			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit the separation of families at or near ports of entry.</official-title></form>
	<legis-body id="HD0FB22A55D1643468CDFF38B4026018F" style="OLC">
 <section id="HEEE2F22546644766BEF179864E4ECE19" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Families Together Act</short-title></quote>.</text> </section><section id="H928575400E31454685D37D7EAFB2F301" section-type="subsequent-section"><enum>2.</enum><header>Limitation on the separation of families</header> <subsection id="HC3318A7DAD764F418EE5911652A4CA65"><enum>(a)</enum><header>In general</header><text>An agent or officer of a designated agency shall be prohibited from removing a child from his or her parent or legal guardian, at or near the port of entry or within 100 miles of a border of the United States, unless one of the following has occurred:</text>
 <paragraph id="HC19A3A5C838C4504A664752FC6018B7B"><enum>(1)</enum><text>A State court, authorized under State law, terminates the rights of the parent or legal guardian, determines that it is in the best interests of the child to be removed from the parent or legal guardian, in accordance with the Adoption and Safe Families Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/89">Public Law 105–89</external-xref>), or makes any similar determination that is legally authorized under State law.</text>
 </paragraph><paragraph id="H6A993B7443B14398A3D533EF6DC27090"><enum>(2)</enum><text>An official from the State or county child welfare agency with expertise in child trauma and development makes a best interests determination that it is in the best interests of the child to be removed from the parent or legal guardian because the child is in danger of abuse or neglect at the hands of the parent or legal guardian, or is a danger to herself or others.</text>
 </paragraph><paragraph id="HD65F927780D04D6E8C1379B927E555E8"><enum>(3)</enum><text>The Chief Patrol Agent or the Area Port Director in their official and undelegated capacity, authorizes separation upon the recommendation by an agent or officer, based on a finding that—</text>
 <subparagraph id="H0C0DEA5A711B48479A1D124A345BE900"><enum>(A)</enum><text>the child is a victim of trafficking or is at significant risk of becoming a victim of trafficking;</text> </subparagraph><subparagraph id="HA9086E81F14A4F10B895680E95CE75D7"><enum>(B)</enum><text>there is a strong likelihood that the adult is not the parent or legal guardian of the child; or</text>
 </subparagraph><subparagraph id="H782E2210A74F40DE80EECF82ADFC974E"><enum>(C)</enum><text>the child is in danger of abuse or neglect at the hands of the parent or legal guardian, or is a danger to themselves or others,</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">except that, in the case that a child is removed from his or her parent or legal guardian under
			 this section, an independent child welfare expert licensed by the State or
			 county in which the child was so removed, authorizes the separation not
			 later than 48 hours after such removal, and if such expert does not
			 authorize such separation, the child shall be reunited with his or her
			 parent or legal guardian not later than 48 hours after such determination.</continuation-text></paragraph></subsection><subsection id="H2FBA8E18B4564922963E850568D49B8C"><enum>(b)</enum><header>Prohibition on separation</header>
 <paragraph id="H366D7F46A4B542B2BD7AA4D97F5AB04F"><enum>(1)</enum><header>In general</header><text>A designated agency may not remove a child from a parent or legal guardian solely for the policy goal of deterring individuals from migrating to the United States or for the policy goal of promoting compliance with civil immigration laws.</text>
 </paragraph><paragraph commented="no" id="H623FC2748FB34B5291CB9A8A8D8B739D"><enum>(2)</enum><header>Penalty for family separation</header><text>Any person who knowingly separates a child from his or her parent or legal guardian in violation of this section, shall be fined not more than $10,000.</text>
 </paragraph></subsection><subsection id="HD0B92426379A4930AACDB7088208A4BB"><enum>(c)</enum><header>Documentation required</header><text>The Secretary shall ensure that a separation under subsection (a)(3) is documented in writing and includes, at a minimum, the reason for such separation, together with the stated evidence for such separation.</text>
			</subsection></section><section id="HD0F07A9CDA954E5CB983EDF854FF8DB0"><enum>3.</enum><header>Recommendations for separation by agents or officers</header>
 <subsection id="H6E4F0E13ADBE49F8873603EE37624DA6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary, in consultation with the Secretary of Health and Human Services, shall develop training and guidance, with an emphasis on the best interests of the child, childhood trauma, attachment, and child development, for use by agents and officers of designated agencies, in order to standardize the implementation of section 2(a)(3).</text>
 </subsection><subsection id="H6ECE0DCC07F0446290126BAEBA7A7ABE"><enum>(b)</enum><header>Annual review</header><text>Not less frequently than annually, the Secretary of Health and Human Services shall review the guidance developed under subsection (a) and make recommendations to the Secretary to ensure such guidance is in accordance with current evidence and best practices in child welfare, child development, and childhood trauma.</text>
 </subsection><subsection id="H00183E53FA1D49E481C708F57CC0F392"><enum>(c)</enum><header>Requirement</header><text>The guidance under subsection (a) shall incorporate the presumptions described in section 4.</text> </subsection><subsection id="H111F78A1AA184CCEA977EA3DCD706370"><enum>(d)</enum><header>Additional requirements</header> <paragraph id="HD08E438EC9A94687A6309A79DC48AE27"><enum>(1)</enum><header>Evidence-based</header><text>The guidance and training developed under this section shall incorporate evidence-based practices.</text>
				</paragraph><paragraph id="H1AC12942011B419B9785CAFB15A3635E"><enum>(2)</enum><header>Training required</header>
 <subparagraph id="H4A86365EB1324B41B0C856F849356A16"><enum>(A)</enum><text>All agents and officers of designated agencies, upon hire, and annually thereafter, shall complete training on adherence to the guidance under this section.</text>
 </subparagraph><subparagraph id="H3D5FA6594AA64A64A9FB9D9F292BF114"><enum>(B)</enum><text>All Chief Patrol Agents and Area Port Directors, upon hire, and annually thereafter, shall complete—</text>
 <clause id="H96AEA7D7A7CA4739819088A9101983E3"><enum>(i)</enum><text>training on adherence to the guidance under this section; and</text> </clause><clause commented="no" id="H2231E64A6AAB4C26A0F8A4F59FB2D42E"><enum>(ii)</enum><text>90 minutes of child welfare practice training that is evidence-based and trauma-informed.</text>
 </clause></subparagraph></paragraph></subsection></section><section id="HEBD31937CBEA426CB3D1F30C091D83A5"><enum>4.</enum><header>Presumptions</header><text display-inline="no-display-inline">The presumptions described in this section are the following:</text> <paragraph id="H35AB6C880358437F945635BA719E4C07"><enum>(1)</enum><header>Family unity</header><text>There shall be a strong presumption in favor of family unity.</text>
 </paragraph><paragraph id="HD6F791E38A5846B1B4310B3D8FD4E865"><enum>(2)</enum><header>Siblings</header><text>To the maximum extent practicable, the Secretary shall ensure that sibling groups remain intact.</text> </paragraph><paragraph id="H5281FA6E223247CC92F83062A4A0B516"><enum>(3)</enum><header>Detention</header><text>In general, there is a presumption that detention is not in the best interests of families and children.</text>
			</paragraph></section><section commented="no" id="HBE1FC3B9C70442249E302ECAD7FD04A8"><enum>5.</enum><header>Required policy for locating separated children</header>
 <subsection commented="no" id="H51205177C8204F1FAD03785FBB555AA4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the after the date of the enactment of this Act, the Secretary shall publish final public guidance that describes, with specificity, the manner in which a parent or legal guardian may locate a child who was separated from the parent or legal guardian under section 2(a). In developing the public guidance, the Secretary shall consult with the Secretary of Health and Human Services, immigrant advocacy organizations, child welfare organizations, and State child welfare agencies.</text>
 </subsection><subsection commented="no" id="HF39F4AF37A7249AD9F969FF1B77BF286"><enum>(b)</enum><header>Written notification</header><text>The Secretary shall provide each parent or legal guardian who was separated, with written notice of the public guidance to locate a separated child.</text>
 </subsection><subsection commented="no" id="HE987EB35FBFC4D5CB72C523405655C5C"><enum>(c)</enum><header>Language access</header><text display-inline="yes-display-inline">All guidance shall be available in English and Spanish, and at the request of the parent or legal guardian, either in the parent or legal guardian’s native language or in another language the parent or legal guardian understands, and manner that is understandable by the parent or legal guardian.</text>
			</subsection></section><section id="H10E9C026985A4BAA9443FEA6745A1586"><enum>6.</enum><header>Required information for separated families</header>
 <subsection id="H608B4A706AFA47BC9DD6352EF90C6AED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided under subsection (c), the Secretary of Health and Human Services, in consultation with the heads of other designated agencies, on a weekly basis, shall provide the parent or legal guardian of a child who was separated, the following information, at a minimum:</text>
 <paragraph id="HACD4E6380DE24EA9AA83A9E3C4517A6D"><enum>(1)</enum><text>A status report on the child’s activities during the prior week.</text> </paragraph><paragraph id="H98498B8614294DB0848789270EC9611A"><enum>(2)</enum><text>Information about the education and health of the child, including any medical treatment provided to the child or medical treatment recommended for the child.</text>
 </paragraph><paragraph id="HA9E580CBA4D341BBA2D4FF88FE56300C"><enum>(3)</enum><text>Information about changes to the child’s immigration status.</text> </paragraph><paragraph id="H5E453260D4924A61A9D97FBAF668C592"><enum>(4)</enum><text>Other information about the child, designed to promote and maintain family reunification, as the Secretary of Health and Human Services determines in his or her discretion.</text>
 </paragraph></subsection><subsection id="H7D37CBA20A644A3A9BA567482C414E69"><enum>(b)</enum><header>Phone communication</header><text display-inline="yes-display-inline">Except as provided under subsection (c), the Secretary of Health and Human Services, in consultation with the heads of other designated agencies, on a weekly basis, shall provide the parent or legal guardian of a child who was separated with phone communication between the parent or legal guardian and his or her child.</text>
 </subsection><subsection id="H23CA0409ECB44079A3BE0B6AC3D648AC"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">No information under subsection (a) or phone communication under subsection (b) shall be provided to a parent or legal guardian in the case that a qualified child welfare expert with care and custody of the child, a child’s advocate, the child’s legal representation, or the child him or herself concludes it is harmful or dangerous to the child to communicate with the parent or legal guardian.</text>
 </subsection></section><section id="H5CB13E01CE9D4FACAB88FF3CD221486B"><enum>7.</enum><header>Annual report on family separation</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 6 months thereafter, the Secretary, in consultation with the heads of other designated agencies, shall submit a report to the committees of jurisdiction, describing each instance in which a child was separated from a parent or legal guardian, including the following:</text>
 <paragraph id="HF428FC05681B4296B65BC0232B017ACF"><enum>(1)</enum><text display-inline="yes-display-inline">The relationship of the adult to the child.</text> </paragraph><paragraph id="H412F8AEB3EB24608891F3A46AD0AF237"><enum>(2)</enum><text>The age and gender of the adult and child.</text>
 </paragraph><paragraph id="H47EB27B7421142AAB45DDEAC6231261D"><enum>(3)</enum><text>The length of separation.</text> </paragraph><paragraph id="H133D47D716FA40D08E2E432AB34BCE8C"><enum>(4)</enum><text>Whether the adult was charged with a crime, and if the adult was charged with a crime, the type of crime.</text>
 </paragraph><paragraph id="H893916DF39A0472BA5D4BA8FD49FA868"><enum>(5)</enum><text>Whether the adult made a claim for asylum, expressed a fear to return, or applied for other immigration relief.</text>
 </paragraph><paragraph id="H5E26475E52E34383AAD63B10E2118518"><enum>(6)</enum><text>Whether the adult was prosecuted if charged with a crime and the associated outcome of such charges.</text>
 </paragraph><paragraph id="H366A118BC5E140458304C8C8ED32025E"><enum>(7)</enum><text>The stated reason for, and evidence in support of, the separation.</text> </paragraph><paragraph id="H09A7BA82FBEC43CC8D877329D6F24C35"><enum>(8)</enum><text>If the child was part of a sibling group at the time of the separation, whether the group has had physical contact and visitation.</text>
 </paragraph><paragraph id="HDADDF82AB52446EB97207D70862DF760"><enum>(9)</enum><text>Whether the child was rendered an unaccompanied alien child.</text> </paragraph><paragraph id="HF594831E4BBF49F88D46A2ED9157B1DB"><enum>(10)</enum><text>Other information in the Secretary’s discretion.</text>
 </paragraph></section><section id="H0EB78CE8AFBB438EA6F4AB582BD82413"><enum>8.</enum><header>Clarification of parental rights</header><text display-inline="no-display-inline">If a child is separated from a parent or legal guardian, and a State court has not made a determination that the parental rights have been terminated, there is a presumption that—</text>
 <paragraph id="HCF40F16479E141518A381373C0F1F91A"><enum>(1)</enum><text>the parental rights remain intact; and</text> </paragraph><paragraph id="H2DE432C8BEC04827B79DF016FE010070"><enum>(2)</enum><text>the separation does not constitute an affirmative determination of abuse or neglect under Federal or State law.</text>
			</paragraph></section><section id="H7C851DA53230457A8B37A7DFEBB315D3"><enum>9.</enum><header>Clarification of existing law</header>
 <subsection id="H5ABB6355A6584B8F9FED40E4C059A69D"><enum>(a)</enum><header>Federal law</header><text>Nothing in this Act shall be interpreted to supersede or modify Federal child welfare law, where applicable, including the Adoption and Safe Families Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/89">Public Law 105–89</external-xref>).</text>
 </subsection><subsection id="HCBFFB7563D4F40A8B29422E0B5E3F71D"><enum>(b)</enum><header>State law</header><text>Nothing in this Act shall be interpreted to supersede or modify State child welfare laws where applicable.</text>
			</subsection></section><section id="H234722D8398C4E17AACFD315D7DDE252"><enum>10.</enum><header>Limitation on the prosecution of asylum seekers</header>
 <subsection id="HDEF76F2F77D044AF934C566CF61A1633"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An alien who has expressed a credible or reasonable fear of persecution, filed an application for asylum or withholding of removal, or expressed an intent to file such an application, may not be prosecuted under section 275(a) or 276(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(a)</external-xref>, 1326(a)) until the date on which any such application has been finally adjudicated, including any appeals thereto.</text>
 </subsection><subsection id="HC21D719F6558483C89C619096AF5E4BF"><enum>(b)</enum><header>Affirmative defense</header><text display-inline="yes-display-inline">In the case that an alien is prosecuted under section 275(a) or 276(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(a)</external-xref>, 1326(a)) in violation of subsection (a), it shall be a defense that the alien has expressed a credible or reasonable fear of persecution, filed an application for asylum or withholding of removal, or expressed an intent to file such an application, and that such application has not been finally adjudicated, including any appeals thereto.</text>
 </subsection><subsection id="H174E7F66F2EB4F8EB707186811A244A2"><enum>(c)</enum><header>Treaty obligations</header><text display-inline="yes-display-inline">In accordance with the treaty obligations of the United States under Article 31 of the United Nations Convention Relating to the Status of Refugees, no alien who has been granted asylum or withholding of removal in the United States may be prosecuted under section 275(a) or 276(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(a)</external-xref>, 1326(a)).</text>
 </subsection></section><section id="H736D62DD1AA043609554777C88F3E3E3"><enum>11.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H6D801EA5807D46228198E1CBC7C9A87F"><enum>(1)</enum><header>Designated agency</header><text>The term <term>designated agency</term> means—</text>
 <subparagraph id="H8DB98B11F58E42D695DCECE5CF6F32E8"><enum>(A)</enum><text>the Department of Homeland Security;</text> </subparagraph><subparagraph id="H8C209EB3BA0D44239F4448C318C00370"><enum>(B)</enum><text>the Department of Justice; and</text>
 </subparagraph><subparagraph id="H3DBB12E0E8AF483889B8BCA0BF556868"><enum>(C)</enum><text>the Department of Health and Human Services.</text> </subparagraph></paragraph><paragraph id="HF99D0ABF847248148D9336EE4F7C944F"><enum>(2)</enum><header>Agent or officer</header><text>The term <term>agent or officer</term> includes contractors of the Federal Government.</text>
 </paragraph><paragraph id="H44D247DF9B82485FA2D170D4BE22F8CD"><enum>(3)</enum><header>Child</header><text>The term <term>child</term> means an individual who—</text> <subparagraph id="H01B4365F1D3E483092C9AC46807B296D"><enum>(A)</enum><text>has not reached the age of 18; and</text>
 </subparagraph><subparagraph id="HD64C7E9CE3784072B134E3E15D5F46D6"><enum>(B)</enum><text>has no permanent immigration status.</text> </subparagraph></paragraph><paragraph id="H7E0DE4022D1D44B6880385D5ACAC3803"><enum>(4)</enum><header>Committees of jurisdiction</header><text>The term <term>committees of jurisdiction</term> means—</text>
 <subparagraph commented="no" id="HD9EED439221B4B4C99B11641F17E76B1"><enum>(A)</enum><text>the Committee on the Judiciary and the Committee on Health, Education, Labor, and Pensions of the Senate; and</text>
 </subparagraph><subparagraph commented="no" id="H502867997DE34ECFABF2F622629645CB"><enum>(B)</enum><text>the Committee on the Judiciary and the Committee on Education and the Workforce of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph id="H298A1CCB3F4E4FDBBA813DABFAA45709"><enum>(5)</enum><header>Finding</header><text>The term <term>finding</term> means an individualized written assessment or screening formalized as required under section 2(c), and consistent with sections 3, 4, and 8.</text>
 </paragraph><paragraph id="H7E38C39059D7454AA1C17B3776FC1F4E"><enum>(6)</enum><header>In danger of abuse or neglect at the hand of the parent or legal guardian</header><text>The term <term>in danger of abuse or neglect at the hands of the parent or legal guardian</term> does not include migrating to or crossing of a border of the United States.</text> </paragraph><paragraph id="HE3CDB490402549E4AC79BC7C7F802352"><enum>(7)</enum><header>Secretary</header><text>Unless otherwise specified, the term <term>Secretary</term> means the Secretary of Homeland Security.</text>
