 <section id="H943F1610659B40ADA3479C1DC3735971" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Humane Enforcement and Legal Protections for Separated Children Act</short-title></quote> or the <quote><short-title>HELP Separated Children Act</short-title></quote>.</text> </section><section id="H9E1E3EFB73D440B0A7EF2A4D0CF81D61"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="HDA65734474574A4999AC5876AC58627A"><enum>(1)</enum><header>Apprehension</header><text>The term <term>apprehension</term> means the detention or arrest by officials of the Department or cooperating entities.</text> </paragraph><paragraph id="HC6448F53F7CF4C348393F5DB62A3DDFC"><enum>(2)</enum><header>Child</header><text>The term <term>child</term> means an individual who is younger than 18 years of age.</text>
 </paragraph><paragraph id="H5BEB6F0115884D0097AB92CB7C8A55EE"><enum>(3)</enum><header>Child welfare agency</header><text>The term <term>child welfare agency</term> means a State or local agency responsible for child welfare services under subtitles B and E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.).</text>
 </paragraph><paragraph id="H9480960CC11A49E9A90F6A22E00F3052"><enum>(4)</enum><header>Cooperating entity</header><text>The term <term>cooperating entity</term> means a State or local entity acting under agreement with the Secretary.</text> </paragraph><paragraph id="H0A386A19F51447AC9FCBF8890A85DFBB"><enum>(5)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Homeland Security.</text>
 </paragraph><paragraph id="H94E17BD2D39C41D58EAB537362740DF7"><enum>(6)</enum><header>Detention facility</header><text>The term <term>detention facility</term> means a Federal, State, or local government facility, or a privately owned and operated facility, that is used, in whole or in part, to hold individuals under the authority of the Director of U.S. Immigration and Customs Enforcement, including facilities that hold such individuals under a contract or agreement with the Director.</text>
 </paragraph><paragraph id="H9DA4632EADD64CA98D4EA0C8F9BC2651"><enum>(7)</enum><header>Immigration enforcement action</header><text>The term <term>immigration enforcement action</term> means the apprehension of 1 or more individuals whom the Department has reason to believe are removable from the United States by the Secretary or a cooperating entity.</text>
 </paragraph><paragraph id="HC74998FE1C5B43B78FB7155FAD3C590D"><enum>(8)</enum><header>Parent</header><text>The term <term>parent</term> means—</text> <subparagraph id="HA5BC16774BFB47CB84CB26EFA8A6F05D"><enum>(A)</enum><text>a biological or adoptive parent of a child, whose parental rights have not been relinquished or terminated under State law or the law of a foreign country; or</text>
 </subparagraph><subparagraph id="H04388AFDB52D449B94B0D52D96745101"><enum>(B)</enum><text>a legal guardian under State law or the law of a foreign country.</text> </subparagraph></paragraph><paragraph id="H0304D9E4BC184197933B8407EC37E1DB"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text>
			</paragraph></section><section id="HCA4EEC5A17B24F178A334E56B8ED79A9"><enum>3.</enum><header>Apprehension procedures for immigration enforcement-related activities</header>
 <subsection id="H60E860AD57BD480C976B50A015F92DE3"><enum>(a)</enum><header>Apprehension procedures</header><text>In any immigration enforcement action, the Secretary and cooperating entities shall—</text> <paragraph id="HB6DE977E865D478189CB3A08354D48C7"><enum>(1)</enum><text>as soon as possible, but generally not later than 2 hours after an immigration enforcement action, inquire whether an individual is a parent or primary caregiver of a child in the United States and provide any such individuals with—</text>
 <subparagraph id="H20E7355E5E2B41A1AC20E279B13843B4"><enum>(A)</enum><text>the opportunity to make a minimum of 2 telephone calls to arrange for the care of such child in the individual’s absence; and</text>
 </subparagraph><subparagraph id="H0997C0E29278430CB48D2802757B354C"><enum>(B)</enum><text>contact information for—</text> <clause id="H66F5C00222094E02A5130CD3ADE1797B"><enum>(i)</enum><text>child welfare agencies and family courts in the same jurisdiction as the child; and</text>
 </clause><clause id="HA9335E4608224B5BB48A7C577209A9FB"><enum>(ii)</enum><text>consulates, attorneys, and legal service providers capable of providing free legal advice or representation regarding child welfare, child custody determinations, and immigration matters;</text>
 </clause></subparagraph></paragraph><paragraph id="H33920E49C0214BAFB2AC32D46D422633"><enum>(2)</enum><text>notify the child welfare agency with jurisdiction over the child if—</text> <subparagraph id="H630F9A3C848F4AC8B0A592680FA6D8E9"><enum>(A)</enum><text>the child’s parent or primary caregiver is unable to make care arrangements for the child; or</text>
 </subparagraph><subparagraph id="HC2995FD2018D428CBB7836CAF14EC4BB"><enum>(B)</enum><text>the child is in imminent risk of serious harm;</text> </subparagraph></paragraph><paragraph id="HD5026227F6EE445EA300E7CBD5068BAA"><enum>(3)</enum><text>ensure that personnel of the Department and cooperating entities do not, absent medical necessity or extraordinary circumstances—</text>
 <subparagraph id="H72A9FD35E9704551964BE8F86F2DD56D"><enum>(A)</enum><text>interview individuals in the immediate presence of children; or</text> </subparagraph><subparagraph id="H1527E58935BB48818A11AB4A212650BD"><enum>(B)</enum><text>compel or request children to interpret or translate for interviews of their parents or of other individuals who are encountered as part of an immigration enforcement action;</text>
 </subparagraph></paragraph><paragraph id="H3B719258E29846A0BE61C8B1B54CA770"><enum>(4)</enum><text>absent extraordinary circumstances, ensure that individuals who are the subject of an immigration enforcement action and are parents of children in the United States who are present during the action are given an opportunity—</text>
 <subparagraph id="HF5444A76501D4254982868608ABC72BF"><enum>(A)</enum><text>to communicate with their child, including through physical contact;</text> </subparagraph><subparagraph id="H406A750DC9D34C1E9C2F5B82691C0F67"><enum>(B)</enum><text>to reassure their child; and</text>
 </subparagraph><subparagraph id="H6108E1208EF144E1B5D36477D90679AE"><enum>(C)</enum><text>to share information regarding care arrangements for their child while the parent is detained; and</text> </subparagraph></paragraph><paragraph id="H27C92EA2067446D9A74E0EDA78FEE96A"><enum>(5)</enum><text>ensure that any parent or primary caregiver of a child in the United States—</text>
 <subparagraph id="H69420D6F9FCD421BA657E8FD37E332F6"><enum>(A)</enum><text>absent medical necessity or extraordinary circumstances, is not transferred from his or her area of apprehension until the individual—</text>
 <clause id="HC8E64908E1684AA09813FC878D953400"><enum>(i)</enum><text>has made arrangements for the care of such child; or</text> </clause><clause id="H52392ACC79ED4D0BA3AB86F563DABE72"><enum>(ii)</enum><text>if such arrangements are unavailable or the individual is unable to make such arrangements, is informed of the care arrangements made for the child and of a means to maintain communication with the child;</text>
 </clause></subparagraph><subparagraph id="H84C1F7A507ED4FA2B9F4FAE287622456"><enum>(B)</enum><text>absent medical necessity or extraordinary circumstances, and to the extent practicable, is placed in a detention facility that is—</text>
 <clause id="HA402D3A032A54F92B83FE2898296C96D"><enum>(i)</enum><text>proximate to the location of apprehension; and</text> </clause><clause id="H104F113665D04BD6A51D2171967E7692"><enum>(ii)</enum><text>proximate to the child’s habitual place of residence; and</text>
 </clause></subparagraph><subparagraph id="H447D137409A84608BDB0CB6468FFEBD6"><enum>(C)</enum><text>receives due consideration of the best interests of such child in any decision or action relating to his or her detention, release, or transfer between detention facilities.</text>
 </subparagraph></paragraph></subsection><subsection id="HC36F368CA4D2464F80B2F56F2334A55A"><enum>(b)</enum><header>Requests to State and local entities</header><text>If the Secretary requests a State or local entity to hold in custody an individual whom the Department has reason to believe is removable pending transfer of such individual to the custody of the Secretary or to a detention facility, the Secretary shall request that the State or local entity provide the individual the protections specified in paragraphs (1) and (2) of subsection (a) if such individual is the parent or primary caregiver of a child in the United States.</text>
 </subsection><subsection id="HED702AFF85B141EDA2F1234243511EA3"><enum>(c)</enum><header>Protections against trafficking preserved</header><text>Nothing in this section may be construed to impede, delay, or limit the obligations of the Secretary, the Attorney General, or the Secretary of Health and Human Services under—</text>
 <paragraph id="H623551FE068F4D6E885A2B86BE4E6E79"><enum>(1)</enum><text>section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>);</text>
 </paragraph><paragraph id="H2E9DAFF7971340EAA801FCF3511A734E"><enum>(2)</enum><text>section 462 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279</external-xref>); or</text> </paragraph><paragraph id="H34865297BE514C7491049177D800312A"><enum>(3)</enum><text>the Stipulated Settlement Agreement filed in the United States District Court for the Central District of California on January 17, 1997 (CV 85–4544–RJK) (commonly known as the <quote>Flores Settlement Agreement</quote>).</text>
 </paragraph></subsection></section><section id="H1A72EDC403494902BE434CD3D26DBEF1"><enum>4.</enum><header>Access to children, State and local courts, child welfare agencies, and consular officials</header><text display-inline="no-display-inline">At all detention facilities, the Secretary shall—</text> <paragraph id="HC57CC68601814E5B9646E3970CFAE8CC"><enum>(1)</enum><text>prominently post, in a manner accessible to detainees and visitors, and include in detainee handbooks—</text>
 <subparagraph id="HED502E6338CF449C81DD3034F97940CD"><enum>(A)</enum><text>information regarding the protections required under this Act; and</text> </subparagraph><subparagraph id="H6541A813B5EF4F8988F1486253B16A0B"><enum>(B)</enum><text>information regarding potential eligibility for parole or release;</text>
 </subparagraph></paragraph><paragraph id="HFF6185AB304B4F708DEAC918C08FB669"><enum>(2)</enum><text>absent extraordinary circumstances, ensure that individuals who are detained by the Department and are parents or legal guardians of children in the United States are—</text>
 <subparagraph id="HF30D335B21824FADB664D524B871FB8F"><enum>(A)</enum><text>permitted regular phone calls and contact visits with their children;</text> </subparagraph><subparagraph id="HE8A625CB1EEA4A50829121E329E73019"><enum>(B)</enum><text>provided with contact information for child welfare agencies and family courts in the relevant jurisdictions;</text>
 </subparagraph><subparagraph id="H4D4CCCB58AB547108711A822DB9E5C6E"><enum>(C)</enum><text>given the opportunity to participate fully and, to the extent possible, in person—</text> <clause id="HDE33597B28204E0FBF5ECDC815D1D11F"><enum>(i)</enum><text>in all family court proceedings; and</text>
 </clause><clause id="H49C1E52E26754EE78DDC3EB60B251526"><enum>(ii)</enum><text>in any other proceedings that may impact their right to custody of their children;</text> </clause></subparagraph><subparagraph id="H257A668901324BC28CC6F8768F70973B"><enum>(D)</enum><text>granted free and confidential telephone calls to relevant child welfare agencies and family courts as often as is necessary to ensure that the best interest of their children, including a preference for family unity whenever appropriate, can be considered in child welfare agency or family court proceedings;</text>
 </subparagraph><subparagraph id="HB485E9C993EB43E7A6B8226FC560AC70"><enum>(E)</enum><text>able to fully comply with all family court or child welfare agency orders impacting custody of their children;</text>
 </subparagraph><subparagraph id="H34C5AA4D2061483AA1FCA1400467FEB4"><enum>(F)</enum><text>provided access to United States passport applications or other relevant travel document applications for the purpose of obtaining travel documents for their children;</text>
 </subparagraph><subparagraph id="H4CA6D46EEEA44F3BA1C4AF6E4E9E3450"><enum>(G)</enum><text>afforded timely access to a notary public for the purpose of applying for a passport for their children or executing guardianship or other agreements to ensure the safety of their children; and</text>
 </subparagraph><subparagraph id="H40DF3D61369C48BF9A836DFEDF620048"><enum>(H)</enum><text>granted adequate time and opportunity before removal to obtain passports, apostilled birth certificates, travel documents, and other necessary records on behalf of their children if such children will accompany them on their return to their country of origin or join them in their country of origin; and</text>
 </subparagraph></paragraph><paragraph id="H11486003458B4143B5DBE22F1F86B1E4"><enum>(3)</enum><text>if doing so would not impact public safety or national security, facilitate the ability of detained alien parents and primary caregivers to share information regarding travel arrangements with their consulate, children, child welfare agencies, or other caregivers in advance of the detained alien individual’s departure from the United States.</text>
 </paragraph></section><section id="HC2AFF1262D9C4BB8B6C8363F1A81CC55"><enum>5.</enum><header>Mandatory training</header><text display-inline="no-display-inline">The Secretary, in consultation with the Secretary of Health and Human Services and independent child welfare and family law experts, shall develop and provide training on the protections required under sections 3 and 4 to all personnel of the Department, cooperating entities, and detention facilities operated by or under agreement with the Department who—</text>
 <paragraph id="HDAB6A5859068405D880578831ADA89CE"><enum>(1)</enum><text display-inline="yes-display-inline">regularly engage in immigration enforcement actions, including detention; and</text> </paragraph><paragraph id="HB56F521473E3479897033F6ED3BD9AE8"><enum>(2)</enum><text display-inline="yes-display-inline">in the course of such actions, come into contact with individuals who are parents or primary caregivers of children in the United States.</text>
 </paragraph></section><section id="H33A38516A87C4D868F86AC2B1500F88B"><enum>6.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall promulgate regulations to implement sections 3 and 4.</text>
 </section><section id="H4F9AA7F8AA5F4E978C5EEC1F2E960398"><enum>7.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, any amendment made by this Act, or the application of any such provision or amendment to any person or circumstance is held to be unconstitutional, the remaining provisions of this Act, the remaining amendments made by this Act, and the application of such provisions and amendments to any person or circumstance shall not be affected by such holding.</text>
