 <section id="H09C48716C8F842069C7AC573E6477990" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Contra Costa Canal Transfer Act</short-title></quote>.</text> </section><section id="H2AD2F2C318734DB08D50E4ECC5AB05D1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H73A0E7D752034379A469F9C01BC84ADF"><enum>(1)</enum><header>Acquired land</header><text>The term <term>acquired land</term> means land in Federal ownership and land over which the Federal Government holds an interest for the purpose of the construction and operation of the Contra Costa Canal, including land under the jurisdiction of—</text>
 <subparagraph id="H9F700C322395437E82FDC1C620719C26"><enum>(A)</enum><text>the Bureau of Reclamation;</text> </subparagraph><subparagraph id="HC26A3C927EF747F9AC23803532DD754A"><enum>(B)</enum><text>the Western Area Power Administration; and</text>
 </subparagraph><subparagraph id="HF5F9702EC8514539B92738B7AA97C923"><enum>(C)</enum><text>the Department of Defense in the case of the Clayton Canal diversion traversing the Concord Naval Weapons Station.</text>
 </subparagraph></paragraph><paragraph id="HB8A6119BBDEB4DC8BF2FDB53C3D02317"><enum>(2)</enum><header>Contra Costa Canal Agreement</header><text display-inline="yes-display-inline">The term <quote>Contra Costa Canal Agreement</quote> means an agreement between the District and the Bureau of Reclamation to determine the legal, institutional, and financial terms surrounding the transfer of the Contra Costa Canal, including but not limited to compensation to the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093), equal to the net present value of miscellaneous revenues that the United States would otherwise derive over the 10 years following enactment of this Act from the eligible lands and facilities to be transferred, as governed by reclamation law and policy and the contracts.</text>
			</paragraph><paragraph id="H2D15F1ADD2B944318D275F9C11CCFD23"><enum>(3)</enum><header>Contra Costa Canal</header>
 <subparagraph id="H1935DEB4A17C45C4A3365D0DEC0AB60F"><enum>(A)</enum><header>In general</header><text>The term <term>Contra Costa Canal</term> means the Contra Costa Canal Unit of the Central Valley Project, which exclusively serves the Contra Costa Water District in an urban area of Contra Costa County, California.</text>
 </subparagraph><subparagraph id="HC30B13354C65495AAB0C80D218E90F70"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Contra Costa Canal</term> includes pipelines, conduits, pumping plants, aqueducts, laterals, water storage and regulatory facilities, electric substations, related works and improvements, and all interests in land associated with the Contra Costa Canal Unit of the Central Valley Project in existence on the date of enactment of this Act.</text>
 </subparagraph><subparagraph id="HBEEDEB0CF5FC400D89CA4CE721AC8378"><enum>(C)</enum><header>Exclusion</header><text>The term <term>Contra Costa Canal</term> does not include the Rock Slough fish screen facility.</text> </subparagraph></paragraph><paragraph id="HE551EA5E91C741A0B33DBB0CA17044E9"><enum>(4)</enum><header>Contracts</header><text>The term <term>contracts</term> means the existing water service contract between the District and the United States, Contract No. 175r–3401A–LTR1 (2005), Contract No. 14–06–200–6072A (1972, as amended), and any other contract or land permit involving the United States, the District, and Contra Costa Canal.</text>
 </paragraph><paragraph id="HDAD8DB511B0C44C7BF4F43AEA2B2D654"><enum>(5)</enum><header>District</header><text>The term <term>District</term> means the Contra Costa Water District, a political subdivision of the State of California.</text> </paragraph><paragraph id="H7A0C41E8A8364B238F4E25C420CD5832"><enum>(6)</enum><header>Rock Slough fish screen facility</header> <subparagraph id="HF37530E747754C869D987E8594363D59"><enum>(A)</enum><header>In general</header><text>The term <term>Rock Slough fish screen facility</term> means the fish screen facility at the Rock Slough intake to the Contra Costa Canal.</text>
 </subparagraph><subparagraph id="H2CBEDED71BC542568A675F9E35568F94"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Rock Slough fish screen facility</term> includes the screen structure, rake cleaning system, and accessory structures integral to the screen function of the Rock Slough fish screen facility, as required under the Central Valley Project Improvement Act (<external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; 106 Stat. 4706).</text>
 </subparagraph></paragraph><paragraph id="H24D2E9B9EA6E4364871BB908E6738E25"><enum>(7)</enum><header>Rock Slough fish screen facility title transfer agreement</header><text display-inline="yes-display-inline">The term <quote>Rock Slough fish screen facility title transfer agreement</quote> means an agreement between the District and the Bureau of Reclamation to—</text> <subparagraph id="H01ADE02309FD4732B32619A8CF96E746"><enum>(A)</enum><text>determine the legal, institutional, and financial terms surrounding the transfer of the Rock Slough fish screen facility; and</text>
 </subparagraph><subparagraph id="HBC575A290BDD4D32B219040F9DD2CF03"><enum>(B)</enum><text>ensure the continued safe and reliable operations of the Rock Slough fish screen facility.</text> </subparagraph></paragraph><paragraph id="H91A6F3DD43A4484BACA9D29205B62C9A"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="H7DBFCB56362A44B9B7D536E7F83C403C"><enum>3.</enum><header>Conveyance of land and facilities</header>
 <subsection id="H40D90DF7824E4B2C8943B0D4A9F177D4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, in consideration for the District assuming from the United States all liability for the administration, operation, maintenance, and replacement of the Contra Costa Canal, consistent with the terms and conditions set forth in the Contra Costa Canal Agreement and subject to valid existing rights and existing recreation agreements between the Bureau of Reclamation and the East Bay Regional Park District for Contra Loma Regional Park and other local agencies within the Contra Costa Canal, the Secretary shall offer to convey and assign to the District—</text>
 <paragraph id="HB96C5ED21A5A43D884FF78E900C05383"><enum>(1)</enum><text>all right, title, and interest of the United States in and to—</text> <subparagraph id="H30372DF9030B4CCABB3E8BF1A82B56BA"><enum>(A)</enum><text>the Contra Costa Canal; and</text>
 </subparagraph><subparagraph id="HD8F04FD3298249FAA724D85743D80568"><enum>(B)</enum><text>the acquired land; and</text> </subparagraph></paragraph><paragraph id="HF42BE635E7F5497BB513E4306B95852A"><enum>(2)</enum><text>all interests reserved and developed as of the date of enactment of this Act for the Contra Costa Canal in the acquired land, including existing recreation agreements between the Bureau of Reclamation and the East Bay Regional Park District for Contra Loma Regional Park and other local agencies within the Contra Costa Canal.</text>
				</paragraph></subsection><subsection id="H842FD92B73804B259076991F1EA6DA7E"><enum>(b)</enum><header>Rock Slough fish screen facility</header>
 <paragraph id="H7871B6D13F5A41AAAC7EC54EEF71C2C0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall convey and assign to the District all right, title, and interest of the United States in and to the Rock Slough fish screen facility pursuant to the Rock Slough fish screen facility title transfer agreement.</text>
 </paragraph><paragraph id="H3DA82209EAD44F5AB1BEED0DBB843E89"><enum>(2)</enum><header>Cooperation</header><text display-inline="yes-display-inline">No later than 180 days after the conveyance of the Contra Costa Canal, the Secretary and the District shall enter into good faith negotiations to accomplish the conveyance and assignment under paragraph (1).</text>
 </paragraph></subsection><subsection id="HEDEC069E97A24EA49C5763286DECA7B7"><enum>(c)</enum><header>Payment of costs</header><text>The District shall pay to the Secretary any administrative and real estate transfer costs incurred by the Secretary in carrying out the conveyances and assignments under subsections (a) and (b), including the cost of any boundary survey, title search, cadastral survey, appraisal, and other real estate transaction required for the conveyances and assignments.</text>
			</subsection><subsection id="H3F431FB6FCE6439FBC60CEB0F81B2680"><enum>(d)</enum><header>Compliance with environmental laws</header>
 <paragraph id="H5BB20A86DBDE4174B0C79E49D74496B7"><enum>(1)</enum><header>In general</header><text>Before carrying out the conveyances and assignments under subsections (a) and (b), the Secretary shall comply with all applicable requirements under—</text>
 <subparagraph id="HFD8DE18B0A774AB995A5634664B47985"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.);</text> </subparagraph><subparagraph id="HB698DC9E749F4319B41C9F1ED01BCE39"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="H2BB63A377992432083DA97DF72AA106B"><enum>(C)</enum><text>any other law applicable to the Contra Costa Canal or the acquired land.</text> </subparagraph></paragraph><paragraph id="H419441995D99409BB8ADEA8EAD42CC17"><enum>(2)</enum><header>Effect</header><text>Nothing in this Act modifies or alters any obligations under—</text>
 <subparagraph id="H0FC772D3D11F4AE2B64B3DDE28D3014C"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); or</text> </subparagraph><subparagraph id="HC528288033AD4E13B9059C7999062E23"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text>
					</subparagraph></paragraph></subsection></section><section id="HB1A14019A49144EF86341BA299DE42FC"><enum>4.</enum><header>Relationship to existing Central Valley Project contracts</header>
 <subsection id="HA4F48C6D2A7043CFA39EC4AC0264A94A"><enum>(a)</enum><header>In general</header><text>Nothing in this Act affects—</text> <paragraph id="H80C69CE8EF6642CAB4B603F441AF6737"><enum>(1)</enum><text>the application of the reclamation laws to water delivered to the District pursuant to any contract with the Secretary; or</text>
 </paragraph><paragraph id="H90ACC69D66A34E09ABDB887A9A2BAD0F"><enum>(2)</enum><text>subject to subsection (b), the contracts.</text> </paragraph></subsection><subsection id="H9979A0A3736544C39D496098F3A602DE"><enum>(b)</enum><header>Amendments to contracts</header><text>The Secretary and the District may modify the contracts as necessary to comply with this Act.</text>
			</subsection><subsection id="HC968052BCF114722B82FF3A51F861100"><enum>(c)</enum><header>Liability</header>
 <paragraph id="H0BA8021A44E3469BA07259CEC5C88ED2"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the United States shall not be liable for damages arising out of any act, omission, or occurrence relating to the Contra Costa Canal or the acquired land.</text>
 </paragraph><paragraph id="HD5823C53A8544E898578F55BB59BBA42"><enum>(2)</enum><header>Exception</header><text>The United States shall continue to be liable for damages caused by acts of negligence committed by the United States or by any employee or agent of the United States before the date of the conveyance and assignment under section 3(a), consistent with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly known as the <quote>Federal Tort Claims Act</quote>).</text>
 </paragraph><paragraph id="H629EFD57567349D5B526EE10A1E7F848"><enum>(3)</enum><header>Limitation</header><text>Nothing in this Act increases the liability of the United States beyond the liability provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code.</text>
 </paragraph></subsection></section><section id="H900260C8D3014C678427CC926AE1811F"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">If the conveyance and assignment authorized by section 3(a) is not completed by the date that is 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report that—</text>
 <paragraph id="HEA50F57C5F954A28BFBF6F652FCD6015"><enum>(1)</enum><text>describes the status of the conveyance and assignment;</text> </paragraph><paragraph id="H4B9C34A2642B41E8B2016BAD49613679"><enum>(2)</enum><text>describes any obstacles to completing the conveyance and assignment; and</text>
 </paragraph><paragraph id="H00113631BC8B47A0B380DEA542828F92"><enum>(3)</enum><text>specifies an anticipated date for completion of the conveyance and assignment.</text> </paragraph></section></legis-body> <endorsement display="yes"> <action-date>August 31, 2018</action-date> <action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement> </bill>
