			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to authorize hospitals to dispose of controlled substances
			 on behalf of patients who die at the hospital, and for other purposes.</official-title></form>
	<legis-body id="HAE331EE29CE24D77A489B75C3139FF74" style="OLC">
 <section id="HCB1F2E495EB64ABB8BD0AA7BFF36FDC9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disposal of Opioids Safely and Effectively Act of 2018</short-title></quote> or the <quote><short-title>DOSE Act</short-title></quote>.</text> </section><section id="H42892B52A2BE409FB5BDE34242E2A26F"><enum>2.</enum><header>Disposal by a hospital of controlled substances on behalf of patients who die at the hospital</header> <subsection id="H222FF306EDB94F099C179E8F87AA8225"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 302(g)(3) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/822">21 U.S.C. 822(g)(3)</external-xref>) is amended—</text>
 <paragraph id="H86FB9A4DB0044FA18318E0D081A1DEDD"><enum>(1)</enum><text>by striking <quote>(3)</quote> and inserting <quote>(3)(A)</quote>; and</text> </paragraph><paragraph id="H45DEF0E27E7941EDB465A42EED4D3C62"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H25F0F9D3F56E42B3BA927C9C08A39017" style="OLC">
 <subparagraph id="H0E572BB791CC48EBA50DB55156C4F9C2" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">The Attorney General may, by regulation, authorize hospitals, as defined by the Attorney General by regulation, to dispose of controlled substances—</text>
 <clause id="HF951D41F6F934782B39EE01F62224212"><enum>(i)</enum><text>on behalf of individuals who are admitted (whether as an inpatient or outpatient) to the respective hospital and die before discharge from the hospital; and</text>
 </clause><clause id="H46DE4C7A0BBC4AA79CA5F5015A74D03E"><enum>(ii)</enum><text>in a manner that the Attorney General determines will provide effective controls against diversion and be consistent with the public health and safety.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H73EDF978303147DEA744B3065025DF90"><enum>(b)</enum><header>No order form required</header><text>Section 308(b)(3) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/828">21 U.S.C. 828(b)(3)</external-xref>) is amended by inserting <quote>hospital,</quote> after <quote>long-term care facility,</quote>.</text> </subsection></section></legis-body></bill>
