EA61"><enum>(J)</enum><text>In the case of findings under subparagraph (G)(iii) and (H)(ii)(IV), the publication under subparagraph (A) or (B)(i), respectively, may consist solely of a notice of each finding.</text>
					</subparagraph><subparagraph id="HC34F03E2072D4E76A286EF7BF6550130"><enum>(K)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H06046D15FB9B421A91E92522AE09245D"><enum>(i)</enum><text display-inline="yes-display-inline">Except as otherwise provided in this Act, the Secretary shall regularly maintain on the internet site of the United States Fish and Wildlife Service a publically available database of petitions referred to in this paragraph and species otherwise evaluated under subsection (a).</text>
 </clause><clause id="H60FCA7B34E6340F68A3FD0C1F9F98C3E" indent="up1"><enum>(ii)</enum><text>The database shall contain information about each petitioned-for species including—</text> <subclause id="HEF4DB6ACF2BC480CAC6ED7C1275633C1"><enum>(I)</enum><text>the date a petition for such species was submitted;</text>
 </subclause><subclause id="H2D2473D043D64FF5B014BAA99AC350E8"><enum>(II)</enum><text>the person who submitted the petition;</text> </subclause><subclause id="H9D52BB82EA534DA7A2756BDC9732875D"><enum>(III)</enum><text>the current status of the petition within the statutory and agency process, including the most recent agency action taken;</text>
 </subclause><subclause id="HF04F8D1E5E704542B5698D25AE707C2D"><enum>(IV)</enum><text>a web link to any documents received under this paragraph that constituted the petition for such species;</text>
 </subclause><subclause id="HBE58D2093F21494D96BFD30A683D9083"><enum>(V)</enum><text>a web link to any materials the Secretary has received from State or local governments pertaining to petitions to list such species;</text>
 </subclause><subclause id="H0C47134BEB264D0A8687C5A42AD1F6FD"><enum>(VI)</enum><text>the outcomes of all prior petitioning or listing procedures for such species; and</text> </subclause><subclause id="H78A7BAB22B4543618C7CDBE8FE811ECF"><enum>(VII)</enum><text>the outcomes of all prior litigation against the Federal Government on the basis of a petition for or listing of such species, including actions or agreements by the Federal Government to—</text>
 <item id="H849819E6184B4DD782E1390630FA15F9"><enum>(aa)</enum><text display-inline="yes-display-inline">dispense monies to litigating parties or counsel;</text> </item><item id="HCB09E7B8042942578E64B2C3539F5285"><enum>(bb)</enum><text>promulgate rules as a direct or indirect result of litigation outcomes or agreements;</text>
 </item><item id="H1DA7CBC166964FD0A122308C945C8C64"><enum>(cc)</enum><text>resolve any matter related to the petition or a petitioned-for species by a certain date, or otherwise;</text>
 </item><item id="H37EB322B12A947809F952F5DB12951F1"><enum>(dd)</enum><text>conduct further research or analysis related to the petition or petitioned-for species; or</text> </item><item id="HE2A3AAEE6EC849AFACF75C2350F5C665"><enum>(ee)</enum><text>engage in any other activity as a result of the terms of litigation settlements or court-orders related to such petitions or petitioned-for species.</text>
								</item></subclause></clause></subparagraph><subparagraph id="HB8B998D3300D4028AC31CAAB6D18B502"><enum>(L)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HD3AE57BD3C9A442F9D55A1AC7108388F"><enum>(i)</enum><text>Except as provided in clauses (ii) and (iii), any negative finding described in subparagraph (A) and any finding described in clause (i) or (ii) of subparagraph (B) shall be subject to judicial review.</text>
 </clause><clause id="H266740C9150F4069BF8A80304D057D2F" indent="up1"><enum>(ii)</enum><text>A petition in the list under section 2(a)(3)(A)(i) of the backlog schedule for a 12-month petition backlog is not subject to judicial review—</text>
 <subclause id="H152CE10C0C9F402F904B0D2DE39E4404"><enum>(I)</enum><text>on the basis of a negative finding by the Secretary under subparagraph (H)(ii)(IV); or</text> </subclause><subclause id="H8592321FCF79409C8294C9D347FBFF65"><enum>(II)</enum><text>on the basis that the Secretary has failed to make a finding within the 12-month timeframe established under subparagraph (B).</text>
 </subclause></clause><clause id="HB51924BC13424B3FAF6C1F1D52376105" indent="up1"><enum>(iii)</enum><text>Notwithstanding subparagraph (C)(ii), a finding by the Secretary under subparagraph (G)(iii), and any failure by the Secretary in the effective period of a 90-day petition backlog to make a finding under subparagraph (A) with respect to any species included in the list under section 2(b)(3)(A)(i) in the applicable backlog schedule, is not subject to judicial review.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HB047BCB8D65E4D7284AAAA054E4BF7E0"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 4(b)(3)(C) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(b)(3)(C)</external-xref>) is amended—</text> <paragraph id="H5C3BE806685249AFB888D9C9FE867AED"><enum>(1)</enum><text>by striking clause (ii); and</text>
 </paragraph><paragraph id="H69B73B44168C47D892B749E22C7793A2"><enum>(2)</enum><text>by redesignating clause (iii) as clause (ii).</text> </paragraph></subsection></section></legis-body></bill>
