 <section id="HBA4C77C0281548DAAE2D7F9797723959" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Innovation Modernization by Laboratory Empowerment Act</short-title></quote> or the <quote><short-title>NIMBLE Act</short-title></quote>.</text> </section><section id="HF852568B0C3B4068A64B710F5F351C1C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H70B4E16F0EAD47A5A27C05F9B3A7E139"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text> </paragraph><paragraph id="H21AFAD7A39784657B08EA7EBDD1FDFDE"><enum>(2)</enum><header>National laboratory</header><text>The term <term>National Laboratory</term> means a Department of Energy nonmilitary national laboratory, including—</text>
 <subparagraph id="HC11A9D722F084B868D99E45A18752C27"><enum>(A)</enum><text>Ames Laboratory;</text> </subparagraph><subparagraph id="H118C31E93EAB44369F479CA3A13A9D60"><enum>(B)</enum><text>Argonne National Laboratory;</text>
 </subparagraph><subparagraph id="HD0431D5F7109414288B30DB44BB39AF1"><enum>(C)</enum><text>Brookhaven National Laboratory;</text> </subparagraph><subparagraph id="HA43C581BB7A547A29CD8B6113127B0C6"><enum>(D)</enum><text>Fermi National Accelerator Laboratory;</text>
 </subparagraph><subparagraph id="HCBF242329CA54C138E109DA3B11F081F"><enum>(E)</enum><text>Idaho National Laboratory;</text> </subparagraph><subparagraph id="H661D5EBE95CF4227998E36EB31A1D5AF"><enum>(F)</enum><text>Lawrence Berkeley National Laboratory;</text>
 </subparagraph><subparagraph id="H70FA7634DB914BC38298DA0CFC36F50F"><enum>(G)</enum><text>National Energy Technology Laboratory;</text> </subparagraph><subparagraph id="HC2C9F56B1BC34C2EB0EC0FE41D87DE60"><enum>(H)</enum><text>National Renewable Energy Laboratory;</text>
 </subparagraph><subparagraph id="H3D1D86C1DC4D4CDBB22EBCBEFFAE00FA"><enum>(I)</enum><text>Oak Ridge National Laboratory;</text> </subparagraph><subparagraph id="H35D19FFF213C4A86A0F464019E09D8E3"><enum>(J)</enum><text>Pacific Northwest National Laboratory;</text>
 </subparagraph><subparagraph id="HC38A73125C1E47B69D6AB9621538FB19"><enum>(K)</enum><text>Princeton Plasma Physics Laboratory;</text> </subparagraph><subparagraph id="HD4EDB1B799DA4868A71514FB43B5633C"><enum>(L)</enum><text>Savannah River National Laboratory;</text>
 </subparagraph><subparagraph id="HED34429658504D788A85CE3CCDE3FD05"><enum>(M)</enum><text>Stanford Linear Accelerator Center;</text> </subparagraph><subparagraph id="HF26305BA9C5F47FEB9A9467A654C9868"><enum>(N)</enum><text>Thomas Jefferson National Accelerator Facility; and</text>
 </subparagraph><subparagraph id="HF746A70FE93D4850A35D7285EF9B37F5"><enum>(O)</enum><text>any laboratory operated by the National Nuclear Security Administration, but only with respect to the civilian energy activities thereof.</text>
 </subparagraph></paragraph><paragraph id="H22C2B7A007774992B4F5042CD25C6C21"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text> </paragraph></section><section id="H084EEE43993944C19CFA6DD6F0556C10"><enum>3.</enum><header>Public-private partnerships for commercialization</header> <subsection id="H57EC51D22ADA4F8385495CDBBB3C27A1"><enum>(a)</enum><header>In general</header><text>Subject to subsections (b) and (c), the Secretary shall delegate to directors of the National Laboratories signature authority with respect to any agreement described in subsection (b) the total cost of which (including the National Laboratory contributions and project recipient cost share) is less than $1,000,000, if such an agreement falls within the scope of—</text>
 <paragraph id="H9C868D9E344B49349A052DF1592D9A6B"><enum>(1)</enum><text>a strategic plan for the National Laboratory that has been approved by the Department; or</text> </paragraph><paragraph id="H883D9077BFF24038BD8943F57619111E"><enum>(2)</enum><text>the most recent congressionally approved budget for Department activities to be carried out by the National Laboratory.</text>
 </paragraph></subsection><subsection id="H683ED801A59D4795B8AA8E2673293667"><enum>(b)</enum><header>Agreements</header><text>Subsection (a) applies to—</text> <paragraph id="HEC11EA1D09534B99A71EB5B376E3CD37"><enum>(1)</enum><text>a cooperative research and development agreement;</text>
 </paragraph><paragraph id="H241746C8F9F1444793C9E77EDF9E28C8"><enum>(2)</enum><text>a non-Federal work-for-others agreement; and</text> </paragraph><paragraph id="H0C4B39640B2D4F409D0FD5857FF6B7E8"><enum>(3)</enum><text>any other agreement determined to be appropriate by the Secretary, in collaboration with the directors of the National Laboratories.</text>
				</paragraph></subsection><subsection id="HDA7174F870604247945BF7488BF6C350"><enum>(c)</enum><header>Administration</header>
 <paragraph id="H02135A6759B04164B7BA4A69F1719A50"><enum>(1)</enum><header>Accountability</header><text>The director of the affected National Laboratory and the affected contractor shall carry out an agreement under this section in accordance with applicable policies of the Department, including by ensuring that the agreement does not compromise any national security, economic, or environmental interest of the United States.</text>
 </paragraph><paragraph id="H56344580CF314A97B3D938E92483BA3C"><enum>(2)</enum><header>Certification</header><text>The director of the affected National Laboratory and the affected contractor shall certify that each activity carried out under a project for which an agreement is entered into under this section does not present, or minimizes, any apparent conflict of interest, and avoids or neutralizes any actual conflict of interest, as a result of the agreement under this section.</text>
 </paragraph><paragraph id="H3FC3F0428E7A4DC5A077ED5A5FC6E4E4"><enum>(3)</enum><header>Availability of records</header><text>Within 30 days of entering an agreement under this section, the director of a National Laboratory shall submit to the Secretary for monitoring and review all records of the National Laboratory relating to the agreement.</text>
 </paragraph><paragraph id="H657EE107EEA340389BC0F58E81B6A3A9"><enum>(4)</enum><header>Rates</header><text>The director of a National Laboratory may charge higher rates for services performed under a partnership agreement entered into pursuant to this section, regardless of the full cost of recovery, if such funds are used exclusively to support further research and development activities at the respective National Laboratory.</text>
 </paragraph></subsection><subsection id="H6DD9B166BE2947CDB531910FABCF4B61"><enum>(d)</enum><header>Exception</header><text>This section does not apply to any agreement with a majority foreign-owned company.</text> </subsection><subsection id="H1A4433AF2755471480A02F93FA6E66FF"><enum>(e)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>) is amended—</text>
 <paragraph id="HF0ACCD70968E45688CBAD7C46AE3DAB1"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HE6CEF95970744AD7AF6167FBAEB5B087"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting the subparagraphs appropriately;</text>
 </subparagraph><subparagraph id="H1549C207FE7C449DB6BB9ECBF982F31F"><enum>(B)</enum><text>by striking <quote>Each Federal agency</quote> and inserting the following:</text> <quoted-block id="HF1A337A5257149A9960F974A5504E6E0" style="OLC"> <paragraph id="HF197EFF00DFB492C964CDDC0B7995708"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), each Federal agency</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H32341034AF154F2F93C9ABD794CD434F"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="HE5C4D86A31014D0880703C4C4B4E1419" style="OLC"> <paragraph id="H858AF90998E24A509A8B054BC252DB66"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), in accordance with section 3(a) of the <short-title>NIMBLE Act</short-title>, approval by the Secretary of Energy shall not be required for any technology transfer agreement proposed to be entered into by a National Laboratory of the Department of Energy, the total cost of which (including the National Laboratory contributions and project recipient cost share) is less than $1,000,000.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HF208AF270124419E883BEA75E3D21FC3"><enum>(2)</enum><text>in subsection (b), by striking <quote>subsection (a)(1)</quote> each place it appears and inserting <quote>subsection (a)(1)(A)</quote>.</text> </paragraph></subsection></section><section id="H83F939C053D74EC8B80598C26B979CE3"><enum>4.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this Act or an amendment made by this Act abrogates or otherwise affects the primary responsibilities of any National Laboratory to the Department.</text>
