			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to permanently appropriate funding for the
			 administrative expenses of the Social Security Administration, and for
			 other purposes.</official-title></form>
	<legis-body id="H7AE7B83EA9E1429384FCB410340434B4" style="OLC">
 <section id="H6DEB063B058543A3B3C17FF811D6F7AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security Administration Fairness Act</short-title></quote>.</text> </section><section id="HE9874A050F6748F08F1ED0C1F65C02D1"><enum>2.</enum><header>Funding for administrative expenses of the Social Security Administration</header> <subsection id="H989C169680904842A4599B129E424A62"><enum>(a)</enum><header>In general</header><text>Section 201(g)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401(g)(1)(A)</external-xref>) is amended—</text>
 <paragraph id="H0CBDA3BA18B24548A17458F9E420ED28"><enum>(1)</enum><text>in the third sentence of the matter following clause (ii), by striking <quote>the costs of the part of the administration of this title, title VIII, title XVI, and title XVIII for which the Commissioner of Social Security is responsible,</quote>; and</text>
 </paragraph><paragraph id="HF0B23CF4F2774D9EBF07B5A9DE7E099F"><enum>(2)</enum><text>by adding at the end the following: <quote>For each fiscal year beginning with fiscal year 2019, there is hereby appropriated to pay the costs of the part of the administration of this title, title VIII, and title XVI for which the Commissioner of Social Security is responsible an amount equal to 1.5 percent of the sum of the amount of benefit payments required to be made under this title for the fiscal year involved and the amount of benefit payments expected to be paid under titles VIII and XVI for the fiscal year involved, as estimated by the Commissioner of Social Security. For purposes of the preceding sentence, (I) the portion of the amount to be appropriated for a fiscal year that is attributable to benefit payments required to be made under this title shall be appropriated from the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund in a manner that ensures that the amount appropriated from each Trust Fund for the year bears the same proportion to the amount appropriated from both Trust Funds for the year as the amount of benefit payments required to be made from such Trust Fund for the year bears to the amount of benefit payments required to be made from both Trust Funds for the year, and (II) the portion of the amount to be appropriated for a fiscal year that is attributable to benefit payments expected to be made under titles VIII and XVI shall be appropriated from the general fund of the Treasury. For each fiscal year beginning with fiscal year 2019, there is hereby appropriated from the Federal Hospital Insurance Trust Fund and the Federal Supplementary Medical Insurance Trust Fund, in such proportion as the Commissioner of Social Security shall determine, such sums as are necessary to pay the costs of the part of the administration of title XVIII for which the Commissioner is responsible.</quote>.</text>
				</paragraph></subsection><subsection id="HF46DCA5C163C42ADAF18398073ACB74D"><enum>(b)</enum><header>Removing the limitation on the administrative expenses of the Social Security Administration from
			 discretionary budget caps, the Congressional Budget Resolution, the <enum-in-header>302(a)</enum-in-header>
			 allocations and the <enum-in-header>302(b)</enum-in-header> suballocations</header>
 <paragraph id="HF565B64BD16041F5903F8AC092785E4B"><enum>(1)</enum><header>Exclusion of the administrative costs of Social Security, SSI, and Medicare from all budgets</header><text>Section 13301(a) of the Budget Enforcement Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632</external-xref> note) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HA9C96EB4B18849158CE9A41A1C996822" style="OLC">
						<subsection id="HA735CCA3EA18419082AFB827B30BB635"><enum>(a)</enum><header>Exclusion of the administrative costs of Social Security, SSI, and Medicare from all budgets</header>
 <paragraph id="H93C120BB0FAB45B5BF65C8141815DC58"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the receipts and disbursements described in paragraph (2) shall not be counted as new budget authority, outlays, receipts, or deficit or surplus for purposes of—</text>
 <subparagraph id="H08B7AB8BA29347AAB2A1E8D0B893F0A3"><enum>(A)</enum><text>the budget of the United States Government as submitted by the President under section 1105 of title 31, United States Code;</text>
 </subparagraph><subparagraph id="H81C188EF21FC4F2D926027360CCDD12C"><enum>(B)</enum><text>a concurrent resolution on the budget;</text> </subparagraph><subparagraph id="H125080C5EC934682AFF80A56EFFFA9A1"><enum>(C)</enum><text>the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900</external-xref> et seq.); or</text>
 </subparagraph><subparagraph id="H822BBF74E5894BAA9E10725CB931481F"><enum>(D)</enum><text>the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/931">2 U.S.C. 931</external-xref> et seq.).</text> </subparagraph></paragraph><paragraph id="H54E6103423C744C9A8BA772BA58D0AA9"><enum>(2)</enum><header>Receipts and disbursements covered</header><text>The receipts and disbursements described in this paragraph are—</text>
 <subparagraph id="H83387C0F77674F5DBA5279F2D6A10675"><enum>(A)</enum><text>the receipts and disbursements of the Federal Old-Age and Survivors Trust Fund and the Federal Disability Insurance Trust Fund, including the costs of the part of the administration of title II of the Social Security Act for which the Commissioner of Social Security is responsible; and</text>
 </subparagraph><subparagraph id="HE69F15AC3144441ABD930A7C6948DFEA"><enum>(B)</enum><text>the receipts and disbursements from the Federal Hospital Insurance Trust Fund, the Federal Supplementary Insurance Trust Fund, and amounts appropriated for the Supplemental Security Income program for the costs of the part of the administration of titles XVI and XVIII of the Social Security Act for which the Commissioner of Social Security is responsible.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3B18AB2B28D44D698341F4449CBF11D1"><enum>(2)</enum><header>Exclusion of the administrative costs of Social Security, SSI, and Medicare from the Congressional
 Budget Resolution</header><text>Section 301(a) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632(a)</external-xref>) is amended by striking the matter following paragraph (7) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H628E8A67A3DD4ED69491C62AB7330283" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The concurrent resolution shall not include in the surplus or deficit totals required by this
			 subsection or in any other surplus or deficit totals required by this
			 title the outlays and revenue totals of the program under title II of the
			 Social Security Act, or the related provisions of the Internal Revenue
			 Code of 1986, including the costs of the part of the administration of
			 such title II for which the Commissioner of Social Security is responsible
			 or the costs of the part of the administration of titles XVI and XVIII of
			 the Social Security Act for which the Commissioner of Social Security is
			 responsible.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HDCD149DA919347A6BF3C85D5F778B3A3"><enum>(3)</enum><header>Exclusion of the administrative costs of Social Security, SSI, and Medicare from Congressional
 Budget Act <enum-in-header>302(a)</enum-in-header> allocations</header><text>Section 302(a)(1) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/633">2 U.S.C. 633(a)(1)</external-xref>) is amended by adding at the end the following: <quote>The allocation under this paragraph shall not include the outlays of the program under title II of the Social Security Act, including the costs of the part of the administration of such title for which the Commissioner of Social Security is responsible, or the outlays for the costs of the part of the administration of titles XVI and XVIII of the Social Security Act for which the Commissioner of Social Security is responsible.</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD68575168D5E49B6BC84CF9646CA7F40"><enum>(4)</enum><header>Exclusion of the administrative costs of Social Security, SSI, and Medicare from the Congressional
 Budget Act <enum-in-header>302(b)</enum-in-header> suballocations</header><text>Section 302(b) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/633">2 U.S.C. 633(b)</external-xref>) is amended by adding at the end the following: <quote>The suballocation under this subsection shall not include the outlays of the program under title II of the Social Security Act, including the costs of the part of the administration of such title for which the Commissioner of Social Security is responsible, or the outlays for the costs of the part of the administration of titles XVI and XVIII of the Social Security Act for which the Commissioner of Social Security is responsible.</quote>.</text>
 </paragraph></subsection><subsection id="H3EDA88CD877D4884A9B848397C3400FB"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2018.</text> </subsection></section><section id="HF58863AA8DA941459CC4BFE8E5F270D8"><enum>3.</enum><header>Eliminating the 5-month waiting period for disability benefits and for disabled surviving spouses</header> <subsection id="HE042712226AE49B08F5F97AD8F08C99D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 223(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(a)(1)</external-xref>) is amended in the matter following subparagraph (E)—</text>
 <paragraph id="H7CDF0FC7057F4584BA785E8B40677FC1"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>for months beginning before the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>,</quote> after <quote>(i)</quote>;</text> </paragraph><paragraph id="H49C233D1A5B54C6BB69D1D37AF32800C"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>or (ii)</quote> and inserting <quote>(ii), for months beginning before the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>,</quote>; and</text>
 </paragraph><paragraph id="H413F365915F04B64A81C4C726ADF54E1"><enum>(3)</enum><text>by inserting <quote>or (iii) for months beginning on or after the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>, for each month beginning with the first month during all of which the individual is under a disability and in which the individual becomes entitled to such insurance benefits,</quote> before <quote>and ending</quote>.</text>
 </paragraph></subsection><subsection id="HE430D3894C1B4724B9E6E3CD7BD468E6"><enum>(b)</enum><header>Disabled surviving spouses</header><text>Section 202 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402</external-xref>) is amended—</text> <paragraph id="H9C9EC3DEB9CA47EFB688F492054497CB"><enum>(1)</enum><text>in subsection (e)(1)(F)—</text>
 <subparagraph id="H245C1F54A9924D55A0B73D7E5DCA50D2"><enum>(A)</enum><text>in clause (i)—</text> <clause id="H0A8170A4F4A34DD5BDD993716AB227F0"><enum>(i)</enum><text>by inserting <quote>for months beginning before the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>,</quote> before <quote>the first month</quote>; and</text>
 </clause><clause id="H7466134CCF6C449A98E30C206E7D3B12"><enum>(ii)</enum><text>by striking <quote>, or</quote> and inserting a comma;</text> </clause></subparagraph><subparagraph id="H03555D82A8AA4E4FB1569D6725AC610C"><enum>(B)</enum><text>in clause (ii)—</text>
 <clause id="H6A250097856141D4B4EF536838EEBF75"><enum>(i)</enum><text>by inserting <quote>for months beginning before the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>,</quote> before <quote>the first month</quote>; and</text> </clause><clause id="H4AD2130A93DC4FD38C0CBB8E484B90BC"><enum>(ii)</enum><text>by striking <quote>terminated,</quote> and inserting <quote>, or</quote>; and</text>
 </clause></subparagraph><subparagraph id="H505B9D6A2D16446BA127471A05CD8775"><enum>(C)</enum><text>by adding at the end the following new clause:</text> <quoted-block act-name="" id="HA138F2E0078C43579322881EB3B73AFA" other-style="archaic" style="other"> <clause id="H9C3EE720968E44DE8A15B419E60DA8BF"><enum>(iii)</enum><text display-inline="yes-display-inline">for months beginning on or after the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>, the first month during all of which she is under a disability and in which she becomes entitled to such insurance benefits,</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H9F6A7FFBEEDF431CB16A90F3998F79FE"><enum>(2)</enum><text>in subsection (f)(1)(F)—</text> <subparagraph id="HC864F47988B64E32BF72BBC2841078F9"><enum>(A)</enum><text>in clause (i)—</text>
 <clause id="HF55C4B58A00440B2B0FD77C9F074B87A"><enum>(i)</enum><text>by inserting <quote>for months beginning before the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>,</quote> before <quote>the first month</quote>; and</text> </clause><clause id="H2D0AADA1D2AB4118BACC8A98781ACA07"><enum>(ii)</enum><text>by striking <quote>, or</quote> and inserting a comma;</text>
 </clause></subparagraph><subparagraph id="HB20081D0421D4EB68B2D725442960FA8"><enum>(B)</enum><text>in clause (ii)—</text> <clause id="H8CD6882EE63C4FB4B7A57A1314E82236"><enum>(i)</enum><text>by inserting <quote>for months beginning before the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>,</quote> before <quote>the first month</quote>; and</text>
 </clause><clause id="HF73F311257834E618B8BBE76697A5C6F"><enum>(ii)</enum><text>by striking <quote>terminated,</quote> and inserting <quote>, or</quote>; and</text> </clause></subparagraph><subparagraph id="HC30A287C8E1848DABCE0A53001450EC8"><enum>(C)</enum><text>by adding at the end the following new clause:</text>

 <clause id="H5492DAA7478749BC975ECBC518E42FFC"><enum>(iii)</enum><text display-inline="yes-display-inline">for months beginning on or after the date of the enactment of the <short-title>Social Security Administration Fairness Act</short-title>, the first month during all of which he is under a disability and in which he becomes entitled to such insurance benefits,</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="H4E479354BC3D49F89474F277931819F2"><enum>4.</enum><header>Eliminating the 24-month waiting period for Medicare coverage for individuals with disabilities</header>
 <subsection id="H8D63C94E6BE14E70B63ED638D0DBFA8B"><enum>(a)</enum><header>In general</header><text>Section 226(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/426">42 U.S.C. 426(b)</external-xref>) is amended—</text> <paragraph id="H976D9D3B4A3843239E2F33E393961E33"><enum>(1)</enum><text>in paragraph (2)(A), by striking <quote>, and has for 24 calendar months been entitled to,</quote>;</text>
 </paragraph><paragraph id="HA010455C8AD84C8A9A15F6087573C9D1"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>, and has been for not less than 24 months,</quote>;</text> </paragraph><paragraph id="HDBDF37FB55A8441E8236D6C88286857A"><enum>(3)</enum><text>in paragraph (2)(C)(ii), by striking <quote>, including the requirement that he has been entitled to the specified benefits for 24 months,</quote>;</text>
 </paragraph><paragraph id="HF6B88F176013439780A117594BE6BB71"><enum>(4)</enum><text>in the first sentence, by striking <quote>for each month beginning with the later of (I) July 1973 or (II) the twenty-fifth month of his entitlement or status as a qualified railroad retirement beneficiary described in paragraph (2), and</quote> and inserting <quote>for each month for which the individual meets the requirements of paragraph (2), beginning with the month following the month in which the individual meets the requirements of such paragraph, and</quote>; and</text>
 </paragraph><paragraph id="HC9E8447F32614A0B9EB1A412444568E3"><enum>(5)</enum><text>in the second sentence, by striking <quote>the <quote>twenty-fifth month of his entitlement</quote></quote> and all that follows through <quote>paragraph (2)(C) and</quote>.</text> </paragraph></subsection><subsection id="H7BF9D949C8E64159B3EAC3DABF8CB442"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="HA4A7DE39D8BE4977AF94F3F7899773C1"><enum>(1)</enum><header>Section 226</header><text>Section 226 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/426">42 U.S.C. 426</external-xref>) is amended by—</text>
 <subparagraph id="H960334B14B64474A84FBFCE0E1EAD9B9"><enum>(A)</enum><text>striking subsections (e)(1)(B), (f), and (h); and</text> </subparagraph><subparagraph id="HDDE3C5AB46E9416B8CFB5DB08A3B9EE2"><enum>(B)</enum><text>redesignating subsections (g) and (i) as subsections (f) and (g), respectively.</text>
 </subparagraph></paragraph><paragraph id="H20BDEBE88EB9449C94966046A56ED605"><enum>(2)</enum><header>Medicare description</header><text>Section 1811(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c(2)</external-xref>) is amended by striking <quote>have been entitled for not less than 24 months</quote> and inserting <quote>are entitled</quote>.</text> </paragraph><paragraph id="H4CC7EC5472414EC09731F243D5FE31BD"><enum>(3)</enum><header>Medicare coverage</header><text>Section 1837(g)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(g)(1)</external-xref>) is amended by striking <quote>25th month of</quote> and inserting <quote>month following the first month of</quote>.</text>
 </paragraph><paragraph id="HEF2038DC636B44BE96105588B3E22E5D"><enum>(4)</enum><header>Railroad retirement system</header><text>Section 7(d)(2)(ii) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231f">45 U.S.C. 231f(d)(2)(ii)</external-xref>) is amended—</text> <subparagraph id="H9CE1C348BD4F4BB897CB13E6B127D6F3"><enum>(A)</enum><text>by striking <quote>has been entitled to an annuity</quote> and inserting <quote>is entitled to an annuity</quote>;</text>
 </subparagraph><subparagraph id="H2EF9C7767E124238A90FCCDA7E5B525C"><enum>(B)</enum><text>by striking <quote>, for not less than 24 months</quote>; and</text> </subparagraph><subparagraph id="HB07863DBEB41457692D8BD28A4D0F317"><enum>(C)</enum><text>by striking <quote>could have been entitled for 24 calendar months, and</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA4438A9324ED4276AACFAEF747693B93"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to insurance benefits under title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> with respect to items and services furnished on or after the date of the enactment of this Act.</text> </subsection></section><section id="HC0CCAC2EC5AD431A88E786D133808AD6"><enum>5.</enum><header>Closure of field and hearing offices and resident or rural contact stations</header> <subsection id="HD37348B599164A699C3F107D40546520"><enum>(a)</enum><header>Moratorium on closure or consolidation of field or hearing offices or new limitations on access to such offices</header> <paragraph id="H0000667836014244B2EEC8386A1A590F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Commissioner of Social Security shall take no action on or after the date of the enactment of this Act to close or consolidate field or hearing offices of the Social Security Administration or to otherwise impose any new limitation on access to such offices.</text>
 </paragraph><paragraph id="H0D7326492C1F403093984DBE8A3A18C7"><enum>(2)</enum><header>Cessation of moratorium upon report to Congress</header><text display-inline="yes-display-inline">Paragraph (1) shall cease to be effective 180 days after the Commissioner submits to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a detailed report outlining and justifying the process for selecting field or hearing offices to be closed or consolidated or otherwise to have limited access. Such report shall include—</text>
 <subparagraph id="H55D748695BCE4A8CACF3B5FD9661170A"><enum>(A)</enum><text display-inline="yes-display-inline">an analysis of the criteria used for selecting field or hearing offices for closure, consolidation, or limited access;</text>
 </subparagraph><subparagraph id="H8FF3264F9AB648E09022AA4A4D65FB3D"><enum>(B)</enum><text>a description of how the Commissioner has analyzed and considered relevant factors, including but not limited to transportation and communication burdens faced by individuals serviced by the offices, including elderly and disabled citizens; and</text>
 </subparagraph><subparagraph id="H671BC871349A451B94E791920E5D6CE6"><enum>(C)</enum><text display-inline="yes-display-inline">a description of any method of cost-benefit analysis applied by the Commissioner in connection with closures and consolidations of field or hearing offices, and other limitations on access to field or hearing offices, including any analysis that takes into account—</text>
 <clause id="HEB01AABAB33B490B9656DB1658D2D4E8"><enum>(i)</enum><text display-inline="yes-display-inline">the anticipated savings resulting from the closure, consolidation, or limitation on access;</text> </clause><clause id="H8EB3804CFFDF4DCE8F07D818C3700679"><enum>(ii)</enum><text>the anticipated costs associated with replacing services lost by the closure, consolidation, or limitation on access;</text>
 </clause><clause id="H85E4D2BCA24441249E7FEEF7DA4CCAEF"><enum>(iii)</enum><text display-inline="yes-display-inline">the anticipated effects on employees of the offices affected;</text> </clause><clause id="H804CA2EB99EC4ADD8CB6C37D06BB869D"><enum>(iv)</enum><text display-inline="yes-display-inline">how the loss of access resulting from the closure, consolidation, or limitation on access will be replaced by the establishment of a new field or hearing office, increased access at a different office, or some other means, and the factors considered by the Commissioner in determining how to replace such lost access; and</text>
 </clause><clause id="H94D9CD1B6495470A8C579858631B41BC"><enum>(v)</enum><text display-inline="yes-display-inline">such other relevant factors as may be determined by the Commissioner, including but not limited to transportation and communication burdens faced by individuals serviced by the offices, including elderly and disabled citizens.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H80CB51F5B2CB432F9A3FC271637A35FC"><enum>(b)</enum><header>Requirements for future closures, consolidations, and new limitations on access</header>
 <paragraph id="HE458782D34C346DBB81618B4B0EA3DC3"><enum>(1)</enum><header>In general</header><text>Section 704 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/904">42 U.S.C. 904</external-xref>) is amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HADD76EC7EAD54B61867A0082D980EC86" other-style="archaic" style="other">
 <subsection id="HBC2A6EBCBC59492981D983983B55CF61"><enum>(f)</enum><header>Field and Hearing Offices</header><paragraph commented="no" display-inline="yes-display-inline" id="H32BD596AB4BB4F0DB122D0EDE560EFE1"><enum>(1)</enum><text display-inline="yes-display-inline">The Commissioner may not close a field or hearing office of the Administration, consolidate two or more such offices, or otherwise impose any new limitation on public access to any such office, unless the Commissioner complies with the requirements of paragraphs (2), (3), (4), and (5) in connection with the closure, consolidation, or limitation on public access.</text>
							</paragraph><paragraph id="H0C2FB0A58DB242898D8F37ADEAC78F17" indent="up1"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HF472F2773C084B8290A15107E79B19DF"><enum>(A)</enum><text>The requirements of this paragraph are met in connection with a closure, consolidation, or new limitation on access referred to in paragraph (1) only if—</text>
 <clause id="H666B1686788F488EB9FF7D4DC88C4875" indent="up1"><enum>(i)</enum><text>not later than 120 days before the date of the closure, consolidation, or limitation on access, the Commissioner provides effective public notice of the proposed closure, consolidation, or limitation on access (including, to the extent practicable, notice by direct mailing and through community outlets such as newspapers and posting in heavily frequented public spaces) to individuals residing in the area serviced by the affected office or offices;</text>
 </clause><clause id="H0B155944A0E74113BEDC595C72A594A8" indent="up1"><enum>(ii)</enum><text>the public notice issued pursuant to clause (i) includes information on—</text> <subclause id="H38794B1FC24D4DE3B4469F9C6A916E7D"><enum>(I)</enum><text>how the Commissioner will, not later than 30 days after the date of the closure, consolidation, or limitation on access, replace the loss in access resulting from the closure, consolidation, or limitation on access by establishing a new office, increasing public access to a different office, or some other means; and</text>
 </subclause><subclause id="HF7B2A828C3D947968C539111558C490A"><enum>(II)</enum><text>how to contact the Administration if an individual experiences service delays or problems as a result of the closure, consolidation, or limitation on access; and</text>
 </subclause></clause><clause id="HB459332EE12A44BD873DDC656BE1B2C3" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">not earlier than 30 days after the issuance of public notice pursuant to clause (i) and not later than 45 days before the date of the proposed closure, consolidation, or limitation on access, the Commissioner conducts at least 2 public hearings (scheduled so that the first and last such hearings are separated by at least 10 days), at which the Commissioner presents the justifications for the closure, consolidation, or limitation on access described in subparagraph (B) and provides for attendees an opportunity to present their views regarding the proposed closure, consolidation, or limitation on access.</text>
 </clause></subparagraph><subparagraph id="HBCAF46C619BA4FD4A2D9CEBD351E0650" indent="up1"><enum>(B)</enum><text>The justifications referred to in subparagraph (A)(iii) shall consist of the following:</text> <clause id="H355086BAD5444346A142DCD849779825"><enum>(i)</enum><text display-inline="yes-display-inline">an analysis of the criteria used for selecting the field or hearing office or offices for closure, consolidation, or limited access;</text>
 </clause><clause id="H16F87813B0A44AE895198BA8736C5482"><enum>(ii)</enum><text>a description of how the Commissioner has analyzed and considered relevant factors, including but not limited to transportation and communication burdens faced by individuals serviced by the offices, including elderly and disabled citizens; and</text>
 </clause><clause display-inline="no-display-inline" id="H9F6A3C568C544297B9A789FEB8683641"><enum>(iii)</enum><text display-inline="yes-display-inline">a description of a method of cost-benefit analysis which shall be applied by the Commissioner in connection with the closure, consolidation, or limitation on access, and which shall take into account—</text>
 <subclause id="H920EDCF8450B4561B3755FC173B8DCA0"><enum>(I)</enum><text display-inline="yes-display-inline">the anticipated savings resulting from the closure, consolidation, or limitation on access;</text> </subclause><subclause id="H6F7FDDAC20A240B1A374359C1DD120CD"><enum>(II)</enum><text>the anticipated costs associated with replacing services lost by the closure, consolidation, or limitation on access;</text>
 </subclause><subclause id="H1F786DD7189C4FB89901F437CB6E2943"><enum>(III)</enum><text display-inline="yes-display-inline">the anticipated effects on employees of the offices affected; and</text> </subclause><subclause id="HD260B08E42D148CFAA9CA655BB4A79E5"><enum>(IV)</enum><text display-inline="yes-display-inline">such other relevant factors as may be determined by the Commissioner, including but not limited to transportation and communication burdens faced by individuals serviced by the offices, including elderly and disabled citizens.</text>
 </subclause></clause></subparagraph><subparagraph id="HC6CFC7CC645D4E9E887A306499CF0B92" indent="up1"><enum>(C)</enum><text>The notice provided pursuant to subparagraph (A)(i) shall include notice of the time and place of the public hearings to be conducted pursuant to clause (A)(iii) and of the right of aggrieved individuals to appeal to the Commissioner regarding the proposed closure, consolidation, or limitation on access pursuant to paragraph (4).</text>
 </subparagraph></paragraph><paragraph id="H007A2C3EB0B24561BAB45DD20F27F171" indent="up1"><enum>(3)</enum><text>The requirements of this paragraph are met in connection with a closure, consolidation, or limitation on access referred to in paragraph (1) only if, not later than 30 days before the date of the proposed closure, consolidation, or limitation on access, the Commissioner submits to the Committee on Ways and Means of the House of Representatives, the Committee on Finance of the Senate, and each Member of the Congress representing a State or congressional district in which the affected office or offices are located a detailed final report in support of the closure, consolidation, or limitation on access. Such report shall include—</text>
 <subparagraph id="HBBC3A30848D5421C8DF42048008C9101"><enum>(A)</enum><text display-inline="yes-display-inline">the justifications described in paragraph (2)(B), (including any amendments made to such justifications after the public hearings conducted pursuant to paragraph (2)(A));</text>
 </subparagraph><subparagraph id="H3C7CF7C6D8B44795BBC3F27C25B1568C"><enum>(B)</enum><text>any findings made by the Commissioner pursuant to the public hearings;</text> </subparagraph><subparagraph id="H9F7ECD009FCF42248BB583AC26D6E525"><enum>(C)</enum><text>the status of any appeals regarding the closure, consolidation, or new limitation on access which were commenced pursuant to paragraph (4) before the date of the report;</text>
 </subparagraph><subparagraph id="H019D6A4DB32348EFA1D1CC449077C7D3"><enum>(D)</enum><text display-inline="yes-display-inline">the final decision of the Commissioner regarding the closure, consolidation, or new limitation on access; and</text>
 </subparagraph><subparagraph id="H3ADD494E47ED4FAA94E9313345CEBC8F"><enum>(E)</enum><text>such other information as the Commissioner considers relevant.</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H1B06B9CD7671427FB321DAD94A704CAC" indent="up1"><enum>(4)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H6652A1DA0FE548FAA1763F588B788BD4"><enum>(A)</enum><text>Upon timely request by any individual who makes a showing in writing described in subparagraph (B) in connection with a proposed closure, consolidation, or limitation on access referred to in subparagraph (A), the Commissioner shall give such individual an opportunity for a hearing with respect to the closure, consolidation, or limitation on access. The request for the hearing shall be considered timely only if it is made not later than 30 days before the proposed date of the closure, consolidation, or limitation on access. The Commissioner shall submit to the Committee on Ways and Means of the House of Representatives, the Committee on Finance of the Senate, and each Member of the Congress representing a State or congressional district in which the affected office or offices are located the Commissioner’s findings based on the hearing and a description of any action taken or to be taken by the Commissioner on the basis of such findings.</text>
 </subparagraph><subparagraph id="HC4DBCC736FC1460A8EA585866007E4FF" indent="up1"><enum>(B)</enum><text>A showing described in subparagraph (A) shall consist of a showing that—</text> <clause id="H9F9E7BBF81AA4CF0A869CB51B77C57B3"><enum>(i)</enum><text>the determination of the Commissioner to close a field or hearing office, consolidate field or hearing offices, or impose a new limitation on access to a field or hearing office is arbitrary, capricious, an abuse of discretion, not in accordance with law, or not based on substantial evidence; or</text>
 </clause><clause id="HEFC001B2962E414DA215312D5A7BF95B"><enum>(ii)</enum><text>the Commissioner has failed to observe procedures required by law in connection with the closure, consolidation, or new limitation on access.</text>
 </clause></subparagraph></paragraph><paragraph id="HFCAACCB7D9AE499F8AB168FD2178923F" indent="up1"><enum>(5)</enum><text>The requirement of this paragraph is met in connection with a closure, consolidation, or limitation on access referred to in paragraph (1) only if such closure, consolidation, or limitation on access will not result in the total number of field or hearing offices of the Administration falling below the total number of such offices that were in operation on September 30, 2018.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H85C230E1CB1E4DE7B59351025DBA404A"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) of this subsection shall apply with respect to closures and consolidations of field or hearing offices and impositions of new limitations on access to such offices occurring after the cessation of the moratorium under subsection (a) of this section.</text>
