			 sales of major defense equipment with respect to which nonrecurring costs
			 of research, development, and production are waived or reduced under the
			 Arms Export Control Act, and for other purposes.</official-title></form>
	<legis-body id="HFB9DC624956643E994531E89FCE37C33" style="OLC">
 <section id="H7ABECE5CBA9D4EA2AB95683A9F988C90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Return Expenses Paid and Yielded Act</short-title></quote> or <quote><short-title>REPAY Act</short-title></quote>.</text> </section><section id="H8ECAAB3519E7452AAA3CD809A8403386"><enum>2.</enum><header>Modification of certification and report requirements relating to sales of major defense equipment with respect to which nonrecurring costs of research, development, and production are waived or reduced under the Arms Export Control Act</header> <subsection id="HD4F324CBEBB24284BD5BCCD1E1A6FC84"><enum>(a)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 36(b) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(b)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H36D4A1A4F7AF4BD5A6C13BE346AF6596" style="OLC">
					<paragraph id="HE3A3D1FC42D040BB8B50828C4FC47A0B" indent="up1"><enum>(7)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H6C4155BA83D1488CB3DB7F0654D115A5"><enum>(A)</enum><text>In the case of any letter of offer to sell any major defense equipment for $14,000,000 or more, in addition to the other information required to be contained in a certification submitted to the Congress under this subsection, or a similar certification prior to finalization of a letter of offer to sell, each such certification shall include the value of any charge or charges for the proportionate amount of any nonrecurring costs of research, development, and production of the major defense equipment that was waived or reduced under section 21(e).</text>
 </subparagraph><subparagraph id="H99EE599FDFE34AE4AB7B81BB8A50EA94" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Each such certification shall also include information on—</text> <clause id="HF15FD2915E8A438F9689B68F86D3D5C7"><enum>(i)</enum><text>the type of waiver or reduction;</text>
 </clause><clause id="HA0AC8BD386DF46D4A81ED9C40E1C6A9D"><enum>(ii)</enum><text>the percentage of otherwise obligated nonrecurring costs with respect to which the waiver or reduction comprises;</text>
 </clause><clause id="HDC872E014941472493666E3A9CFD8398"><enum>(iii)</enum><text>a justification for issuance of the waiver or reduction;</text> </clause><clause id="H21D82701DDF34E2BB9A8F6E50FAA9942"><enum>(iv)</enum><text>in the case of a waiver or reduction made under paragraph (2)(A) of section 21(e)—</text>
 <subclause id="HFD79C6FF8D3B4FFFB6E757987B896175"><enum>(I)</enum><text>the manner in which a sale would significantly advance standardization with the foreign countries or international organization described in such section; and</text>
 </subclause><subclause id="H470AF43DD071455B8DAE4BCAF36CFDB5"><enum>(II)</enum><text>the extent to which the sale’s significance should be considered relative to the existing capabilities of the foreign country or international organization and the manner in which the major defense equipment would enhance the capacity of the country or organization in joint operations; and</text>
 </subclause></clause><clause id="HF3923F3A82C14004B9F9D54E505E9AC1"><enum>(v)</enum><text>in the case of a waiver or reduction made under paragraph (2)(B) of section 21(e)—</text> <subclause id="H5C07E6E5370646CBB345954275962267"><enum>(I)</enum><text>the military needs and ability to pay of the foreign country or international organization;</text>
 </subclause><subclause id="H68046952598F4256B622BD11DB8C8EDD"><enum>(II)</enum><text display-inline="yes-display-inline">the price and capability of other relevant options that are or likely would be considered by the foreign country or international organization for purchase in lieu of the major defense equipment described in the letter of offer; and</text>
 </subclause><subclause id="HAAE0F54F3D624AC88A6B67080588970B"><enum>(III)</enum><text>the previous buying history and existing capabilities of the foreign country or international organization.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H3EC730B72BAF4B87A7471BBD0ED48AE4"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Section 36(a) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(a)</external-xref>) is amended—</text> <paragraph id="HDEA1D482460341EC995F9278030A2DE7"><enum>(1)</enum><text>in paragraph (11), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="HB504D35A58B74D959166737D9C256D24"><enum>(2)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="HE9F558F896CB46698FCDE369F4513DE3"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HCE895B81FFE340CEA3637610D954D1DB" style="OLC">
 <paragraph id="H9A77990A83384E96946442B432F0DEA2"><enum>(13)</enum><text display-inline="yes-display-inline">with respect to requests to waive or reduce nonrecurring costs with respect to the sale of major defense equipment for $14,000,000 or more under this Act, a report on—</text>
 <subparagraph id="HC4283C8326C743AFA347BF8838483538"><enum>(A)</enum><text display-inline="yes-display-inline">the total number of such requests that have been approved or denied during the quarter, including the total number of such requests that are currently under review and pending a decision; and</text>
 </subparagraph><subparagraph id="HAA6CA5EE34E640C4BC39A6F89B8517D3"><enum>(B)</enum><text>for each such request—</text> <clause id="HB9A9B3E954FA41B08AF786C092ED478F"><enum>(i)</enum><text>an identification of the foreign country or international organization requesting the waiver or reduction; and</text>
 </clause><clause id="HCEF8D48D32AF465090B9275F66EACF35"><enum>(ii)</enum><text>the total amount of nonrecurring costs to be waived or reduced;</text> </clause><clause id="H4AACE92A8A7E4838AA902904A3EB7594"><enum>(iii)</enum><text>a description of the major defense equipment to be purchased; and</text>
 </clause><clause id="HEEF1AB5E482B4B7ABF34F77E71D54606"><enum>(iv)</enum><text>the justification for the waiver or reduction; and</text> </clause></subparagraph><subparagraph commented="no" id="HCD9EFC1CF2F543C78A86F486C95FE982"><enum>(C)</enum><text display-inline="yes-display-inline">for each such request that is approved, the actual amount of nonrecurring costs that are waived or reduced that are attributable to quantities of major defense equipment sold under such request.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF48A6C94C91E4DA3A64D9275B85D58CB"><enum>(c)</enum><header>Repeal of waiver authority in case of sales of major defense equipment also being procured for use
 by United States Armed Forces</header><text>Section 21(e)(2) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761(e)(2)</external-xref>) is amended—</text> <paragraph id="HEB3888FEEA4440C78A32AF3890526C43"><enum>(1)</enum><text>in subparagraph (B)—</text>
 <subparagraph id="H54A56A626C5A4FFAB6A4BCC1EE98D5FE"><enum>(A)</enum><text>in the matter preceding clause (i)—</text> <clause id="H5E5D045FF3A748EF8E4FA6E3F6679B24"><enum>(i)</enum><text>by striking <quote>The President</quote> and inserting <quote>Except as provided subparagraphs (D) and (E), the President</quote>; and</text>
 </clause><clause id="H2AD6E66CDA1A4B988E76EA9E072BC1A1"><enum>(ii)</enum><text>by striking <quote>that—</quote> and all that follows through <quote>(i) imposition</quote> and inserting <quote>that imposition</quote>;</text> </clause></subparagraph><subparagraph id="H3011CD62564745E792D04C7A89037760"><enum>(B)</enum><text>by striking <quote>sale; or</quote> and inserting <quote>sale.</quote>; and</text>
 </subparagraph><subparagraph commented="no" id="HC819AB912622470C9BA9EE2D30C130A5"><enum>(C)</enum><text>by striking clause (ii); and</text> </subparagraph></paragraph><paragraph commented="no" id="H058A8BD7ED34410CAB4EAC7D20BE8A9A"><enum>(2)</enum><text>by inserting at the end the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="HE98B49BAA6154C05BAAF500AC5442039" style="OLC">
 <subparagraph commented="no" id="HB76D1ECE4398411BB25B2DA365FD47E7" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The President may not waive the charge or charges for a proportionate amount of any nonrecurring costs that would otherwise be considered appropriate under paragraph (1)(B) for a particular sale to a country or international organization for a two-year period that begins on any of the following dates:</text>
 <clause commented="no" id="H292D81EBD575438C9E5AD2E47910E4BF"><enum>(i)</enum><text display-inline="yes-display-inline">The date of approval of a waiver under paragraph (1)(B) of a charge or charges that are valued at $16,000,000 or more under this Act with respect to a sale to the country or organization.</text>
 </clause><clause commented="no" id="HBAA3128DFAF642A6AB2C9B57E7152FA1"><enum>(ii)</enum><text display-inline="yes-display-inline">The date that is the last day of any five-year period in which the country or organization receives 15 or more waivers of a charge or charges under paragraph (1)(B) with respect to sales to the country or organization.</text>
 </clause><clause id="HFC22ADAA757242DB9A6C50BB25B16F8A"><enum>(iii)</enum><text display-inline="yes-display-inline">The date that is the last day of any five-year period in which the country or organization receives waivers of a charge or charges under paragraph (1)(B) that are valued at $425,000,000 or more under this Act with respect to sales to the country or organization.</text>
							</clause></subparagraph><subparagraph id="HB51A774CDA2A44AF9A36A8B6E9DFB04C" indent="up1"><enum>(E)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HADC134F8B97348AF82DD81A530DB9D94"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of any proposed waiver of the charge or charges which would otherwise be considered appropriate under paragraph (1)(B) for a particular sale to a country or international organization of major defense equipment for $10,000,000 or more under this Act, the President shall submit to the Speaker of the House of Representatives, the Committee on Foreign Affairs of the House of Representatives, and to the chairman of the Committee on Foreign Relations of the Senate a notification with respect to such proposed waiver.</text>
 </clause><clause id="HF193B00712EE46CF8F1B365282725942" indent="up1"><enum>(ii)</enum><text>The President may not waive such charge or charges if Congress, not later than 60 calendar days after receiving such notification, enacts a joint resolution prohibiting the proposed waiver.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H18ACE2B753754593A50662B5B5D9ADBB"><enum>(d)</enum><header>Maximum aggregate amount of charges for administrative services</header><text display-inline="yes-display-inline">Section 21(e) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761(e)</external-xref>) is amended—</text> <paragraph id="H6EF454C4F4C7469CBCC629E8326B877E"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>subject to paragraph (4),</quote> before <quote>administrative services</quote>; and</text>
 </paragraph><paragraph id="H176C400075AA493F81323AD78DE8515F"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H87AE52B6E7FD4E2DB72B63E0F53F3C7B" style="OLC"> <paragraph id="HA4404C2B6EDB4B3294F2C8550EC10578"><enum>(4)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H4633F67BC87B4527A7F5E12C6BAA8629"><enum>(A)</enum><text display-inline="yes-display-inline">For each fiscal year beginning on or after the date of the enactment of the Return Expenses Paid and Yielded Act, the President shall—</text>
 <clause id="H6ED263DB2AA0437490DDD1DAC60EFE48" indent="up1"><enum>(i)</enum><text>determine a maximum aggregate amount of charges for administrative services that would be required by paragraph (1)(A) based on the ability of the Department of Defense to issue and administer letters of offer for sale of defense articles or the sale of defense services pursuant to this section or pursuant to section 22 of this Act; and</text>
 </clause><clause id="HE11514E28EAC404EA93E934ED88D388A" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">submit to Congress a report that contains the determination and specifies the maximum aggregate amount of charges for administrative services.</text>
								</clause></subparagraph><subparagraph id="H3878368E8EA24B3FAC3CA9BB355DE45A" indent="up1"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H78D126CC01E949B08C928B3775A5A414"><enum>(i)</enum><text>Except as provided in clause (ii), charges for administrative services that are required by paragraph (1)(A) may not exceed the maximum aggregate amount of charges for administrative services determined under subparagraph (A) for the fiscal year involved.</text>
 </clause><clause id="H06BDBD01D40E4F0295B69EBB989D443C" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The President may waive the requirement of clause (i) on a case-by-case basis if the amount of charges for administrative services that are required by paragraph (1)(A) with respect to a sale of defense articles or a sale of defense services would exceed the maximum aggregate amount of charges for administrative services determined under subparagraph (A) for the fiscal year.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H74BB12A1A4104A149D4006D394F689D6"><enum>(e)</enum><header>Modification of administrative expenses</header>
 <paragraph id="H6CCCAE910BFD4B04AEF8C86F1AEAB13B"><enum>(1)</enum><header>In general</header><text>Section 43(b) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2792">22 U.S.C. 2792(b)</external-xref> is amended—</text> <subparagraph commented="no" id="H377CBE14A5724946A2692537D8DFC4D6"><enum>(A)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text>
 </subparagraph><subparagraph commented="no" id="H5D981795063446A79FA7A204BAC373F6"><enum>(B)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a period; and</text> </subparagraph><subparagraph commented="no" id="H8AE0BCBD2FD34C3F93D62360A403585E"><enum>(C)</enum><text>by striking paragraph (3).</text>
 </subparagraph></paragraph><paragraph id="H3DF01B53042B4A2994BB6FF469074BFD"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 21(e)(1)(A) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761(e)(1)(A)</external-xref>) is amended by striking <quote>and section 43(c)</quote>.</text> </paragraph></subsection><subsection commented="no" id="HECE9D700E9D44900A843F45F79BBB519"><enum>(f)</enum><header>Biennial review and modification of user charges</header> <paragraph id="H55129569C1914E53A8E418BF8A9381FA"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary of Defense, acting through the Director of the Defense Security Cooperation Agency, shall, not less than once every two years—</text>
 <subparagraph id="H84361D6B97164A54B7A0008212E6FC07"><enum>(A)</enum><text>carry out a review of user charges under the foreign military sales program and, based on the results of the review, modify the user charges as appropriate; and</text>
 </subparagraph><subparagraph id="HD2654BB03BB44C59A1DCF32231D27DAB"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the appropriate congressional committees a report that contains the results of the review carried out under subparagraph (A) and a description of any user charges that, based on the results of the review, were modified under subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="H494AF0D84E004074AE644C60A61A2333"><enum>(2)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text> <subparagraph id="H78B8B685769E492BA1DD60DB3DD59DA2"><enum>(A)</enum><text>the Committee on Armed Services and the Committee on Foreign Affairs of the House of Representatives; and</text>
 </subparagraph><subparagraph id="H5D9FC3CEF1E94AC29CA783B5619C9F4F"><enum>(B)</enum><text>the Committee on Armed Services and the Committee on Foreign Relations of the Senate.</text> </subparagraph></paragraph></subsection></section><section id="HEEA1FACEC7DE499B8F211C6DDE21F9B8"><enum>3.</enum><header>Review and report on use and management of administrative surcharges under the foreign military sales program</header> <subsection id="H50B1B142CA2843FA9644DCB98B74D399"><enum>(a)</enum><header>Review</header> <paragraph id="H1B10F0E3D00D4F2AAA3260570044F49E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense, acting through the Director of the Defense Security Cooperation Agency, shall review options for expanding the use of administrative surcharges under the foreign military sales program, including practices for managing administrative surcharges and contract administrative services surcharges.</text>
 </paragraph><paragraph id="H4C2A8D9DD750496FB7CB736DF63B4AE4"><enum>(2)</enum><header>Matters to be included</header><text>The review conducted under paragraph (1) shall include the following:</text> <subparagraph id="HBE26EE669DC14D5DB1072903BB678737"><enum>(A)</enum><text>A determination of which specific expenses are incurred by the United States Government in operation of the foreign military sales program that the administrative surcharge does not currently pay for.</text>
 </subparagraph><subparagraph id="H8D1FD91C8D18403198F65CF100CA6441"><enum>(B)</enum><text>The estimated annual cost of each of such specific expenses.</text> </subparagraph><subparagraph id="HC0055B3B170546A09AC53E94CB7B871C"><enum>(C)</enum><text>An assessment of the costs and benefits of funding such specific expenses through the administrative surcharge, including any data to support such an assessment.</text>
 </subparagraph><subparagraph id="HB2BC3C6D2A5E4F1881C68B696852394C"><enum>(D)</enum><text>An assessment of how the Department of Defense could calculate an upper bound of a target range for the administrative surcharge account and the contract administration services surcharge account, including an assessment of the costs and benefits of setting such a bound.</text>
 </subparagraph><subparagraph id="H37AA178EE42E4C0DAD36D3AE04B33E61"><enum>(E)</enum><text>An assessment of how the Department of Defense calculates the lower bound, or safety level, for the administrative surcharge account and the contract administration services surcharge account, including what specific factors inform the calculation and whether such a method for calculating the safety level is still valid or should be revisited.</text>
 </subparagraph><subparagraph id="H283CA40358DA47CCA50D989F795BE2A9"><enum>(F)</enum><text>An assessment of the process used by the Department of Defense to review and set rates for the administrative surcharge and the contract administration services surcharge, including the extent to which outside parties are consulted and any proposals of the Department of Defense may have for better ensuring that the fee rates are set appropriately.</text>
 </subparagraph><subparagraph id="H0CA217AD4FFA458E906971D5299B21C1"><enum>(G)</enum><text display-inline="yes-display-inline">Such other matters as the Secretary of Defense determines to be appropriate.</text> </subparagraph></paragraph></subsection><subsection id="H466F08BD925A4796B196BCF2B4E56CF7"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense, acting through the Director of the Defense Security Cooperation Agency, shall submit to the congressional defense committees a report on—</text>
 <paragraph id="HC51036E00EC44BEEB019525B5E4EFB05"><enum>(1)</enum><text>the findings of the review conducted under paragraph (1); and</text> </paragraph><paragraph id="H3B7338C46708432997F674D0093FECFD"><enum>(2)</enum><text display-inline="yes-display-inline">any legislative changes needed to allow the surcharge under the foreign military sales program to pay for any expenses currently not covered by administrative surcharge under the foreign military sales program.</text>
 </paragraph></subsection><subsection id="H192EB7DAE83E49938B4B54F8E7E6CC40"><enum>(c)</enum><header>Foreign Military Sales program defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>foreign military sales program</term> means the program authorized under chapter 2 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761</external-xref> et seq.).</text>
			</subsection></section><section id="H2F0B52A28F4F4776A2CE3B126922E63B"><enum>4.</enum><header>Performance measures to monitor foreign military sales program</header>
 <subsection id="HC4A039E8A2A74CDC8A0828DB1F4917D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Defense, acting through the Director of the Defense Security Cooperation Agency and in consultation with the heads of other relevant components of the Department of Defense, shall enhance the ability of the Department of Defense to monitor the performance of the foreign military sales program by taking the following actions:</text>
 <paragraph id="H52E1BEB835A34579AFBD94F3E68F1E7A"><enum>(1)</enum><text>Develop performance measures to monitor the timeliness of deliveries of defense articles and defense services to purchasers in accordance with the delivery schedule for each sale under the foreign military sales program.</text>
 </paragraph><paragraph id="H27CA4ABF91764AB7B3DF8C18D6A87F48"><enum>(2)</enum><text>Identify key choke points, processes, and tasks that contribute most significantly to delays, shortcomings, and issues in the foreign military sales program.</text>
 </paragraph><paragraph id="HB502AF5BEA1A4A328A11EC686578BBD5"><enum>(3)</enum><text>Review existing performance measures for the foreign military sales program to determine whether such measures need to be updated, replaced, or supplemented to ensure that all key aspects of the foreign military sales program’s efficiency and service of United States national interests are able to be monitored and informed by reliable data.</text>
				</paragraph></subsection><subsection id="HB6BAF4DDB7D74098BFF06A9D8C408D7C"><enum>(b)</enum><header>Report on performance measures</header>
 <paragraph id="HDF384CDE8EC84EB0B2C5A10BE1E285C8"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense, acting through the Director of the Defense Security Cooperation Agency, shall submit to the congressional defense committees a report that lists the performance measures developed and identified under subsection (a).</text>
 </paragraph><paragraph id="H9E5B7AC6F6794085B712007BC42FB451"><enum>(2)</enum><header>Matters to be included</header><text>The report required by paragraph (1) shall—</text> <subparagraph id="H3CE28073DE144F6BB51BF50A713E65CB"><enum>(A)</enum><text>define the performance measures, including targets set for the performance measures;</text>
 </subparagraph><subparagraph id="HF96338CDBD4D49BC90EB4EA5E71CA2CE"><enum>(B)</enum><text>identify the data systems used to monitor the performance measures;</text> </subparagraph><subparagraph id="H0C0A192E1D6C461A9EBF3587918E64BE"><enum>(C)</enum><text>identify any concerns related to the reliability of the data used to monitor the performance measures; and</text>
 </subparagraph><subparagraph id="H74C75A940B1C423794786CCD589E0286"><enum>(D)</enum><text>report the results for the performance measures for the most recent fiscal year.</text> </subparagraph></paragraph><paragraph id="H3DD218184B6648408EB88525714BA049"><enum>(3)</enum><header>Plan</header><text>If the performance measures developed and identified under subsection (a) cannot be included in the report required by paragraph (1) for the most recent fiscal year based on reliable and accessible data, the report shall include a plan for ensuring that such data will be monitored within a defined period of time.</text>
				</paragraph><paragraph id="HA015F35E569C41C9AD85FCB85B417414"><enum>(4)</enum><header>Update</header>
 <subparagraph id="H432E472EE3C44910B9ADA5D14DCF95F0"><enum>(A)</enum><header>In general</header><text>For each fiscal year after the fiscal year in which the report required by subsection (b) is submitted to the congressional defense committees, the Secretary of Defense shall submit to the congressional defense committees an update of the report required by paragraph (1).</text>
 </subparagraph><subparagraph id="HD0B0DA16A1D44895A9AACF3494425FAF"><enum>(B)</enum><header>Matters to be included</header><text>Each update of the report required by paragraph (1) shall also include the following:</text> <clause id="HFD1934D5315743CDA57D6FF57D51EC42"><enum>(i)</enum><text>For any performance measures that indicate a decreased level of performance from the prior year—</text>
 <subclause id="HE64F0D6FA7F84608B5D718B76DD96D5F"><enum>(I)</enum><text>a description of the factors that led to such decreased level of performance; and</text> </subclause><subclause id="H044F047A03974227A725C4B84733BFE8"><enum>(II)</enum><text>plans to improve such level of performance.</text>
 </subclause></clause><clause id="H882DE14DC51C44149675C1880C96050C"><enum>(ii)</enum><text>For any performance measures that remain unable to be monitored due to lack of reliable and accessible data, an update on plans to improve the monitoring of data.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H7FAECEF785C645699F089E3587EDE3A5"><enum>(c)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Secretary of Defense, acting through the Director of the Defense Security Cooperation Agency, submits to the congressional defense committees the report required by subsection (b), the Comptroller General of the United States shall provide a briefing to the congressional defense committees on the report, including an evaluation of the performance measures developed and identified under subsection (a).</text>
			</subsection></section><section id="H8013C418F5834122916C7AA2AA5D36AF"><enum>5.</enum><header>Report and briefing on administrative budgeting of foreign military sales program</header>
 <subsection id="H375250EA3F824A5E82CA631EA3FDA711"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Comptroller General of the United States shall provide a briefing to the congressional defense committees and submit to the congressional defense committees a report on the methodology used by the Department of Defense to determine future-year needs for administrative surcharges under the foreign military sales program.</text>
 </subsection><subsection id="H1B0DFF8FBE1A4D17B7F7098D581D583F"><enum>(b)</enum><header>Matters To be included</header><text display-inline="yes-display-inline">The briefing and report required by subsection (a) shall include the following:</text> <paragraph id="H1B82FE9765A54D658A1BADBD3F94EAD3"><enum>(1)</enum><text display-inline="yes-display-inline">A description of the methodology the Department of Defense used to develop the overall administrative budget of the foreign military sales program and the administrative budgets for each other relevant component of the Department of Defense that receives funds from the foreign military sales program.</text>
 </paragraph><paragraph id="HD72DE46310FB4D649EC9AB7094CC6F45"><enum>(2)</enum><text>An assessment of the extent to which the methodology described in paragraph (1) reflects relevant best practices.</text>
 </paragraph><paragraph id="HC21255CAD058448C8EFAD8C4BF0C4B9E"><enum>(3)</enum><text>Any other related matters the Comptroller General determines to be appropriate.</text> </paragraph></subsection></section><section id="HEB5D297190E645FA8C08D5FAAC93E296"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="HE6D137EB9D78449BB95EAEF84D933A3D"><enum>(1)</enum><header>Congressional defense committees</header><text>The term <term>congressional defense committees</term> has the meaning given such term in section 101 of title 10, United States Code.</text> </paragraph><paragraph id="H67EB59F400AB471AB75ED0E3CD2B660B"><enum>(2)</enum><header>Foreign military sales program</header><text>The term <term>foreign military sales program</term> means the program authorized under chapter 2 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761</external-xref> et seq.).</text>
