			 reduction program, and for other purposes.</official-title></form>
	<legis-body id="H30E23B38069F4B418BD21A12E8151F15" style="OLC">
 <section id="HBB320A54690643D2909B7CB454FD076B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bus Operator and Pedestrian Protection Act</short-title></quote>.</text> </section><section id="H365BC350999F4F61B9E3190D2BD70795" section-type="subsequent-section"><enum>2.</enum><header>Bus operations safety risk reduction program</header> <subsection id="HBC2685EA4282431486F648EFB82E2469"><enum>(a)</enum><header>Public transportation safety program section</header><text display-inline="yes-display-inline">Section 5329 of title 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H19C174522E2C4C46889D708EC38D6A5D" style="OLC">
					<subsection id="H69C9D65784DE43738F4CB5D30E6B527E"><enum>(l)</enum><header>Bus operations safety risk reduction program</header>
 <paragraph id="H1BFE5C9CDE13450EAF2BB192B96F64DA"><enum>(1)</enum><header>Requirements</header><text>Not later than 2 years after the date of the enactment of this subsection, the Secretary shall require each recipient that operates fixed route bus service to—</text>
 <subparagraph id="H5A5B93405EF34DEE96A00AFB0B8A6CBC"><enum>(A)</enum><text>develop a risk reduction program for bus operations under paragraph (2) to improve safety by reducing the number and rates of accidents, injuries, assaults on bus operators, and fatalities;</text>
 </subparagraph><subparagraph id="HD07B6A1284984F64B3D7CA875E0EF1AC"><enum>(B)</enum><text>submit the program, including the implementation plan required under paragraph (3), to the Secretary for review and approval; and</text>
 </subparagraph><subparagraph id="HA0768ACA53A94F679A8FD658DE99CB23"><enum>(C)</enum><text>implement the program and plans approved by the Secretary.</text> </subparagraph></paragraph><paragraph id="HB20DF05F5A694714B3C24DF6E2BA1963"><enum>(2)</enum><header>Development of program</header><text>A recipient required to develop and submit a risk reduction program for bus operations under paragraph (1)—</text>
 <subparagraph id="H2F66BD9C5EDF482692390A96F4FC32E5"><enum>(A)</enum><text>shall develop such program by conducting risk analysis on the bus operations of the recipient;</text> </subparagraph><subparagraph id="H57608EA2E0294E83B5B4F36C2C71141C"><enum>(B)</enum><text>may incorporate such program into an applicable comprehensive safety plan that such recipient prepares pursuant to subsection (d), if all requirements under this subsection are addressed in the recipient’s comprehensive safety plan; and</text>
 </subparagraph><subparagraph id="H085EF94FC8F149349B0DBD516E726ECC"><enum>(C)</enum><text>shall develop such program in cooperation with bus operators and collective bargaining representatives of bus operators, including the development of—</text>
 <clause id="H664C01749A4E4662BE538A8C7B2484BF"><enum>(i)</enum><text>the risk analysis required under subparagraph (A); and</text> </clause><clause id="H0F8FD4B5D20F457EBB03C794C2D40110"><enum>(ii)</enum><text>implementation plans required under paragraph (3).</text>
 </clause></subparagraph></paragraph><paragraph id="HE17337AF2ECF490DA950BCEB37636CF1"><enum>(3)</enum><header>Implementation plan</header><text>Each risk reduction program for bus operations under paragraph (1) shall include an implementation plan for—</text>
 <subparagraph id="HCF5D9851689C44AFB894E199A64958AA"><enum>(A)</enum><text>reduction of vehicular and pedestrian accidents involving buses that includes—</text> <clause id="H600ACCF082474EF5893F18832BFDB2DE"><enum>(i)</enum><text>deployment of driver assistance technologies for bus operators that reduce or prevent accidents; and</text>
 </clause><clause id="HCA1D4D8AAD87488A969C47E07F6AA35B"><enum>(ii)</enum><text>measures to reduce visibility impairments for bus operators that contribute to accidents, including retrofits to buses in revenue service and specifications for future procurements that reduce visibility impairments;</text>
 </clause></subparagraph><subparagraph id="HE71124D7F16A4BFCBEFB842976B3C77D"><enum>(B)</enum><text>bus operator assault mitigation, including—</text> <clause id="H2A3B710E96BE48A8A90502579276ECEC"><enum>(i)</enum><text>the deployment of assault mitigation infrastructure and technology on buses, including barriers to restrict the unwanted entry of individuals and objects into bus operators’ workstations when a recipient’s risk analysis determines that such barriers would reduce assaults and injuries to bus operators; and</text>
 </clause><clause id="H14D3B4E45A8140069FAD799824E24BDE"><enum>(ii)</enum><text>conflict de-escalation training for bus operators;</text> </clause></subparagraph><subparagraph id="HE0DEF70CCC35437B845F42244637D227"><enum>(C)</enum><text>installation of seating and modification to design specifications of bus operator workstations that reduce or prevent injuries from ergonomic risks; and</text>
 </subparagraph><subparagraph id="HABA0491D1B6E4ABB9DA4C3354E172D1C"><enum>(D)</enum><text>other measures that the Secretary determines would significantly reduce the number and rate of accidents, injuries, assaults on bus operators, and fatalities related to bus operations;</text>
 </subparagraph></paragraph><paragraph id="HD77ED85129954BC987D6D160819E7702"><enum>(4)</enum><header>Updating requirements</header><text>The Secretary shall require each recipient required to develop a program under paragraph (1) to—</text> <subparagraph id="HC613E914D59942DFBAC1E830146B8BCE"><enum>(A)</enum><text>update such program annually; and</text>
 </subparagraph><subparagraph id="H2CE4D3A7C65A43E9A05F37B66A8CB59D"><enum>(B)</enum><text>resubmit such program for approval by the Secretary not less than once every 3 years.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H5728C9FC0DBC4E7E803BE6C12DBDC1F5"><enum>(b)</enum><header>FAST Act</header><text display-inline="yes-display-inline">Section 3022(a) of the Fixing America's Surface Transportation Act (<external-xref legal-doc="usc" parsable-cite="usc/49/5329">49 U.S.C. 5329</external-xref> note) is amended by adding the following new sentence: <quote>Not later than 1 year after the date of the enactment of the Bus Operator and Pedestrian Protection Act, the Secretary shall issue a final rule regarding the protection of public transportation operators from the risk of assault.</quote> </text>
			</subsection></section><section id="HF4E4AA92C9914BD4986905479B97106D"><enum>3.</enum><header>Authorization of appropriations</header>
 <subsection id="H6E8D52B202454EE6924FFD1C397A4D27"><enum>(a)</enum><header>Amount and duration</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out implementation plans under the risk reduction program described in section 5329(l) of title 49, United States Code, as added by section 2 of this Act, $25,000,000 for each of fiscal years 2019 through 2023.</text>
 </subsection><subsection id="HAD04CA1E4741497686EC4E96242EF068"><enum>(b)</enum><header>Formula</header><text>Of the amounts made available to carry out this subsection for a fiscal year—</text> <paragraph id="HC5ED6B0AB4444441AE51B699E74556A4"><enum>(1)</enum><text>80 percent shall be distributed under the formula set forth in section 5336 of title 49, United States Code, other than subsection (b) of such section; and</text>
 </paragraph><paragraph id="HB3A03CDA0E0F439A82EA8BCE06503E3A"><enum>(2)</enum><text>20 percent shall be distributed under the formula set forth in section 5311(c)(3) of such title.</text> </paragraph></subsection></section><section id="H07DB0388767248C1B0A04BCCFAE732BE"><enum>4.</enum><header>Operator assault data</header><text display-inline="no-display-inline">Section 5335 of title 49, United States Code, is amended by adding at the end the following:</text>

				<subsection id="H812E77D66EB0401BBBDF0D08EC1A8F2E"><enum>(d)</enum><header>Operator Assault Data</header>
 <paragraph id="H5AD9DAC87BAE40EFB97DF13E9A2CAB28"><enum>(1)</enum><header>Report</header><text>The recipient of a grant under this chapter shall report to the Secretary, for inclusion in the National Transit Database, any information on each assault on an operator.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="H43F7DEB2D69F4F89B2B3E494A53FA49C"><enum>(2)</enum><header>Other reports</header><text>A report required under paragraph (1) shall be separate from the reporting on other safety incidents in the National Transit Database.</text>
 </paragraph><paragraph id="HCCBC514DE2DA4D49B3325E875F63FA89"><enum>(3)</enum><header>Definition</header><text>For purposes of this subsection:</text> <subparagraph id="HB2592A24A1F341B7A4D3C1438A37B22B"><enum>(A)</enum><text>The term <term>assault on an operator</term> means any circumstance when an individual knowingly and without lawful authority or permission with intent to endanger the safety or health of any individual, or with a reckless disregard for the safety or health of human life, interferes with, disables, or incapacitates any dispatcher, driver, captain, locomotive engineer, railroad conductor, or other individual while the individual is employed in dispatching, operating, controlling, or maintaining on-track equipment or a public transportation vehicle, including circumstances that do not require immediate medical attention or that do not result in a fatality.</text>
 </subparagraph><subparagraph id="H0894ADD31CCB4966AED851973EFC51D0"><enum>(B)</enum><text>The term <term>recipient</term> has the meaning given the term in section 5329(a).</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section></legis-body></bill>
