 <section id="HA52D33D2820542FD808AF87A77060D08" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Export Promotion Act</short-title></quote>.</text> </section><section id="H5C9DB8D268B14E53A1B51E8DF33DD8C5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="HCB554FA3839E4A109472DE0F7BCAE030"><enum>(1)</enum><text>Exporting goods and services is a critical part of the United States economy. A recent study by the International Trade Administration recently found that 11.6 million jobs across the country are directly supported by exports.</text>
 </paragraph><paragraph id="HD56DF851DCFE4BBF93D4824A6AAFD0D1"><enum>(2)</enum><text>Though United States exports have increased by one-third since 2010 and contributed to roughly one-third of all domestic economic growth, increases in exports have failed to meet lofty goals established by the Administration.</text>
 </paragraph><paragraph id="HA1CB2033BC134C228384DE514BD22065"><enum>(3)</enum><text>An important part of helping small- and mid-size businesses begin to export or to access new markets is export assistance provided by the Federal Government.</text>
 </paragraph><paragraph id="HD9E0A886BEFF477DB904A6BD4BABCDB4"><enum>(4)</enum><text>Numerous resources for companies exist at Federal agencies, including in the Department of Commerce, the Department of Agriculture, the Small Business Administration, the Department of State, the Export-Import Bank of the United States, the Overseas Private Investment Corporation, and others.</text>
 </paragraph><paragraph id="HC990563854274DA0B25D0EC5E4FF2A69"><enum>(5)</enum><text>These Federal agencies offer programs to provide technical and cultural assistance, low-cost financing, and the development of future export markets overseas.</text>
 </paragraph><paragraph id="HEAE769A3F115440193AA6EDBB02142EB"><enum>(6)</enum><text>While these Federal agencies and the programs they operate provide important assistance to United States companies, there is significant overlap among agencies that fails to maximize Federal resources and creates confusion for businesses seeking to navigate the bureaucracy.</text>
 </paragraph><paragraph id="HBF7F08435E644583A9F71E3C2FC7DC3F"><enum>(7)</enum><text>This confusion leads to less effective export promotion, wasted government resources, and an inability to track the success of Federal efforts.</text>
 </paragraph><paragraph id="H01FFED45935A4589A17B2099BFAC79EE"><enum>(8)</enum><text>Specifically, the U.S. Government Accountability Office has found that enhanced collaboration among these efforts could improve Federal agency efforts, reduce overlap, and ease confusion for small businesses.</text>
 </paragraph><paragraph id="HD1206BDAD7B54201811217E9CB563FAD"><enum>(9)</enum><text>Intra-agency efforts have fallen short in providing greater cohesion and communication among Federal export programs.</text>
 </paragraph><paragraph id="H4F0EA81A4BBD44DCB3DFA91D9426B7B2"><enum>(10)</enum><text>The U.S. Government Accountability Office found significant shortcomings at the Trade Promotion Coordination Committee, including a lack of information about total export promotion resources, ineffectiveness in tracking data and outcomes, and a failure to coordinate export promotion resources with governmentwide policies.</text>
 </paragraph><paragraph id="H6F6316DD2AFE4826997C5EC8347DEA4A"><enum>(11)</enum><text>Given the shortcoming of Federal export assistance, significant change is necessary to ensure the United States maintains its global economic competitiveness while small businesses can grow their businesses and create more jobs.</text>
 </paragraph><paragraph id="H0A50F81FEB63447ABA7FB76361B2293D"><enum>(12)</enum><text display-inline="yes-display-inline">By consolidating the functions of multiple Federal agencies, including the International Trade Administration, the Office of International Trade of the Small Business Administration, the Trade and Development Agency, the Export Credit Guarantee Program and Facilities Guarantee Program of the Department of Agriculture, and the Bureau of Economic and Business Affairs of the Department of State, into the new Export Promotion Agency in the Department of Commerce, small- and mid-size businesses will be able to utilize a one-stop-shop for export assistance.</text>
 </paragraph><paragraph id="HCA97BA319B264D838B076486A10B9CCF"><enum>(13)</enum><text>These reforms will reduce waste and overlap to maximize Federal resources, improve businesses’ access to information and assistance by cutting bureaucracy, and allow the Department of Commerce to better track and report to Congress on the effectiveness of its export programs.</text>
 </paragraph><paragraph id="H5A4A9212B47E49B28E3E08C78215DC85"><enum>(14)</enum><text display-inline="yes-display-inline">Additionally, including the Trade and Development Agency and the Bureau of Economic and Business Affairs of the Department of State as part of the new agency will strengthen their coordination with traditional export assistance to ensure that United States companies are able to take advantage of new emerging markets overseas.</text>
 </paragraph></section><section id="HD7E574F7D8A24D04B6F7222E08EEE4F3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H392A29D36B22491C8B1A21CDC666DDFF"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>Agency</term> means the Export Promotion Agency established under section 4(a).</text>
 </paragraph><paragraph id="H10AD2B1A45514D9B93A0D073B45CEE5A"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The term <term>functions</term> includes authorities, powers, rights, privileges, immunities, programs, projects, activities, duties, and responsibilities.</text>
 </paragraph><paragraph id="HC497E611E88041FCBC8130A448B297CD"><enum>(3)</enum><header>Personnel</header><text display-inline="yes-display-inline">The term <term>personnel</term> means officers and employees.</text> </paragraph><paragraph id="HEB51B386265841CA88E1D8D494B98E42"><enum>(4)</enum><header>Under Secretary</header><text display-inline="yes-display-inline">The term <term>Under Secretary</term> means the Under Secretary of Commerce for Export Promotion appointed under section 4(b).</text>
			</paragraph></section><section id="HC5268C696D72494C805A5CE455AEDECC"><enum>4.</enum><header> Establishment of Export Promotion Agency</header>
 <subsection id="H758A7630C0924A7C8BC9F94488527788"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Department of Commerce an agency to be known as the <quote>Export Promotion Agency</quote>.</text> </subsection><subsection id="H8965E5A8332546A4A527A84888C0B803"><enum>(b)</enum><header>Under Secretary</header><text>The head of the Agency shall be the Under Secretary of Commerce for Export Promotion, who shall be appointed by the President, by and with the advice and consent of the Senate.</text>
 </subsection><subsection id="H483347FCED194ACB978B84DD52565556"><enum>(c)</enum><header>Transfers of functions</header><text display-inline="yes-display-inline">In accordance with section 7 (relating to transition provisions), there are transferred to the Agency the functions of each of the following:</text>
 <paragraph id="HA80D2784959D4D86975B0733991DAC86"><enum>(1)</enum><text>The International Trade Administration.</text> </paragraph><paragraph id="H0BD2D32AFEC946F386E272EC4AAB5FB9"><enum>(2)</enum><text>The Office of International Trade of the Small Business Administration.</text>
 </paragraph><paragraph id="H599E95A5FE7144E0834B1FECD7439BFB"><enum>(3)</enum><text>The Trade and Development Agency.</text> </paragraph><paragraph id="H40360BDB852D407491C09154CD02C697"><enum>(4)</enum><text>The Export Credit Guarantee Program and the Facilities Guarantee Program of the Department of Agriculture.</text>
 </paragraph><paragraph id="HF99D833F42BA45AB892C85F6FDA724BB"><enum>(5)</enum><text>The Bureau of Economic and Business Affairs of the Department of State.</text> </paragraph></subsection><subsection commented="no" id="H8D2EABEC3FD04648B4BC25543EE43178"><enum>(d)</enum><header>Chairperson of TPCC</header><text>Section 2312(d)(3) of the Export Enhancement Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/15/4727">15 U.S.C. 4727(d)(3)</external-xref>) is amended by inserting <quote>, acting through the Under Secretary of Commerce for Export Promotion,</quote> after <quote>Secretary of Commerce</quote>.</text>
 </subsection><subsection commented="no" id="H0F4FDCBB3DBA4415BC4B384E821AF078"><enum>(e)</enum><header>Compensation</header><text display-inline="yes-display-inline">Section 5314 of title 5, United States Code, is amended by striking <quote>and Under Secretary of Commerce for Travel and Tourism</quote> and inserting <quote>Under Secretary of Commerce for Travel and Tourism, and Under Secretary of Commerce for Export Promotion</quote>.</text>
			</subsection></section><section id="HB338B73A798D47F0A4DA831294D44A44"><enum>5.</enum><header>Organizational structure and performance metrics</header>
 <subsection id="HDC2DD58255E44627BACB546A167162D0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Under Secretary shall develop the following:</text> <paragraph id="HF8F1B19B497040B4A0FF70D193DB7330"><enum>(1)</enum><text>An organizational structure for the Agency that consolidates programs and eliminates duplicative programs, where appropriate.</text>
 </paragraph><paragraph id="H2285AA8B21074A74A7E0054CA01BE933"><enum>(2)</enum><text>Metrics designed to measure performance on an annual basis with respect to the following:</text> <subparagraph id="H8B83D60E6BB547A78067943C195FA9F7"><enum>(A)</enum><text display-inline="yes-display-inline">The total exports from the United States, including exports assisted by the Agency.</text>
 </subparagraph><subparagraph id="H1498A5D11A434B818F066B96B3553E84"><enum>(B)</enum><text display-inline="yes-display-inline">The number of United States business concerns, including small- and medium-sized business concerns, exporting, including exports assisted by the Agency.</text>
 </subparagraph><subparagraph id="H9A1DB4449932499C86A866C2BCD2A808"><enum>(C)</enum><text>The number and presence of United States business concerns in key foreign markets.</text> </subparagraph></paragraph></subsection><subsection id="HDF138BCEE25A449F8B3048CC432D2F4A"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the date on which the first Under Secretary takes office, the Under Secretary shall submit to Congress a report that contains matters required under subsection (a).</text>
 </subsection></section><section id="H0385A9202D5847B4B75ECFD792953738"><enum>6.</enum><header>Annual reports to Congress</header><text display-inline="no-display-inline">The Under Secretary shall submit to Congress an annual report on the operations of the Agency, including the following:</text>
 <paragraph id="H1C1B8ACEC6504049AA0ED93DC8A2A2A9"><enum>(1)</enum><text>The effectiveness of its organizational structure and any changes made to that structure developed under section 5(a)(1).</text>
 </paragraph><paragraph id="H5E99BA2674FF41FAB7D2FA4D8C56486C"><enum>(2)</enum><text>The data the Agency has received from applying the metrics developed under section 5(a)(2).</text> </paragraph></section><section commented="no" id="H0EEFF9868ED146DDA3305C38A46B8707"><enum>7.</enum><header>Transition provisions</header> <subsection commented="no" id="HADCF8F80BE2A41F48468881B41764CA6"><enum>(a)</enum><header>Acting officials</header> <paragraph commented="no" id="H54A69535FE9044EF9B5895139513F627"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">During the transition period, pending the advice and consent of the Senate to the appointment of an officer required by this Act to be appointed by and with such advice and consent, the President may designate any officer whose appointment was required to be made by and with such advice and consent and who was such an officer immediately before the effective date of this Act (and who continues in office) or immediately before such designation, to act in such office until the same is filled as provided in this Act. While so acting, such officers shall receive compensation at the higher of—</text>
 <subparagraph commented="no" id="H4818D50741CB4B83ABE2E57A1DFB9CF9"><enum>(A)</enum><text display-inline="yes-display-inline">the rates provided by this Act for the respective offices in which they act; or</text> </subparagraph><subparagraph commented="no" id="H7A1555F682624B58B5B505BD98F072A3"><enum>(B)</enum><text display-inline="yes-display-inline">the rates provided for the offices held at the time of designation.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HE5CC0169A9374A0380FF16319BC86ECB"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this Act shall be understood to require the advice and consent of the Senate to the appointment by the President to a position in the Agency of any officer whose entity or program the functions of which are transferred to the Agency under section 4(c) and whose duties following such transfer are germane to those performed before such transfer.</text>
				</paragraph></subsection><subsection commented="no" id="H0D9F3C6E0E664BD58F82A5D3FD14D0F9"><enum>(b)</enum><header>Transfer of personnel, assets, obligations, and functions</header>
 <paragraph id="HFB5306E073F043ED885FDA9A2873F675"><enum>(1)</enum><header>In general</header><text>Upon transfer of the functions of an entity or program to the Agency under section 4(c)—</text> <subparagraph commented="no" id="H7099774583D14180B9AA39787705DAB7"><enum>(A)</enum><text>the personnel, assets, and obligations held by or available in connection with such functions shall be transferred to the Under Secretary for appropriate allocation, subject to the approval of the Director of the Office of Management and Budget and in accordance with the provisions of section 1531(a)(2) of title 31, United States Code; and</text>
 </subparagraph><subparagraph commented="no" id="H14BEC9AF4DE149B88B25E337527F8A8F"><enum>(B)</enum><text display-inline="yes-display-inline">the Under Secretary shall have all functions relating to the entity or program that any other official could by law exercise in relation to the entity or program immediately before such transfer, and shall have in addition all functions vested in the Under Secretary by this Act or other law.</text>
					</subparagraph></paragraph><paragraph id="H422801FEBA3C45D5B4D3D559FBBBABD2"><enum>(2)</enum><header>Incidental transfers</header>
 <subparagraph id="H4B31960A2B55444CB4F18D856C1F731C"><enum>(A)</enum><header>Authorization of Director of Office of Management and Budget; termination of affairs</header><text>The Director of the Office of Management and Budget, at such time or times as the Director shall provide, is authorized and directed to make such determinations as may be necessary with regard to the functions, entities or programs, or portions thereof transferred by this Act, and to make such additional incidental dispositions of personnel, assets, liabilities, grants, contracts, property, records, and unexpended balances of appropriations, authorizations, allocations, and other funds held, used, arising from, available to, or to be made available in connection with such functions, entities or programs, or portions thereof, as may be necessary to carry out the provisions of this Act. The Director shall provide for the termination of the affairs of all entities and programs terminated by this Act and for such further measures and dispositions as may be necessary to effectuate the purposes of this Act.</text>
 </subparagraph><subparagraph id="H1F0D8E6D353C42CDAFBF7E4231B32A96"><enum>(B)</enum><header>Transfer of positions within Senior Executive Service</header><text>After consultation with the Director of the Office of Personnel Management, the Director of the Office of Management and Budget is authorized, at such time as the Director of the Office of Management and Budget provides, to make such determinations as may be necessary with regard to the transfer of positions within the Senior Executive Service in connection with functions and entities and programs transferred by this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HDCD4AA6267744C4D8FC2696D2B89FC31"><enum>(c)</enum><header>Savings provisions</header>
				<paragraph commented="no" id="H1C613FB8AC6B4EF2A3E59506DC9F0BD9"><enum>(1)</enum><header>Completed administrative actions</header>
 <subparagraph commented="no" id="H06C1EA16288E4FF7B5971059414BC3A8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Completed administrative actions of an entity or program shall not be affected by the enactment of this Act or the transfer of the functions of such entity or program to the Agency under section 4(c), but shall continue in effect according to their terms until amended, modified, superseded, terminated, set aside, or revoked in accordance with law by an officer of the United States or a court of competent jurisdiction, or by operation of law.</text>
 </subparagraph><subparagraph commented="no" id="H35BB85407B904B55BA36FC4745CA14A5"><enum>(B)</enum><header>Definition</header><text>For purposes of subparagraph (A), the term <term>completed administrative action</term> includes orders, determinations, rules, regulations, personnel actions, permits, agreements, grants, contracts, certificates, licenses, registrations, and privileges.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H6940964BCAD24BDE958B0A694126C095"><enum>(2)</enum><header>Pending civil actions</header><text>Subject to the authority of the Under Secretary under this Act, pending civil actions shall continue notwithstanding the enactment of this Act or the transfer of the functions of an entity or program to the Agency under section 4(c), and in such civil actions, proceedings shall be had, appeals taken, and judgments rendered and enforced in the same manner and with the same effect as if such enactment or transfer had not occurred.</text>
				</paragraph><paragraph id="H489E51B4FEA74F85A6C129DA1211EAE7"><enum>(3)</enum><header>Proceeding not affected</header>
 <subparagraph id="H7FA64CC105364BE79DE8013B94C19BBE"><enum>(A)</enum><header>In general</header><text>The provisions of this Act shall not affect any proceedings, including notices of proposed rulemaking, or any application for any license, permit, certificate, or financial assistance pending on the effective date of this Act before any entity or program with respect to functions transferred by this Act, but such proceedings or applications, to the extent that they relate to functions transferred, shall be continued. Orders shall be issued in such proceedings, appeals shall be taken therefrom, and payments shall be made under such orders, as if this Act had not been enacted, and orders issued in any such proceedings shall continue in effect until modified, terminated, superseded, or revoked by the head of the Federal agency to which such functions are transferred by this Act, by a court of competent jurisdiction, or by operation of law. Nothing in this subparagraph prohibits the discontinuance or modification of any such proceeding under the same terms and conditions and to the same extent that such proceeding could have been discontinued or modified if this Act had not been enacted.</text>
 </subparagraph><subparagraph commented="no" id="H6DB9CF461CB0401EA3FD875EEF44A8BA"><enum>(B)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Under Secretary is authorized to issue regulations providing for the orderly transfer of proceedings continued under subparagraph (A).</text>
 </subparagraph></paragraph></subsection><subsection id="H025C19DD77164EBC989AB17C1068A0FA"><enum>(d)</enum><header>Termination of entities and programs</header><text>On the effective date of this Act, the following entities and programs shall terminate:</text> <paragraph id="H337500EEE9104B8AA00232453DE50B4D"><enum>(1)</enum><text>The International Trade Administration.</text>
 </paragraph><paragraph id="H52B909A5EAAA4A359A53C08C85155F46"><enum>(2)</enum><text>The Office of International Trade of the Small Business Administration.</text> </paragraph><paragraph id="HF2D37BD5DD874274A4709756B03298AB"><enum>(3)</enum><text>The Trade Development Agency.</text>
 </paragraph><paragraph id="HC2FFE2DF61C247EA93C4574D39B6B3D7"><enum>(4)</enum><text>The Export Credit Guarantee Program and the Facilities Guarantee Program of the Department of Agriculture.</text>
 </paragraph><paragraph id="HB2F5695CD50E45CAAA3AA73F899279D7"><enum>(5)</enum><text>The Bureau of Economic and Business Affairs of the Department of State.</text> </paragraph></subsection></section><section id="H30734017A5444CCB90179A88F1613E5D"><enum>8.</enum><header>References</header><text display-inline="no-display-inline">With respect to any function of an entity or program transferred to the Agency under section 4(c) to, and exercised on or after the effective date specified in section 9 by, the Under Secretary, any reference in any other Federal law, Executive order, rule, regulation, or delegation of authority, or any document of or pertaining to an entity or program of government from which such function is transferred—</text>
 <paragraph id="H9AA3B0BAE19A4F83862FCED278AF055A"><enum>(1)</enum><text>to the head of such entity or program is deemed to refer to the Under Secretary of Commerce for Export Promotion; or</text>
 </paragraph><paragraph id="H6DCAB68DBCAE439B91682459B2AEB727"><enum>(2)</enum><text display-inline="yes-display-inline">to such entity or program is deemed to refer to the Export Promotion Agency.</text> </paragraph></section><section id="H44C2ADDEFA394F3693FF9BC6EF0F7497"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act takes effect on the date that is 1 year after the date of the enactment of this Act.</text>
