			 conducted on non-Federal surface estate to access subsurface mineral
			 estate that is less than 50 percent Federally owned, and for other
			 purposes.</official-title></form>
	<legis-body id="H33F0A038C7634E04A617E603D633D05B" style="OLC">
 <section id="H008793268485431196BF94C15860531C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Duplicative Permitting Act</short-title></quote>.</text> </section><section id="H57D059BC08E44C3898FEBDB46644F624" section-type="subsequent-section"><enum>2.</enum><header>Access to Federal oil and gas from non-Federal surface estate</header><text display-inline="no-display-inline">Section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HA4D81EAB1D7343D6879E1D20FCC13121" style="OLC">
				<subsection id="HAC5DA1251EB94796BE338C849CCF27EB"><enum>(q)</enum><header>No Federal permit required for oil and gas activities on certain land</header>
 <paragraph id="H04AA29E766F44407A08A32D88A89DB38"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall not require an operator to obtain a Federal drilling permit for oil and gas exploration and production activities conducted on non-Federal surface estate, provided that—</text>
 <subparagraph id="H639CC637D69B49169CDD2787B3E480EC"><enum>(A)</enum><text>the United States holds an ownership interest of less than 50 percent of the subsurface mineral estate to be accessed by the proposed action; and</text>
 </subparagraph><subparagraph id="HC66C419214C7429B8155D64B8BABA470"><enum>(B)</enum><text>the operator submits to the Secretary a State permit to conduct oil and gas exploration and production activities on the non-Federal surface estate.</text>
 </subparagraph></paragraph><paragraph id="H39748A09407B40A495BD079A0DCAEC90"><enum>(2)</enum><header>No Federal action</header><text display-inline="yes-display-inline">Oil and gas exploration and production activities carried out under paragraph (1)—</text> <subparagraph id="H8887466395144BD2B0E176A63570CA22"><enum>(A)</enum><text>shall require no additional Federal action;</text>
 </subparagraph><subparagraph id="H2089CFF4CAAE4772868D8BE986447AB3"><enum>(B)</enum><text>may commence 30 days after submission of the State permit to the Secretary;</text> </subparagraph><subparagraph id="H62F8D9D38DB349EAACD65B2964534027"><enum>(C)</enum><text>are categorically excluded from any further analysis and documentation under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="HA348CA977A114480AB967A47F3F16FAA"><enum>(D)</enum><text>shall not require any analysis under section 106 of the National Historic Preservation Act of 1966, as amended (<external-xref legal-doc="usc" parsable-cite="usc/54/306108">54 U.S.C. 306108</external-xref>); and</text>
 </subparagraph><subparagraph id="HB251C6E485A8475BB02A0174B87F3378"><enum>(E)</enum><text>shall not require any analysis, assessment, or consultation under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/15/1536">15 U.S.C. 1536</external-xref>).</text>
						</subparagraph></paragraph><paragraph id="H88003E5D485A4FFF9247BBDE019048EE"><enum>(3)</enum><header>Royalties and production accountability</header>
 <subparagraph commented="no" display-inline="yes-display-inline" id="HB61D8E3833204D9E8AD4BB8698B9ED70"><enum>(A)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall affect the amount of royalties due to the United States under this Act from the production of oil and gas, or alter the Secretary’s authority to conduct audits and collect civil penalties pursuant to the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1711">30 U.S.C. 1711</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="HF3E3667AE36B4B84BB9E06585704A083" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary may conduct on-site reviews and inspections to ensure proper accountability, measurement, and reporting of production of Federal oil and gas, and payment of royalties.</text>
 </subparagraph></paragraph><paragraph id="H8974E7B6B41E4122B32E662BC88D85B2"><enum>(4)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This subsection shall not apply to actions on Indian lands or resources managed in trust for the benefit of Indian tribes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
