			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit the separation of families including an individual with an developmental disability at or

	<legis-body id="H9AC94C19C0FC4C2BA848F6E640DE30C9" style="OLC">
 <section id="H78A618979E1F4445B86FA21CB14FDB18" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Family Separation for Immigrants with Disabilities Act</short-title></quote>.</text> </section><section id="HEB04727F98DE421BBD86EB7D74327F57"><enum>2.</enum><header>Limitation on the separation of families including an individual with an developmental disability</header> <subsection id="H2C7719F05FC8435089BF8594153DC015"><enum>(a)</enum><header>In general</header><text>An agent or officer of a designated agency shall be prohibited from removing a protected individual from his or her family member, at or near the port of entry or within 100 miles of the border of the United States, unless one of the following has occurred:</text>
 <paragraph id="H5A04DD4698054D2D9FBA8CA3795BAE9A"><enum>(1)</enum><text>A State court, authorized under State law, terminates the rights of a family member, determines that it is in the best interests of the protected individual to be removed from his or her family member, in accordance with the Adoption and Safe Families Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/89">Public Law 105–89</external-xref>), or makes any similar determination that is legally authorized under State law.</text>
 </paragraph><paragraph id="H383874F73611414197242695126C6CB0"><enum>(2)</enum><text>An official from the State or county welfare agency with expertise in trauma and development and an official from the State protection and advocacy system make a best interests determination that it is in the best interests of the protected individual to be removed from his or her family member because the protected individual is in danger of abuse or neglect at the hands of the family member, or is a danger to herself or others.</text>
 </paragraph><paragraph id="HF915DA813E194B42A1529BD9FEE90328"><enum>(3)</enum><text>The Chief Patrol Agent or the Area Port Director in their official and undelegated capacity, authorizes separation upon the recommendation by an agent or officer, based on a finding that—</text>
 <subparagraph id="HF1356A7F8139413394EAB65235A16BFB"><enum>(A)</enum><text>the protected individual is a victim of trafficking or is at significant risk of becoming a victim of trafficking;</text>
 </subparagraph><subparagraph id="H66AF5A6A9FEF48D398397C217DA748F3"><enum>(B)</enum><text>there is a strong likelihood that the adult is not a family member of the protected individual; or</text> </subparagraph><subparagraph id="H677977A3A6AB4A9EB9A468B26ACFD98A"><enum>(C)</enum><text>the protected individual is in danger of abuse or neglect at the hands of the family member, or is a danger to themselves or others.</text>
 </subparagraph></paragraph></subsection><subsection id="H1632B661C38D4C4D847020C71BCB3421"><enum>(b)</enum><header>Prohibition on separation</header><text>An agency may not remove a protected individual from a family member solely for the policy goal of deterring individuals from migrating to the United States or for the policy goal of promoting compliance with civil immigration laws.</text>
 </subsection><subsection id="H805584609DFC46D794DD7B706A1C4DE7"><enum>(c)</enum><header>Documentation required</header><text>The Secretary shall ensure that a separation under subsection (a)(3) is documented in writing and includes, at a minimum, the reason for such separation, together with the stated evidence for such separation.</text>
 </subsection></section><section id="HC34FC5554576419198DB3CC509D369E2"><enum>3.</enum><header>Required information for separated families</header><text display-inline="no-display-inline">Not less frequently than once every month, the Secretary shall provide the family member of a protected individual who was separated, the following information, at a minimum:</text>
 <paragraph id="HBF8211D0179043F3BF716B418111CBF3"><enum>(1)</enum><text>A status report on the monthly activities of the protected individual.</text> </paragraph><paragraph id="HEE732192D6304B53BE9ABA0B9AD78D2B"><enum>(2)</enum><text>Information about the education and health of the protected individual, including any medical treatment provided to the individual or medical treatment recommended for the individual.</text>
 </paragraph><paragraph id="H78F277E87EBE476C99D34C8C2A1D2746"><enum>(3)</enum><text>Information about changes to the individual’s immigration status, as well as information about the State protection and advocacy office that has monitoring authority.</text>
 </paragraph><paragraph id="H3A8A31063E1A400B9B45C831D1A94939"><enum>(4)</enum><text>Other information about the individual, designed to promote and maintain family reunification, as the Secretary determines in his or her discretion.</text>
 </paragraph></section><section id="H418061CDA4A548DA98DA8FDD60103FD4"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H04683B5FE0DC460A9337B2CA6E9FCAD8"><enum>(1)</enum><header>Agent; officer</header><text>The terms <quote>agent</quote> and <quote>officer</quote> include contractors of the Federal Government.</text>
 </paragraph><paragraph id="HC57F5BA10E8C4433887C85904F37EC9C"><enum>(2)</enum><header>Danger of abuse or neglect at the hands of the family member</header><text>The term <quote>danger of abuse or neglect at the hands of the family member</quote> shall not mean migrating to or crossing the United States border.</text> </paragraph><paragraph id="H6F5AA810AED749AA8A585F28BE3884BB"><enum>(3)</enum><header>Designated agency</header><text>The term <quote>designated agency</quote> means—</text>
 <subparagraph id="H025D6286C7E1431F92C87C39057F84DB"><enum>(A)</enum><text>the Department of Homeland Security;</text> </subparagraph><subparagraph id="H9F5DC6EA19984454A9493207B4A2A7C3"><enum>(B)</enum><text>the Department of Justice; and</text>
 </subparagraph><subparagraph id="HDB5658AE104B4B3CA23D5552F0117041"><enum>(C)</enum><text>the Department of Health and Human Services.</text> </subparagraph></paragraph><paragraph id="HCA272BDD9C204405BE6E0E258E204C23"><enum>(4)</enum><header>Disabilities specialist</header><text>The term <quote>disabilities specialist</quote> means an individual with expertise working with individuals with a disability who is—</text>
 <subparagraph id="H44581DFDBD9B46C5BCDCD38D71B52FB6"><enum>(A)</enum><text>a physician;</text> </subparagraph><subparagraph id="HADCD144073AB4E14B11431AC4BF151CF"><enum>(B)</enum><text>an osteopath; or</text>
 </subparagraph><subparagraph id="H6805E16B7DCA4B1EB9E0BB8B9AA79FAC"><enum>(C)</enum><text>a psychologist.</text> </subparagraph></paragraph><paragraph id="H7733541018D04B8DA236FA219924DE91"><enum>(5)</enum><header>Finding</header><text>The term <quote>finding</quote> means an individualized written assessment or screening by the trained agent or officer that includes a consultation with a disabilities specialist, formalized as required under section 1(c).</text>
 </paragraph><paragraph id="HA1A382EE6B56450E815196FF62CC9898"><enum>(6)</enum><header>Protected individual</header><text>The term <quote>protected individual</quote> means an individual who—</text> <subparagraph id="HD578BA2645C84A7EBDA2D5A9D05C8F6F"><enum>(A)</enum><text>has an developmental disability; and</text>
 </subparagraph><subparagraph id="H7F90F213A8A847BEAA620D6FA98FA576"><enum>(B)</enum><text>has no permanent immigration status.</text> </subparagraph></paragraph><paragraph id="HAFFE7C9A79C54F99BE30F2FEBD7D16A8"><enum>(7)</enum><header>Secretary</header><text>Unless otherwise specified, the term <quote>Secretary</quote> means the Secretary of Homeland Security.</text>
