 <subsection id="HEC2E7FBD1C4A4099B3C24D4C39E0BEAB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In this Act:</text> <paragraph id="H480C89D0BE5548F4ACF192AFF509ADC2"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text>
 </paragraph><paragraph id="HE9C924349A4748CE8A442AA970FC8659"><enum>(2)</enum><header>Standards</header><text>The term <term>standards</term> means benchmarks, guidelines, best practices, methodologies, procedures, and processes.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H57BD850961FE45ED8455EB28B10E2DA5"><enum>(b)</enum><header>Other definitions</header><text display-inline="yes-display-inline">The definitions set forth in section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>), as amended by section 3(a) of this Act, shall apply in this Act, except to the extent the Commission provides otherwise by regulations issued under section 553 of title 5, United States Code.</text>
			</subsection></section><section id="H56C8379F7160490D887E00551DFA6EE4"><enum>3.</enum><header>Online collection, use, and disclosure of personal information of children and minors</header>
 <subsection id="HA4F6A13DFA0A4E3882EB835BE574A55C"><enum>(a)</enum><header>Definitions</header><text>Section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>) is amended—</text> <paragraph id="H11F8EE0B0EBD448B9B5FCF12A23DDDC4"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H8C80B6A036B6437C829CDC0886248A3F" style="OLC">
 <paragraph id="HA3A4B282FF31457C81B040CED88E7028"><enum>(2)</enum><header>Operator</header><text>The term <term>operator</term>—</text> <subparagraph id="H2A4B7B73896D4F7A96A00B49BB95AE6C"><enum>(A)</enum><text>means any person—</text>
 <clause id="H10FCFB9E924F4BCD8428F33F05C11B0D"><enum>(i)</enum><text>who, for commercial purposes, in interstate or foreign commerce—</text> <subclause id="HD2F1CAD81B904F398E7111002B723E38"><enum>(I)</enum><text>operates or provides a website on the Internet, an online service, an online application, or a mobile application; or</text>
 </subclause><subclause id="HEF2A19E8C16D4D559C577C09362A5E55"><enum>(II)</enum><text>manufactures a connected device; and</text> </subclause></clause><clause id="H9A7D1020A5E44F5AAE3F6A32BDBE305A"><enum>(ii)</enum><text>who—</text>
 <subclause id="HF8C1B5F5BB594C85A4556084CE7EEE5A"><enum>(I)</enum><text>collects or maintains, either directly or through a service provider, personal information from or about the users of that website, service, application, or connected device;</text>
 </subclause><subclause id="H42D8074AD2654D6F88107E91C363DF5E"><enum>(II)</enum><text>allows another person to collect personal information directly from users of that website, service, application, or connected device (in which case, the operator is deemed to have collected the information); or</text>
 </subclause><subclause id="H627C38214A25481A8E08228FF3821FDD"><enum>(III)</enum><text>allows users of that website, service, application, or connected device to publicly disclose personal information (in which case, the operator is deemed to have collected the information); and</text>
 </subclause></clause></subparagraph><subparagraph id="H1662F0A92AB24FC88E8721FBF47444A5"><enum>(B)</enum><text>does not include any nonprofit entity that would otherwise be exempt from coverage under section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>).</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H30040C4AD57248868CFDB66C00F4BA98"><enum>(2)</enum><text>in paragraph (4)—</text> <subparagraph id="H076852BF2FA34F8D80DAC9AF73857E28"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HD9C7BF652F4946B5B0BCB347BC624C9B" style="OLC">
 <subparagraph id="H49096E8AE9094221AD96495DF6D17CAD"><enum>(A)</enum><text>the release of personal information collected from a child or minor for any purpose, except where the personal information is provided to a person other than an operator who—</text>
 <clause id="H316BD06A723A4477B47BE2DC3A6A87F0"><enum>(i)</enum><text>provides support for the internal operations of the website, online service, online application, or mobile application of the operator, excluding any activity relating to targeted marketing directed to children, minors, or connected devices; and</text>
 </clause><clause id="H948C281869474964BFE5C04E64C54B4F"><enum>(ii)</enum><text>does not disclose or use that personal information for any other purpose; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H2AFA426ACA53413EB88B68C18146A8CA"><enum>(B)</enum><text>in subparagraph (B)—</text>
 <clause id="HD521F462926345EDA1339B2CDA58ADF3"><enum>(i)</enum><text>by inserting <quote>or minor</quote> after <quote>child</quote> each place the term appears;</text> </clause><clause id="HBC5A1553EFA4483E9C57F8734F0E9875"><enum>(ii)</enum><text>by inserting <quote>or minors</quote> after <quote>children</quote>; and</text>
 </clause><clause id="HCD808039ED92408EB8F132AEA828E482"><enum>(iii)</enum><text>by striking <quote>website or online service</quote> and inserting <quote>website, online service, online application, or mobile application</quote>;</text> </clause></subparagraph></paragraph><paragraph id="H96460B83C35A42ABA4FDF88235B0B9DC"><enum>(3)</enum><text>in paragraph (8)—</text>
 <subparagraph id="HE3A24AE8DFB7480DA35FBCA4929FBA8D"><enum>(A)</enum><text>by amending subparagraph (G) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H7B4530194752494487DCED6BA8749F57" style="OLC"> <subparagraph id="H7B0416EED4FE4FA2B6764BF8370B4F38"><enum>(G)</enum><text>information concerning a child or minor or the parents of that child or minor (including any unique or substantially unique identifier, such as a customer number) that an operator collects online from the child or minor and combines with an identifier described in subparagraphs (A) through (G).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HEB993778EECA4E3E9A1B3E5339F8FF2A"><enum>(B)</enum><text>by redesignating subparagraphs (F) and (G) as subparagraphs (H) and (I), respectively; and</text> </subparagraph><subparagraph id="HFDD51C660A96478886534B397A0CD9B8"><enum>(C)</enum><text>by inserting after subparagraph (E) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H8371684C928B41F89E4DD73A453F24D7" style="OLC">
 <subparagraph id="HC916A0E23FF643D698746A7523EF5DC4"><enum>(F)</enum><text>information (including an Internet protocol address) that permits the identification of—</text> <clause id="H58C7E519AA024DC1816F9D1607097A52"><enum>(i)</enum><text>an individual;</text>
 </clause><clause id="H76203D40790C42A5B6E6750F5006D5E6"><enum>(ii)</enum><text>a computer of an individual; or</text> </clause><clause id="H8DDF4C6E00794D789CDE1FB283B14526"><enum>(iii)</enum><text>any other device used by an individual to access the Internet or an online service, online application, or mobile application;</text>
 </clause></subparagraph><subparagraph id="HD3D6177D9B474320865B63C883B27831"><enum>(G)</enum><text>geolocation information;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HAA74FB5CA1A74FF1BA59790AC24A624E"><enum>(4)</enum><text>by amending paragraph (9) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H05BC92C9D5D2462E9802751B1D48A322" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="H4F79D2BF75314E898D876F8284B408C4"><enum>(9)</enum><header display-inline="yes-display-inline">Verifiable consent</header><text display-inline="yes-display-inline">The term <term>verifiable consent</term> means any reasonable effort (taking into consideration available technology), including a request for authorization for future collection, use, and disclosure described in the notice, to ensure that, in the case of a child, a parent of the child, or, in the case of a minor, the minor—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HDC4A914B9D6140AC804DABC05C456EFF"><enum>(A)</enum><text display-inline="yes-display-inline">receives notice of the personal information collection, use, and disclosure practices of the operator; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5B36D507EFF64495AB5017A10370FB95"><enum>(B)</enum><text display-inline="yes-display-inline">before the personal information of the child or minor is collected, authorizes—</text> <clause commented="no" display-inline="no-display-inline" id="H39B878C45ADE4BD28E98E115B6BFB30D"><enum>(i)</enum><text display-inline="yes-display-inline">the collection, use, and disclosure, as applicable, of that personal information; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H86BC342382E940039531D190039D4358"><enum>(ii)</enum><text display-inline="yes-display-inline">any subsequent use of that personal information.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="HCEFA32F4A5AB42EB850A272144661ECA"><enum>(5)</enum><text>by striking paragraph (10) and redesignating paragraphs (11) and (12) as paragraphs (10) and (11), respectively; and</text>
 </paragraph><paragraph id="H3DA61F9EBD3744028896C930C4BC6D1B"><enum>(6)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H45863D3F02F44493BF72B79361D63F5F" style="OLC"> <paragraph id="H0380AA3A9D3D463E9FDE4A7E53725946"><enum>(12)</enum><header>Connected device</header><text>The term <term>connected device</term> means a device that is—</text>
 <subparagraph id="HBDE558C598D44E79AC38713C9423FE52"><enum>(A)</enum><text>capable of connecting to the Internet, directly or indirectly, or to another connected device; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H09043F4EB54444D5B77174905C8833C4"><enum>(B)</enum><text>directed towards a child or minor.</text>
							</subparagraph></paragraph><paragraph id="HEE46D3532B2A49A191173D3A23355799"><enum>(13)</enum><header>Online; online application; online service; directed to a child; directed to a minor; mobile
			 application</header>
 <subparagraph id="H01AE77FC4F704394A8CD9D37FACEE779"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (C) and (D), the terms <term>online</term>, <term>online application</term>, <term>online service</term>, <term>directed to a child</term>, <term>directed to a minor</term>, and <term>mobile application</term> shall have the meanings given those terms by regulation promulgated by the Commission under subparagraph (B).</text>
 </subparagraph><subparagraph id="H5E8BF6E63F154F4391E30891463D9B33"><enum>(B)</enum><header>Promulgation of regulations</header><text>Not later than 1 year after the date of the enactment of the Do Not Track Kids Act of 2018, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations that define the terms described in subparagraph (A) broadly enough to ensure that the terms are not limited to current technology, consistent with—</text>
 <clause id="H24653BC27FD248809145916133780559"><enum>(i)</enum><text>the principles articulated by the Commission regarding the definition of the term <term>Internet</term> in the statement of basis and purpose on the final rule under this title promulgated on November 3, 1999 (64 Fed. Reg. 59891); and</text>
 </clause><clause id="HE86F843B94004FC1874017109708807B"><enum>(ii)</enum><text>the principles articulated by the Commission regarding the definition of the term <term>directed to children</term> in the statement of basis and purpose on the final rule under this title promulgated on January 17, 2013 (78 Fed. Reg. 3972).</text>
 </clause></subparagraph><subparagraph id="HCCB98CE94EA64A05B2449797F4041406"><enum>(C)</enum><header>Online service</header><text>The definition of the term <term>online service</term> in the regulations promulgated under subparagraph (B) shall include broadband Internet access service (as defined in the Report and Order on Remand, Declaratory Ruling, and Order in the matter of protecting and promoting the open Internet, adopted by the Federal Communications Commission on February 26, 2015 (FCC 15–24)).</text>
 </subparagraph><subparagraph id="H28C9395DF8F34BC2878F18DE49D90F2B"><enum>(D)</enum><header>Online application; online service; mobile application</header><text>The terms <term>online service</term>, <term>online application</term>, and <term>mobile application</term> include a service or application offered via a connected device.</text> </subparagraph></paragraph><paragraph id="H963CBAD93EBC4ABE811C6DBA7017FBB1"><enum>(14)</enum><header>Geolocation information</header><text>The term <term>geolocation information</term> means information sufficient to identify a street name and name of a city or town.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB1AD7DB2F25449BA4BA6B7379A45DCF"><enum>(15)</enum><header display-inline="yes-display-inline">Minor</header><text display-inline="yes-display-inline">The term <term>minor</term> means an individual over the age of 12 and under the age of 16.</text> </paragraph><paragraph id="H8D1801151F554447B3CEF13FAC552295"><enum>(16)</enum><header>Targeted marketing</header><text>The term <term>targeted marketing</term> means advertising or any other effort to market a product or service that is directed to a specific individual or device—</text>
 <subparagraph id="H87D9A0DE73C14EC5B5023E219DA7D8A4"><enum>(A)</enum><text>based on the personal information of the individual or a unique identifier of the device; and</text> </subparagraph><subparagraph id="H304CF26F00E24F339A4BE4CC319E704A"><enum>(B)</enum><text>as a result of use by the individual, or access by the device, of—</text>
 <clause id="H7796B0C5C9A84BFA98E034D80FDAC3FC"><enum>(i)</enum><text>a website;</text> </clause><clause id="H4933127D83F146C0A26CF6A88C0A515B"><enum>(ii)</enum><text>an online service;</text>
 </clause><clause id="H2EDC4BB0188C46D596AB09E859EF3235"><enum>(iii)</enum><text>an online application; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="H0FF4A2647DCC4A31A04DE2BB9A459683"><enum>(iv)</enum><text>a mobile application.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H69AF939AAB9446B5AC928B77C6FF61B5"><enum>(b)</enum><header>Online collection, use, and disclosure of personal information of children and minors</header><text>Section 1303 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502</external-xref>) is amended—</text> <paragraph id="H1310A5BD7CBB403E8EE48A07EBDB02C6"><enum>(1)</enum><text>by striking the heading and inserting the following: <quote><header-in-text level="section" style="OLC">Online collection, use, and disclosure of personal information of children and minors.</header-in-text></quote>;</text>
 </paragraph><paragraph id="HFA3310C486494B2C8A9602A0F71EFFE6"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="HE558BA116B764D82A54041582BAA7800"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HEFF79FF1470A494D926AC7306D2D45B8" style="OLC">
 <paragraph id="HD928836B9F41475C889F30815B8EFF8E"><enum>(1)</enum><header>In general</header><text>It is unlawful for an operator of a website, online service, online application, or mobile application directed to a child or minor, or an operator having actual knowledge that personal information being collected is from a child or minor, to collect personal information from a child or minor in a manner that violates the regulations prescribed under subsection (b).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H5BFDE6C64E6B4670B02D98C465E7E3BB"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="HCD23D2EE2CBE4ED99B4F59D52970FAF0"><enum>(i)</enum><text>by striking <quote>of such a website or online service</quote>; and</text>
 </clause><clause id="HCB9EB29F14DD45ED96FBBFAC63F90F88"><enum>(ii)</enum><text>by striking <quote>subsection (b)(1)(B)(iii) to the parent of a child</quote> and inserting <quote>subsection (b)(1)(C)(iii) to the parent of a child or under subsection (b)(1)(D)(iii) to a minor</quote>; and</text> </clause></subparagraph></paragraph><paragraph id="H3DE88E2030A74CA4B8D2BE827C4365AB"><enum>(3)</enum><text>in subsection (b)—</text>
 <subparagraph id="HD2DD9153ECF149B1A31392DE55FC7E22"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H4F866F02F0434491B69A0C942CC85211" style="OLC"> <paragraph id="HF324856AC1A64DCB80C044C4B992F3E9"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of the Do Not Track Kids Act of 2018, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations to require an operator of a website, online service, online application, or mobile application directed to children or minors, or an operator having actual knowledge that personal information being collected is from a child or minor—</text>
 <subparagraph id="H75163C66F4064BB5A272AA8CEBBB2DA1"><enum>(A)</enum><text>to provide clear and conspicuous notice in clear and plain language of—</text> <clause id="HD0D58FE51B384BFEBE08240C2EC7F46C"><enum>(i)</enum><text>the types of personal information the operator collects;</text>
 </clause><clause id="H831E878B01324C18B6C292A70A8008DA"><enum>(ii)</enum><text>how the operator uses the information;</text> </clause><clause id="H2DCD35A63F444693BE3F10B373CD1B24"><enum>(iii)</enum><text>whether the operator discloses the information; and</text>
 </clause><clause id="H0979277716FA40EABD79503463557951"><enum>(iv)</enum><text>the procedures or mechanisms the operator uses to ensure that personal information is not collected from children or minors except in accordance with the regulations promulgated under this paragraph;</text>
 </clause></subparagraph><subparagraph id="HC5F231E73B9347388078A857474ACE26"><enum>(B)</enum><text>to obtain verifiable consent for the collection, use, or disclosure of personal information of a child or minor;</text>
 </subparagraph><subparagraph id="H35F0E044CF494AD7BA4D5B6EF8FCD689"><enum>(C)</enum><text>to provide to a parent whose child has provided personal information to the operator, upon request by and proper identification of the parent—</text>
 <clause id="H5F6513AA34BF4A3190A5948FE59E5467"><enum>(i)</enum><text>a description of the specific types of personal information collected from the child by the operator;</text>
 </clause><clause id="H63998D4A9A7B4FF4A885C84EEEF892B9"><enum>(ii)</enum><text>the opportunity at any time to refuse to permit the further use or maintenance in retrievable form, or future collection, by the operator of personal information collected from the child; and</text>
 </clause><clause id="H2C4C137FBF7B43EBA23456E55FFC9D05"><enum>(iii)</enum><text>a means that is reasonable under the circumstances for the parent to obtain any personal information collected from the child, if such information is available to the operator at the time the parent makes the request;</text>
 </clause></subparagraph><subparagraph id="HD857A3C50DFE46BCA0E45988295152DD"><enum>(D)</enum><text>to provide to a minor who has provided personal information to the operator, upon request by and proper identification of the minor—</text>
 <clause id="H31F67D66A1C440799FB15FFFEC0A07E0"><enum>(i)</enum><text>a description of the specific types of personal information collected from the minor by the operator;</text>
 </clause><clause id="HE1BA6FE04AA94EA8A06669A1C35C53A4"><enum>(ii)</enum><text>the opportunity at any time to refuse to permit the further use or maintenance in retrievable form, or future collection, by the operator of personal information collected from the minor; and</text>
 </clause><clause id="HA8E6D53AC89144D0AFAE9AF897888A36"><enum>(iii)</enum><text>a means that is reasonable under the circumstances for the minor to obtain any personal information collected from the minor, if such information is available to the operator at the time the minor makes the request;</text>
 </clause></subparagraph><subparagraph id="H667526EDFD09494B95CAEDA1E3CB9287"><enum>(E)</enum><text>not to condition participation in a game, or use of a website, service, or application, by a child or minor on the provision by the child or minor of more personal information than is reasonably required to participate in the game or use the website, service, or application; and</text>
 </subparagraph><subparagraph id="H33FF90DDC0034FD79A8C53F903A85141"><enum>(F)</enum><text>to establish and maintain reasonable procedures to protect the confidentiality, security, and integrity of personal information collected from children and minors.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HDBEC5B3E99BD4F2082C8BC4442AFF5C3"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H142064DD58A44E64A091B640E902AFB4"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>verifiable parental consent under paragraph (1)(A)(ii)</quote> and inserting <quote>verifiable consent under paragraph (1)(B)</quote>; and</text>
 </clause><clause id="H9AB0B1C52F864EE39DAABF561A1CABC7"><enum>(ii)</enum><text>in subparagraph (A)—</text> <subclause id="H7FCEB721B3E64D70A94AC16641F1E101"><enum>(I)</enum><text>by inserting <quote>or minor</quote> after <quote>collected from a child</quote>;</text>
 </subclause><subclause id="H4A473CF381B443C3A1CE0F03320046B6"><enum>(II)</enum><text>by inserting <quote>or minor</quote> after <quote>request from the child</quote>; and</text> </subclause><subclause id="HD2E99E1EAFEB4E789D331D1769F2D595"><enum>(III)</enum><text>by inserting <quote>or minor or to contact a different child or minor</quote> after <quote>to recontact the child</quote>;</text>
 </subclause></clause><clause id="HE7B20592EADE4628B5CF4B590A564183"><enum>(iii)</enum><text>in subparagraph (B)—</text> <subclause id="H684790EA00084A728E23315529226D98"><enum>(I)</enum><text>by striking <quote>parent or child</quote> and inserting <quote>parent, child, or minor</quote>; and</text>
 </subclause><subclause id="H2B3B074D3DF84922A19FD3BC573819FA"><enum>(II)</enum><text>by striking <quote>parental consent</quote> each place the term appears and inserting <quote>verifiable consent</quote>;</text> </subclause></clause><clause id="H26BF256F5D5E4241869371297BEA2EBC"><enum>(iv)</enum><text>in subparagraph (C)—</text>

 <paragraph id="H1EFCBB1D94CF4A99B9381D18A10878DC"><enum>(3)</enum><header>Continuation of service</header><text>The regulations shall prohibit an operator from discontinuing service provided to a child or minor on the basis of refusal by the parent of the child or by the minor, under the regulations prescribed under subparagraphs (C)(ii) and (D)(ii) of paragraph (1), respectively, to permit the further use or maintenance in retrievable form, or future collection, by the operator of personal information collected from the child or minor, to the extent that the operator is capable of providing such service without such information.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="HC575E1A57756445981B7A5D43D1572BF"><enum>(c)</enum><header>Safe harbors</header><text>Section 1304 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) is amended—</text> <paragraph id="H40C03577DF8E40F7A68E8CB3A655D875"><enum>(1)</enum><text>in subsection (b)(1), by inserting <quote>and minors</quote> after <quote>children</quote>; and</text>
 </paragraph><paragraph id="H7D2AEAC095E3402180F7BA821CB38FBF"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HB97A9D0A5C404F529BECB07D21889CF1" style="OLC"> <subsection id="H38D2B5BA33C54BF1AE454D5DCB7C6D4D"><enum>(d)</enum><header>Publication</header><text>The Commission shall publish on the internet website of the Commission any report or documentation required by regulation to be submitted to the Commission to carry out this section, except to the extent that the report or documentation contains proprietary information, which the Commission may in its discretion redact.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H6439AABDC2CC49BB9369D9C6E7908E7F"><enum>(d)</enum><header>Administration and applicability of act</header><text>Section 1306 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6505">15 U.S.C. 6505</external-xref>) is amended—</text> <paragraph id="HF4AE1FF7FA03414EB0D1A6D11A2262C9"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="HD58EA95B17C64EB0B9DEBFD8DFDA2BCC"><enum>(A)</enum><text>in paragraph (1), by striking <quote>, in the case of</quote> and all that follows and inserting the following: <quote>by the appropriate Federal banking agency, with respect to any insured depository institution (as those terms are defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>));</quote>; and</text>
 </subparagraph><subparagraph id="H6807AA86D7A24BAA910EC76E33C8C08D"><enum>(B)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) through (6) as paragraphs (2) through (5), respectively; and</text>
 </subparagraph></paragraph><paragraph id="HCF9C1F9E6BCE4B3FB8468D68A708DAC2"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H8327E5B8AC284437BD3E3500DDBFC9C2" style="OLC"> <subsection id="HAA00BD75DE5643CFA8211314F0BFCB16"><enum>(f)</enum><header>Telecommunications carriers and cable operators</header> <paragraph id="HCF640B89103440B3ABD65E5A00440F5F"><enum>(1)</enum><header>Enforcement by Commission</header><text>Notwithstanding section 5(a)(2) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(2)</external-xref>), compliance with the requirements imposed under this title shall be enforced by the Commission with respect to any telecommunications carrier (as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)).</text>
 </paragraph><paragraph id="HF42BB3C5A8804394BF62B4F000D5A088"><enum>(2)</enum><header>Relationship to other law</header><text>To the extent that section 222, 338(i), or 631 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>; 338(i); 551) is inconsistent with this title, this title controls.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HA73E4AB9AD1849B09B3D930F5D1B6FC8"><enum>4.</enum><header>Fair Information Practices Principles</header><text display-inline="no-display-inline">The Fair Information Practices Principles described in this section are the following:</text> <paragraph id="HD4F9B55FEEE04B5182B7A441A6B66D1C"><enum>(1)</enum><header>Collection limitation principle</header><text>Except as provided in paragraph (3), personal information should be collected from a minor only when collection of the personal information is—</text>
 <subparagraph id="H54AF647ED0D14F6D9448CD084ABC3521"><enum>(A)</enum><text>consistent with the context of a particular transaction or service or the relationship of the minor with the operator, including collection necessary to fulfill a transaction or provide a service requested by the minor; or</text>
 </subparagraph><subparagraph id="HF99DC245696A4B449B3CE472E6AD4580"><enum>(B)</enum><text>required or specifically authorized by law.</text> </subparagraph></paragraph><paragraph id="H4AE3F747A4244F46BAB7723B86D28A0F"><enum>(2)</enum><header>Data quality principle</header><text>The personal information of a minor should be accurate, complete, and kept up-to-date to the extent necessary to fulfill the purposes described in subparagraphs (A) through (D) of paragraph (3).</text>
 </paragraph><paragraph id="H9CFB8D713C414BFCAD3479B8D42AE5C3"><enum>(3)</enum><header>Purpose specification principle</header><text>The purposes for which personal information is collected should be specified to the minor not later than at the time of the collection of the information. The subsequent use or disclosure of the information should be limited to—</text>
 <subparagraph id="HD9715C28AEC2480BA8596B41F889C60D"><enum>(A)</enum><text>fulfillment of the transaction or service requested by the minor;</text> </subparagraph><subparagraph id="H728F4A6178F148BD92BE1EF939A61969"><enum>(B)</enum><text>support for the internal operations of the website, service, or application, as described in section 312.2 of title 16, Code of Federal Regulations, excluding any activity relating to targeted marketing directed to children, minors, or connected devices;</text>
 </subparagraph><subparagraph id="H3FC3546860D742D1875CEE6DAC58B4F9"><enum>(C)</enum><text>compliance with legal process or other purposes expressly authorized under specific legal authority; or</text>
 </subparagraph><subparagraph id="H13E7FDB23CBE42C48B6172C25178886F"><enum>(D)</enum><text>other purposes—</text> <clause id="H5D08207C57B1439DBCB26D7F52A5A996"><enum>(i)</enum><text>that are specified in a notice to the minor; and</text>
 </clause><clause id="HB3383AA4F6BE444C8474621AED3BC6BB"><enum>(ii)</enum><text>to which the minor has consented under paragraph (7) before the information is used or disclosed for such other purposes.</text>
 </clause></subparagraph></paragraph><paragraph id="H15092C78B783437C95D9CE0E469888F9"><enum>(4)</enum><header>Retention limitation principle</header><text>The personal information of a minor should not be retained for longer than is necessary to fulfill a transaction or provide a service requested by the minor or such other purposes specified in subparagraphs (A) through (D) of paragraph (3). The operator should implement a reasonable and appropriate data disposal policy based on the nature and sensitivity of such personal information.</text>
 </paragraph><paragraph id="H2B8DAB6963074A3895BC1C6AAF90C2BE"><enum>(5)</enum><header>Security safeguards principle</header><text>The personal information of a minor should be protected by reasonable and appropriate security safeguards against risks such as loss or unauthorized access, destruction, use, modification, or disclosure.</text>
			</paragraph><paragraph id="H4E4CED356594437C861079FC1CA1FD63"><enum>(6)</enum><header>Openness principle</header>
 <subparagraph id="HED27CE6BB26543389789E0CA39813C5C"><enum>(A)</enum><header>In general</header><text>The operator should maintain a general policy of openness about developments, practices, and policies with respect to the personal information of a minor. The operator should provide each minor using the website, online service, online application, or mobile application of the operator with a clear and prominent means—</text>
 <clause id="H23AC23C7503C407CA890597E05995148"><enum>(i)</enum><text>to identify and contact the operator, by, at a minimum, disclosing, clearly and prominently, the identity of the operator and—</text>
 <subclause id="HD5C67B2640124F4DBEA4BD133BB3B9DC"><enum>(I)</enum><text>in the case of an operator who is an individual, the address of the principal residence of the operator and an email address and telephone number for the operator; or</text>
 </subclause><subclause id="H878564DD51AF445CB92133BE5C86FF4C"><enum>(II)</enum><text>in the case of any other operator, the address of the principal place of business of the operator and an email address and telephone number for the operator;</text>
 </subclause></clause><clause id="H7A9AF5A5FB944E8CBA6B821200A064F2"><enum>(ii)</enum><text>to determine whether the operator possesses any personal information of the minor, the nature of any such information, and the purposes for which the information was collected and is being retained;</text>
 </clause><clause id="HEDEF6DFB5959493389A3A303FC0DAAFC"><enum>(iii)</enum><text>to obtain any personal information of the minor that is in the possession of the operator from the operator, or from a person specified by the operator, within a reasonable time after making a request, at a charge (if any) that is not excessive, in a reasonable manner, and in a form that is readily intelligible to the minor;</text>
 </clause><clause id="H3A6A9D4EAD754BC585FE527760AA3BCD"><enum>(iv)</enum><text>to challenge the accuracy of personal information of the minor that is in the possession of the operator; and</text>
 </clause><clause id="H56D8109048E74366BD871E94A763D001"><enum>(v)</enum><text>if the minor establishes the inaccuracy of personal information in a challenge under clause (iv), to have such information erased, corrected, completed, or otherwise amended.</text>
 </clause></subparagraph><subparagraph id="HD23E97DFEE4740E098FFB6EA551F832A"><enum>(B)</enum><header>Limitation</header><text>Nothing in this paragraph shall be construed to permit an operator to erase or otherwise modify personal information requested by a law enforcement agency pursuant to legal authority.</text>
 </subparagraph></paragraph><paragraph id="H5A027C76943145D68B9B7B163FC68D61"><enum>(7)</enum><header>Individual participation principle</header><text>The operator should—</text> <subparagraph id="HC4EC2BC9CFB249989FF7F05615E96330"><enum>(A)</enum><text>obtain consent from a minor before using or disclosing the personal information of the minor for any purpose other than the purposes described in subparagraphs (A) through (C) of paragraph (3); and</text>
 </subparagraph><subparagraph id="HF642710828D541428A74AE91E566B7ED"><enum>(B)</enum><text>obtain affirmative express consent from a minor before using or disclosing previously collected personal information of the minor for purposes that constitute a material change in practice from the original purposes specified to the minor under paragraph (3).</text>
				</subparagraph></paragraph></section><section id="HDDD87A5F30F44C7F84C739D2468868D1"><enum>5.</enum><header>Digital Marketing Bill of Rights for Minors</header>
 <subsection id="H7618B9EE5D604A89BE2AEB36E40C88AD"><enum>(a)</enum><header>Acts prohibited</header><text>It is unlawful for an operator of a website, online service, online application, or mobile application directed to minors, or an operator having actual knowledge that personal information being collected is from a minor, to collect personal information from a minor unless such operator has adopted and complies with a Digital Marketing Bill of Rights for Minors that is consistent with the Fair Information Practices Principles described in section 4.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H82D4A33E7CAB435EBCDCE1BE0248EAAD"><enum>(b)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations to implement this section, including regulations further defining the Fair Information Practices Principles described in section 4.</text>
			</subsection></section><section id="HA8A1909827C242109A1E379F1EC56B26"><enum>6.</enum><header>Targeted marketing to children or minors</header>
 <subsection id="H9D2E531AFECF446FA0F84F8094241D55"><enum>(a)</enum><header>Acts prohibited</header><text>It is unlawful for—</text> <paragraph id="H49E6F9508FF4411D8A2856106B0D35AB"><enum>(1)</enum><text>an operator of a website, online service, online application, mobile application, or connected device directed to children, or an operator having actual knowledge that personal information being collected is from a child or a connected device of a child, to use, disclose to third parties, or compile personal information for purposes of targeted marketing; or</text>
 </paragraph><paragraph id="H904A7BE22C7D4609AFAB53D25F8EAEFE"><enum>(2)</enum><text>an operator of a website, online service, online application, mobile application, or connected device directed to minors, or an operator having actual knowledge that personal information being collected is from a minor or a connected device of a minor, to use, disclose to third parties, or compile personal information for purposes of targeted marketing without the verifiable consent of the minor.</text>
 </paragraph></subsection><subsection id="H9F4D3C03874847888485836AB4016131"><enum>(b)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations to implement this section.</text>
			</subsection></section><section id="H75F2E7D95D3B4AC7BA1E83A01A823407"><enum>7.</enum><header>Removal of content</header>
 <subsection id="H7801BADC52DE42269D8E1D49C091F84A"><enum>(a)</enum><header>Acts prohibited</header><text>It is unlawful for an operator to make publicly available through a website, online service, online application, or mobile application content or information that contains or displays personal information of children or minors in a manner that violates a regulation prescribed under subsection (b).</text>
			</subsection><subsection id="H561B58A9DD2346B682E5E1B162573C48"><enum>(b)</enum><header>Regulations</header>
 <paragraph id="HE48731EF3FB64515A9E63E173D7DF3F6"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations that require an operator—</text>
 <subparagraph id="H6C68410C389E4FBBAE49B25E29C3E6BB"><enum>(A)</enum><text>to the extent technologically feasible, to implement mechanisms that permit a user of the website, online service, online application, or mobile application of the operator to erase or otherwise eliminate content or information that is—</text>
 <clause id="H26960A2718104F5DAF38CEB38BC60631"><enum>(i)</enum><text>submitted to the website, online service, online application, or mobile application by that user;</text> </clause><clause id="H765B0D7342614521B7380527F889A591"><enum>(ii)</enum><text>publicly available through the website, online service, online application, or mobile application; and</text>
 </clause><clause id="HBFB9407C07354ECAAAF2AD4900F24F49"><enum>(iii)</enum><text>contains or displays personal information of children or minors; and</text> </clause></subparagraph><subparagraph id="HFFE1E9E89D79401CB2929A965E93EF7E"><enum>(B)</enum><text>to take appropriate steps to make users aware of the mechanisms described in subparagraph (A) and to provide notice to users that the mechanisms do not necessarily provide comprehensive removal of the content or information submitted by users.</text>
 </subparagraph></paragraph><paragraph id="H231DCBA99BD14E3DACF870DD865604C1"><enum>(2)</enum><header>Exception</header><text>The regulations promulgated under paragraph (1) may not require an operator or third party to erase or otherwise eliminate content or information that—</text>
 <subparagraph id="H93976BFD3D06431BBA4842EE2E0251A7"><enum>(A)</enum><text>any other provision of Federal or State law requires the operator or third party to maintain; or</text> </subparagraph><subparagraph id="HC414B328C68741C485E37F333572CCE3"><enum>(B)</enum><text>was submitted to the website, online service, online application, or mobile application of the operator by any person other than the user who is attempting to erase or otherwise eliminate the content or information, including content or information submitted by the user that was republished or resubmitted by another person.</text>
 </subparagraph></paragraph><paragraph id="H33BBC9DFC9E44D0080FE877379CD1B04"><enum>(3)</enum><header>Limitation</header><text>Nothing in this section shall be construed to limit the authority of a law enforcement agency to obtain any content or information from an operator as authorized by law or pursuant to an order of a court of competent jurisdiction.</text>
				</paragraph></subsection></section><section id="H1AF095C112764A9D8BDE76AAFB75FEC7"><enum>8.</enum><header>Privacy dashboard for connected devices for children and minors</header>
 <subsection id="H60794D20F9674FE5945AF216F2290B35"><enum>(a)</enum><header>In general</header><text>A manufacturer of a connected device shall prominently display on the packaging for the connected device a standardized and easy-to-understand privacy dashboard, detailing whether, what, and how personal information of a child or minor is—</text>
 <paragraph id="H52B97927E4574CA7845239B4C5CA53FC"><enum>(1)</enum><text>collected from the connected device;</text> </paragraph><paragraph id="H5AB07CEC2BDD495B872C3A567A5E9F29"><enum>(2)</enum><text>transmitted from the connected device;</text>
 </paragraph><paragraph id="HB83292C4EC3645D1A832C859B9DB0571"><enum>(3)</enum><text>retained on the connected device;</text> </paragraph><paragraph id="H643F3763EAE74A6B88AF1262901E92B7"><enum>(4)</enum><text>retained by the manufacturer or affiliated person;</text>
 </paragraph><paragraph id="H6DF9CE8717B24D0D9487B79D29C8726D"><enum>(5)</enum><text>used by the manufacturer or affiliated person; and</text> </paragraph><paragraph id="HEC51155A6E4B466B86073115FF79CC42"><enum>(6)</enum><text>protected.</text>
 </paragraph></subsection><subsection id="H711C8F400F2B4DCC8C5A111381FA7C72"><enum>(b)</enum><header>Features</header><text>A privacy dashboard under subsection (a) shall inform a consumer of—</text> <paragraph id="H7342956DDA6344ECA0F88D853983A39B"><enum>(1)</enum><text>the extent to which the connected device meets the highest cybersecurity and data security standards, including if and how to obtain security patches;</text>
 </paragraph><paragraph id="H9AE79E85A26E42958070C3384D518D6A"><enum>(2)</enum><text>the extent to which the connected device gives—</text> <subparagraph id="HAB01D5918C1742AEBC06DA2D3845FACD"><enum>(A)</enum><text>a parent meaningful control over the information of a child of the parent; and</text>
 </subparagraph><subparagraph id="H251519680C7C48B4904E68067C499169"><enum>(B)</enum><text>a minor meaningful control over the information of the minor;</text> </subparagraph></paragraph><paragraph id="H0363500ACE7F444FB47569254486B2B0"><enum>(3)</enum><text>the extent to which the device minimizes the collection, retention, and use of information from a child or minor;</text>
 </paragraph><paragraph id="HABF9A771402C4FA7A24A2D96CDC845B9"><enum>(4)</enum><text>the location of privacy policies;</text> </paragraph><paragraph id="H9F8F3C6C5DBF45AA82584D6C5D50B4B5"><enum>(5)</enum><text>the type of personal information the connected device may collect; and</text>
 </paragraph><paragraph id="HE4193B93849843F5BCDF0613E5BE55AD"><enum>(6)</enum><text>any other information as the Commission considers appropriate.</text> </paragraph></subsection><subsection id="H1EED9AB9B3774A0EAE2AFEC0A20B133E"><enum>(c)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations to implement this section.</text>
			</subsection></section><section id="H1B8F3D21C5334B5595E4427F2FE766F3"><enum>9.</enum><header>Prohibition on sale of connected devices for children and minors that fail to meet appropriate
			 cybersecurity and data security standards</header>
 <subsection id="H42777CD0C9704E6586798B13BF60C122"><enum>(a)</enum><header>Prohibition</header><text>Beginning 1 year after the date of enactment of this Act, or such earlier date as the Commission considers appropriate, no person may sell a connected device unless the connected device meets appropriate cybersecurity and data security standards established by the Commission.</text>
			</subsection><subsection id="HFBF81F4ABB7D4EACB72056E806FB532F"><enum>(b)</enum><header>Cybersecurity and data security standards</header>
 <paragraph id="HF5B802E5EBC648D8925FF3F558733332"><enum>(1)</enum><header>In general</header><text>The Commission shall promulgate, under section 553 of title 5, United States Code, cybersecurity and data security standards described in subsection (a).</text>
 </paragraph><paragraph id="H8C619B837252490784413333709F9ACF"><enum>(2)</enum><header>Considerations</header><text>In promulgating cybersecurity and data security standards under paragraph (1), the Commission shall—</text>
 <subparagraph id="HDD7AB540E95644A8B1C76DA35A8DA647"><enum>(A)</enum><text>create cybersecurity and data security standards for different subsets of connected devices based on the varying degrees of—</text>
 <clause id="H48CFF376EC124797BB3F24696285D7B5"><enum>(i)</enum><text>cybersecurity and data security risk associated with each subset of connected device;</text> </clause><clause id="H8823D02FE81A4865985E3F89A04B4941"><enum>(ii)</enum><text>sensitivity of information collected, stored, or transmitted by each subset of connected device; and</text>
 </clause><clause id="HF81A7E4960D247809ED9239132DF7570"><enum>(iii)</enum><text>functionality of each subset of connected device;</text> </clause></subparagraph><subparagraph id="H0C8F2EA57BE14A28B87422DC81397ABC"><enum>(B)</enum><text>consider incorporating, to the extent practicable, existing cybersecurity and data security standards; and</text>
 </subparagraph><subparagraph id="H6B20F568EE914D0CB27EF80DED7F7490"><enum>(C)</enum><text>ensure that the cybersecurity and data security standards—</text> <clause id="HF8E30E7F015543C4A3470368145CFEF3"><enum>(i)</enum><text>are consistent with Fair Information Practice Principles described in section 4; and</text>
 </clause><clause id="H790168F9E39F456FA52F132AA2F90F89"><enum>(ii)</enum><text>promote data minimization.</text> </clause></subparagraph></paragraph></subsection></section><section id="H9628ED485D9F47ABA9820E04C2D063D4"><enum>10.</enum><header>Rule for treatment of users of websites, services, and applications directed to children or minors</header><text display-inline="no-display-inline">For the purposes of this Act, an operator of a website, online service, online application, or mobile application that is directed to children or minors shall treat each user of that website, online service, online application, or mobile application as a child or minor, respective to whether the website, online service, online application, or mobile application is directed to children or minors, except as permitted by the Commission pursuant to a regulation promulgated under this Act.</text>
		</section><section id="HE4E5FF74FBB1420DAADFCB070C45CABB"><enum>11.</enum><header>Enforcement and applicability</header>
			<subsection id="H3BA3C05CEB814BD6BCBD59D76200B776"><enum>(a)</enum><header>Enforcement by the Commission</header>
 <paragraph id="HFA20D8A967D7450EB11EF15157473ADC"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided, this Act and the regulations prescribed under this Act shall be enforced by the Commission under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.).</text>
 </paragraph><paragraph id="HC3F29F5EAD7C4286A2FD720F9833F164"><enum>(2)</enum><header>Unfair or deceptive acts or practices</header><text>Subject to subsection (b), a violation of this Act or a regulation prescribed under this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text>
				</paragraph><paragraph id="H426F21D7DC3A4096BE04861573805401"><enum>(3)</enum><header>Actions by the Commission</header>
 <subparagraph id="H7821503D3B674B60846BFBDCB70D6616"><enum>(A)</enum><header>In general</header><text>Subject to subsection (b), and except as provided in subsection (d)(1), the Commission shall prevent any person from violating this Act or a regulation prescribed under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made a part of this Act, and any person who violates this Act or such regulation shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text>
 </subparagraph><subparagraph id="HD11231B2BC504F1A8E8AC3B7ABF9CCD8"><enum>(B)</enum><header>Violations</header><text>In an action brought by the Commission to enforce this Act and the regulations prescribed under this Act, each connected device that fails to meet a standard promulgated under this Act shall be treated as a separate violation.</text>
 </subparagraph></paragraph></subsection><subsection id="HF34FD0009FCB4EFCBEBE95842664F4C1"><enum>(b)</enum><header>Enforcement by certain other agencies</header><text>Notwithstanding subsection (a), compliance with the requirements imposed under this Act shall be enforced as follows:</text>
 <paragraph id="H20546041D15446E0A9253333D017B19A"><enum>(1)</enum><text>Under section 8 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1818">12 U.S.C. 1818</external-xref>) by the appropriate Federal banking agency, with respect to an insured depository institution (as such terms are defined in section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)).</text>
 </paragraph><paragraph id="HF565484BE6B8471D838D68BA71B3F9A4"><enum>(2)</enum><text>Under the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1751">12 U.S.C. 1751</external-xref> et seq.) by the National Credit Union Administration Board, with respect to any Federal credit union.</text>
 </paragraph><paragraph id="HD64D7852E9FF46E587C9B30E3ECC334C"><enum>(3)</enum><text>Under part A of subtitle VII of title 49, United States Code, by the Secretary of Transportation, with respect to any air carrier or foreign air carrier subject to such part.</text>
 </paragraph><paragraph id="H57781A1040774B1DA328CF71D99AC5A0"><enum>(4)</enum><text>Under the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/181">7 U.S.C. 181</external-xref> et seq.) (except as provided in section 406 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/226">7 U.S.C. 226</external-xref>; 227)) by the Secretary of Agriculture, with respect to any activities subject to that Act.</text>
 </paragraph><paragraph id="HF3C1103A6BC540D98E398F271873039C"><enum>(5)</enum><text>Under the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2001">12 U.S.C. 2001</external-xref> et seq.) by the Farm Credit Administration, with respect to any Federal land bank, Federal land bank association, Federal intermediate credit bank, or production credit association.</text>
				</paragraph></subsection><subsection id="HA49F250BFAB34965B3E94AE71B417563"><enum>(c)</enum><header>Enforcement by State attorneys general</header>
				<paragraph id="H6509EEE0FCAD4380BE9049E55B2B7690"><enum>(1)</enum><header>In general</header>
 <subparagraph id="H52932AB255774843BF3CD503BEF0C0BD"><enum>(A)</enum><header>Civil actions</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any person in a practice that violates this Act or a regulation prescribed under this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States of appropriate jurisdiction to—</text>
 <clause id="H9B1A1A216136486F8BBEB56A248A206B"><enum>(i)</enum><text>enjoin that practice;</text> </clause><clause id="H19CBDA4184914CCF911FA1B0C7CA0B3B"><enum>(ii)</enum><text>enforce compliance with this Act or such regulation;</text>
 </clause><clause id="HFA9A0DA20CF24F6487B5BFA92B184B5E"><enum>(iii)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State; or</text> </clause><clause id="H968919D3A044416D902EB9D1AEE526AD"><enum>(iv)</enum><text>obtain such other relief as the court may consider to be appropriate.</text>
						</clause></subparagraph><subparagraph id="H26F00D3BB5B84A85BD64B7ADFA445329"><enum>(B)</enum><header>Notice</header>
 <clause id="HDFAD7508522145B5888312D73BCBD72E"><enum>(i)</enum><header>In general</header><text>Before filing an action under subparagraph (A), the attorney general of the State involved shall provide to the Commission—</text>
 <subclause id="HAC77D1CC4F544093BEC69D19B6A1D9FB"><enum>(I)</enum><text>written notice of that action; and</text> </subclause><subclause id="H6907CAEA536F47AE87BC027C41CA2079"><enum>(II)</enum><text>a copy of the complaint for that action.</text>
							</subclause></clause><clause id="H3A388C88861443AA9DBC051C3E526644"><enum>(ii)</enum><header>Exemption</header>
 <subclause id="HA3ACF72E65C4426F822F20370A13C1A0"><enum>(I)</enum><header>In general</header><text>Clause (i) shall not apply with respect to the filing of an action by an attorney general of a State under this paragraph if the attorney general of the State determines that it is not feasible to provide the notice described in that clause before the filing of the action.</text>
 </subclause><subclause id="H30460769ED934CBCA6FC175B3D00E168"><enum>(II)</enum><header>Notification</header><text>In an action described in subclause (I), the attorney general of a State shall provide notice and a copy of the complaint to the Commission at the same time as the attorney general files the action.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="H935A9F248579400E81E288C70697B353"><enum>(2)</enum><header>Intervention</header>
 <subparagraph id="H9E83A453EAEF4584BC815B579A61000D"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (1)(B), the Commission shall have the right to intervene in the action that is the subject of the notice.</text>
 </subparagraph><subparagraph id="H0B6A829F80E64808A0B9FCAF60C78DFE"><enum>(B)</enum><header>Effect of intervention</header><text>If the Commission intervenes in an action under paragraph (1), it shall have the right—</text> <clause id="HF023663D87E2487FA460488561FB3146"><enum>(i)</enum><text>to be heard with respect to any matter that arises in that action; and</text>
 </clause><clause id="H270480CFDB7848A5B90E77004C6C6D7C"><enum>(ii)</enum><text>to file a petition for appeal.</text> </clause></subparagraph></paragraph><paragraph id="H6808C0E9038A454B8B3885FAEA21F081"><enum>(3)</enum><header>Construction</header><text>For purposes of bringing any civil action under paragraph (1), nothing in this Act shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of that State to—</text>
 <subparagraph id="HA8C995C9EB8C4BF2BFD0AE213C0CE183"><enum>(A)</enum><text>conduct investigations;</text> </subparagraph><subparagraph id="HE03FC14EFED44D309FD1E7C00270282B"><enum>(B)</enum><text>administer oaths or affirmations; or</text>
 </subparagraph><subparagraph id="HF6C9EE4C3BF14CCE9A924CF2A4C07EC0"><enum>(C)</enum><text>compel the attendance of witnesses or the production of documentary and other evidence.</text> </subparagraph></paragraph><paragraph id="H1BD6D33415D04964A7165DFC81C9D89A"><enum>(4)</enum><header>Actions by the Commission</header><text>In any case in which an action is instituted by or on behalf of the Commission for violation of this Act or a regulation prescribed under this Act, no State may, during the pendency of that action, institute an action under paragraph (1) against any defendant named in the complaint in the action instituted by or on behalf of the Commission for that violation.</text>
				</paragraph><paragraph id="H4B2E24F3DE94440FAA8A3A910E21E85A"><enum>(5)</enum><header>Venue; service of process</header>
 <subparagraph id="H943C549B6AB942CBAA0569780EC2BCE5"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code.</text>
 </subparagraph><subparagraph id="H9234F48E15D644C0897A5D41E70FCE2F"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1), process may be served in any district in which the defendant—</text>
 <clause id="H031592F7AF9941AD976EA4C52CBBA3DF"><enum>(i)</enum><text>is an inhabitant; or</text> </clause><clause id="H3908B590FD2D483188E0FF8A86D87B9A"><enum>(ii)</enum><text>may be found.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H495612A8580A4D59848BF5E9A4D3E5C0"><enum>(d)</enum><header>Telecommunications carriers and cable operators</header>
 <paragraph id="H4F16F72147C846E3BE50652CC27FEEF2"><enum>(1)</enum><header>Enforcement by Commission</header><text>Notwithstanding section 5(a)(2) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(2)</external-xref>), compliance with the requirements imposed under this Act shall be enforced by the Commission with respect to any telecommunications carrier (as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)).</text>
 </paragraph><paragraph id="H3484488690724300842C37E1646C4A35"><enum>(2)</enum><header>Relationship to other laws</header><text>To the extent that section 222, 338(i), or 631 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>; 338(i); 551) is inconsistent with this Act, this Act controls.</text>
				</paragraph></subsection><subsection id="HC19D50E2624C49D9889ADF32CC6A0478"><enum>(e)</enum><header>Safe harbors</header>
 <paragraph id="HF1A2C9B2A0CD4958B5816920606C75F6"><enum>(1)</enum><header>Definition</header><text>In this subsection—</text> <subparagraph id="H2BFF358DD421477F970D6A348FC02E35"><enum>(A)</enum><text>the term <term>applicable section</term> means section 5, 6, 7, 8, or 9 of this Act;</text>
 </subparagraph><subparagraph id="H8C7A4F0F90D14F14A6AB1DF695E5E410"><enum>(B)</enum><text>the term <term>covered operator</term> means an operator subject to guidelines approved under paragraph (2);</text> </subparagraph><subparagraph id="HBC40A6719F544E0F99BBDDED6EBA583D"><enum>(C)</enum><text>the term <term>requesting entity</term> means an entity that submits a safe harbor request to the Commission; and</text>
 </subparagraph><subparagraph id="H626A632A037F45579A8AE5B942BA3D02"><enum>(D)</enum><text>the term <term>safe harbor request</term> means a request to have self-regulatory guidelines described in paragraph (2)(A) approved under that paragraph.</text>
					</subparagraph></paragraph><paragraph id="H5E8FA623461946ADB3904CBD875A310C"><enum>(2)</enum><header>Guidelines</header>
 <subparagraph id="H9BC0AECC2A634A538667E03250EF9A06"><enum>(A)</enum><header>In general</header><text>An operator may satisfy the requirements of regulations issued under an applicable section by following a set of self-regulatory guidelines, issued by representatives of the marketing or online industries, or by other persons, that, after notice and an opportunity for comment, are approved by the Commission upon making a determination that the guidelines meet the requirements of the regulations issued under that applicable section.</text>
 </subparagraph><subparagraph id="H804686194D4642549C78086381D95980"><enum>(B)</enum><header>Expedited response to requests</header><text>Not later than 180 days after the date on which a safe harbor request is filed under subparagraph (A), the Commission shall act upon the request set forth in writing the conclusions of the Commission with regard to the request.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2C266B4DADC349CD9562D37871C84298"><enum>(C)</enum><header>Appeals</header><text>A requesting entity may appeal the final action of the Commission under subparagraph (B), or a failure by the Commission to act in the period described in that paragraph, to a district court of the United States of appropriate jurisdiction, as provided for in section 706 of title 5, United States Code.</text>
					</subparagraph></paragraph><paragraph id="HC7EF6CB9AC504BC5A9CF500CEEDBE221"><enum>(3)</enum><header>Incentives</header>
 <subparagraph id="HE4DE4686DDCB467DB950EFDED5786DAA"><enum>(A)</enum><header>Self-regulatory incentives</header><text>In prescribing regulations under an applicable section, the Commission shall provide incentives for self-regulation by covered operators to implement the protections afforded children and minors, as applicable, under the regulatory requirements described in those sections.</text>
 </subparagraph><subparagraph id="H953106F942C74721960FB07E43D83585"><enum>(B)</enum><header>Deemed compliance</header><text>The incentives under subparagraph (A) shall include provisions for ensuring that a covered operator will be deemed to be in compliance with the requirements of the regulations under an applicable section if that person complies with guidelines approved under paragraph (2).</text>
 </subparagraph></paragraph><paragraph id="H7B5F839249D14166A9D77024BF73AB49"><enum>(4)</enum><header>Regulations</header><text>In prescribing regulations relating to safe harbor guidelines under an applicable section, the Commission shall—</text>
 <subparagraph id="HE37BCAEA39C042DAA2AB942A018C9898"><enum>(A)</enum><text>establish criteria for the approval of guidelines that will ensure that a covered operator provides substantially the same or greater protections for children and minors, as applicable, as those contained in the regulations issued under the applicable section; and</text>
 </subparagraph><subparagraph id="HB87BD6A96C6E447C9AD754D7BC3DF3BE"><enum>(B)</enum><text>require that any report or documentation required to be submitted to the Commission by a covered operator or requesting entity will be published on the internet website of the Commission, except to the extent that the report or documentation contains proprietary information, which the Commission may in its discretion redact.</text>
					</subparagraph></paragraph></subsection></section><section id="HFE38E9D209D94C8AA7E3548E34B23832"><enum>12.</enum><header>Effective dates</header>
 <subsection id="HB2E897EF6C26470FAB9CCFB7741B8F76"><enum>(a)</enum><header>In general</header><text>Except as provided in subsections (b) and (c), this Act and the amendments made by this Act shall take effect on the date that is 1 year after the date of enactment of this Act.</text>
 </subsection><subsection id="H6932B50F1F5447F5A7F15711272353F4"><enum>(b)</enum><header>Authority To promulgate regulations</header><text>The following shall take effect on the date of enactment of this Act:</text> <paragraph id="H30D0B5AD7FE44D2BB57D7BF8D118330F"><enum>(1)</enum><text>Section 2(b).</text>
 </paragraph><paragraph id="H4403B681DE59498E9DCD0DEFE57A143A"><enum>(2)</enum><text>The amendments made by subsections (a)(6) and (b) of section 3.</text> </paragraph><paragraph id="HFDF3AE6132AE48678109E5A1170F3FD9"><enum>(3)</enum><text>Sections 5(b), 6(b), 7(b), 8(c), and 9(b).</text>
 </paragraph></subsection><subsection id="HCCBF8DE8A32A46BDB073EB9161927C3D"><enum>(c)</enum><header>Digital Marketing Bill of Rights for minors</header><text>Section 5(a) shall take effect on the date that is 180 days after the promulgation of regulations under that subsection.</text>
 </subsection><subsection id="HDDC546227DE944A596462D4606C2026E"><enum>(d)</enum><header>Privacy dashboard for connected devices for children and minors</header><text>Subsections (a) and (b) of section 8 shall take effect on the date that is 180 days after the promulgation of regulations under such subsection.</text>
