 <section id="H5C528E3EDB994EF1A522EFED7DD37662" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Codifying President Trump’s Affording Congress an Opportunity to Address Family Separation Executive Order Act</short-title></quote>.</text>
		</section><section id="HDEDC1EC6E5BF4D65ADC0F8145207472B" section-type="subsequent-section"><enum>2.</enum>
 <header>Keeping illegal alien families together while detained</header><text display-inline="no-display-inline">At the end of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>), insert the following:</text> <quoted-block display-inline="no-display-inline" id="idCB3072BCD6334D229BB142D890022F2E" style="OLC"> <section display-inline="no-display-inline" id="HC3AA9F1349954B0D8BBC15E1821DAC6D"><enum>601.</enum> <header>Findings</header><text display-inline="no-display-inline">Congress finds it to be the policy of the United States to rigorously enforce our immigration laws. Under our laws, the only legal way for an alien to enter this country is at a designated port of entry at an appropriate time. When an alien enters or attempts to enter the country anywhere else, that alien has committed at least the crime of improper entry and is subject to a fine or imprisonment under section 1325(a) of title 8, United States Code. This Administration will initiate proceedings to enforce this and other criminal provisions of the INA until and unless Congress directs otherwise. It is also the policy of this Administration to maintain family unity, including by detaining alien families together where appropriate and consistent with law and available resources. It is unfortunate that Congress's failure to act and court orders have put the Administration in the position of separating alien families to effectively enforce the law.</text>
 </section><section id="idC8B78FBD4E494B988B7EB37C433EB6E5"><enum>602.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following definitions apply:</text> <subsection id="H8483B9135CCE4D13BD143F7C5F2E9097"><enum>(a)</enum><text display-inline="yes-display-inline"><term>Alien family</term> means—</text>
 <paragraph id="idC3921E87EE6242EEBF6260DDEFB5BF25"><enum>(1)</enum><text>any person not a citizen or national of the United States who has not been admitted into, or is not authorized to enter or remain in, the United States, who entered this country with an alien child or alien children at or between designated ports of entry and who was detained; and</text>
 </paragraph><paragraph id="idAFB5021DF0E2413E9DB9647B56B4F7D5"><enum>(2)</enum><text>that person's alien child or alien children.</text> </paragraph></subsection><subsection id="H0F11496B42DB479A96B841B5091548BD"><enum>(b)</enum> <text><term>Alien child</term> means any person not a citizen or national of the United States who—</text>
						<paragraph id="H645DC22766D3474DB5D7A290FE660D0E"><enum>(1)</enum>
 <text>has not been admitted into, or is not authorized to enter or remain in, the United States;</text> </paragraph><paragraph id="HDA72DE8C17424DDCAC7E43D143FB86B9"><enum>(2)</enum> <text>is under the age of 18; and</text>
 </paragraph><paragraph id="id6A583CA8C2864338AEEF4FAE5197E4AB"><enum>(3)</enum><text>has a legal parent-child relationship to an alien who entered the United States with the alien child at or between designated ports of entry and who was detained.</text>
						</paragraph></subsection></section><section id="HD2B6862942484ADF80184706CBF3E601"><enum>603.</enum>
					<header>Temporary detention policy for families entering this country illegally</header>
 <subsection id="H1BC1496470494D26B9DF0BE45A6138DB"><enum>(a)</enum><text>The Secretary of Homeland Security (Secretary), shall, to the extent permitted by law and subject to the availability of appropriations, maintain custody of alien families during the pendency of any criminal improper entry or immigration proceedings involving their members.</text>
 </subsection><subsection id="idBF36C05A78AC40B1B757A8821DCBDA00"><enum>(b)</enum><text>The Secretary shall not, however, detain an alien family together when there is a concern that detention of an alien child with the child's alien parent would pose a risk to the child's welfare.</text>
 </subsection><subsection id="idC2E9FEFD20A74881823607E7A336DA39"><enum>(c)</enum><text>The Secretary of Defense shall take all legally available measures to provide to the Secretary, upon request, any existing facilities available for the housing and care of alien families, and shall construct such facilities if necessary and consistent with law. The Secretary, to the extent permitted by law, shall be responsible for reimbursement for the use of these facilities.</text>
 </subsection><subsection id="id9AC5BD65F0CC4C978430696D9C3CA991"><enum>(d)</enum><text>Heads of executive departments and agencies shall, to the extent consistent with law, make available to the Secretary, for the housing and care of alien families pending court proceedings for improper entry, any facilities that are appropriate for such purposes. The Secretary, to the extent permitted by law, shall be responsible for reimbursement for the use of these facilities.</text>
 </subsection><subsection id="idAF2E4E00500E493794B7AC96EAE82084"><enum>(e)</enum><text>The Attorney General shall promptly file a request with the U.S. District Court for the Central District of California to modify the Settlement Agreement in Flores v. Sessions, CV 85–4544 (<quote>Flores settlement</quote>), in a manner that would permit the Secretary, under present resource constraints, to detain alien families together throughout the pendency of criminal proceedings for improper entry or any removal or other immigration proceedings.</text>
					</subsection></section><section id="HDDBEF1DB56974F4BA7E9AA1F00139EC3"><enum>604.</enum>
 <header>Prioritization of immigration pro­ceed­ings involving alien families</header><text display-inline="no-display-inline">The Attorney General shall, to the extent practicable, prioritize the adjudication of cases involving detained families.</text>
				</section><section id="id426B83BE238D4D318571E099A3A47C94"><enum>605.</enum><header>General provisions</header>
 <subsection id="id9C7A7E5CE54D4C8D834318641750DEBF"><enum>(a)</enum><text>Nothing in this bill shall be construed to impair or otherwise affect—</text> <paragraph id="H7CCBE3A29B614F5F9E29266132EAB377"><enum>(1)</enum><text>the authority granted by law to an executive department or agency, or the head thereof; or</text>
						</paragraph><paragraph id="HBAB56AD3DCB941A7A171C706F89C2CD4"><enum>(2)</enum>
 <text>the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
