			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the boycotting of countries friendly to the United States, and for other purposes.</official-title></form>
	<legis-body id="HE5AC07BDE9354F7EBC032DD246D2FA5A" style="OLC">
 <section id="HC8C40273B5724701A7AD205FBC945AB2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Export Administration Anti-Discrimination Act</short-title></quote>.</text> </section><section id="H250AD02A1F854470AC48B43D6499B8FC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="H799B59EE433B48F8B4F2A0E4A670D185"><enum>(1)</enum><text>The ability of United States citizens to engage in international commerce is a fundamental concern of United States policy.</text>
 </paragraph><paragraph id="H750451E13A294040AD3BA85BD6DE169E"><enum>(2)</enum><text>It is important to the national interests of the United States that both the private sector and the Federal Government place a high priority on encouraging international trade, consistent with the economic, security, and foreign policy objectives of the United States.</text>
 </paragraph><paragraph id="H94D88464C99544049F126E9E39515330"><enum>(3)</enum><text>It is in the best interest of the United States to protect countries friendly to the United States and United States persons residing, operating, or doing business in such countries from restrictive trade practices or boycotts.</text>
 </paragraph><paragraph id="H98853F527362413396B0C28269D327C5"><enum>(4)</enum><text>Boycotts against friendly countries and their citizens, or against United States companies doing business with such countries or citizens, do not make for effective business decisionmaking, prevent a business from making the best use of the resources available to it, and should further be opposed as discriminatory.</text>
 </paragraph><paragraph id="HC51A06BABEE446748F4A4CF23D59869D"><enum>(5)</enum><text>More than $45,000,000,000 in goods and services is traded between Israel and the United States annually, in addition to roughly $10,000,000,000 per year in United States foreign direct investment in Israel.</text>
 </paragraph><paragraph id="H6E08243EA74D42119E513664F5DDBB07"><enum>(6)</enum><text>Fellow democratic countries, such as Israel and other allied countries, are vital partners in the global pursuit of civil and human rights, including the protection of free speech.</text>
 </paragraph><paragraph id="H10C1E1167F5A416E9AF71ABB1DC478D9"><enum>(7)</enum><text>The enactment of legislative prohibitions against discrimination in the commercial context or by federally funded programs, including academic institutions, is consistent with the United States Constitution.</text>
 </paragraph><paragraph id="H65B12EBE0D7B49DDA845EDF341BB4F07"><enum>(8)</enum><text>Attempts to single out Israel and its citizens, or other allied countries and their citizens, for discriminatory boycotts violate fundamental principles of academic freedom.</text>
 </paragraph></section><section id="HDD1B5DC4536D442A8DBB703D6EC1264D"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States—</text> <paragraph id="H9798E531B2824372B7B2A903E5A3C017"><enum>(1)</enum><text>to oppose restrictive trade practices or boycotts against other countries friendly to the United States or against any United States person; and</text>
 </paragraph><paragraph id="H20FA0DE4F9184A2B827F0D35A49988DC"><enum>(2)</enum><text>to require United States persons engaged in business anywhere to refuse to take actions, including furnishing information or supporting restrictive trade practices or boycotts, against a country friendly to the United States or against any United States person.</text>
			</paragraph></section><section id="H78A8DC754D8F4E0F8FA678EF82C89EA2"><enum>4.</enum><header>Prohibition on boycotting friendly countries</header>
			<subsection id="H29901F8F09FC41F5A77ADC6EA5BA0D07"><enum>(a)</enum><header>Prohibitions</header>
 <paragraph id="H31B7F8DEED2B424ABEB8AAC634689CB0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No United States person, with respect to the activities of such person in the interstate or foreign commerce of the United States, may knowingly take or agree to take any of the following actions in a manner that complies with, furthers, or supports any boycott against a boycotted country, other than a country with respect to which the United States has imposed sanctions:</text>
 <subparagraph id="H4E3B6C5014E04A38AAC8BB7122182B7F"><enum>(A)</enum><text>Refusing, or requiring any other person to refuse, to do business with or in the boycotted country, with any business concern organized under the laws of the boycotted country, with any national or resident of the boycotted country, or with any other person, pursuant to an agreement with, a requirement of, or a request from or on behalf of, a boycotting entity.</text>
 </subparagraph><subparagraph id="HDB4297BFF8144207B70FB373EA6FDD6E"><enum>(B)</enum><text>Refusing or requiring any other person to refuse to employ, or otherwise discriminating against, any person on the basis of national origin of that person or of any owner, officer, director, or employee of such person.</text>
 </subparagraph><subparagraph id="HA894C73B3B784379812D7F6605A30904"><enum>(C)</enum><text>Furnishing information with respect to the national origin of any person or of any owner, officer, director, or employee of such person in a manner that enables a boycotting entity to conduct a commercial boycott.</text>
 </subparagraph><subparagraph id="HF6A44901EA104C62A36FF8FC454D1C59"><enum>(D)</enum><text>Furnishing information about whether any person has, had, or proposes to have any business relationship (including a relationship by way of sale, purchase, legal or commercial representation, shipping or other transport, insurance, investment, or supply) with or in the boycotted country, with any business concern organized under the laws of the boycotted country, or with any national or resident of the boycotted country.</text>
 </subparagraph><subparagraph id="H6927D44F4061461787FB2F0308962277"><enum>(E)</enum><text>Furnishing information about whether any person is a member of, has made contribution to, or is otherwise associated with or involved in the activities of any charitable or fraternal organization which supports the boycotted country.</text>
 </subparagraph><subparagraph id="H5A17131A879344C4801C20139844A4B6"><enum>(F)</enum><text>Establishing and acting on a formal or official policy of refusing to deal, in any manner, with an academic institution or scholar on the basis of the connection of such institution or scholar with the boycotted country.</text>
 </subparagraph><subparagraph id="H5CD803DF9C1841A39EFDCD994B54003D"><enum>(G)</enum><text>Paying, honoring, confirming, or otherwise implementing a letter of credit which contains any condition or requirement compliance with which requires furnishing information or otherwise acting in any manner described in subparagraphs (A) through (F).</text>
 </subparagraph></paragraph><paragraph id="H02D9DFADAE824D859FE7960534AB2353"><enum>(2)</enum><header>Rule of construction with respect to antitrust and civil rights laws</header><text>Nothing in this section may be construed to supersede or limit the operation of the antitrust or civil rights laws of the United States, or to limit the rights guaranteed to any person by the First Amendment to the United States Constitution with respect to the freedoms of speech and expression.</text>
 </paragraph></subsection><subsection id="H2B48F3CDA7DD47279B2D480A0594EAF8"><enum>(b)</enum><header>Preemption</header><text>The provisions of this section and any regulations issued pursuant to this section shall preempt any law, rule, or regulation of any of the several States or the District of Columbia, or any of the territories or possessions of the United States, or of any governmental subdivision thereof, to the extent that such law, rule, or regulation pertains to participation in, compliance with, implementation of, or the furnishing of information regarding restrictive trade practices or boycotts fostered or imposed by foreign countries against other countries or called for by a boycotting entity.</text>
			</subsection></section><section id="HDF0A35DFFF0348E09F3AD3517DCFB945"><enum>5.</enum><header>Penalties</header>
			<subsection commented="no" id="HEDDD57553A664931A7C5F1944051AEE6"><enum>(a)</enum><header>Intentional violations</header>
 <paragraph commented="no" id="HC58350F6FAC5446CA821FEC312984E8A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever intentionally violates, or conspires or attempts to violate, any provision of <internal-xref idref="H78A8DC754D8F4E0F8FA678EF82C89EA2" legis-path="4.">section 4</internal-xref>—</text> <subparagraph commented="no" id="HB67E59C41FF4480F989A8D43CE02BDA4"><enum>(A)</enum><text>in the case of an individual, shall be fined not more than $250,000, or imprisoned not more than 10 years, or both; or</text>
 </subparagraph><subparagraph commented="no" id="H8F4BBA96FAD44E568DF33CBA9589B04F"><enum>(B)</enum><text>shall be fined not more than five times the value of the transaction involved or $1,000,000, whichever is greater.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HADD18B1680034E9892E292400ECAA52A"><enum>(2)</enum><header>Establishment of intent</header><text display-inline="yes-display-inline">The absence of a business relationship with or in the boycotted country may not be construed to establish, without more, the intent required for a violation under this subsection.</text>
				</paragraph></subsection><subsection id="HBCB32647CB564AC8998B0CB83D9804AE"><enum>(b)</enum><header>Knowing violations</header>
 <paragraph id="H71CEB89117C1472A8EC4FE715539D9E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly violates, or conspires or attempts to violate, any provision of <internal-xref idref="H78A8DC754D8F4E0F8FA678EF82C89EA2" legis-path="4.">section 4</internal-xref> shall be fined not more than five times the value of the transaction involved or $50,000, whichever is greater, imprisoned not more than 5 years, or both.</text>
 </paragraph><paragraph id="H720122F35B364152BFC23AF9488BD232"><enum>(2)</enum><header>Applicability</header><text>A person may be found to knowingly violate a provision of <internal-xref idref="H78A8DC754D8F4E0F8FA678EF82C89EA2" legis-path="4.">section 4</internal-xref> if the person allows an agent or employee of such person to violate any provision of <internal-xref idref="H78A8DC754D8F4E0F8FA678EF82C89EA2" legis-path="4.">section 4</internal-xref> where the person has actual knowledge of such violation by such employee.</text> </paragraph></subsection><subsection id="HA0AECF55DD57414D98C7F2B5463B4CCD"><enum>(c)</enum><header>Institutions of higher education</header> <paragraph id="H801733F1ED924B35A53974F88623FDDE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in <internal-xref idref="H7567FEB9D0B04DF38327AABFC118F6FB" legis-path="5.(c)(2)">paragraph (2)</internal-xref>, an institution of higher education may not receive Federal funds if the Secretary of Commerce determines, and notifies such institution, that the institution has violated any provision of a regulation issued pursuant to <internal-xref idref="H78A8DC754D8F4E0F8FA678EF82C89EA2" legis-path="4.">section 4</internal-xref>.</text>
 </paragraph><paragraph id="H7567FEB9D0B04DF38327AABFC118F6FB"><enum>(2)</enum><header>Exception</header><text>The prohibition under <internal-xref idref="H801733F1ED924B35A53974F88623FDDE" legis-path="5.(c)(1)">paragraph (1)</internal-xref> shall not apply with respect to Federal funds made available under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.).</text>
				</paragraph><paragraph commented="no" id="H855E5C4AE7274637B12DE367247F5707"><enum>(3)</enum><header>Waiver</header>
 <subparagraph commented="no" id="H9DFF7B187BBF4852A56B300D4173F5E9"><enum>(A)</enum><header>In general</header><text>The Secretary may, upon request from an institution of higher education that receives a notification under <internal-xref idref="H801733F1ED924B35A53974F88623FDDE" legis-path="5.(c)(1)">paragraph (1)</internal-xref>, waive the application of the prohibition under <internal-xref idref="H801733F1ED924B35A53974F88623FDDE" legis-path="5.(c)(1)">paragraph (1)</internal-xref> to such institution.</text>
 </subparagraph><subparagraph commented="no" id="HB8AEDEDF187E404BA2BF0EE31D8FCFCE"><enum>(B)</enum><header>Timely consideration</header><text>The Secretary may only consider a request for a waiver pursuant to <internal-xref idref="H9DFF7B187BBF4852A56B300D4173F5E9" legis-path="5.(c)(3)(A)">subparagraph (A)</internal-xref> that is received not later than 30 days after the receipt of the applicable notification.</text> </subparagraph></paragraph><paragraph id="H2476916862194ED6BE508D4153419B9E"><enum>(4)</enum><header>Restoration of eligibility</header><text>A prohibition under <internal-xref idref="H801733F1ED924B35A53974F88623FDDE" legis-path="5.(c)(1)">paragraph (1)</internal-xref> shall cease to apply with respect to an institution of higher education beginning on the date on which the Secretary determines that such institution has ceased such violation.</text>
 </paragraph><paragraph id="H6D5B1B224B3E46D0A1EB9A7EE841B1F1"><enum>(5)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">In this subsection, the term <term>institution of higher education</term> has the meaning given such term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text>
 </paragraph></subsection><subsection id="H4F9A36B46A824F9DBC1B79F6BDAA3C4C"><enum>(d)</enum><header>Centralized complaint mechanism</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Commerce shall establish procedures to allow any person to complain of a violation of section 4 of this Act by a United States person, and to refer such complaints to appropriate law enforcement entities.</text>
			</subsection></section><section id="H60F11589EB414961A3B7BB4D17CAE9E0"><enum>6.</enum><header>Private right of action</header>
 <subsection id="H9F3986D5490B481BA0B73443499AD457"><enum>(a)</enum><header>Right To bring action in Federal court</header><text display-inline="yes-display-inline">Any person who suffers injury to property or business as a result of a violation of <internal-xref idref="H78A8DC754D8F4E0F8FA678EF82C89EA2" legis-path="4.">section 4</internal-xref> or any regulation issued pursuant to such section may bring an action in the appropriate district court of the United States.</text>
 </subsection><subsection id="HC03503FC1420444FB9D15D19BEC89205"><enum>(b)</enum><header>Damages; relief</header><text>In an action under this section, the court may—</text> <paragraph id="H80C8490713E9404DB1ECA888D6F7ECCC"><enum>(1)</enum><text>award damages, in an amount not to exceed three times the value of the injury to the person bringing the action, and may additionally award attorneys’ fees and costs; and</text>
 </paragraph><paragraph id="HDD93A35A8125494D900E1A05F3F57541"><enum>(2)</enum><text>order appropriate injunctive relief.</text> </paragraph></subsection></section><section id="H13589D8D7CB640198481B344DB6231D7"><enum>7.</enum><header>Reports</header> <text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Commerce shall submit to the appropriate congressional committees a report listing—</text>
 <paragraph id="HB419B31D3CFD4CE88BB549BE8A34F8A0"><enum>(1)</enum><text>each person that sponsored a commercial boycott against a friendly country to the United States in the prior calendar year; and</text>
 </paragraph><paragraph id="H1B10242DA8E349A0A727EC246CE584C3"><enum>(2)</enum><text>each institution of higher education that has formally or officially participated in a boycott against an academic institution or scholar from a friendly country to the United States in the prior calendar year.</text>
 </paragraph></section><section id="HB3830B13FBA24FA98EDCCBD7DCD351CC"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H6BEF219DF05E4F0ABF70D98182032FC8"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text>
 <subparagraph id="H1B32974FEFED4076ADE050BD7D3F96F2"><enum>(A)</enum><text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives; and</text>
 </subparagraph><subparagraph id="HBDF04059243144B8A7CFA41626473A9C"><enum>(B)</enum><text>the Committee on Banking, Housing, and Urban Affairs and the Committee on Appropriations of the Senate.</text>
 </subparagraph></paragraph><paragraph id="HD1A8FDF6226A4C26AEAB9D2BBFF21822"><enum>(2)</enum><header>Boycotted country</header><text>The term <term>boycotted country</term> shall be construed to include all territories controlled by such country.</text> </paragraph><paragraph id="HDBB993F1436D4C15B414AEAA84E54836"><enum>(3)</enum><header>Boycotting entity</header><text>The term <term>boycotting entity</term> means any country or person calling for a commercial boycott of a boycotted country.</text>
 </paragraph><paragraph id="HD6328A18E6DF44E88B7570014A7F8B65"><enum>(4)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="H2804A71BE7CD4AC29B18D1B1378B9FB1"><enum>(A)</enum><text display-inline="yes-display-inline">a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text>
 </subparagraph><subparagraph id="HABD32442462C4FE3A154C23943744D08"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text>
				</subparagraph></paragraph></section></legis-body></bill>
