			 consolidation and to maintain Postal Service delivery standards, and for
			 other purposes.</official-title></form>
	<legis-body id="H04FAD2E26C804B218DD90FF1D7EBC438" style="OLC">
 <section id="HD421EA5C3C8146A2BD3729C8D5F677C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Postal Closures Act</short-title></quote>.</text> </section><section id="H4A52150BB2C34CEFA2D21DC03007AD74"><enum>2.</enum><header>Postal facility closure and consolidations</header> <subsection id="H6CD6B81F243A4065B4B445FF4FADD531"><enum>(a)</enum><header>Moratorium on closings and consolidations</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this Act, the United States Postal Service may not close or consolidate any postal facility (as that term is defined in section 404(f)(5) of title 39, United States Code, as added by subsection (b)), or carry out any network rationalization activity, until the Postal Regulatory Commission has certified that the Postal Service has met the national service standards in accordance with the requirements of section 3.</text>
 </subsection><subsection id="H02763AB4906141E1818E5F995583E9F7"><enum>(b)</enum><header>Process for closing and consolidating processing facilities</header><text display-inline="yes-display-inline">Section 404 of title 39, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H60202A0CB0434E2BB05734C17258B5A7" style="USC"> <subsection id="H4C41CE9B144B45E8A2E916C934167000"><enum>(f)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HEB85901CDFA54A8C9ABBDBBF4E59E089"><enum>(1)</enum><text>The Postal Service may not close or consolidate any postal facility without the approval of the Postal Regulatory Commission, as provided in this subsection. For purposes of this subsection, the term <quote>postal facility</quote> means a Postal Service facility that is primarily involved in the preparation, dispatch, or other physical processing of mail, but does not include—</text>
 <subparagraph id="HB997A186E91A457CB0369857A87A1879" indent="up1"><enum>(A)</enum><text>any post office, station, or branch; or</text> </subparagraph><subparagraph id="H57292CD9DB174660B109A19F2A197594" indent="up1"><enum>(B)</enum><text>any facility used only for administrative functions.</text>
 </subparagraph></paragraph><paragraph id="H123424A35A50465A8546188A7E390B35" indent="up1"><enum>(2)</enum><text>Before making a determination to close or consolidate any postal facility, the Postal Service shall conduct an area mail processing study with respect to the facility. Such study shall include—</text>
 <subparagraph id="H55A6BA28BE50462DAE5FB4021F078BE1" indent="up1"><enum>(A)</enum><text>a plan to reduce the capacity of the facility without closing the facility;</text> </subparagraph><subparagraph id="H077B9B40C5B94F5793AB74671B90EB3F" indent="up1"><enum>(B)</enum><text>an analysis of the effect of the closure or consolidation on the ability of individuals served by the facility to vote by mail and the ability of the Postal Service to timely deliver ballots in elections for public office by mail in accordance with the deadline to return ballots established under applicable law;</text>
 </subparagraph><subparagraph id="H108CF29B4B4C42F08FA73C19A7AADF75" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">an analysis of the effect of closure or consolidation on the—</text> <clause id="H75517FE25EEF4112B1A9CD809624F722"><enum>(i)</enum><text>ability of individuals served by the facility to receive medications and other crucial notices and market-dominant products;</text>
 </clause><clause id="H8D34EC65B33A49B39CE4DBBBC88082AD"><enum>(ii)</enum><text>affected community, including any disproportionate impact on a State, region, or locality;</text> </clause><clause id="H23CE5072E9DD4540822EB270A30D92CD"><enum>(iii)</enum><text>travel times and distances for affected customers to access postal services;</text>
 </clause><clause id="H1A709CC499164B63B2ED685E75FB6E22"><enum>(iv)</enum><text>delivery times for all classes of mail; and</text> </clause><clause id="HDB9F99756D0942B092D67A8D8D1B0A86"><enum>(v)</enum><text>small businesses in the area, including shipping and communications with customers and suppliers and the corresponding impact on revenues, operations, and growth;</text>
 </clause></subparagraph><subparagraph id="H97E8765C6B4844E68C0ABF0A7E73A976" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">an analysis of any characteristics of the geographic area in which the facility is located that may have a unique effect, including remoteness, broadband internet availability, and weather-related obstacles to using alternative postal facilities; and</text>
 </subparagraph><subparagraph id="HD68A1A67535B4678A82F20F7F8A3536B" indent="up1"><enum>(E)</enum><text>any other factor the Postal Service determines necessary.</text> </subparagraph></paragraph><paragraph id="H08395BBC2B874F68B6033194F794B9F0" indent="up1"><enum>(3)</enum><text>The Postmaster General shall publish—</text>
 <subparagraph id="H479E6B6CB37F4B02A4DFBEA014D99EA0"><enum>(A)</enum><text>any study completed under paragraph (2) on the Postal Service public Web site; and</text> </subparagraph><subparagraph id="H4B644003758B49A8922896C49BA6FC0F"><enum>(B)</enum><text>a notice that the study is complete and available to the public.</text>
 </subparagraph></paragraph><paragraph id="H3331C807FDCC4DC0B9874077F69D337B" indent="up1"><enum>(4)</enum><text>If the Postal Service makes a determination to close or consolidate a postal facility after completing the requirements of paragraphs (2) and (3), the Postal Service shall—</text>
 <subparagraph id="H51A87EDDB2A14EA7861633DACC1DE31E"><enum>(A)</enum><text>provide written notice of the determination to Congress and the Postal Regulatory Commission;</text> </subparagraph><subparagraph id="H2F91AB9168C147138F057BF95687A02B"><enum>(B)</enum><text display-inline="yes-display-inline">provide adequate public notice of the intention to close or consolidate the facility, including through written notification (in multiple languages where necessary), within 30 days after the date notice is provided under subparagraph (A), to each person in the ZIP code served by such postal facility;</text>
 </subparagraph><subparagraph id="H300A0B05A4314AB8BD4F11E90E8C5CE2"><enum>(C)</enum><text>during the period of 120 days beginning on the date that is 30 days after the date notice is provided under subparagraph (A), ensure that interested persons have an opportunity to submit public comments;</text>
 </subparagraph><subparagraph id="HA43A01F6248A470D98E5DCB41CE310C4"><enum>(D)</enum><text>prior to the period described in subparagraph (C), provide for public notice of such opportunity by—</text>
 <clause id="H6C66B5388F134B458B65CF3761B5EDB3"><enum>(i)</enum><text>publication on the Postal Service public Web site;</text> </clause><clause id="H9C06FCE849FB4981B151812362433CC2"><enum>(ii)</enum><text>prominent posting at the affected postal facility; and</text>
 </clause><clause id="HF66ED8A2F387478FB8FAD6D6085C6FDD"><enum>(iii)</enum><text>advertising the dates and locations of the public community meetings required under subparagraph (E); and</text>
 </clause></subparagraph><subparagraph id="HF95B7E9184A1439F84A0CB6B2F923979"><enum>(E)</enum><text display-inline="yes-display-inline">during the period described in subparagraph (C), conduct at least 3 public meetings located within the area affected by the closing or consolidation that provides an opportunity for public comments to be submitted verbally or in writing.</text>
 </subparagraph></paragraph><paragraph id="HF4C106E8996B409B8FD240EBDDF36149" indent="up1"><enum>(5)</enum><text>Before the date on which the Postal Service proposes to close or consolidate a postal facility, the Postal Service shall publish on the Postal Service public Web site—</text>
 <subparagraph id="HC1B5C2AD2DFC4212BE98D64FED2433CF"><enum>(A)</enum><text>notice of the final determination to close or consolidate the facility; and</text> </subparagraph><subparagraph id="H421A81CF180141B5939CE737D7CDABA2"><enum>(B)</enum><text>a justification statement that includes—</text>
 <clause id="H0CD77F8B634B4B2695A1FC9AD8EC591C"><enum>(i)</enum><text>a response to all public comments received under paragraph (4);</text> </clause><clause id="H97980F86512B42FC8420A7A72C6D4249"><enum>(ii)</enum><text>the considerations made by the Postal Service under such paragraph; and</text>
 </clause><clause id="H043FD4063FDE44FC9DBC11836A67781A"><enum>(iii)</enum><text>the actions that will be taken by the Postal Service to mitigate any negative effects identified under such paragraph.</text>
								</clause></subparagraph></paragraph><paragraph id="H97DD3C73864A4199819AFDCCC98D4372" indent="up1"><enum>(6)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HB73B666512C443869C51EA0B976565CB"><enum>(A)</enum><text>Beginning on the date that the Postal Service publishes the notice under paragraph (5), the Postal Regulatory Commission shall have 90 days to—</text>
 <clause id="H44ECADAEC53C448786FB85CBCB54D338" indent="up1"><enum>(i)</enum><text>review the study, public comments, and the Postal Service’s response and notice, as described in such paragraphs; and</text>
 </clause><clause id="HCD07D594DBC54AAEB9C437044F5BC616" indent="up1"><enum>(ii)</enum><text>approve or disapprove of the closure or consolidation.</text> </clause></subparagraph><subparagraph id="H9FE3315C977949488464AC637EF649C5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If the Commission disapproves the closure or consolidation, the Postal Service may not attempt to consolidate or close that facility under this subsection for two years beginning on the date of the Commission’s determination under subparagraph (A)(ii). A disapproval notice under this subparagraph shall be published on the Commission’s public Web site.</text>
 </subparagraph><subparagraph id="H5CA3D20851BF4D71A4E1EB615FD9D569" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If the Commission approves the closure or consolidation, the Postal Service may not begin the closure or consolidation action until the date that is 15 days after the date of the Commission’s approval. An approval notice under this subparagraph shall be published on the Commission’s public Web site.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HB1353E218EE64C989455B79A54D16DA1"><enum>(c)</enum><header>Application</header><text>The amendment made by subsection (b) shall apply to any closure or consolidation determination made by the United States Postal Service with respect to a postal facility (as that term is defined in section 404(f)(1) of title 39, United States Code, as added by subsection (b)) on or after the date of enactment of this Act.</text>
			</subsection></section><section id="H63618600184C42E7AB49908A3B677A50"><enum>3.</enum><header>Market-dominant product service standards</header>
 <subsection id="H195807A5308149F19D0D6FB43FD527A3"><enum>(a)</enum><header>National mail delivery service standards</header><text>With respect to any market-dominant product (as that term is defined in section 102(8) of title 39, United States Code)—</text>
 <paragraph id="H177316324BAF4708B0D11614EBB93203"><enum>(1)</enum><text>the national service standards implemented by the United States Postal Service and in effect on January 5, 2015, shall have no force or effect; and</text>
 </paragraph><paragraph id="H08045EC9A7FF4510BB401B8171016BD9"><enum>(2)</enum><text>the Postal Service shall reinstate the national service standards that were in effect on July 1, 2012.</text>
 </paragraph></subsection><subsection commented="no" id="H2C72A43543064D139E76D563A48D802F"><enum>(b)</enum><header>Delivery standards enforcement</header><text>The Postal Regulatory Commission shall determine, on an annual basis and using the performance ratings established under subsection (c), if the United States Postal Service is meeting the national service standards established under subsection (a) for market-dominant products. Such determination shall be submitted to the Federal Register.</text>
 </subsection><subsection commented="no" id="H5552B0AEE1B94768A9612E72DD95464A"><enum>(c)</enum><header>Performance ratings</header><text display-inline="yes-display-inline">The Postal Regulatory Commission shall rate the performance of the Postal Service with respect to—</text> <paragraph commented="no" id="H2FCC1D79B3D347D2BACB9FF215EFC970"><enum>(1)</enum><text>each 3-digit ZIP code area, postal district, and operational area;</text>
 </paragraph><paragraph commented="no" id="H3C404FB952E047B985DBD74A40FC59F8"><enum>(2)</enum><text>all postal districts—</text> <subparagraph commented="no" id="HBA1E014EB9724C0D929A8DAA8C0E0ED7"><enum>(A)</enum><text>by urban, suburban, or rural category; and</text>
 </subparagraph><subparagraph commented="no" id="HD459B1A92CE6408F8EE011D29671DC65"><enum>(B)</enum><text>nationwide;</text> </subparagraph></paragraph><paragraph commented="no" id="H2B9B39619FF34BF9AC20323ECDCF4FCF"><enum>(3)</enum><text>all operational areas—</text>
 <subparagraph commented="no" id="H31A8B079D11D42A98F1C914F2A3F5379"><enum>(A)</enum><text>by urban, suburban, or rural category; and</text> </subparagraph><subparagraph commented="no" id="HBEC90A2098C34527ACFBD3715CC92325"><enum>(B)</enum><text>nationwide;</text>
 </subparagraph></paragraph><paragraph commented="no" id="H830736BE54864D99A88E1AC7E7F313C5"><enum>(4)</enum><text>market-dominant products nationwide; and</text> </paragraph><paragraph commented="no" id="H56929ABC29744DABB375B7C7475EB603"><enum>(5)</enum><text>first-class mail nationwide.</text>
 </paragraph></subsection><subsection commented="no" id="H1264EAA5D95C4B72BA667E3925AC4119"><enum>(d)</enum><header>Definition of urban, suburban, and rural</header><text display-inline="yes-display-inline">For purposes of subsection (c), the Postal Regulatory Commission—</text> <paragraph commented="no" id="HF67644779A114CBAAFFB0665C12E4969"><enum>(1)</enum><text>shall promulgate regulations to define the terms <quote>urban</quote>, <quote>suburban</quote>, and <quote>rural</quote>;</text>
 </paragraph><paragraph commented="no" id="H068CD29906A44DA0B9DE7EB67C1F4FE4"><enum>(2)</enum><text>in defining the terms under paragraph (1), shall—</text> <subparagraph commented="no" id="H842A8D88D6D74878ABA5B43652BD5ABC"><enum>(A)</enum><text>consider—</text>
 <clause commented="no" id="H95B47C728D164949A4A43964E7258637"><enum>(i)</enum><text>any recommendations submitted to the Commission by the Postmaster General; and</text> </clause><clause commented="no" id="H3059E354598B464793759E7E16F96F08"><enum>(ii)</enum><text>existing definitions of those terms that are in use by the Postal Service, the Federal Government, and other sources; and</text>
 </clause></subparagraph><subparagraph commented="no" id="H0CF0A1AB72DA410BB1831B8C885E478C"><enum>(B)</enum><text>incorporate stakeholder input; and</text> </subparagraph></paragraph><paragraph commented="no" id="HA71CCA0D274E4E268666F23AC0E58250"><enum>(3)</enum><text>shall categorize each 3-digit ZIP code area as an urban, suburban, or rural community.</text>
				</paragraph></subsection><subsection commented="no" id="HE9965A2BEFAC42C3AE1309021E9651BB"><enum>(e)</enum><header>Corrective action</header>
 <paragraph commented="no" id="HA2E6299AC6BE4851A1BCA75BD2E34C03"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Postal Regulatory Commission finds that the Postal Service is not meeting the national service standards, the Commission may recommend to the Postal Service corrective actions and reasonable performance targets to meet the standards. The recommendations shall be published on the Commission’s public Web site and annually submitted to Congress and the Postal Service.</text>
 </paragraph><paragraph commented="no" id="H9FC0833D23554D6FAC91C1CCA074CD8F"><enum>(2)</enum><header>Postal Service response</header><text display-inline="yes-display-inline">Not later than 60 days after receiving any recommendations under paragraph (1), the Postmaster General shall respond in writing to the recommendations. The response shall explain how the Postal Service will change operations to achieve the recommendations. The response shall be published on the Commission’s public Web site and annually submitted to Congress and the Commission.</text>
