		<official-title display="yes">To provide competitive grants for the operation, security, and maintenance of certain memorials to
			 victims of the terrorist attacks of September 11, 2001.</official-title>

 <section id="H7922E471B0C041998DF69339FA5F8A5B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>9/11 Memorial Act</short-title></quote>.</text> </section><section id="H2D5DE2EBB0204EAEA723D77845957586"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="HCE9C5DA8951548F086323C7B908F942E"><enum>(1)</enum><header>Covered memorial</header><text>The term <term>covered memorial</term> means a memorial located in the United States established to commemorate the events of, and honor the victims of, the terrorist attacks on the World Trade Center, the Pentagon, and United Airlines Flight 93 on September 11, 2001, at the site of the attacks.</text>
 </paragraph><paragraph id="H169BC48025854D4F89A6695CD9D65094"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means the official organization, as in existence on the date of enactment of this Act—</text> <subparagraph id="H056AC0B22E07441DA56D47DD9CB7DB48"><enum>(A)</enum><text>the focus of which is the operations and preservation of a covered memorial; and</text>
 </subparagraph><subparagraph id="HA9E29A5A86064E168DE2DC39C31CF912"><enum>(B)</enum><text>which is an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under 501(a) of that Code.</text>
 </subparagraph></paragraph><paragraph id="H1D94C8EF64A34A0AB58CB97B8DBABBFB"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="H020EAD96C201475BA8E4BE6F5C268C02"><enum>3.</enum><header>Competitive grants for covered memorials</header> <subsection id="HFB64873845D145CBAE77D6EE79F5D9F9"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary shall award to eligible entities competitive grants of varying amounts, as determined by the Secretary, to be used by the eligible entity solely for the purposes described in subsection (b).</text>
 </subsection><subsection id="HD36997E6F85F4BD68BBCCAD563808F8D"><enum>(b)</enum><header>Purposes</header><text>A grant awarded under subsection (a) shall be used by an eligible entity for the operation, security, and maintenance of a covered memorial.</text>
 </subsection><subsection id="H92A686312C4149E985BB7D8148FE1EC2"><enum>(c)</enum><header>Deadline for award</header><text>If the Secretary, after review of an application from an eligible entity, determines to award a grant to the eligible entity, the Secretary shall award the grant not later than 60 days after the date of receipt of the completed application.</text>
 </subsection><subsection id="H544D04C195E247AA8157FE0B804F89E7"><enum>(d)</enum><header>Availability</header><text>Grant funds made available under this section shall remain available until expended.</text> </subsection><subsection id="HEC0708CA3ED041048ACBE3E304812121"><enum>(e)</enum><header>Criteria</header><text>In awarding grants under this section, the Secretary shall give greatest weight in the selection of eligible entities using the following criteria:</text>
 <paragraph id="H5B484CDF0448461BA438EE02A6F2312F"><enum>(1)</enum><text>The needs of the eligible entity, and ability and commitment of the eligible entity to use grant funds, with respect to ensuring the security and safety of visitors of the covered memorial.</text>
 </paragraph><paragraph id="H8572C0C7AF014C1C91C711C2484AD31B"><enum>(2)</enum><text>The ability of the eligible entity to match the amount of the grant, on at least a 1-to-1 basis, with non-Federal assets from non-Federal sources, including cash or durable goods and materials fairly valued, as determined by the Secretary.</text>
 </paragraph><paragraph id="HA683244FC4B744099AF41E4C9B76FC80"><enum>(3)</enum><text>The greatest number of visitors that would benefit.</text> </paragraph><paragraph id="HC8ECACE123E04106958743B6B8B37F27"><enum>(4)</enum><text>The ability and commitment of an eligible entity to use grant funds—</text>
 <subparagraph id="H720B4908204B4EDCBA704B9EA560573B"><enum>(A)</enum><text>to preserve the grounds at the covered memorial; and</text> </subparagraph><subparagraph id="H1327DF1CA5C142E8BA3E87B359D53A69"><enum>(B)</enum><text>to educate future generations.</text>
 </subparagraph></paragraph><paragraph id="HEF689D0A36D9488BAE4F4B9EF48884D6"><enum>(5)</enum><text>The ability and commitment of an eligible entity to use grant funds to increase the numbers of economically disadvantaged visitors to the covered memorial.</text>
 </paragraph></subsection><subsection id="HA7E17EA93F7C4E4B98E830BB05FCD814"><enum>(f)</enum><header>Limitation</header><text>No grant shall be awarded under this section—</text> <paragraph id="H9719302B6DD148898EA7201CA2E97927"><enum>(1)</enum><text>for use at a covered memorial that does not provide for—</text>
 <subparagraph id="H0FBCB925096A4F258345F7FA092D768F"><enum>(A)</enum><text>free admission to all facilities and museums associated with the covered memorial for active and retired members of the military, registered first responders to the attacks of September 11, 2001, and family members of victims of the attacks of September 11, 2001; and</text>
 </subparagraph><subparagraph id="H045F3AE99F2844FB880F8B20B0161CAA"><enum>(B)</enum><text>dedicated free admission hours for the general public at least once a week; or</text> </subparagraph></paragraph><paragraph id="H905DB74CA3B74EE1BC32583DE4930CA4"><enum>(2)</enum><text>to an eligible entity that does not allow for annual Federal audits of the financial statements of the eligible entity, including revenues associated with ticket sales, charitable donations, grants, and all expenditures on salaries and operations, which shall be subject to review by the Secretary and made available to the public.</text>
 </paragraph></subsection><subsection id="H53341E5C1CA1491B8AA14902BDCC3F81"><enum>(g)</enum><header>Reports</header><text>Not later than 90 days after the end of each calendar year for which an eligible entity obligates or expends any amounts made available under a grant under this section, the eligible entity shall submit to the Secretary and the appropriate committees of Congress a report that—</text>
 <paragraph id="H0BD34E8D66934BCC8D492345A8C2C3A2"><enum>(1)</enum><text>specifies the amount of grant funds obligated or expended for the preceding fiscal year;</text> </paragraph><paragraph id="HAC257C61190B44F18CA7066470533C9B"><enum>(2)</enum><text>specifies any purposes for which the funds were obligated or expended; and</text>
 </paragraph><paragraph id="H91E0D05215834E05ABC82C11D76A844D"><enum>(3)</enum><text>includes any other information that the Secretary may require to more effectively administer the grant program under this section.</text>
				</paragraph></subsection></section></legis-body>
