			 device requirements, and for other purposes.</official-title></form>
	<legis-body id="H1C576E4D90B343DC87EE2D13DC6AEF99" style="OLC">
 <section id="HEE51282031184642A5C3FCA4D32A7990" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Business Electronic Logging Device Exemption Act of 2018</short-title></quote>.</text> </section><section id="H508ECAC225F54452A5AACC967F7D91C7"><enum>2.</enum><header>Exception to the electronic logging device requirements for certain motor carriers engaged in agricultural business</header><text display-inline="no-display-inline">Section 31137(b)(3) of title 49, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H9192EF71983F43C39CC89C73DBE5186A" style="OLC">
				<paragraph id="HAD133EC8C1044D1394FDC0C1E9ADC4A1"><enum>(3)</enum><header>Exception</header>
 <subparagraph id="HEE6A8595E1904CA5AC56530C5816E12A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An excepted motor carrier may comply with the hours of service requirements by requiring each driver to use—</text>
 <clause id="H5402CB22D1754E64AD8A8C9102703627"><enum>(i)</enum><text>a paper record of duty status form; or</text> </clause><clause id="H237029531B8941D383B89D327A747FAF"><enum>(ii)</enum><text>an electronic logging device.</text>
 </clause></subparagraph><subparagraph id="H2ECE9DFC13AE4DC89B9F6772F0BD0FAC"><enum>(B)</enum><header>Excepted motor carrier defined</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>excepted motor carrier</quote> means—</text> <clause id="HD36F92CA4E0E42EDAAC700A609BD9622"><enum>(i)</enum><text display-inline="yes-display-inline">a motor carrier when transporting a motor home or recreation vehicle trailer within the definition of the term <quote>driveaway-towaway operation</quote> (as defined in section 390.5 of title 49, Code of Federal Regulations);</text>
 </clause><clause id="HF14AB19EFB8C45D69EC6F046009E0860"><enum>(ii)</enum><text display-inline="yes-display-inline">a motor carrier when—</text> <subclause id="H41B09156D5AF4D97974D65F103966254"><enum>(I)</enum><text>transporting an agricultural product (as defined in section 207 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1626">7 U.S.C. 1626</external-xref>)) from the source of such product; or</text>
 </subclause><subclause id="H2E5934E423AC46BEBB5382C857D1438D"><enum>(II)</enum><text>returning empty to such source; and</text> </subclause></clause><clause id="H573977013EC54D3499C76A3513D6C27E"><enum>(iii)</enum><text display-inline="yes-display-inline">a motor carrier when—</text>
 <subclause id="H8EDAB66D386A404ABF74379687B59CE0"><enum>(I)</enum><text>transporting farm supplies for agricultural purposes (as defined in section 395.2 of title 49, Code of Federal Regulations) from the distribution point for such farm supplies; or</text>
 </subclause><subclause id="H2FA8EDB4BE3C4225812668949D08E56B"><enum>(II)</enum><text>returning empty to such distribution point.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H728D777B41544AFB989D384CAB20E7C6"><enum>3.</enum><header>Requirement to prescribe regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall promulgate such regulations as are necessary to carry out the amendment made by section 2 of this Act.</text>
