			 advance high-definition road mapping in order to further the safe
			 deployment of highly automated vehicles.</official-title></form>
	<legis-body id="H5F96CFBF4DF04CC89E45AE2DD2E3EC46" style="OLC">
 <section id="H9B71BED08F634C62B036B6098D4FB178" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Automated Vehicle Safety Act of 2018</short-title></quote>.</text> </section><section id="HF296F8207D50455D9DE2435E9B5F58D7"><enum>2.</enum><header>Grants for establishment of high-definition road mapping pilot programs</header> <subsection id="H4DDA21D18F114CE4BE66BECB2960BFA1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall make grants on a competitive basis to eligible entities for such entities to establish pilot programs to advance high-definition road mapping in order to further the safe deployment of highly automated vehicles.</text>
 </subsection><subsection id="H33F11872E3AE48D68A53A12B9E34E7DE"><enum>(b)</enum><header>Eligibility</header><text>The Secretary may only award a grant under this section to an eligible entity that—</text> <paragraph id="HE2D34A1D397C4AEBB6F773910644CEF1"><enum>(1)</enum><text>submits an application at such time, in such form, and with such information and assurances as the Secretary may require;</text>
 </paragraph><paragraph id="H6C0DA4D746EF450FB6560FF4A4E11587"><enum>(2)</enum><text display-inline="yes-display-inline">has the ability to—</text> <subparagraph id="H2A05EC862B174BECB84F9BF142ECDF19"><enum>(A)</enum><text>integrate high-definition road mapping data into a human-in-the-loop, motion-based driving simulator that—</text>
 <clause id="HECF3FAC2189740D28A1E23E3B2EB14D4"><enum>(i)</enum><text>has a 360-degree field of view;</text> </clause><clause id="HAFD7FAEF321E49E8A58034854BEB4D7D"><enum>(ii)</enum><text>has the ability to simultaneously perform sustained acceleration and braking combined with multiple lane changes to realistically recreate the experience of driving a vehicle; and</text>
 </clause><clause id="H3019ED4B155E46A28AB78E65853A08E1"><enum>(iii)</enum><text>has interchangeable physical vehicle cabs to support testing with light and heavy vehicles;</text> </clause></subparagraph><subparagraph id="HAF5FA38266824D32B8709B0169D46BA4"><enum>(B)</enum><text>integrate high-definition road mapping data into highly automated vehicles operated on public roads or highways; and</text>
 </subparagraph><subparagraph id="HEA2CA2E951174D8B83AB67C15A55A6DC"><enum>(C)</enum><text>use a facility that has been designated as an Automated Vehicle Proving Ground by the Secretary; and</text>
 </subparagraph></paragraph><paragraph id="H89636554BE2C483F91585AC6B2189B47"><enum>(3)</enum><text>has a demonstrated history of working with the Department of Transportation or a State department of transportation on high-definition road mapping.</text>
				</paragraph></subsection><subsection id="HADF85E3267A243DF8B5A74FD3F9AB1C9"><enum>(c)</enum><header>Use of funds</header>
 <paragraph id="H18315FA6928344BCAD172246672F898C"><enum>(1)</enum><header>Pilot program</header><text display-inline="yes-display-inline">An eligible entity that is awarded a grant under this section shall use the grant funds to conduct a pilot program to carry out high-definition road mapping and to use such mapping in the operation of highly automated vehicles in order to determine the challenges, barriers, and considerations that must be taken into account when planning for and deploying a nationwide high-definition road mapping digital infrastructure that enables the safe operation of highly automated vehicles.</text>
 </paragraph><paragraph id="H921C60C7DA8C4520BD42E7E00F4101B8"><enum>(2)</enum><header>Requirements</header><text>In conducting a pilot program under paragraph (1), an eligible entity shall—</text> <subparagraph id="HA0D67C49941A4FDCBC809E4BD039A417"><enum>(A)</enum><text display-inline="yes-display-inline">identify and evaluate minimum data quality standards and specifications for high-definition road mapping that are required to support the safe operation of highly automated vehicles, based on best practices from across the United States;</text>
 </subparagraph><subparagraph id="H57188712DD7D44E1B8A08D9AC1B3C06E"><enum>(B)</enum><text>conduct a feasibility analysis of the high-definition road mapping, and the use of such mapping in the operation of highly automated vehicles, proposed to be carried out in the pilot program;</text>
 </subparagraph><subparagraph id="HC28A7D3F43444D0B8DBDCA81D6E2D060"><enum>(C)</enum><text>conduct a simulation to ensure the safe operation of highly automated vehicles before operating any such vehicles on public roads or highways;</text>
 </subparagraph><subparagraph id="H32698CBDB7FE4B669788268EFD06B072"><enum>(D)</enum><text>ensure consideration of—</text> <clause id="H1EE0C0ABDB314A2EA0512D89686C497D"><enum>(i)</enum><text>the ability to perform accurate mapping in varied weather conditions; and</text>
 </clause><clause id="H1A6A504C96074EBD85B480FA6FF11BDA"><enum>(ii)</enum><text>mapping of both rural and urban roadways and environments (including gravel roads); and</text> </clause></subparagraph><subparagraph id="HFB8DE7B4A258479097BEB17AAD6318AE"><enum>(E)</enum><text>prepare and submit to the Secretary the reports required by subsection (g)(1).</text>
 </subparagraph></paragraph><paragraph id="HEB0AF32D00714B9EB4F20DB0ED3FE18B"><enum>(3)</enum><header>Other permitted uses of funds</header><text>An eligible entity that is awarded a grant under this section may use grant funds—</text> <subparagraph id="H19490A125EE24D89AC47D05680B0C2F2"><enum>(A)</enum><text display-inline="yes-display-inline">to contract, through a competitive selection process, for the carrying out of any activity for which grant funds are required or permitted to be used, including procuring services from or carrying out activities at a research center at an institution of higher education (as defined in sections 101 and 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>; 1002)) that has experience with high-definition road mapping and highly automated vehicles capable of ingesting high-definition road mapping data; and</text>
 </subparagraph><subparagraph id="HB8A1E2C71C2E4AAAA7DDE54B48A450B8"><enum>(B)</enum><text>for international travel for purposes of exchanging information with other institutions involved in high-definition road mapping and highly automated vehicle research or operation.</text>
 </subparagraph></paragraph></subsection><subsection id="HD297244D93924CAEB08C98AD2EA8CE02"><enum>(d)</enum><header>Duration</header><text>An eligible entity that is awarded a grant under this section shall complete all activities required under the grant (except for preparation and submission of the final report required by subsection (g)(1)(B)) not later than 3 years after the date on which such grant is awarded.</text>
 </subsection><subsection id="H0776317D3CFF45A392D9E4EA6EC9E2D7"><enum>(e)</enum><header>Number of grants</header><text>The Secretary may not make—</text> <paragraph id="HADA62C3E146B4682B97FD28C9FC38654"><enum>(1)</enum><text>more than 3 grants under this section; or</text>
 </paragraph><paragraph commented="no" id="HF82EA87EEE264A5590B2BFFC023B2C81"><enum>(2)</enum><text>more than 1 grant under this section to the same eligible entity.</text> </paragraph></subsection><subsection id="H012660EA513E494AA39FB6E8CD346FBD"><enum>(f)</enum><header>Grant amount</header><text>The amount of each grant awarded under this section may not exceed $10,000,000.</text>
			</subsection><subsection id="H70ADA546BC1D403BBB6EF723060F7606"><enum>(g)</enum><header>Reports</header>
				<paragraph id="H4A928D0D6EB94250AD0CCC2ADBC3F6ED"><enum>(1)</enum><header>By eligible entities to Secretary</header>
 <subparagraph id="H228AEB38AD724F6083471EC9FD29372B"><enum>(A)</enum><header>Interim reports</header><text display-inline="yes-display-inline">An eligible entity that is awarded a grant under this section shall submit to the Secretary, not later than 6 months, 18 months, and 2 years after the date on which such grant is awarded, an interim report that contains a description of the activities carried out using grant funds.</text>
 </subparagraph><subparagraph id="H4167C4DA72624F91A1698F418A4225AC"><enum>(B)</enum><header>Final report</header><text display-inline="yes-display-inline">An eligible entity that is awarded a grant under this section shall submit to the Secretary, not later than 39 months after the date on which such grant is awarded, a final report that contains a description of—</text>
 <clause id="H109AEBBC3AA847E89FD663C2803BED58"><enum>(i)</enum><text>the activities carried out using grant funds;</text> </clause><clause commented="no" id="H80ADCD23D7E5470C9E84DF5DEAE03AEE"><enum>(ii)</enum><text>the results of the pilot program conducted under subsection (c)(1), including the challenges, barriers, and considerations determined under such subsection; and</text>
 </clause><clause commented="no" id="HC744A69DC6D3404FAC1FF7FC56FCF242"><enum>(iii)</enum><text display-inline="yes-display-inline">the minimum data quality standards and specifications identified under subsection (c)(2)(A).</text> </clause></subparagraph></paragraph><paragraph id="H8D9ECC0B17114F2FBD232694B7E73F1B"><enum>(2)</enum><header>By Secretary to Congress</header><text>Not later than 41 months after all grants under this section have been awarded, the Secretary shall submit to Congress a report on the activities carried out using grant funds under this section that summarizes the information in the reports submitted by eligible entities under paragraph (1).</text>
				</paragraph></subsection><subsection id="H3C2EF30656D247E6BE283B7D85700DD8"><enum>(h)</enum><header>Definitions</header>
 <paragraph id="H50FCD0E6AD464115A88298623DA06128"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In this section:</text> <subparagraph id="H17B5D49136624639B37B062BCF9FD930"><enum>(A)</enum><header>Automated driving system</header><text display-inline="yes-display-inline">The term <quote>automated driving system</quote> means the hardware and software that are collectively capable of performing the entire dynamic driving task on a sustained basis, regardless of whether such system is limited to a specific operational design domain.</text>
 </subparagraph><subparagraph id="H1E154E82DE5845C082BE3BEFE396C4AE"><enum>(B)</enum><header>Dynamic driving task</header><text display-inline="yes-display-inline">The term <quote>dynamic driving task</quote> means all of the real time operational and tactical functions required to operate a vehicle in on-road traffic, excluding the strategic functions such as trip scheduling and selection of destinations and waypoints, and including—</text>
 <clause id="H8943A1BC09B343C28A9722CF0F74F40A"><enum>(i)</enum><text>lateral vehicle motion control via steering;</text> </clause><clause id="HD00BDA0D916940058E06E7C27EF35C08"><enum>(ii)</enum><text>longitudinal vehicle motion control via acceleration and deceleration;</text>
 </clause><clause id="HA185DC6E56CC44D0B1178E8E8621A2D4"><enum>(iii)</enum><text>monitoring the driving environment via object and event detection, recognition, classification, and response preparation;</text>
 </clause><clause id="H6D756EFBD2A84D8EA9E6CAC53D75C69C"><enum>(iv)</enum><text>object and event response execution;</text> </clause><clause id="HD77E1895FB9145C983BF3C1646189789"><enum>(v)</enum><text>maneuver planning; and</text>
 </clause><clause id="HB90CFFE413AA4FE09D4750BBC61961E0"><enum>(vi)</enum><text>enhancing conspicuity via lighting, signaling, and gesturing.</text> </clause></subparagraph><subparagraph id="H4441FE8DEE6E49BF86B82F1E03C1420C"><enum>(C)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text>
 <clause id="H854259155194476EA7AC8922298D0ACE"><enum>(i)</enum><text>a nonprofit organization;</text> </clause><clause id="HF82C911339E845BAA15B01F0E0852E3D"><enum>(ii)</enum><text>a State or political subdivision of a State; and</text>
 </clause><clause id="HC6BC88DCB37648968C3E2E066C4C20AF"><enum>(iii)</enum><text>an institution of higher education (as defined in sections 101 and 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>; 1002)).</text>
 </clause></subparagraph><subparagraph id="H52B45BB4D32341DF9727E76220B2D8A4"><enum>(D)</enum><header>Highly automated vehicle</header><text>The term <quote>highly automated vehicle</quote>—</text> <clause id="HF9A3F343D85746D8A1C40B5579B8215E"><enum>(i)</enum><text>means a motor vehicle equipped with an automated driving system; and</text>
 </clause><clause id="H5D09DC41847646F7B3D17B438480206A"><enum>(ii)</enum><text display-inline="yes-display-inline">does not include a commercial motor vehicle (as defined in section 31101 of title 49, United States Code).</text>
 </clause></subparagraph><subparagraph commented="no" id="HF1411FE88E3540EB9F6DFC955C08EC84"><enum>(E)</enum><header>High-definition</header><text>The term <quote>high-definition</quote> means, with respect to road mapping, that the mapping involves highly accurate data that enables a highly automated vehicle to accurately position and control itself in a lane.</text>
 </subparagraph><subparagraph id="HD8B8A2FED55C495D96D7C6C37CEB50F6"><enum>(F)</enum><header>Motor vehicle</header><text>The term <quote>motor vehicle</quote> has the meaning given such term in section 30102(a) of title 49, United States Code.</text> </subparagraph><subparagraph id="HB1BB754E92AD45E398EC0FC88241460A"><enum>(G)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <quote>nonprofit organization</quote> means any corporation or association, however organized, no part of the net earnings of which inures to the benefit of any private shareholder or individual.</text>
 </subparagraph><subparagraph id="H65537F8A791D4EEDBF0535C201FF4AC9"><enum>(H)</enum><header>Operational design domain</header><text display-inline="yes-display-inline">The term <quote>operational design domain</quote> means the specific conditions under which a given driving automation system or feature thereof is designed to function.</text>
 </subparagraph><subparagraph id="H3EC254C8B00F426BBD8597DBF97ED374"><enum>(I)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Transportation.</text> </subparagraph><subparagraph commented="no" id="HD1F82C6A9F5A45FB887FD10759173DB5"><enum>(J)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H008AA8A087FB47C4B98C637A758528E0"><enum>(2)</enum><header>Revisions to certain definitions</header>
 <subparagraph commented="no" id="HB4F4ACED34354BFF9DA795ACB9195BDF"><enum>(A)</enum><header>Revisions by SAE International</header><text display-inline="yes-display-inline">If SAE International (or its successor organization) revises the definition of any of the terms defined in subparagraph (A), (B), or (H) of paragraph (1) in Recommended Practice Report J3016, it shall notify the Secretary of the revision. The Secretary shall publish a notice in the Federal Register to inform the public of the new definition unless, within 90 days after receiving notice of the new definition and after opening a period for public comment on the new definition, the Secretary notifies SAE International (or its successor organization) that the Secretary has determined that the new definition does not meet the need for motor vehicle safety, or is otherwise inconsistent with the purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code. If the Secretary so notifies SAE International (or its successor organization), the existing definition in paragraph (1) shall remain in effect.</text>
 </subparagraph><subparagraph commented="no" id="H8BB0F18A9DB64D8B86472305CD45B6DA"><enum>(B)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">If the Secretary does not reject a <italic></italic>definition revised by SAE International (or its successor organization) as described in subparagraph (A), the Secretary shall promptly make any conforming amendments to the regulations and standards of the Secretary that are necessary. The revised definition shall apply for purposes of this section. The requirements of section 553 of title 5, United States Code, shall not apply to the making of any such conforming amendments.</text>
 </subparagraph><subparagraph commented="no" id="H3B4EFC07901E4DD0813BD7AB25C86792"><enum>(C)</enum><header>Updates by Secretary</header><text display-inline="yes-display-inline">Pursuant to section 553 of title 5, United States Code, the Secretary may update any of the definitions in subparagraph (A), (B), or (H) of paragraph (1) if <italic></italic>the Secretary determines that materially changed circumstances regarding highly automated vehicles have impacted motor vehicle safety such that the definitions need to be updated to reflect such circumstances.</text>
 </subparagraph></paragraph></subsection><subsection id="HED283B9891AC43EA8EA4C3C16AAC46EB"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $31,500,000, of which not more than 5 percent shall be available for administrative costs, for fiscal year 2019.</text>
