<section id="H1151125E7C024986A6DD9B95691511E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mill Springs Battlefield National Monument Act</short-title></quote>.</text></section> <section id="H250EDB8233394704B76F24AE5651A2C8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H0A11EC3BA1864969BA3B367C68C23656"><enum>(1)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>Map</quote> means the map entitled <quote>Mill Springs Battlefield National Monument, Nancy, Kentucky</quote> numbered 297/145513, and dated June 2018.</text></paragraph> <paragraph id="HE0378FCAF4BF4A598DF5DC151818A21D"><enum>(2)</enum><header>Monument</header><text>The term <quote>Monument</quote> means the Mill Springs Battlefield National Monument established by section 3(a).</text></paragraph>
<paragraph id="H61C7F563ECB747F2B2E90C0CB27179BD"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior, acting through the Director of the National Park Service.</text></paragraph></section> <section id="H18316F2342BE455784D4960A0A2B60A0"><enum>3.</enum><header>Establishment of mill springs battlefield national monument</header> <subsection id="H80D2DAEF25794ECC868512212DE61F72"><enum>(a)</enum><header>Establishment</header> <paragraph id="H91DF7A7275EE45F69E534D0B4403D906"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), there is established, as a unit of the National Park System, the Mill Springs Battlefield National Monument in the State of Kentucky, to preserve, protect, and interpret for the benefit of present and future generations the nationally significant historic resources of the Mill Springs Battlefield and its role in the American Civil War.</text></paragraph>
<paragraph id="H88C585FA97E54D01B7CBBC1144C56E94"><enum>(2)</enum><header>Conditions</header><text>The Monument shall not be established until the Secretary—</text> <subparagraph id="H4FD0B9FA7CD54870A240DC97D9CB4D5F"><enum>(A)</enum><text>has entered into a written agreement with the owner of any private or non-Federal land within the Mill Springs Battlefield National Monument boundary as depicted on the Map, providing that such property shall be donated to the United States for inclusion in the Monument to be managed consistently with the purposes of the Monument; and</text></subparagraph>
<subparagraph id="H219B838F2D5640E6A9C42BEFD90FF060"><enum>(B)</enum><text>has determined that sufficient land or interests in land have been acquired within the boundary of the Monument to constitute a manageable unit.</text></subparagraph></paragraph></subsection> <subsection id="H23C0F3EA4C47461A8ABE437EC0EF1803"><enum>(b)</enum><header>Boundaries</header><text>The boundaries of the Monument shall be the boundaries generally depicted on the Map.</text></subsection>
<subsection id="H2458C155F97C4F4C81ED3B3B862D2AB2"><enum>(c)</enum><header>Availability of map</header><text>The Map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subsection> <subsection id="H5012FD4D5418488EBF017BE4C0109EBE"><enum>(d)</enum><header>Acquisition authority</header><text>The Secretary may only acquire land or an interest in land located within the boundary of the Monument by—</text>
<paragraph id="H59EC051933B140F4BB3A280F78CBDA98"><enum>(1)</enum><text>donation;</text></paragraph> <paragraph id="HA170D6FC29C4403AAF714FFEC469C6D8"><enum>(2)</enum><text>purchase with donated funds; or</text></paragraph>
<paragraph id="H7B1FC90E678443DB9E863ADB42E10B5B"><enum>(3)</enum><text>exchange.</text></paragraph></subsection> <subsection id="HB6C61E81AE7F4B62B8633C3798A8D71A"><enum>(e)</enum><header>Administration</header> <paragraph id="HFCAB4DD336D7469194AFA20DAB646214"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the Monument in accordance with—</text>
<subparagraph id="HE666C30DD66C4BE2A18FFD8258414C6E"><enum>(A)</enum><text>this Act; and</text></subparagraph> <subparagraph id="H3F8C334C060141518BF9BC510CBC84ED"><enum>(B)</enum><text>the laws generally applicable to units of the National Park System, including—</text>
<clause id="H296AFB5BB6E544F2B3BB780A91EF0D7C"><enum>(i)</enum><text>section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54, United States Code; and</text></clause> <clause id="HEFB44F7B94CA437E982B2F8993370F1C"><enum>(ii)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/3201">chapter 3201</external-xref> of title 54, United States Code.</text></clause></subparagraph></paragraph>
<paragraph id="H64EA25AD838941A193E9DACF8D41317D"><enum>(2)</enum><header>Management plan</header>
<subparagraph id="HD3383CA1D0EC4287AF5AB24BAD757D7E"><enum>(A)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are first made available to the Secretary for this purpose, the Secretary shall prepare a general management plan for the Monument in accordance with section 100502 of title 54, United States Code.</text></subparagraph> <subparagraph id="HB3EC1FF9947D419A8CC78731B38999C0"><enum>(B)</enum><header>Submit to congress</header><text>On completion of the general management plan, the Secretary shall submit it to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph></subsection>
<subsection id="H2E7800BEF0B440EEA7BBEE375F07E719"><enum>(f)</enum><header>Private property protection</header><text>No private property or non-Federal public property shall be managed as part of the Monument without the written consent of the owner of such property.</text></subsection> <subsection id="HB075C95C636646ED8ECEAD5714717827"><enum>(g)</enum><header>No buffer zones</header><text>Nothing in this Act, the establishment of the Monument, or the management of the Monument shall be construed to create buffer zones outside of the Monument. The fact that an activity or use can be seen, heard, or detected from within the Monument shall not preclude the conduct of that activity or use outside of the Monument.</text></subsection></section>
