			 checks prepared for employment purposes, and for other purposes.</official-title></form>
	<legis-body id="HB4756148C160494A83C26761863ED526" style="OLC">
 <section id="HABDB0338983A4D6F9880528523C51371" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness and Accuracy in Employment Background Checks Act of 2018</short-title></quote>.</text> </section><section id="H32B89C4F81004AD096E8F20F5364529D"><enum>2.</enum><header>Safeguards for background checks</header><text display-inline="no-display-inline">The Attorney General shall establish and enforce procedures to ensure the prompt release of accurate records and information exchanged for employment-related purposes through the records system created under section 534 of title 28, United States Code.</text>
 </section><section id="H55316F9514704AF093D00C0A142AC103"><enum>3.</enum><header>Required procedures</header><text display-inline="no-display-inline">The procedures established under section 2 shall include the following:</text> <paragraph id="HF8D6551439EF4197BAE1E60548726955"><enum>(1)</enum><header>Inaccurate record or information</header><text display-inline="yes-display-inline">If the Attorney General determines that a record or information is inaccurate, the Attorney General shall promptly correct that record or information or, if appropriate, promptly make any changes or deletions to the records or information.</text>
			</paragraph><paragraph id="H83703F0659F9456482BC13223283B64D"><enum>(2)</enum><header>Incomplete record or information</header>
 <subparagraph display-inline="no-display-inline" id="H0360FDF0E6754346A8D513BACC5FBEF6"><enum>(A)</enum><text>If the Attorney General determines that a record or information is incomplete or cannot be verified, the Attorney General shall attempt to complete or verify the record or information, and if the Attorney General is unable to do so, the Attorney General may promptly make any changes or deletions to the record or information.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="HE99EA3A8E86D427E89224EE05DC9AD1C"><enum>(B)</enum><text display-inline="yes-display-inline">For the purposes of this paragraph, an incomplete record or information includes a record or information that indicates there was an arrest and does not include the disposition of that arrest.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H33BF76CBD3BC4C6A81A7BDAE8F7B9309"><enum>(C)</enum><text>If the record or information is an incomplete record or information described in subparagraph (B), the Attorney General shall, not later than 10 days after the requesting entity requests the exchange and before the exchange is made, obtain the disposition (if any) of the arrest.</text>
 </subparagraph></paragraph><paragraph id="H9851DD10916448E6AB4C9495E34F6E40"><enum>(3)</enum><header>Notification of reporting jurisdiction</header><text>The Attorney General shall notify each appropriate reporting jurisdiction of any action taken under paragraph (1) or (2).</text>
 </paragraph><paragraph id="H2DFF7FE873FC4B65A8A9F93388355679"><enum>(4)</enum><header>Opportunity to review records or information by applicant</header><text display-inline="yes-display-inline">In connection with an exchange of such a record or information, the Attorney General shall—</text> <subparagraph id="H8F7CDF72959B4799AE7D35C9431E45AB"><enum>(A)</enum><text>obtain the consent of the applicant to exchange the record or information with the requesting entity;</text>
 </subparagraph><subparagraph commented="no" id="HBDAB6BC61D7A48A5A0B3BDE6F8AEDCA4"><enum>(B)</enum><text>at the time of consent, notify the applicant that the applicant can obtain a copy of the record or information;</text>
 </subparagraph><subparagraph id="HC560BE621AEE4117BFF9C7853D955947"><enum>(C)</enum><text>provide to the applicant an opportunity to obtain a copy of the record or information upon request and to challenge the accuracy and completeness of that record or information;</text>
 </subparagraph><subparagraph id="H3EB91C9DB28048D68002C56E03C2C94B"><enum>(D)</enum><text display-inline="yes-display-inline">promptly notify the requesting entity of any such challenge;</text> </subparagraph><subparagraph id="H4B157E417C304898A3E9C5C04311C1F8"><enum>(E)</enum><text>not later than 30 days after the challenge is made, complete an investigation of the challenge;</text>
 </subparagraph><subparagraph id="HDF25EE765A344D6595F70CC57AD096BC"><enum>(F)</enum><text>provide to the applicant the specific findings and results of that investigation;</text> </subparagraph><subparagraph id="H97B8B652F66948DEA3497D3860F65AC4"><enum>(G)</enum><text>promptly make any changes or deletions to the records or information required as a result of the challenge; and</text>
 </subparagraph><subparagraph id="HBF11804FAFA740EA85561AB71B6AA7C1"><enum>(H)</enum><text display-inline="yes-display-inline">report those changes to the requesting entity.</text> </subparagraph></paragraph><paragraph id="HFC64665BD17F46D29E38973A8B02F2B3"><enum>(5)</enum><header>Certain exchanges prohibited</header><text>An exchange shall not include any record or information—</text>
 <subparagraph id="HE57A5285F38B44178FBFB1FD9053BA47"><enum>(A)</enum><text>about an arrest more than one-year-old as of the date of the request for the exchange, that does not also include a disposition (if any) of that arrest;</text>
 </subparagraph><subparagraph id="H73E31EA9357A47968B22445FEF663386"><enum>(B)</enum><text display-inline="yes-display-inline">relating to an adult or juvenile non-serious offense of the sort described in section 20.32(b) of title 28, Code of Federal Regulations, as in effect on July 1, 2009; or</text>
 </subparagraph><subparagraph id="HFBDFD024673948E6932CA0387596AE67"><enum>(C)</enum><text>to the extent the record or information is not clearly an arrest or a disposition of an arrest.</text> </subparagraph></paragraph></section><section id="H6E1F91E1CEA448259A016E16C47BA9C4"><enum>4.</enum><header>Fees</header><text display-inline="no-display-inline">The Attorney General may collect reasonable fees for all exchanges of records or information for employment-related purposes through the records system created under section 534 of title 28, United States Code, to defray the costs associated with exchanges for those purposes, including any costs associated with the investigation of inaccurate or incomplete records or information.</text>
 </section><section id="HA03EEEE7D2E747DB87F4E00B46FAFD7C"><enum>5.</enum><header>Regulations on reasonable procedures</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Attorney General shall issue regulations to carry out this Act.</text>
 </section><section id="HF0025C200D064E2886D0CA9F50163A25"><enum>6.</enum><header>Annual reports on procedures</header><text display-inline="no-display-inline">For each of the first 3 years beginning after the date of enactment of this Act, the Attorney General shall submit an annual report to Congress that includes—</text>
 <paragraph id="HE9BEA174BE954118995EF5B611515AF5"><enum>(1)</enum><text display-inline="yes-display-inline">the number of exchanges of records or information for employment-related purposes made with entities in each State through the records system created under section 534 of title 28, United States Code;</text>
 </paragraph><paragraph id="HCD3016DED8A34B24AE9EFDD34639E893"><enum>(2)</enum><text>appropriate statistical information to determine whether the exchange of records or information about arrests that did not result in convictions is affecting the employment opportunities of employees to whom those records or information pertain;</text>
 </paragraph><paragraph id="H13DE2DC273B3403B9224E6A07484F5F3"><enum>(3)</enum><text>any prolonged failure of a reporting jurisdiction to comply with a request by the Attorney General for information about dispositions of arrests;</text>
 </paragraph><paragraph id="H2FA49D0BDD104B54BE69B05420CD238C"><enum>(4)</enum><text display-inline="yes-display-inline">the percent of missing arrest dispositions located within the time limit required by this Act; and</text> </paragraph><paragraph id="HBFA50CD19AC74B9785258FFB62BE2C3E"><enum>(5)</enum><text display-inline="yes-display-inline">the numbers of successful and unsuccessful challenges to the accuracy and completeness of records or information, by State where the records and information originated.</text>
			</paragraph></section><section id="H98B78459144A42EFA48D5F8D14B906BA"><enum>7.</enum><header>Report on statutory and regulatory restrictions and disqualifications based on criminal records</header>
 <subsection id="H2DA18A8B26A74A3BA5577EB9272CED5A"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Attorney General shall report to Congress on all Federal statutes, regulations, and policies providing employment restrictions and disqualifications based on criminal records.</text>
 </subsection><subsection id="HF543D19D71C54737898DB3F5886798D5"><enum>(b)</enum><header>Identification of information</header><text display-inline="yes-display-inline">In the report, the Attorney General shall identify each occupation or position to which such restrictions or disqualifications apply, and for each such occupation or position, include—</text>
 <paragraph display-inline="no-display-inline" id="H89A38CABC58A451D99BE8F98CA945452"><enum>(1)</enum><text>a description of the restriction or disqualification;</text> </paragraph><paragraph id="H151C781ECFF548059DCE1BB08EDC07EB"><enum>(2)</enum><text>the duration of the restriction or disqualification;</text>
 </paragraph><paragraph id="H7D71BA802EE346AE85397FC9EC865343"><enum>(3)</enum><text>an evaluation of the rationale for the restriction or disqualification and its continuing usefulness;</text>
 </paragraph><paragraph id="H07D188AAA593425E909E5CBABF4DA973"><enum>(4)</enum><text>the procedures, if any, to appeal, waive or exempt the restriction or disqualification based on a showing of rehabilitation or other relevant evidence;</text>
 </paragraph><paragraph id="H5AB09A1932084BD089709D265A478C50"><enum>(5)</enum><text>any information available about the numbers of individuals restricted or disqualified on the basis of a criminal record; and</text>
 </paragraph><paragraph id="HC2133599A9A943EEB64C54C42C1FBE50"><enum>(6)</enum><text>the identity of the Federal agency with jurisdiction over the restriction or disqualification.</text> </paragraph></subsection></section><section id="H9A6C34B13EAD447393A49BE037CDD09D"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
 <paragraph id="HC50A56FE7F7A44FD80E2764A61EED9CD"><enum>(1)</enum><text>the term <term>for employment-related purposes</term> includes for the purpose of screening an individual for employment or occupational licensing;</text> </paragraph><paragraph id="HADEF1A39C6404861928CF5E7AD66F944"><enum>(2)</enum><text>the term <term>applicant</term> means the person to whom the record or information sought to be exchanged pertains;</text>
 </paragraph><paragraph id="HA983BA3865D94575B1B8DB9DD83B1ED8"><enum>(3)</enum><text>the term <term>requesting entity</term> means the person or entity seeking the exchange of records or information;</text> </paragraph><paragraph id="H68CDABB44DFC4D8C9E1C369D97A908CF"><enum>(4)</enum><text>the term <term>State</term> includes the District of Columbia, Puerto Rico, and each other territory and possession of the United States; and</text>
 </paragraph><paragraph id="H06F23069C68C425C8CF86BF88EEB0EB2"><enum>(5)</enum><text>the term <term>reporting jurisdiction</term> includes any person or entity that provides relevant records and information to the Attorney General under section 534 of title 28, United States Code.</text>
