			 of HA–LEU for domestic commercial use, and for other purposes.</official-title></form>
	<legis-body id="HDF401E29F4FA40D786486B4AC381F219" style="OLC">
 <section id="H17129D0561DE48D19E13D9224D216686" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Nuclear Fuel Availability Act</short-title></quote>.</text> </section><section id="H46E5B17DC4CE492CA089931BCB23475C"><enum>2.</enum><header>Program</header> <subsection id="HC88B4A3A7FF641C580F40C38FEA69959"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish and carry out, through the Office of Nuclear Energy, a program to support the availability of HA–LEU for domestic commercial use.</text>
 </subsection><subsection id="HEBDCDCB380D64025873FC73CF6983B27"><enum>(b)</enum><header>Program elements</header><text>In carrying out the program under subsection (a), the Secretary—</text> <paragraph commented="no" id="HC36F9DB4B00A40898A776507B625F0B0"><enum>(1)</enum><text>may provide financial assistance to assist commercial entities to design and license transportation packages for HA–LEU, including canisters for metal, gas, and other HA–LEU compositions;</text>
 </paragraph><paragraph id="H95286B1C48B847C99F3FB539067B1539"><enum>(2)</enum><text>shall, to the extent practicable—</text> <subparagraph id="HDD4C9B1DA74D4E30A72FA161ECAA0021"><enum>(A)</enum><text>by January 1, 2021, have commercial entities submit such transportation package designs<italic></italic> to the Commission for certification by the Commission under part 71 of title 10, Code of Federal Regulations; and</text>
 </subparagraph><subparagraph commented="no" id="HED28DA6EFE084011A0A55A1F20770B16"><enum>(B)</enum><text>encourage the Commission to have such transportation package designs so certified by the Commission by January 1, 2023;</text>
 </subparagraph></paragraph><paragraph id="H35C55AB6FE2B46A1ACD92E27B2EEBF80"><enum>(3)</enum><text>not later than January 1, 2020, shall submit to Congress a report on the Department’s uranium inventory that may be available to be processed to HA–LEU for purposes of such program;</text>
 </paragraph><paragraph id="H623B25A673E84807BFA2F137A1A27517"><enum>(4)</enum><text display-inline="yes-display-inline">not later than one year after the date of enactment of this Act, and biennially thereafter through September 30, 2025, shall conduct a survey of stakeholders to estimate the quantity of HA–LEU necessary for domestic commercial use for each of the five subsequent years;</text>
 </paragraph><paragraph commented="no" id="HDAE91C45097B49DBB2DA82D5AAE474EA"><enum>(5)</enum><text display-inline="yes-display-inline">shall assess options available for the Secretary to acquire HA–LEU for such program, including an assessment, for each such option, of the cost and amount of time required;</text>
 </paragraph><paragraph display-inline="no-display-inline" id="H198D229F8FCF4DCC820A993AB1EFFFCC"><enum>(6)</enum><text display-inline="yes-display-inline">shall establish a consortium, which may include entities involved in any stage of the nuclear fuel cycle, to partner with the Department to support the availability of HA–LEU for domestic commercial use, including by—</text>
 <subparagraph id="HD072F843F6C946E291E46B69BC0C6ECF"><enum>(A)</enum><text>providing information to the Secretary for purposes of surveys conducted under paragraph (4); and</text> </subparagraph><subparagraph id="HD33F497AEF1344EA94D66B56C15919D0"><enum>(B)</enum><text>purchasing HA–LEU made available to members of the consortium by the Secretary under the program;</text>
 </subparagraph></paragraph><paragraph commented="no" id="H0F2BEE59042A4C3B82A9336BD557FE1D"><enum>(7)</enum><text>shall, prior to acquiring HA–LEU under paragraph (8), in coordination with the consortium established pursuant to paragraph (6), develop a schedule for cost recovery of HA–LEU made available to members of the consortium pursuant to paragraph (8);</text>
 </paragraph><paragraph commented="no" id="H4E7F91BFABDE455A8F811662797A83B6"><enum>(8)</enum><text display-inline="yes-display-inline">may, beginning not later than 3 years after the establishment of a consortium under paragraph (6), acquire HA–LEU, in order, to the extent practicable, to make such HA–LEU available to members of the consortium beginning not later than January 1, 2025, in amounts that are consistent, to the extent practicable, with the quantities estimated under the surveys conducted under paragraph (4); and</text>
 </paragraph><paragraph id="H43DE70830C3C4C949575334F12238102"><enum>(9)</enum><text display-inline="yes-display-inline">shall develop, in consultation with the Commission, criticality benchmark data to assist the Commission in—</text>
 <subparagraph id="HF655AC216BAE44348B66D87566CAF557"><enum>(A)</enum><text display-inline="yes-display-inline">the licensing and regulation of category II spent nuclear material fuel fabrication and enrichment facilities under part 70 of title 10, Code of Federal Regulations; and</text>
 </subparagraph><subparagraph id="HC6FBEAE2C2144365B6767B1231F2CFEE"><enum>(B)</enum><text display-inline="yes-display-inline">certification of transportation packages under part 71 of title 10, Code of Federal Regulations.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="HAAD950DAFA5F4AD0B51752FEE55E4C31"><enum>(c)</enum><header>Applicability of USEC Privatization Act</header><text display-inline="yes-display-inline">Section 3112(d)(2) of the <short-title>USEC Privatization Act</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h-10">42 U.S.C. 2297h–10(d)(2)</external-xref>) shall not apply to a sale or transfer of HA–LEU by the Secretary to a member of the consortium under this section.</text>
			</subsection><subsection id="H485E9A676B004474841E79B902A60CF2"><enum>(d)</enum><header>Funding for transportation package design</header>
 <paragraph commented="no" id="HE19CD2092C2B41898008717B49CFED78"><enum>(1)</enum><header>Cost share</header><text display-inline="yes-display-inline">The Secretary shall ensure that not less than 20 percent of the costs of design and license activities carried out pursuant to subsection (b)(1) are paid by a non-Federal entity.</text>
 </paragraph><paragraph id="H6491E3F231D843DBA79B3F3D25554B62"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out subsection (b)(1)—</text> <subparagraph id="H7811406D2040495DB8C21BB36CEF795B"><enum>(A)</enum><text>$1,500,000 for fiscal year 2019;</text>
 </subparagraph><subparagraph id="H7F957D5A7A9142EDAC47F7D7B2145F80"><enum>(B)</enum><text>$1,500,000 for fiscal year 2020; and</text> </subparagraph><subparagraph id="HFAE0A8D66C944BFDBE1A726DF446F273"><enum>(C)</enum><text>$1,500,000 for fiscal year 2021.</text>
 </subparagraph></paragraph></subsection><subsection id="HF38F6689B9424AE2B5C70618B93C97A0"><enum>(e)</enum><header>Sunset</header><text display-inline="yes-display-inline">The authority of the Secretary to carry out the program under this section shall expire on September 30, 2033.</text>
 </subsection></section><section id="H9B2657D7CC7843A3899AC8D8A64F3EF7"><enum>3.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 12 months after the date of enactment of this Act, the Commission shall submit to Congress a report that includes—</text>
 <paragraph commented="no" id="H4E7B4C8CE7054DA29B0F0DA20CD1B910"><enum>(1)</enum><text>identification of updates to regulations, certifications, and other regulatory policies that the Commission determines are necessary in order for HA–LEU to be commercially available, including—</text>
 <subparagraph commented="no" id="H57524632FD2F494C8ABE1A9FB9B077BC"><enum>(A)</enum><text>guidance for material control and accountability of category II special nuclear material;</text> </subparagraph><subparagraph commented="no" id="HEAB233AF430C497894510628D9333202"><enum>(B)</enum><text display-inline="yes-display-inline">certifications relating to transportation packaging for HA–LEU; and</text>
 </subparagraph><subparagraph id="H7419EE6CB23D4478B4496408ACFE0F07"><enum>(C)</enum><text>licensing of enrichment, conversion, and fuel fabrication facilities for HA–LEU, and associated physical security plans for such facilities;</text>
 </subparagraph></paragraph><paragraph id="H7BDB0A94667D4644AE052A69120AD7FA"><enum>(2)</enum><text>a description of such updates; and</text> </paragraph><paragraph id="HD03E0372F54449B88D64F31E7E93C5DB"><enum>(3)</enum><text>a timeline to complete such updates.</text>
 </paragraph></section><section id="H17FD8FA66B4C4F349DF5D46CC355C341"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HDF6AF40DD0E54EDBA4461C498BAB86A9"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text>
 </paragraph><paragraph id="H79BF7E715394463E8B3C74C0C21F85EB"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> means Department of Energy.</text> </paragraph><paragraph commented="no" id="HC3FC47EC89E6464E8D882E5FC679F70A"><enum>(3)</enum><header>HA–LEU</header><text>The term <term>HA–LEU</term> means high-assay low-enriched uranium.</text>
 </paragraph><paragraph id="H11CD2BC48A6B4A8990F71B34F90F6212"><enum>(4)</enum><header>High-assay low-enriched uranium</header><text>The term <term>high-assay low-enriched uranium</term> means uranium having an assay greater than 5.0 percent and less than 20.0 percent enrichment of the uranium-235 isotope.</text>
 </paragraph><paragraph id="HDD93035DCF794E2ABF36C8DB73A33E96"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text> </paragraph></section></legis-body></bill>
