 <section id="HED7655C7DD174CD2974D35B92799EC3D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Social Security Fairness Act of 2018</short-title></quote>.</text> </section><section id="H5C90FDAF0638409591216C1D10E034C2"><enum>2.</enum><header>Voluntary agreements for coverage of services by American Indian tribal council members</header> <subsection id="H9026083E4E544796B6884353B275FCD6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> et seq.) is amended by inserting after section 218 the following new section:</text>

 <section id="HC92809CAF52341F5B41B1BB221D09B03"><enum>218A.</enum><header>Voluntary agreements for coverage of Indian tribal council members</header><subsection commented="no" display-inline="yes-display-inline" id="H9B3DC817644641C5997E4FF04FC156FE"><enum>(a)</enum><header>Purpose of agreement</header><paragraph commented="no" display-inline="yes-display-inline" id="H009C914878A441468D8F1900E6F6DD21"><enum>(1)</enum><text display-inline="yes-display-inline">The Commissioner of Social Security shall, at the request of any Indian tribe, enter into an agreement with such Indian tribe for the purpose of extending the insurance system established by this title to services performed by individuals as members of such Indian tribe's tribal council. Any agreement with an Indian tribe under this section applies to all members of the tribal council, and shall include all services performed by individuals in their capacity as council members.</text>
 </paragraph><paragraph changed="added" committee-id="HWM00" id="H2F82C356119F4B72A25CD615CE01C29E" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Notwithstanding section 210(a), for the purposes of this title, the term <term>employment</term> includes any service included under an agreement entered into under this section.</text> </paragraph></subsection><subsection changed="added" committee-id="HWM00" id="HA013DFAD459148A895EB104551B6A6F7" reported-display-style="italic"><enum>(b)</enum><header>Definitions</header><text>For the purposes of this section:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="HE01D8E59919145A68478FD6E9956DECF"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>member</term> means, with respect to a tribal council, an individual appointed or elected to serve as a member or the head of the tribal council.</text>
 </paragraph><paragraph commented="no" id="H59CFB52107DB4A928A1D3B9B0E2C04DD"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>tribal council</term> means the appointed or elected governing body of a federally recognized Indian tribe.</text> </paragraph></subsection><subsection changed="added" commented="no" committee-id="HWM00" id="H8641E6051D524F26A3FBDEC91CA12F45" reported-display-style="italic"><enum>(c)</enum><header>Effective date of agreement</header><paragraph commented="no" display-inline="yes-display-inline" id="HC82668DB634B41358EB03B1D57D5B780"><enum>(1)</enum><text>Any agreement under this section shall be effective with respect to services performed after an effective date specified in such agreement, provided that such date may not be earlier than the first day of the next calendar month after the month in which the agreement is executed by both parties.</text>
 </paragraph><paragraph changed="added" committee-id="HWM00" id="H518FAE70CCC143E5A65569E0345C1393" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">At the request of the Indian tribe at the time of the agreement, such agreement may apply with respect to services performed before such effective date for which there were timely paid in good faith (and not subsequently refunded) to the Secretary of the Treasury amounts equivalent to the sum of the taxes which would have been imposed by sections 3101 and 3111 of the Internal Revenue Code of 1986 had such services constituted employment for purposes of chapter 21 of such Code. No agreement under this section may require payment to be made after the effective date specified in such agreement of any taxes with respect to services performed before such effective date.</text>
 </paragraph></subsection><subsection changed="added" commented="no" committee-id="HWM00" id="HFE7FD15E78D54601A5069B41503F567C" reported-display-style="italic"><enum>(d)</enum><header>Duration of agreement</header><text>No agreement under this section may be terminated on or after the effective date of the agreement.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H1E3693D7309649628B3BD601557680B4"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H29F3174632AD41B48C1E69814E5D4BCC"><enum>(1)</enum><header>Social Security Act</header><text>Section 210(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/410">42 U.S.C. 410(a)</external-xref>) is amended—</text>
 <subparagraph id="H4763BB0E86B842ED89BBF230C459812F"><enum>(A)</enum><text>in paragraph (20), by striking <quote>or</quote> at the end;</text> </subparagraph><subparagraph id="H65C6D0B3450B4DFEBC07A676EFBDD1EC"><enum>(B)</enum><text>in paragraph (21), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph id="H1631239A237244B6A33951DBAB2DEB36"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (21) the following new paragraph:</text> <quoted-block changed="added" committee-id="HWM00" display-inline="no-display-inline" id="H1C35C8C47F9944AD9EAD44E14E19FF46" reported-display-style="italic" style="OLC"> <paragraph id="H66791AD56CA44D1A9FE327D42B0779A9"><enum>(22)</enum><text display-inline="yes-display-inline">Service performed by members of Indian tribal councils as tribal council members in the employ of an Indian tribal government, except that this paragraph shall not apply in the case of service included under an agreement under section 218A.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H69A92322EA8945AA8247AE2D9606380D"><enum>(2)</enum><header>Internal Revenue Code of 1986</header><text display-inline="yes-display-inline">The Internal Revenue Code of 1986 is amended—</text> <subparagraph id="H820D4F589B4047DB9D4ABF947D3AF137"><enum>(A)</enum><text display-inline="yes-display-inline">in section 3121(b)—</text>
 <clause id="HF4C5F3807D9445179A1EE782A694EE1C"><enum>(i)</enum><text>in paragraph (20), by striking <quote>or</quote> at the end;</text> </clause><clause id="H1C7AA137D30F496EBFE28E8BF9F2C077"><enum>(ii)</enum><text>in paragraph (21), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </clause><clause id="H40CB26B67C7043B7A8194D518A42CBC7"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting after paragraph (21) the following new paragraph:</text> <quoted-block changed="added" committee-id="HWM00" display-inline="no-display-inline" id="H261ECB8A207B4DF8BD71B01267A8F459" reported-display-style="italic" style="OLC"> <paragraph id="HD1A33B1C82324A05B2BB74B9C6F4F036"><enum>(22)</enum><text display-inline="yes-display-inline">service performed by members of Indian tribal councils as tribal council members in the employ of an Indian tribal government, except that this paragraph shall not apply in the case of service included under an agreement under section 218A of the Social Security Act.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="HC55941CDDEF34925A79834F41D1D7C38"><enum>(B)</enum><text>in section 3121(d)(4), by inserting <quote>or 218A</quote> after <quote>section 218</quote>.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8121B3E3154B4E098C96E2B7B85C0A78"><enum>(c)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to affect application of any Federal income tax withholding requirements under the Internal Revenue Code of 1986.</text>
