			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require reports by the Secretary of State, the Secretary of the Treasury, and the Director of
			 National Intelligence relating to construction of the Nord Stream 2
			 pipeline, and for other purposes.</official-title></form>
	<legis-body id="H1E0CE5EA3B6B4C3799FE4F17C31F1303" style="OLC">
 <section id="H847EEDC87A61461F9A69885DF206A887" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect European Energy Security Act</short-title></quote>.</text> </section><section id="H5E4F6EA8CD014C59BE85D31571CD5F14"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="H76F13ECCEC7B45F29AC904DE2FE96913"><enum>(1)</enum><text display-inline="yes-display-inline">The Russian Federation is proposing to construct a gas pipeline from Russia to Germany, named the Nord Stream 2 pipeline, the completion of which could address potential increases in European energy consumption but also increase European dependence on Russian energy and have destabilizing effects on the Government of Ukraine if Ukraine loses energy transit fees as a result of construction of the Nord Stream 2 pipeline.</text>
 </paragraph><paragraph id="HDDF94617F8D944839C860A8897E14915"><enum>(2)</enum><text>According to experts, the Nord Stream 2 pipeline would transport 80 percent of Russia’s current gas exports to Europe through one single pipeline system, which would run counter to the European Union energy policy of energy security and diversification of supply.</text>
 </paragraph><paragraph id="H522EBBFD28FE4F9A9F225514D3F77ACB"><enum>(3)</enum><text>Section 257(a) of the Countering America’s Adversaries through Sanctions Act of 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/44">Public Law 115–44</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/9546">22 U.S.C. 9546(a)</external-xref>) states in part that it is the policy of the United States—</text>
 <subparagraph id="HEBF8A98E6D0E44E9B5D46258BBB81D58"><enum>(A)</enum><text><quote>to work with European Union member states and European Union institutions to promote energy security through developing diversified and liberalized energy markets that provide diversified sources, suppliers, and routes</quote>; and</text>
 </subparagraph><subparagraph id="HF090FCDDCD894B21BF82000F64B42B94"><enum>(B)</enum><text><quote>to continue to oppose [the Nord Stream 2 pipeline] given its detrimental impacts on the European Union’s energy security, gas market development in Central and Eastern Europe, and energy reforms in Ukraine</quote>.</text>
 </subparagraph></paragraph><paragraph id="HA73E6360697B4CBCB4433A8517118F25"><enum>(4)</enum><text>On January 27, 2018, then-Secretary of State Rex Tillerson stated, <quote>[T]he United States opposes the Nord Stream 2 pipeline. We see it as undermining Europe’s overall energy security and stability …</quote>. Tillerson further stated that the pipeline would allow Putin to use energy as a <quote>political tool</quote>.</text>
 </paragraph><paragraph id="HE6BA9E8A792C4114AAEF2ED9CA3355AB"><enum>(5)</enum><text>On March 11, 2018, German chancellor Angela Merkel acknowledged <quote>political</quote> and <quote>strategic</quote> concerns regarding the Nord Stream 2 pipeline and stated that the pipeline <quote>is not just an economic project, but that, of course, political factors must also be taken into account</quote>.</text>
 </paragraph><paragraph id="H6AA059B4C2FF4610A1B3782E812C4D28"><enum>(6)</enum><text>Gazprom, a Russian energy company, is controlled by the Government of the Russian Federation, which, according to the European Commission’s Statement of Objections to Gazprom dated April 22, 2015, has undertaken efforts to use gas as a weapon of coercion.</text>
 </paragraph><paragraph id="H8A7FAF0EF46B4D0187D632A515CD12C1"><enum>(7)</enum><text display-inline="yes-display-inline">The Department of State, led by the Bureau of Energy of Resources, has worked extensively with allies, including Denmark, to thwart such Russian efforts.</text>
 </paragraph></section><section id="HA356897E7CF34C2B983E6DE332EC0B2D"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the United States should—</text> <paragraph id="H5CC139AB46C646628FA1CB747A9C1101"><enum>(1)</enum><text>continue to oppose construction of the Nord Stream 2 pipeline and other Russian Federation gas pipelines in northern Europe; and</text>
 </paragraph><paragraph id="HFCF33C33144542329B27B9663E08DD27"><enum>(2)</enum><text>take affirmative diplomatic steps to halt the construction of such pipelines.</text> </paragraph></section><section id="H1A6690C13ECA45979331CB2CCB1E5B73"><enum>4.</enum><header>Reporting requirements</header> <subsection id="H7250786494C446839854A72812247A06"><enum>(a)</enum><header>Report by Secretary of State</header> <paragraph id="H2A9C9D4B6D6A42D1AEC348758D698E6B"><enum>(1)</enum><header>In general</header><text>The Secretary of State, in coordination with the Secretary of the Treasury, shall submit to the appropriate congressional committees a report on actions the Department of State is taking to implement section 257 of the Countering America’s Adversaries through Sanctions Act of 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/44">Public Law 115–44</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/9546">22 U.S.C. 9546</external-xref>).</text>
 </paragraph><paragraph id="H8618F0F818DC4290B49F6D4E52F40250"><enum>(2)</enum><header>Elements</header><text>The report shall include details on the following:</text> <subparagraph id="H4F467BAC5CBD45A4AD06AC47FF5BE970"><enum>(A)</enum><text display-inline="yes-display-inline">Efforts by the Department of State since August 3, 2017, to work with European Union member states and institutions to promote energy security and decrease their dependence on Russian sources of energy, including use of the Countering Russian Influence Fund authorized pursuant to section 254 of the Countering America’s Adversaries through Sanctions Act of 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/44">Public Law 115–44</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/9543">22 U.S.C. 9543</external-xref>).</text>
 </subparagraph><subparagraph id="HD385DC6CA0184734BFE8C5479F8BA388"><enum>(B)</enum><text>Diplomatic efforts undertaken by the Department of State to oppose directly the Nord Stream 2 pipeline and the Turk Stream pipeline.</text>
 </subparagraph><subparagraph id="HDEA04393953C47339DAF8C1BFCA7B07F"><enum>(C)</enum><text>An estimation of European natural gas supply demand from 2019 through 2023.</text> </subparagraph></paragraph></subsection><subsection id="HFB1F1594864A4EFF8AC42AE72BD766B5"><enum>(b)</enum><header>Report by Secretary of the Treasury</header> <paragraph id="H83C92DAB8EDF47F288A53D0BAEDF3FB1"><enum>(1)</enum><header>In general</header><text>The Secretary of Treasury, in coordination with the Secretary of State, shall submit to the appropriate congressional committees a report on each entity involved in construction of the Nord Stream 2 pipeline or construction of the Turk Stream pipeline.</text>
 </paragraph><paragraph id="HA3A77B202CB14C8FB0DDEF6BBB4097CB"><enum>(2)</enum><header>Entity defined</header><text>In this subsection, the term <term>entity</term>—</text> <subparagraph id="H6EFE439431084E6A888C311274A5637E"><enum>(A)</enum><text>means an entity organized under the laws of the United States; and</text>
 </subparagraph><subparagraph id="H0B5AFACE3B6F4ABCBDAE519AEE568469"><enum>(B)</enum><text>includes, with respect to the entity, a sub entity, parent entity, subsidiary, or any other entity.</text> </subparagraph></paragraph></subsection><subsection id="HA5BB3E67500943C19C3C250E83D4AB5A"><enum>(c)</enum><header>Report by Director of National Intelligence</header><text display-inline="yes-display-inline">The Director of National Intelligence, in coordination with the Secretary of Defense, shall submit to the appropriate congressional committees a report on the impact of the Nord Stream 2 pipeline on—</text>
 <paragraph id="H4E6CDDA48C814809BED5A0FAFE320757"><enum>(1)</enum><text>United States interests and security objectives;</text> </paragraph><paragraph id="H7FB72D2971AD4C5F848A51A7A177B595"><enum>(2)</enum><text display-inline="yes-display-inline">European energy security and defense posture;</text>
 </paragraph><paragraph id="HF242923712E7490EA87BC5AAB4EF4CEE"><enum>(3)</enum><text>Russian influence in Europe; and</text> </paragraph><paragraph id="H61580062FD9245AD9512D75E15C7ECAA"><enum>(4)</enum><text>Ukraine, including the implications of reductions in transit fees as a result of Nord Stream 2 pipeline.</text>
 </paragraph></subsection><subsection id="H7A5C2C0D08234C4CB86BE822F1C74FE5"><enum>(d)</enum><header>Form</header><text>The reports required by this section shall be submitted in unclassified form, but may contain a classified annex.</text>
 </subsection><subsection id="H3B6E3AFFE02C46ECAF2BDE02F469F25B"><enum>(e)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="H09ED8F04DDA3493AA6FCD53A0B66665C"><enum>(1)</enum><text>in the House of Representatives—</text>
 <subparagraph id="HB952BD5713A74FFA8E555EAA4666CCCF"><enum>(A)</enum><text>the Committee on Armed Services;</text> </subparagraph><subparagraph id="H73252281AA8B44C6B574FA440724DF8A"><enum>(B)</enum><text>the Committee on Foreign Affairs;</text>
 </subparagraph><subparagraph id="HDC3EAFE334534740B2E0D63D0366CF63"><enum>(C)</enum><text>the Committee on Financial Services;</text> </subparagraph><subparagraph id="HB3CD2CCBAD8146EFB429E49C226138D6"><enum>(D)</enum><text>the Committee on Energy and Commerce; and</text>
 </subparagraph><subparagraph id="HDE06AC8A106749B1BE68FD2FE93307BF"><enum>(E)</enum><text>the Permanent Select Committee on Intelligence; and</text> </subparagraph></paragraph><paragraph id="H8F51E892A8F34D608FDC5EF6BE7D2AE4"><enum>(2)</enum><text>in the Senate—</text>
 <subparagraph id="H49F53D493F6C493E8649051220B81268"><enum>(A)</enum><text>the Committee on Armed Services;</text> </subparagraph><subparagraph id="HE488699F3CE8415A8B107F4F2F201C3C"><enum>(B)</enum><text>the Committee on Foreign Relations;</text>
 </subparagraph><subparagraph id="H35EB66E2F53F4B818D849FE73BAD683C"><enum>(C)</enum><text>the Committee on Finance;</text> </subparagraph><subparagraph id="HBD16D931605E4727B9AFA493B9E2414C"><enum>(D)</enum><text>the Committee on Banking, Housing, and Urban Affairs; and</text>
 </subparagraph><subparagraph id="H7847E5980C564424BD50C197153053AF"><enum>(E)</enum><text>the Select Committee on Intelligence.</text> </subparagraph></paragraph></subsection></section></legis-body></bill>
