Short title
This Act may be cited as the Puerto Rico Data Collection Equality Act of 2018. (b)

<enum>I</enum><header>Matters related to Federal Statistical Programs</header> <section id="HB403E8BD38654BA0928F6C2AF2AEF25C"><enum>101.</enum><header>Plan to include the Commonwealth of Puerto Rico in Federal statistical programs</header> <subsection id="HDB12806472D94AACB1AD46A092EDB3BF"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">The head of the Interagency Council on Statistical Policy shall develop a plan to collect and publish statistics regarding the Commonwealth of Puerto Rico in the same manner as statistics are collected and reported by Federal agencies for the several States.</text> </subsection><subsection id="H0B9F5788AF784F7CAA0CDCBEB35156C5"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The head of the Interagency Council on Statistical Policy, in coordination with the heads of appropriate Federal agencies, shall implement the plan developed under subsection (a).</text> </subsection><subsection id="H996EA4D847584A00AF44D85BA897F429"><enum>(c)</enum><header>Report</header><text>Not later than two years after the date of the enactment of this Act, and every two years thereafter, the head of the Interagency Council on Statistical Policy shall submit to Congress a report which shall include—</text> <paragraph id="HDCE4CB7FC7EE4C4A9F9E2AA2C1B0C611"><enum>(1)</enum><text>a description of the plan developed under subsection (a); and</text> </paragraph><paragraph id="HFDAB9D9C597B41F5B84137785D5B59AC"><enum>(2)</enum><text display-inline="yes-display-inline">information on the implementation of such plan.</text> </paragraph></subsection></section><section id="HDD9D90A5291B4D9F85137F8A4765E22F" section-type="subsequent-section"><enum>102.</enum><header>Statistics to be collected and reported by the Census Bureau</header> <subsection id="H5BEADEBC1A024A519249DC59D2DF656E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Bureau of the Census, in consultation with the heads of appropriate Federal agencies, shall include statistics regarding the Commonwealth of Puerto Rico collected and reported by the Bureau as part of the statistical programs described in subsection (b).</text> </subsection><subsection id="HFAC9A0551B2442C1811E5D93073FD821"><enum>(b)</enum><header>Statistical programs described</header><text>The statistical programs described in this subsection include the following:</text> <paragraph id="HD1CCCF714F65469BAEB2028B8FAF9B85"><enum>(1)</enum><text>Census of Governments.</text> </paragraph><paragraph id="H877FA3DED6244567B0D7B6A306A5940C"><enum>(2)</enum><text>Survey of Business Owners and Self-Employed Persons.</text> </paragraph><paragraph id="HAC27AC0A1CA44CF2A6B0781F1A7681F2"><enum>(3)</enum><text>Building Permits Survey.</text> </paragraph><paragraph id="HF9F80248DFC1448B9AE1B7D06CCB11CE"><enum>(4)</enum><text>Quarterly Workforce Indicators.</text> </paragraph><paragraph id="H5B311C39C98A402BAB4A095CC8BBB517"><enum>(5)</enum><text>American Housing Survey.</text> </paragraph><paragraph id="HA8D629E0DAB4477AA2D1C2113C937632"><enum>(6)</enum><text>Construction Progress Reporting Survey.</text> </paragraph><paragraph id="HC6C7317E1D5C433DBDCBAD9D532F41CA"><enum>(7)</enum><text>Housing Vacancy Survey.</text> </paragraph><paragraph id="H9277045DED5142F795B0A62DFCA95860"><enum>(8)</enum><text>Manufactured Housing Survey.</text> </paragraph><paragraph id="HFC27D5D0CF4942B0A7289C1FF5C5BC34"><enum>(9)</enum><text>Value of Construction Put in Place Survey.</text> </paragraph><paragraph id="HEDF7430BB05E4A539E35F0644E4BAA4A"><enum>(10)</enum><text>Current Population Survey.</text> </paragraph></subsection><subsection id="HDA8D741CCE794BE3BE129C123C8044E3"><enum>(c)</enum><header>National Economic Census</header><text display-inline="yes-display-inline">The Director of the Bureau of the Census shall—</text> <paragraph id="H6069D218257E4C278F50D722F4D55778"><enum>(1)</enum><text>collect and report statistics regarding the Commonwealth of Puerto Rico for the Economic Census of Island Areas in a manner consistent, in terms of both substance and timing, with the collection and reporting of statistics for the National Economic Census; and</text> </paragraph><paragraph id="HEFBADB1D128B46A2946C84497047B439"><enum>(2)</enum><text>not later than 1 year after the date of enactment of this Act, submit to Congress a report recommending whether statistics regarding the Commonwealth of Puerto Rico should be included in the National Economic Census rather than in the Economic Census of Island Areas.</text> </paragraph></subsection></section><section id="H9FB40079988E49FB872BA73022A56B09" section-type="subsequent-section"><enum>103.</enum><header>National Center for Education Statistics treatment of the Commonwealth of Puerto Rico</header><text display-inline="no-display-inline">The Secretary of Education, acting through the National Center for Education Statistics, shall, to the maximum extent practicable, collect and publish data for the Commonwealth of Puerto Rico in the same manner as data is collected and published for the several States.</text> </section><section id="H7FEC9A9B5CBD46549416887B3932064D"><enum>104.</enum><header>National Agricultural Statistics Service treatment of the Commonwealth of Puerto Rico</header> <subsection id="HEF350A7F15B04F9FA3D5C278A781D87D"><enum>(a)</enum><header>Surveys in the Commonwealth of Puerto Rico</header><text display-inline="yes-display-inline">The Administrator of the National Agricultural Statistics Service shall—</text> <paragraph id="H7AE4092AE0B3437B85D8B3D4550B7898"><enum>(1)</enum><text>include, to the maximum extent practicable, the Commonwealth of Puerto Rico in the surveys conducted by the Service; and</text> </paragraph><paragraph id="H2B5BEE8418C5472CBBB69CD48BE7ECDC"><enum>(2)</enum><text>in the case of agricultural data collection that cannot be carried out under the surveys described in paragraph (1), identify an alternative method of collecting such data from the Commonwealth of Puerto Rico.</text> </paragraph></subsection><subsection id="H878EAB993D8A4BEA9A4ECFCB33461B61"><enum>(b)</enum><header>Report on feasibility of surveys in the Commonwealth of Puerto Rico</header><text>Not later than 1 year after the date of the enactment of this Act, the Administrator of the National Agricultural Statistics Service shall submit a report to Congress that includes recommendations on the feasibility of conducting surveys in the Commonwealth of Puerto Rico.</text> </subsection></section><section display-inline="no-display-inline" id="H75568D6A4A794FD5B714AA569831E989" section-type="subsequent-section"><enum>105.</enum><header>Substance Abuse and Mental Health Services Administration: National Survey on Drug Use and Health</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Assistant Secretary for Mental Health and Substance Use shall submit to each committee of the Congress a report on the status of efforts to include the populations of the Commonwealth of Puerto Rico and the other territories of the United States in the National Survey on Drug Use and Health for fiscal year 2019 and subsequent fiscal years.</text> </section><section display-inline="no-display-inline" id="H0BC2EB233193451DBE0F3298D5E7270D"><enum>106.</enum><header>National Center for Health Statistics treatment of the Commonwealth of Puerto Rico</header><text display-inline="no-display-inline">Section 306 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k</external-xref>) is amended—</text> <paragraph id="H8F776F27B31E49838D11A03EAA621A5F"><enum>(1)</enum><text>by redesignating subsection (n) as subsection (o); and</text> </paragraph><paragraph id="HD92BD52A0387481BAEF21895ED711572"><enum>(2)</enum><text>by inserting after subsection (m) the following:</text> <quoted-block display-inline="no-display-inline" id="H6DBDFF7C6D40423EAED9A09C74446FD4" style="OLC"> <subsection id="H870923E12B52478F987EB7C3F6B70E05"><enum>(n)</enum><text display-inline="yes-display-inline">In carrying out this section, the Secretary, acting through the Center, shall take all reasonable steps to collect, evaluate, and make available information with respect to the populations of the Commonwealth of Puerto Rico and the other territories to the same extent as the Secretary collects, evaluates, and makes available information with respect to the populations of the several States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section display-inline="no-display-inline" id="HFE63D82F5791478FB51F4FEACE66296B" section-type="subsequent-section"><enum>107.</enum><header>Bureau of Justice inclusion of Puerto Rico in justice statistics</header><text display-inline="no-display-inline">Section 302(d) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10132">34 U.S.C. 10132(d)</external-xref>) is amended by inserting after paragraph (2) the following:</text> <quoted-block display-inline="no-display-inline" id="H29D1932CACD14456BE15F71CE8751C83" style="OLC"> <paragraph id="HEB53727DDC5741D2934DC2961BBB3A54"><enum>(3)</enum><header>Inclusion of Puerto Rico in justice statistics</header><text display-inline="yes-display-inline">To the extent practicable, the Director shall gather information from Puerto Rico in carrying out the statistical collection, analysis, and dissemination functions of the Bureau.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="HF24E2769F6684765823465F067405296"><enum>108.</enum><header>Energy Information Administration treatment of Puerto Rico</header><text display-inline="no-display-inline">The Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall annually update the data and information included on the website of the Energy Information Administration in order to ensure, to the extent practicable, that the data and information included on the website with respect to Puerto Rico is as inclusive and complete as the data and information included on the website with respect to any State.</text> </section><enum>II</enum><header>Matters related to the Puerto Rico Institute of Statistics</header> <section commented="no" id="H39D11FEDB05F4941A3A89678B792A6EF"><enum>201.</enum><header>Puerto Rico Institute of Statistics</header> <subsection commented="no" id="H501D3E4F7C794D48A18E2387C110A1EE"><enum>(a)</enum><header>Covered territorial instrumentality</header><text display-inline="yes-display-inline">The Puerto Rico Institute of Statistics is deemed to be a covered territorial instrumentality subject to the requirements of PROMESA (<external-xref legal-doc="usc" parsable-cite="usc/48/2101">48 U.S.C. 2101</external-xref>, et seq.).</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H02906F11D61A49C2A38550EB55C0E4A3"><enum>(b)</enum><header>Report on Instrumentality Budget Funding Level</header><text>Not later than December 31 of the first full year after the date of the enactment of this Act and of each year thereafter, the Oversight Board of Puerto Rico shall submit to Congress a report on the Oversight Board’s rational, with supporting documentation, for the funding level for the Puerto Rico Institute of Statistics in the most recent approved budget.</text> </subsection><subsection commented="no" id="H407A7FDE58B9410EBAF7DFB443518FAC"><enum>(c)</enum><header>Information required To be available in English</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Puerto Rico Institute of Statistics shall—</text> <paragraph commented="no" id="HF22FE2FF016C4B12BB3562ACF01A3BC1"><enum>(1)</enum><text>make all communications, publications, information, and other records of the institute created after the date of the enactment of this Act available in English to the same or a greater extent as those materials are available in Spanish; and</text> </paragraph><paragraph commented="no" id="HFFE784F98D604C0A8AB99F7201DA3234"><enum>(2)</enum><text display-inline="yes-display-inline">publish a plan to make all communications, publications, information, and other records of the institute created before the date of the enactment of this Act available in English to the same or a greater extent as those materials are available in Spanish.</text> </paragraph></subsection></section><enum>III</enum><header>Matters related to Puerto Rico’s Economy </header> <section display-inline="no-display-inline" id="H23E730962AFD432BBAD138F1E9A8F344" section-type="subsequent-section"><enum>301.</enum><header>Annual update of the Report on the Competitiveness of Puerto Rico’s Economy</header><text display-inline="no-display-inline">The Federal Reserve Bank of New York shall annually update the report titled <quote>Report on the Competitiveness of Puerto Rico’s Economy</quote> (published June 29, 2012).</text> </section><section id="HEF970670B3B04045BBC4A0EDD8A2CB65"><enum>302.</enum><header>Effect of electric power on the economic growth of Puerto Rico</header><text display-inline="no-display-inline">The Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall annually submit to Congress a report on the cost and unreliability of electric power in Puerto Rico and how such cost and unreliability affects the economic growth of Puerto Rico.</text> </section>
