 </subsection></section><section id="HC7C494E7F92741F0896DA4811DDFE0D2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HE9D392889AAD47DBA0DFEAE459C648D9"><enum>(1)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Energy.</text>
 </paragraph><paragraph id="HC03DB11B59E74FAAA274735078E28928"><enum>(2)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Science of the Department, except as otherwise indicated.</text> </paragraph><paragraph id="H95015829A9164DAEAA764AC9D8896355"><enum>(3)</enum><header>National Laboratory</header><text>The term <quote>National Laboratory</quote> has the meaning given that term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text>
 </paragraph><paragraph id="HEDB6AD87735C4003BC0D00E04A2F0AFC"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text> </paragraph></section><title id="H7E9E0C128AF349E18590C5DBD601D31B"><enum>I</enum><header>Laboratory Modernization and Technology Transfer</header> <section id="H68383C3656E64E99A267C6B73E6C79C5" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Laboratory Modernization and Technology Transfer Act</short-title></quote>.</text>
 </section><section id="H2443D99DE0994FB89307337AB9D0E288"><enum>102.</enum><header>Inclusion of early stage technology demonstration in authorized technology transfer activities</header><text display-inline="no-display-inline">Section 1001 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16391">42 U.S.C. 16391</external-xref>) is amended—</text> <paragraph id="H51FC776658D14FA79EE34656E3722A9D"><enum>(1)</enum><text>by redesignating subsection (g) as subsection (h); and</text>
 </paragraph><paragraph id="HC83FC3F605B14705B2088604555C137A"><enum>(2)</enum><text>by inserting after subsection (f) the following:</text> <quoted-block display-inline="no-display-inline" id="H93BFE0EBF8FF4E538A46B1CE00F257E1" style="OLC"> <subsection id="H606E91461F394E379B66652B9ACE4398"><enum>(g)</enum><header>Early stage technology demonstration</header><text>The Secretary shall permit the directors of the National Laboratories to use funds authorized to support technology transfer within the Department to carry out early stage and precommercial technology demonstration activities to remove technology barriers that limit private sector interest and demonstrate potential commercial applications of any research and technologies arising from National Laboratory activities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H66B1ACA81DFD467BA4682F0818812CA4"><enum>103.</enum><header>Sense of Congress on accelerating energy innovation</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="H287AEF6988F84F76B80243109FF427B3"><enum>(1)</enum><text>although important progress has been made in cost reduction and deployment of clean energy technologies, accelerating clean energy innovation will help meet critical competitiveness, energy security, and environmental goals;</text>
 </paragraph><paragraph id="H33C72FB6A6BF41789E94276FB373CCF5"><enum>(2)</enum><text>accelerating the pace of clean energy innovation in the United States calls for—</text> <subparagraph id="HE76DDD4A5DCF4839A818B0DFEDAC478D"><enum>(A)</enum><text>supporting existing research and development programs at the Department and the world-class National Laboratories;</text>
 </subparagraph><subparagraph id="H9AB031A9B0FE45FAB42DEDC718D30AB6"><enum>(B)</enum><text>exploring and developing new pathways for innovators, investors, and decision-makers to leverage the resources of the Department for addressing the challenges and comparative strengths of geographic regions; and</text>
 </subparagraph><subparagraph id="H1E46BF33D0944740B9DB0EB89B3254F7"><enum>(C)</enum><text>recognizing the financial constraints of the Department, regularly reviewing clean energy programs to ensure that taxpayer investments are maximized;</text>
 </subparagraph></paragraph><paragraph id="HF6E872EB5BF34F15B3FE335172949919"><enum>(3)</enum><text>the energy supply, demand, policies, markets, and resource options of the United States vary by geographic region;</text>
 </paragraph><paragraph id="H243E375561474D9F9DF84DA1A83683D7"><enum>(4)</enum><text>a regional approach to innovation can bridge the gaps between local talent, institutions, and industries to identify opportunities and convert United States investment into domestic companies; and</text>
 </paragraph><paragraph id="H1993C936723F43E983D0E2970611AF94"><enum>(5)</enum><text>Congress, the Secretary, and energy industry participants should advance efforts that promote international, domestic, and regional cooperation on the research and development of energy innovations that—</text>
 <subparagraph id="H3C7E7D1957DE4CAA93A9FE5B057CC8A0"><enum>(A)</enum><text>provide clean, affordable, and reliable energy for everyone;</text> </subparagraph><subparagraph id="H277AC931C9CB42A79E3D7DECCA2F3107"><enum>(B)</enum><text>promote economic growth;</text>
 </subparagraph><subparagraph id="H7CED5DBC5B614409AEDFA1E92C5A0E0C"><enum>(C)</enum><text>are critical for energy security; and</text> </subparagraph><subparagraph id="H3F1760B89C64415E85BD479FFC2AD195"><enum>(D)</enum><text>are sustainable without government support.</text>
					</subparagraph></paragraph></section><section id="H951BEF5CD4B74B8DB3FE362A892F8D1C"><enum>104.</enum><header>Restoration of laboratory directed research and development program</header>
 <subsection id="HBAE2C9D4F06B49AA8B42A78C3C3BD2D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Secretary shall ensure that laboratory operating contractors do not allocate costs of general and administrative overhead to laboratory directed research and development.</text>
 </subsection><subsection id="HE807F66B526B400A9761061192A48B93"><enum>(b)</enum><header>Exception for national security laboratories</header><text display-inline="yes-display-inline">This section shall not apply to the national security laboratories with respect to which section 3119 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>) applies.</text>
				</subsection></section><section id="H97CF31D94DBC4F18A5C6FB8ED2D012E9"><enum>105.</enum><header>Research grants database</header>
 <subsection id="H23620C0239704BB3950C81388DA35838"><enum>(a)</enum><header>In General</header><text>The Secretary shall establish and maintain a public database, accessible on the website of the Department, that contains a searchable listing of each unclassified research and development project contract, grant, cooperative agreement, task order for a federally funded research and development center, or other transaction administered by the Department.</text>
 </subsection><subsection id="HEA2D7111D25D431789A663EE53AB925D"><enum>(b)</enum><header>Requirements</header><text>Each listing described in subsection (a) shall include, at a minimum, for each listed project, the Department office carrying out the project, the project name, an abstract or summary of the project, funding levels, project duration, contractor or grantee name (including the names of any subcontractors), and expected objectives and milestones.</text>
 </subsection><subsection id="H6D297CF0BA16496994E49F08568D966D"><enum>(c)</enum><header>Relevant literature and patents</header><text>The Secretary shall provide information through the public database established under subsection (a) on relevant literature and patents that are associated with each research and development project contract, grant, or cooperative agreement, or other transaction, of the Department.</text>
 </subsection></section><section id="H5B2B5D8271514E5BA7A747B668584949"><enum>106.</enum><header>Technology transfer and transitions assessment</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and as often as the Secretary determines to be necessary thereafter, the Secretary shall transmit to the appropriate committees of Congress a report that includes recommended changes to the policy of the Department and legislative changes to section 1001 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16391">42 U.S.C. 16391</external-xref>) to improve the ability of the Department to successfully transfer new energy technologies to the private sector.</text>
			</section><section commented="no" id="H2E25B00FCEA146E4A679E07DB10F3253"><enum>107.</enum><header>Agreements for commercializing technology pilot program</header>
 <subsection commented="no" id="HC7CE9803077940CFA1F98BD02B053F7B"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out the Agreements for Commercializing Technology pilot program of the Department, as announced by the Secretary on December 8, 2011, in accordance with this section.</text>
 </subsection><subsection commented="no" id="H2F890C2989C74796A14210121F64EA10"><enum>(b)</enum><header>Terms</header><text>Each agreement entered into pursuant to the pilot program referred to in subsection (a) shall provide to the contractor of the applicable National Laboratory, to the maximum extent determined to be appropriate by the Secretary, increased authority to negotiate contract terms, such as intellectual property rights, payment structures, performance guarantees, and multiparty collaborations.</text>
				</subsection><subsection commented="no" id="HA88B6130AA264B6891613C6793F5ED06"><enum>(c)</enum><header>Eligibility</header>
 <paragraph commented="no" id="HBD78266401384C4CBA02348594E99F07"><enum>(1)</enum><header>In general</header><text>Any director of a National Laboratory may enter into an agreement pursuant to the pilot program referred to in subsection (a).</text>
 </paragraph><paragraph commented="no" id="HC9A18F05E9284531AF65B35295503CB5"><enum>(2)</enum><header>Agreements with non-federal entities</header><text>To carry out paragraph (1) and subject to paragraph (3), the Secretary shall permit the directors of the National Laboratories to execute agreements with a non-Federal entity, including a non-Federal entity already receiving Federal funding that will be used to support activities under agreements executed pursuant to paragraph (1), provided that such funding is solely used to carry out the purposes of the Federal award.</text>
 </paragraph><paragraph commented="no" id="H00D18118D5A2474EA8E7D50FDD8F55E4"><enum>(3)</enum><header>Restriction</header><text>The requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/18">chapter 18</external-xref> of title 35, United States Code (commonly known as the <quote>Bayh-Dole Act</quote>) shall apply if—</text> <subparagraph commented="no" id="HA2DD84F82A0441D4A11D8CD5BAE9BADD"><enum>(A)</enum><text>the agreement is a funding agreement (as that term is defined in section 201 of that title); and</text>
 </subparagraph><subparagraph commented="no" id="H34875543D9944FAE955C8CEF4178A797"><enum>(B)</enum><text>at least one of the parties to the funding agreement is eligible to receive rights under that chapter.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H66C0526BBFAE4889A7745D22501D273E"><enum>(d)</enum><header>Submission to secretary</header><text>Each affected director of a National Laboratory shall submit to the Secretary, with respect to each agreement entered into under this section—</text>
 <paragraph commented="no" id="H25F525BA85B74DF386BDA45E82955E32"><enum>(1)</enum><text>a summary of information relating to the relevant project;</text> </paragraph><paragraph commented="no" id="HD0CD932E928046C3AC183E5C9E0EA094"><enum>(2)</enum><text>the total estimated costs of the project;</text>
 </paragraph><paragraph commented="no" id="H8178CA8FFD2542DD81822B1F12172BF8"><enum>(3)</enum><text>estimated commencement and completion dates of the project; and</text> </paragraph><paragraph commented="no" id="H711721C0C2DB42D1B746BFCAE3540197"><enum>(4)</enum><text>other documentation determined to be appropriate by the Secretary.</text>
 </paragraph></subsection><subsection commented="no" id="H96ED94AEF8E54E559A723C0A55BD1C5A"><enum>(e)</enum><header>Certification</header><text>The Secretary shall require the contractor of the affected National Laboratory to certify that each activity carried out under a project for which an agreement is entered into under this section—</text>
 <paragraph commented="no" id="H4F1A4BB8D1EB4DC0A3F5CFB54CD95149"><enum>(1)</enum><text>is not in direct competition with the private sector; and</text> </paragraph><paragraph commented="no" id="H15BA9FEB180148149597393C49005D6E"><enum>(2)</enum><text>does not present, or minimizes, any apparent conflict of interest, and avoids or neutralizes any actual conflict of interest, as a result of the agreement under this section.</text>
 </paragraph></subsection><subsection commented="no" id="HD2F77F4FB0014AFD912204CDBCC40872"><enum>(f)</enum><header>Extension</header><text>The pilot program referred to in subsection (a) shall be extended until September 30, 2019.</text> </subsection><subsection commented="no" id="HCF01F84DA41944A499E5AB3725187768"><enum>(g)</enum><header>Reports</header> <paragraph commented="no" id="HD79EB0DB5CBB4D4FBA0C89E77641FFE3"><enum>(1)</enum><header>Overall assessment</header><text>Not later than 60 days after the date described in subsection (f), the Secretary, in coordination with directors of the National Laboratories, shall submit to the appropriate committees of Congress a report that—</text>
 <subparagraph commented="no" id="H07A364390DDA4A87A023BF0DEA386812"><enum>(A)</enum><text>assesses the overall effectiveness of the pilot program referred to in subsection (a);</text> </subparagraph><subparagraph commented="no" id="HA4A2682608DE4146844AD8528C079D22"><enum>(B)</enum><text>identifies opportunities to improve the effectiveness of the pilot program;</text>
 </subparagraph><subparagraph commented="no" id="H8D63DC1B3A77485D8D598055589D82CE"><enum>(C)</enum><text>assesses the potential for program activities to interfere with the responsibilities of the National Laboratories to the Department; and</text>
 </subparagraph><subparagraph commented="no" id="H5D1C6A4F4E554047926435C9D8D85E39"><enum>(D)</enum><text>provides a recommendation regarding the future of the pilot program.</text> </subparagraph></paragraph><paragraph commented="no" id="H5E9F85CB3FD941688EE5C1F08A0F21AE"><enum>(2)</enum><header>Transparency</header><text>The Secretary, in coordination with directors of the National Laboratories, shall submit to the appropriate committees of Congress an annual report that accounts for all incidences of, and provides a justification for, non-Federal entities using funds derived from a Federal contract or award to carry out agreements pursuant to this section.</text>
					</paragraph></subsection></section><section commented="no" id="H11C1CFC0C4C04003831F40F5FBC3456D"><enum>108.</enum><header>Short-term cost-share pilot program</header>
 <subsection commented="no" id="HBAD7EF6E7F6148739E46C9768E3A9DBA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 988(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352(b)</external-xref>) is amended—</text> <paragraph commented="no" id="HE7566B0BC2AC4E4FB1CA3811FA7552A1"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Except as provided in paragraphs (2) and (3)</quote> and inserting <quote>Except as provided in paragraphs (2), (3), and (4)</quote>; and</text>
 </paragraph><paragraph commented="no" id="H7EB8A0E28994490AA36ACB247BF1DC94"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H7532CFADE4C2434DB158C7B0900AFD2C" style="OLC"> <paragraph commented="no" id="HC74A141941BC4747B08080EE4A8E01FB"><enum>(4)</enum><header>Exemption for institutions of higher education and other nonprofit institutions</header> <subparagraph commented="no" id="H6BAEBC2958C641B9B46DE1CA85C56997"><enum>(A)</enum><header>In general</header><text>Paragraph (1) shall not apply to a research or development activity performed by an institution of higher education or nonprofit institution (as defined in section 4 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703</external-xref>)).</text>
 </subparagraph><subparagraph commented="no" id="H1445EEA631C34696BF003D2BDBA24930"><enum>(B)</enum><header>Termination date</header><text>The exemption under subparagraph (A) shall apply during the 2-year period beginning on the date of enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="H8DCC9E1BE4A54850801FA6EE8E6AE70F"><enum>(b)</enum><header>Reports</header>
 <paragraph commented="no" id="H732125BCCD0446FE99111C0C18048487"><enum>(1)</enum><header>Initial report</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall submit to the appropriate committees of Congress a report that describes the use of cost-sharing waivers by the Department under section 988(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352(b)</external-xref>) during the 2-year period ending on the date of enactment of this Act.</text>
 </paragraph><paragraph commented="no" id="H5733D040EEED45718824BD6E315F0272"><enum>(2)</enum><header>Annual reports</header><text>Annually during the 2-year period beginning on the date of enactment of this Act, the Secretary shall submit to the appropriate committees of Congress a report that describes the use of cost-sharing waivers by the Department under section 988(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352(b)</external-xref>) during the period covered by the report.</text>
					</paragraph></subsection></section></title><title id="HDE96BCB11E5E4FE6B67B9E6155AC95B3"><enum>II</enum><header>Department of Energy Research Coordination</header>
 <section id="H45551E6356994DC390BAC8CFEAD54A17" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Department of Energy Research Coordination Act</short-title></quote>.</text> </section><section id="HF50844D89435430096A0C857CA5F47BA"><enum>202.</enum><header>Protection of information</header><text display-inline="no-display-inline">Section 5012 of the America Competes Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16538">42 U.S.C. 16538</external-xref>) is amended—</text>
 <paragraph id="H1D863DC83965417A8C6CDF4546EE6E14"><enum>(1)</enum><text>in subsection (a)(3), by striking <quote>subsection (n)(1)</quote> and inserting <quote>subsection (o)(1)</quote>;</text> </paragraph><paragraph id="HDB4EFBB0A9444FCEBBB896634904C37B"><enum>(2)</enum><text>by redesignating subsection (n) as subsection (o); and</text>
 </paragraph><paragraph id="H70009115073D4BD2841B49830AC9321C"><enum>(3)</enum><text>by inserting after subsection (m) the following:</text> <quoted-block display-inline="no-display-inline" id="HB3CECB82B7D440AC933723242A88A14F" style="OLC"> <subsection id="H2560A450C3044330B03A641EA2683833"><enum>(n)</enum><header>Protection of information</header><text>The following types of information collected by ARPA–E from recipients of financial assistance awards shall be considered commercial and financial information obtained from a person and privileged or confidential and not subject to disclosure under section 552(b)(4) of title 5, United States Code:</text>
 <paragraph id="HCD538C2D2D6541FCA293B46438B0C9EC"><enum>(1)</enum><text>Plans for commercialization of technologies developed under the award, including business plans, technology-to-market plans, market studies, and cost and performance models.</text>
 </paragraph><paragraph id="H63CBF5A789D9486D82F3274F02D06B8E"><enum>(2)</enum><text>Investments provided to an awardee from third parties (such as venture capital firms, hedge funds, and private equity firms), including amounts and the percentage of ownership of the awardee provided in return for the investments.</text>
 </paragraph><paragraph id="H4C8098B7A4E14EA185B2C81D6866D77E"><enum>(3)</enum><text>Additional financial support that the awardee—</text> <subparagraph id="H610CE77474CF4A7796BA21E10FF8C4E9"><enum>(A)</enum><text>plans to or has invested into the technology developed under the award; or</text>
 </subparagraph><subparagraph id="HA9627658814449A794AD4ED1EF5111A0"><enum>(B)</enum><text>is seeking from third parties.</text> </subparagraph></paragraph><paragraph id="HF4B256753FA24E9F978D7D4274A1E2E4"><enum>(4)</enum><text>Revenue from the licensing or sale of new products or services resulting from research conducted under the award.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HE582C6C3C08246EBBCF830F883C5A780"><enum>203.</enum><header>Crosscutting research and development</header>
 <subsection id="HD23B6FDB5F3B4EB299EB7DBFD4E76895"><enum>(a)</enum><header>In general</header><text>The Secretary shall use the capabilities of the Department to identify strategic opportunities for collaborative research, development, demonstration, and commercial application of innovative science and technologies.</text>
 </subsection><subsection id="H9D71F51E7FCD4834BA450EC0B8DEEBDC"><enum>(b)</enum><header>Existing programs; coordination of activities</header><text>To the maximum extent practicable, the Secretary shall seek—</text> <paragraph id="H37DCE1B995884051991E9B6F19F42995"><enum>(1)</enum><text>to leverage existing programs of the Department; and</text>
 </paragraph><paragraph id="H9C7FFF2519C940178A912B2F9EB8AE62"><enum>(2)</enum><text>to consolidate and coordinate activities throughout the Department to promote collaboration and crosscutting approaches within programs of the Department.</text>
 </paragraph></subsection><subsection id="HF373CBA9A71B43E19B330FAF02096532"><enum>(c)</enum><header>Additional actions</header><text>The Secretary shall—</text> <paragraph id="H0478CF4031504E2C9365B53A09B20112"><enum>(1)</enum><text>prioritize activities that use all affordable domestic resources;</text>
 </paragraph><paragraph id="H0C7EB8376E594738822869F20FBBA391"><enum>(2)</enum><text>develop a planning, evaluation, and technical assessment framework for setting objective long-term strategic goals and evaluating progress that—</text>
 <subparagraph id="H91138C5CB76E4043A890AF9EE8D80B24"><enum>(A)</enum><text>ensures integrity and independence; and</text> </subparagraph><subparagraph id="HA78CCE9D859B4D59AAD36F62B0059641"><enum>(B)</enum><text>provides the flexibility to adapt to market dynamics;</text>
 </subparagraph></paragraph><paragraph id="H07574092FC5A45DA802F829C73726D04"><enum>(3)</enum><text>ensure that activities shall be undertaken in a manner that does not duplicate other activities within the Department or other Federal Government activities; and</text>
 </paragraph><paragraph id="H89EA9522BB684CFFA8A8403021563875"><enum>(4)</enum><text>identify programs that may be more effectively left to the States, industry, nongovernmental organizations, institutions of higher education, or other stakeholders.</text>
 </paragraph></subsection></section><section id="HEB1833B6C9A747AA9DA493BAB2C7AAF3"><enum>204.</enum><header>Strategic research portfolio analysis and coordination plan</header><text display-inline="no-display-inline">The Energy Policy Act of 2005 is amended by striking section 994 (<external-xref legal-doc="usc" parsable-cite="usc/42/16358">42 U.S.C. 16358</external-xref>) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HFCD45CF8960242549784B1B841AD49B3" style="OLC">
					<section id="HD3C0749E77A34F34B07EDD824A2DBD94"><enum>994.</enum><header>Strategic research portfolio analysis and coordination plan</header>
 <subsection id="H8BD23FC10F1746E6AF4A3E705C48BA44"><enum>(a)</enum><header>In general</header><text>The Secretary shall periodically review all of the science and technology activities of the Department in a strategic framework that takes into account—</text>
 <paragraph id="H83442CF1E7A94E9192D8375DB9EDBA27"><enum>(1)</enum><text>the frontiers of science to which the Department can contribute;</text> </paragraph><paragraph id="H4487919718AA44C385E07E8E59E6DEE9"><enum>(2)</enum><text>the national needs relevant to the statutory missions of the Department; and</text>
 </paragraph><paragraph id="H17580D020F404D8EA9C21A59CDB5227C"><enum>(3)</enum><text>global energy dynamics.</text> </paragraph></subsection><subsection id="H14BEB5B028DD455F81B6877B2CF4DBC8"><enum>(b)</enum><header>Coordination analysis and plan</header> <paragraph id="H14445562D6F0469BA44D8AE660DCD9C9"><enum>(1)</enum><header>In general</header><text>As part of the review under subsection (a), the Secretary shall develop a plan to improve coordination and collaboration in research, development, demonstration, and commercial application activities across organizational boundaries of the Department.</text>
 </paragraph><paragraph id="HCA9B3E3E697A4147BF62DF075FB189BF"><enum>(2)</enum><header>Plan contents</header><text>The plan developed under paragraph (1) shall describe—</text> <subparagraph id="H63A10DE7C6F74399881B228736F49F75"><enum>(A)</enum><text>crosscutting scientific and technical issues and research questions that span more than one program or major office of the Department;</text>
 </subparagraph><subparagraph id="H76C07CA206C146B79A5CD45381C85DFE"><enum>(B)</enum><text>ways in which the applied technology programs of the Department are coordinating activities and addressing the questions referred to in subparagraph (A);</text>
 </subparagraph><subparagraph id="HF1B7F075888C4D4A88F0BD316401CD09"><enum>(C)</enum><text>ways in which the technical interchange within the Department, particularly between the Office of Science and the applied technology programs, could be enhanced, including ways in which the research agendas of the Office of Science and the applied programs could better interact and assist each other;</text>
 </subparagraph><subparagraph id="HF98EAD77F3684AEC93B532F4EC3252AF"><enum>(D)</enum><text>ways in which the Secretary would ensure that the overall research agenda of the Department includes, in addition to fundamental, curiosity-driven research, fundamental research related to topics of concern to the applied programs, and applications in Departmental technology programs of research results generated by fundamental, curiosity-driven research;</text>
 </subparagraph><subparagraph id="H992B9019E9C9435DB1A2CEC7E3BAFCEA"><enum>(E)</enum><text>critical assessments of any ongoing programs that have experienced subpar performance or cost overruns of 10 percent or more over 1 or more years;</text>
 </subparagraph><subparagraph id="HEDF7E37DB16D4CFFAD912585AB07425C"><enum>(F)</enum><text>any activities that may be more effectively left to the States, industry, nongovernmental organizations, institutions of higher education, or other stakeholders; and</text>
 </subparagraph><subparagraph id="H2F136781C72544EDB4E5EAF6AC69F173"><enum>(G)</enum><text>detailed evaluations and proposals for innovation hubs, institutes, and research centers of the Department, including—</text>
 <clause id="H5C79365195874D4BA2B99D0FD64ED4D8"><enum>(i)</enum><text>an affirmation that the hubs, institutes, and research centers will—</text> <subclause id="H7ACCA98CDF0A4F7B8FF74C37035E765B"><enum>(I)</enum><text>advance the mission of the Department; and</text>
 </subclause><subclause id="H128F6E39E449450394415E5CDCFFC93B"><enum>(II)</enum><text>prioritize research, development, and demonstration; and</text> </subclause></clause><clause id="H40205B09F2EF412597E5547CC9FDF0A8"><enum>(ii)</enum><text>an affirmation that any hubs, institutes, or research centers that are established or renewed within the Office of Science are consistent with the mission of the Office of Science described in subsection (c) of section 209 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7139">42 U.S.C. 7139</external-xref>).</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H7450C52B87094A468EBD14092EE2980D"><enum>(c)</enum><header>Submission to Congress</header><text>Every 4 years, the Secretary shall submit to Congress—</text> <paragraph id="H942333C96F3D4854B88D5670178B408D"><enum>(1)</enum><text>the results of the review under subsection (a); and</text>
 </paragraph><paragraph id="H580BC55EF9474023BFA96E46C237843B"><enum>(2)</enum><text>the coordination plan under subsection (b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H4F50F67F9748476D8BE11196A14783BC"><enum>205.</enum><header>Strategy for facilities and infrastructure</header> <subsection id="H815693AF1AC146269BB7EE7E057CBBC4"><enum>(a)</enum><header>Amendments</header><text>Section 993 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16357">42 U.S.C. 16357</external-xref>) is amended—</text>

 <subsection id="H4BF8341553D745FBAFCFE8FD30287888"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H38334CE59B2649FBA24E5033DE88BBAF"><enum>(1)</enum><header>Advanced energy technology</header><text>The term <term>advanced energy technology</term> means—</text>
 <subparagraph id="HF47B8C9907DE427B993EC641C48164F0"><enum>(A)</enum><text>an innovative technology—</text> <clause id="H3CB67A8EF4CA46A493D2C8014ECC5835"><enum>(i)</enum><text>that produces energy from solar, wind, geothermal, biomass, tidal, wave, ocean, or other renewable energy resources;</text>
 </clause><clause id="H2C68AAB7973E4EDAB43835A74712492B"><enum>(ii)</enum><text>that produces nuclear energy;</text> </clause><clause id="HA88BE6C29EAB408C9518E50245B2AAF5"><enum>(iii)</enum><text>for carbon capture and sequestration;</text>
 </clause><clause id="H408DC7628AED47C78DD72484CEFA2E03"><enum>(iv)</enum><text>that enables advanced vehicles, vehicle components, and related technologies that result in significant energy savings;</text>
 </clause><clause id="H8697140B29A64F4E94F797B3A2822CF2"><enum>(v)</enum><text>that generates, transmits, distributes, uses, or stores energy more efficiently than conventional technologies, including through Smart Grid technologies; or</text>
 </clause><clause id="H0E631C9A2C2D406EA032EF188FFB42A4"><enum>(vi)</enum><text>that enhances the energy independence and security of the United States by enabling improved or expanded supply and production of domestic energy resources, including coal, oil, and natural gas;</text>
 </clause></subparagraph><subparagraph id="HF6F551CB37D7482AA55D1F3EBA00FEC1"><enum>(B)</enum><text>a research, development, demonstration, or commercial application activity necessary to ensure the long-term, secure, and sustainable supply of an energy-critical element; or</text>
 </subparagraph><subparagraph id="H35B4CC16424549578A3923917D8CD7EE"><enum>(C)</enum><text>any other innovative energy technology area identified by the Secretary.</text> </subparagraph></paragraph><paragraph id="H70AEE1FED85D4201BE057DC7DDE551A7"><enum>(2)</enum><header>Hub</header> <subparagraph id="H41B0DB99562C4C5AA06CD18CE8D6CB23"><enum>(A)</enum><header>In general</header><text>The term <term>Hub</term> means an Energy Innovation Hub established under this section.</text>
 </subparagraph><subparagraph id="H357DAD00E6A54699950FD7FB755B5B13"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Hub</term> includes any Energy Innovation Hub in existence on the date of enactment of this Act.</text> </subparagraph></paragraph><paragraph id="H280102AC807948109EA2F54496D96EDE"><enum>(3)</enum><header>Qualifying entity</header><text>The term <term>qualifying entity</term> means—</text>
 <subparagraph id="H12A6DF1522084A6B93E20E94603ED0EF"><enum>(A)</enum><text>an institution of higher education;</text> </subparagraph><subparagraph id="H9416F247E0AF4EAEAF2B6C4932DFFF26"><enum>(B)</enum><text>an appropriate State or Federal entity, including a federally funded research and development center of the Department;</text>
 </subparagraph><subparagraph id="H591EE2A6C48145CCAF468D2C3537290C"><enum>(C)</enum><text>a nongovernmental organization with expertise in advanced energy technology research, development, demonstration, or commercial application; or</text>
 </subparagraph><subparagraph id="H15729640B7A74F4B892E48CB250E2C08"><enum>(D)</enum><text>any other relevant entity the Secretary determines appropriate.</text> </subparagraph></paragraph></subsection><subsection id="H154CCC71EE60402E858F94D1E2F1E3C6"><enum>(b)</enum><header>Authorization of program</header> <paragraph id="H016AF89998A54C3BB8E6A9B711287845"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a program to enhance the economic, environmental, and energy security of the United States by making awards to consortia for establishing and operating hubs, to be known as <quote>Energy Innovation Hubs</quote>, to conduct and support, at, if practicable, one centralized location, multidisciplinary, collaborative research, development, demonstration, and commercial application of advanced energy technologies.</text>
 </paragraph><paragraph id="HB3393AB16274488C85E4DB54E079CE7F"><enum>(2)</enum><header>Technology development focus</header><text>The Secretary shall designate for each Hub a unique advanced energy technology or basic research focus.</text>
 </paragraph><paragraph id="H7D31798D15FD461FB9E86A6756FCC435"><enum>(3)</enum><header>Coordination</header><text>The Secretary shall ensure the coordination of, and avoid unnecessary duplication of, the activities of each Hub with the activities of—</text>
 <subparagraph id="H29F7B63328C9473F8BA1DDF9B9858EB8"><enum>(A)</enum><text>other research entities of the Department, including the National Laboratories, the Advanced Research Projects Agency—Energy, and Energy Frontier Research Centers; and</text>
 </subparagraph><subparagraph id="H06EBCF32300A4AF1B28B96FF42A3F49E"><enum>(B)</enum><text>industry.</text> </subparagraph></paragraph></subsection><subsection id="H7F494472B3CD4942B83A90F280051A85"><enum>(c)</enum><header>Application process</header> <paragraph id="HCD4AFCCE426E4F14AE6582CB0C5A9DFD"><enum>(1)</enum><header>Eligibility</header><text>To be eligible to receive an award for the establishment and operation of a Hub under subsection (b)(1), a consortium shall—</text>
 <subparagraph id="H00038E8F75554F888EA4B77DB4E8C857"><enum>(A)</enum><text>be composed of not fewer than two qualifying entities;</text> </subparagraph><subparagraph id="H3BED2D6F57784D09822066039FA18708"><enum>(B)</enum><text>operate subject to a binding agreement, entered into by each member of the consortium, that documents—</text>
 <clause id="HD3A0A067D3EC4669B85D0E867D996096"><enum>(i)</enum><text>the proposed partnership agreement, including the governance and management structure of the Hub;</text> </clause><clause id="HD3BCD96ACC1C455FAB47CE382B8B8CA3"><enum>(ii)</enum><text>measures the consortium will undertake to enable cost-effective implementation of activities under the program described in subsection (b)(1); and</text>
 </clause><clause id="H77732F03CB0B4CA7B18303395B36AD58"><enum>(iii)</enum><text>a proposed budget, including financial contributions from non-Federal sources; and</text> </clause></subparagraph><subparagraph id="HEF00EA6A5E3E4A0A9FEF3DD66AB52DFE"><enum>(C)</enum><text>operate as a nonprofit organization.</text>
						</subparagraph></paragraph><paragraph id="H6F4DDD8C0D6E4B4DAF6AF80DB50E3BA2"><enum>(2)</enum><header>Application</header>
 <subparagraph id="H9AF2A683268344AEB13DD29366E03E9D"><enum>(A)</enum><header>In general</header><text>A consortium seeking to establish and operate a Hub under subsection (b)(1) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a detailed description of each element of the consortium agreement required under paragraph (1)(B).</text>
 </subparagraph><subparagraph id="HB47C60FAE88741E38C02EBAF121C3BD8"><enum>(B)</enum><header>Requirement</header><text>If the consortium members will not be located at one centralized location, the application under subparagraph (A) shall include a communications plan that ensures close coordination and integration of Hub activities.</text>
						</subparagraph></paragraph><paragraph id="H5DDDF36EC75F48C6AA0D5EE136EC3008"><enum>(3)</enum><header>Selection</header>
 <subparagraph id="H42313F13208A488C8D0658BC256657BF"><enum>(A)</enum><header>In general</header><text>The Secretary shall select consortia for awards for the establishment and operation of Hubs through a competitive selection process.</text>
 </subparagraph><subparagraph id="H3910779C1EC3407CBDDA7F86F3B8D589"><enum>(B)</enum><header>Considerations</header><text>In selecting consortia under subparagraph (A), the Secretary shall consider—</text> <clause id="H37CD4A3DC055493CBB911A1374394D0D"><enum>(i)</enum><text>the information disclosed by the consortium under this subsection; and</text>
 </clause><clause id="H90EF8373EB7946AEB70D088B666AF0C4"><enum>(ii)</enum><text>any existing facilities a consortium will provide for Hub activities.</text> </clause></subparagraph></paragraph></subsection><subsection id="H0BD3489D6BB44AFA8F4339130D2901FC"><enum>(d)</enum><header>Term</header> <paragraph id="H574FE0D8B47C4356B0534485ED791631"><enum>(1)</enum><header>In general</header><text>An award made to a Hub under this section shall be for a period of not more than 5 years, subject to the availability of appropriations, after which the award may be renewed, subject to a rigorous merit review.</text>
 </paragraph><paragraph id="H045092AB4C454B8795B18E47BDA6193D"><enum>(2)</enum><header>Existing Hubs</header><text>A Hub already in existence on, or undergoing a renewal process on, the date of enactment of this Act—</text>
 <subparagraph id="HBE70DE4EA4584DFC8AA208B6656988DC"><enum>(A)</enum><text>may continue to receive support during the 5-year period beginning on the date of establishment of that Hub; and</text>
 </subparagraph><subparagraph id="H0BF53881DEE84DCF87D87CC88164473E"><enum>(B)</enum><text>shall be eligible for renewal of that support at the end of that 5-year period.</text> </subparagraph></paragraph></subsection><subsection id="H0321A5EF9A534C4C9984BF9DCFBB34CA"><enum>(e)</enum><header>Hub Operations</header> <paragraph id="HDD17D4119EC7435080038AB220738DD3"><enum>(1)</enum><header>In general</header><text>Each Hub shall conduct or provide for multidisciplinary, collaborative research, development, demonstration, and commercial application of advanced energy technologies within the technology development focus designated under subsection (b)(2).</text>
 </paragraph><paragraph id="H9811D3AFCE0647CCBE4CB764875B4ABD"><enum>(2)</enum><header>Activities</header><text>Each Hub shall—</text> <subparagraph id="H9539EE0AC05D4361AE03EC211B3B1334"><enum>(A)</enum><text>encourage collaboration and communication among the member qualifying entities of the consortium and awardees;</text>
 </subparagraph><subparagraph id="H55E9F743C1F146DFBFA09CE174EB0ED5"><enum>(B)</enum><text>develop and publish proposed plans and programs on a publicly accessible website;</text> </subparagraph><subparagraph id="HF79EAC4C31894670BE883A26B87A5DBB"><enum>(C)</enum><text>submit an annual report to the Department summarizing the activities of the Hub, including—</text>
 <clause id="HA7940C4EE089417B8B69173108100FBE"><enum>(i)</enum><text>detailing organizational expenditures; and</text> </clause><clause id="H3E4F7BDF90EE428B9133057CB97E94A3"><enum>(ii)</enum><text>describing each project undertaken by the Hub; and</text>
 </clause></subparagraph><subparagraph id="HB654BE2C857A4925B85CB8B333932B32"><enum>(D)</enum><text>monitor project implementation and coordination.</text> </subparagraph></paragraph><paragraph id="HD905A6EC1FEA4CF6B8124675D42B0F8D"><enum>(3)</enum><header>Conflicts of Interest</header><text>Each Hub shall maintain conflict of interest procedures, consistent with the conflict of interest procedures of the Department.</text>
					</paragraph><paragraph id="H02D0FBBDDFFE4000979F8DB3355D0C90"><enum>(4)</enum><header>Prohibition on construction</header>
 <subparagraph id="H12F152620BF94E43BA2A639E6BFAE1A5"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B)—</text> <clause id="H0FEB34FF268A49C28FF99E013E4E27DE"><enum>(i)</enum><text>no funds provided under this section may be used for construction of new buildings or facilities for Hubs; and</text>
 </clause><clause id="H9D96A54CA0E64B26B486F8068133F86F"><enum>(ii)</enum><text>construction of new buildings or facilities shall not be considered as part of the non-Federal share of a Hub cost-sharing agreement.</text>
 </clause></subparagraph><subparagraph id="H65A197C7C26A42FC9782E993F0AF82B6"><enum>(B)</enum><header>Test bed and renovation exception</header><text>Nothing in this paragraph prohibits the use of funds provided under this section or non-Federal cost share funds for the construction of a test bed or renovations to existing buildings or facilities for the purposes of research if the Secretary determines that the test bed or renovations are limited to a scope and scale necessary for the research to be conducted.</text>
						</subparagraph></paragraph></subsection></section></title><title id="H64B59F374B5B4C339F79A5E3AC3A49A2"><enum>III</enum><header>Department of Energy Office of Science Policy</header>
 <section id="HE4CDDBCEDA1F4710BDC915553461B7C5" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Department of Energy Office of Science Policy Act</short-title></quote>.</text> </section><section commented="no" id="H160969DDCF35409CB7810257F6B4ECDE"><enum>302.</enum><header>Mission</header><text display-inline="no-display-inline">Section 209 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7139">42 U.S.C. 7139</external-xref>) is amended by adding at the end the following:</text>

 <subsection id="H0D41D8546BD54A3CA1343F828D53CAE9"><enum>(c)</enum><header>Mission</header><text>The mission of the Office of Science shall be the delivery of scientific discoveries, capabilities, and major scientific tools to transform the understanding of nature and to advance the energy, economic, and national security of the United States.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
			</section><section commented="no" id="H848C08C75C1941DE928BF6BF0C43A208"><enum>303.</enum><header>Basic energy sciences</header>
				<subsection id="H06A65F1856EB49C7AF3929C10668CD77"><enum>(a)</enum><header>Energy Frontier Research Centers</header>
 <paragraph id="H93BF93C369F24462937C22EEB3C39A63"><enum>(1)</enum><header>In general</header><text>The Director shall carry out a program to provide awards, on a competitive, merit-reviewed basis, to multi-institutional collaborations or other appropriate entities to conduct fundamental and use-inspired energy research to accelerate scientific breakthroughs.</text>
 </paragraph><paragraph id="H75A017F6391B4282BF0A116B59C972AB"><enum>(2)</enum><header>Collaborations</header><text>A collaboration receiving an award under this subsection may include multiple types of institutions and private sector entities.</text>
					</paragraph><paragraph id="H0D3E00144686480486F3C290684F6B0A"><enum>(3)</enum><header>Selection and duration</header>
 <subparagraph id="H18D2E5C4226E4D71BC1EC51554F91367"><enum>(A)</enum><header>In general</header><text>A collaboration under this subsection shall be selected for a period of 4 years.</text> </subparagraph><subparagraph id="H4D981D0DC89B4B06BA53A39635CEA525"><enum>(B)</enum><header>Existing centers</header><text>An Energy Frontier Research Center in existence and supported by the Director on the date of enactment of this Act may continue to receive support for a period of 4 years beginning on the date of establishment of that center.</text>
 </subparagraph><subparagraph id="H8D27FE1B3FAC46E3A033ECB21553198F"><enum>(C)</enum><header>Reapplication</header><text>After the end of the period described in subparagraph (A) or (B), as applicable, a recipient of an award may reapply for selection on a competitive, merit-reviewed basis.</text>
 </subparagraph><subparagraph id="HFBB06B8D4D9342729C25D2576897B60A"><enum>(D)</enum><header>Termination</header><text display-inline="yes-display-inline">Consistent with the existing authorities of the Department, the Director may terminate an underperforming center for cause during the performance period.</text>
 </subparagraph></paragraph><paragraph id="HE03FCB0D915E438AAFA195A4348E6CFA"><enum>(4)</enum><header>No funding for construction</header><text>No funding provided pursuant to this subsection may be used for the construction of new buildings or facilities.</text>
					</paragraph></subsection><subsection commented="no" id="HA65C71D0A9104E738850031EF2AEF25B"><enum>(b)</enum><header>Basic energy sciences user facilities</header>
 <paragraph commented="no" id="H27938EE4B13346F2A421763C00D5A16A"><enum>(1)</enum><header>In general</header><text>The Director shall carry out a program for the development, construction, operation, and maintenance of national user facilities.</text>
 </paragraph><paragraph commented="no" id="H37EE30402216427B976408BFBDE4E189"><enum>(2)</enum><header>Requirements</header><text>To the maximum extent practicable, the national user facilities developed, constructed, operated, or maintained under paragraph (1) shall serve the needs of the Department, industry, the academic community, and other relevant entities to create and examine materials and chemical processes for the purpose of improving the competitiveness of the United States.</text>
 </paragraph><paragraph commented="no" id="HAEDEBEFAE18542EA9F8273B2FD87A2C3"><enum>(3)</enum><header>Included facilities</header><text>The national user facilities developed, constructed, operated, or maintained under paragraph (1) shall include—</text>
 <subparagraph id="H1CB074C45CED41E9B6F2EE2ED630AD1E"><enum>(A)</enum><text>x-ray light sources;</text> </subparagraph><subparagraph id="HD99E5D45DF57411CA70D9FF31CFCF37E"><enum>(B)</enum><text>neutron sources;</text>
 </subparagraph><subparagraph id="HE4F179621E2C4D28A5EE56D0DB411105"><enum>(C)</enum><text>nanoscale science research centers; and</text> </subparagraph><subparagraph id="H59C46DF155CB426CB0D7F3C0561033A5"><enum>(D)</enum><text>such other facilities as the Director considers appropriate, consistent with section 209 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7139">42 U.S.C. 7139</external-xref>).</text>
 </subparagraph></paragraph></subsection><subsection id="H6F3CCB71F8144B0A89F6EF97875B5C6E"><enum>(c)</enum><header>Accelerator research and development</header><text>The Director shall carry out research and development on advanced accelerator and storage ring technologies relevant to the development of basic energy sciences user facilities, in consultation with the High Energy Physics and Nuclear Physics programs of the Office of Science.</text>
				</subsection><subsection id="H260DA14370B44A8284C0F950E9CDCAD5"><enum>(d)</enum><header>Solar fuels research initiative</header>

 <subparagraph id="HCE49ABF122A34BDF9A2C0C0EE734081C"><enum>(A)</enum><text>the Basic Energy Sciences Program and the Biological and Environmental Research Program of the Office of Science; and</text>
 </subparagraph><subparagraph id="H2785CDF3E4034FEA88127EC728E4C813"><enum>(B)</enum><text>the Office of Energy Efficiency and Renewable Energy.</text> </subparagraph></paragraph><paragraph id="HC626111077BC42FDA24EB6666D9193A9"><enum>(3)</enum><header>Teams</header> <subparagraph id="H0B824FBCD72D44BDA79063890B9BE204"><enum>(A)</enum><header>In general</header><text>In carrying out the Initiative, the Secretary shall organize activities among multidisciplinary teams to leverage, to the maximum extent practicable, expertise from the National Laboratories, institutions of higher education, and the private sector.</text>
 </subparagraph><subparagraph id="H864AB01B69C2471A98C31DA381858EF1"><enum>(B)</enum><header>Goals</header><text>The multidisciplinary teams described in subparagraph (A) shall pursue aggressive, milestone-driven, basic research goals.</text>
 </subparagraph><subparagraph id="H64A83AB77C6240B39BBFF49F517AE47B"><enum>(C)</enum><header>Resources</header><text>The Secretary shall provide sufficient resources to the multidisciplinary teams described in subparagraph (A) to achieve the goals described in subparagraph (B) over a period of time to be determined by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="H8B0763C50A3E49ADBCC6E65CCB781652"><enum>(4)</enum><header>Additional activities</header><text>The Secretary may organize additional activities under this subsection through Energy Frontier Research Centers, Energy Innovation Hubs, or other organizational structures.</text>
									</paragraph></subsection><subsection id="HA02E042999FE4ECE85D98738C637D4F7"><enum>(b)</enum><header>Artificial photosynthesis</header>
 <paragraph id="H82AD1DD07D5E44FB9D663D96D443A7DE"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out under the Initiative a program to support research needed to bridge scientific barriers to, and discover knowledge relevant to, artificial photosynthetic systems.</text>
 </paragraph><paragraph id="HD5D5D04DC2FE479ABB0E93927D063213"><enum>(2)</enum><header>Activities</header><text>As part of the program described in paragraph (1)—</text> <subparagraph id="H598464AC959F42BAB34E60ACF25E98ED"><enum>(A)</enum><text>the Director of the Office of Basic Energy Sciences shall support basic research to pursue distinct lines of scientific inquiry, including—</text>
 <clause id="HB965D281EB664863B340D4A8ABFFB442"><enum>(i)</enum><text>photoinduced production of hydrogen and oxygen from water; and</text> </clause><clause id="H9560C40D1EAA424BB77F3835C673D516"><enum>(ii)</enum><text>the sustainable photoinduced reduction of carbon dioxide to fuel products including hydrocarbons, alcohols, carbon monoxide, and natural gas; and</text>
 </clause></subparagraph><subparagraph id="H6AF51DE0530D4FF38FA0358A17029543"><enum>(B)</enum><text>the Assistant Secretary for Energy Efficiency and Renewable Energy shall support translational research, development, and validation of physical concepts developed under the program.</text>
 </subparagraph></paragraph><paragraph id="HFD1A7542E0264DF289DDA16AE7F14029"><enum>(3)</enum><header>Standard of review</header><text>The Secretary shall review activities carried out under the program described in paragraph (1) to determine the achievement of technical milestones.</text>
 </paragraph><paragraph id="H181E44A179EF4EDB87956EA01448C2FB"><enum>(4)</enum><header>Prohibition</header><text>No funds allocated to the program described in paragraph (1) may be obligated or expended for commercial application of energy technology.</text>
									</paragraph></subsection><subsection id="H603CEB69E062483D8F77959590CDDAAB"><enum>(c)</enum><header>Biochemistry, replication of natural photosynthesis, and related processes</header>
 <paragraph id="H1CCEADAE51174ECD89AE826BE79930FB"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out under the Initiative a program to support research needed to replicate natural photosynthetic processes by use of artificial photosynthetic components and materials.</text>
 </paragraph><paragraph id="H732104FDF22648CAA99CA893D2B33A2C"><enum>(2)</enum><header>Activities</header><text>As part of the program described in paragraph (1)—</text> <subparagraph id="H273FD63591F642ABA1E368D19FD0B7DD"><enum>(A)</enum><text>the Director of the Office of Basic Energy Sciences shall support basic research to expand fundamental knowledge to replicate natural synthesis processes, including—</text>
 <clause id="HDE43A746DF5F4E2FA5FCB03E999EC88F"><enum>(i)</enum><text>the photoinduced reduction of dinitrogen to ammonia;</text> </clause><clause id="HD23CD71667FC4F889720FCD969AE01B1"><enum>(ii)</enum><text>the absorption of carbon dioxide from ambient air;</text>
 </clause><clause id="H4028D241DEC04801B70525A57E82E338"><enum>(iii)</enum><text>molecular-based charge separation and storage;</text> </clause><clause id="H507E18E9E713485E81A8B65D686A08C6"><enum>(iv)</enum><text>photoinitiated electron transfer; and</text>
 </clause><clause id="H978F615649BB4D77BD9786086EDC5DCA"><enum>(v)</enum><text>catalysis in biological or biomimetic systems;</text> </clause></subparagraph><subparagraph id="H8399852DDF204D969BB2650E2544CD40"><enum>(B)</enum><text>the Associate Director of Biological and Environmental Research shall support systems biology and genomics approaches to understand genetic and physiological pathways connected to photosynthetic mechanisms; and</text>
 </subparagraph><subparagraph id="H83D6D58F2C814B68B4D1C1DA5904FE90"><enum>(C)</enum><text>the Assistant Secretary for Energy Efficiency and Renewable Energy shall support translational research, development, and validation of physical concepts developed under the program.</text>

 </paragraph><paragraph id="HEC57E590482D4D009D5F365562951715"><enum>(2)</enum><header>Activities</header><text>As part of the program described in paragraph (1)—</text> <subparagraph id="HC2CE8BF8321B477C962B2897EB1F37D5"><enum>(A)</enum><text>the Director of the Office of Basic Energy Sciences shall investigate electrochemical properties and the dynamics of materials, including charge transfer phenomena and mass transport in materials; and</text>

 </paragraph><paragraph id="HA72C7A31F8A34A65B7DEAD9645270BEF"><enum>(2)</enum><header>Activities</header><text>As part of the program described in paragraph (1)—</text> <subparagraph id="H2CF45442C88D4F2CB12FA4F2D265356E"><enum>(A)</enum><text>the Director of the Office of Basic Energy Sciences, in coordination with the Associate Director of Advanced Scientific Computing Research, shall support the development of high performance computational tools through a joint development process to maximize the effectiveness of current and projected high performance computing systems; and</text>
 </subparagraph><subparagraph id="H2457944F35D54F82AB5D5B55AA5A866B"><enum>(B)</enum><text>the Assistant Secretary for Energy Efficiency and Renewable Energy shall support translational research, development, and validation of physical concepts developed under the program.</text>

 </subparagraph></paragraph><paragraph id="H867701272CEA4F9EAEB33BA0054ED963"><enum>(2)</enum><header>Activities</header><text>As part of the program described in paragraph (1)—</text> <subparagraph id="H8273EFA1B86741A4B4C2DFC7C7EB083A"><enum>(A)</enum><text>the Director of the Office of Basic Energy Sciences and the Associate Director of Biological and Environmental Research shall investigate phenomena of mesoscale electrochemical confinement for the purpose of replicating and controlling new electrochemical behavior; and</text>

 <subparagraph id="H9665497839894D50B6948658D29268E3"><enum>(A)</enum><header>In general</header><text>In carrying out the Program, the Secretary shall—</text> <clause id="H47231D22B8AA4B0FAD63007BD5991FC3"><enum>(i)</enum><text>establish two or more National Laboratory partnerships with industry partners and institutions of higher education for the research and development of two or more exascale computing architectures across all applicable organizations of the Department;</text>
 </clause><clause id="H943B90CB3E2E449FB54D75C70743482C"><enum>(ii)</enum><text>conduct mission-related codesign activities in developing the exascale computing architectures under clause (i);</text>
 </clause><clause id="HB30CE63554344BB0909FBEA49FACF368"><enum>(iii)</enum><text>develop such advancements in hardware and software technology as are required to fully realize the potential of an exascale production system in addressing Department target applications and solving scientific problems involving predictive modeling and simulation and large scale data analytics and management;</text>
 </clause><clause id="H09A8C9106142481CB59F90F0DBDE46AE"><enum>(iv)</enum><text>explore the use of exascale computing technologies to advance a broad range of science and engineering; and</text>
 </clause><clause id="HAD11919AE5E64F3B89823B2EF4B4747E"><enum>(v)</enum><text>provide, as appropriate, on a competitive, merit-reviewed basis, access for researchers in industries in the United States, institutions of higher education, National Laboratories, and other Federal agencies to the exascale computing systems developed pursuant to clause (i).</text>
 </clause></subparagraph><subparagraph id="H89DE7AF771AD46D4B2F3EE19078C9911"><enum>(B)</enum><header>Selection of partners</header><text>The Secretary shall select the partnerships with the computing facilities of the Department under subparagraph (A) through a competitive, peer-review process.</text>
										</subparagraph></paragraph><paragraph id="H61BE086023C04888B261AF92B5AB5C60"><enum>(3)</enum><header>Codesign and application development</header>
 <subparagraph id="H3FBB7C4ACD1144D9B0F6A0C48316E436"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text> <clause id="HB2B4976DF09C43F58A4684E64623613C"><enum>(i)</enum><text>carry out the Program through an integration of applications, computer science, applied mathematics, and computer hardware architecture using the partnerships established pursuant to paragraph (2) to ensure that, to the maximum extent practicable, two or more exascale computing machine architectures are capable of solving Department target applications and broader scientific problems, including predictive modeling and simulation and large scale data analytics and management; and</text>
 </clause><clause id="HB52516333F6B444D942FC55C9C456915"><enum>(ii)</enum><text>conduct outreach programs to increase the readiness for the use of such platforms by domestic industries, including manufacturers.</text>
 </clause></subparagraph><subparagraph id="HA8EF1BF8AB2543E5BDC5719006C5E652"><enum>(B)</enum><header>Report</header><text>The Secretary shall submit to Congress a report describing—</text> <clause id="H6698BFE1989E4F3A9AED399E9D2A0317"><enum>(i)</enum><text>how the integration under subparagraph (A) is furthering application science data and computational workloads across application interests, including national security, material science, physical science, cybersecurity, biological science, the Materials Genome and BRAIN Initiatives of the President, advanced manufacturing, and the national electric grid; and</text>
 </clause><clause id="HA07035FC01E34CB9A42576FA7937C80A"><enum>(ii)</enum><text>the roles and responsibilities of National Laboratories and industry, including the definition of the roles and responsibilities within the Department to ensure an integrated program across the Department.</text>
											</clause></subparagraph></paragraph><paragraph id="H99297678B38243A28DCA318FDC095072"><enum>(4)</enum><header>Project review</header>
 <subparagraph id="HD2E9ED1C8C244E7EAD4569D904AA544E"><enum>(A)</enum><header>In general</header><text>The exascale architectures developed pursuant to partnerships established pursuant to paragraph (2) shall be reviewed through a project review process.</text>
 </subparagraph><subparagraph id="H395EB27BEC1D4CB88EA2A7FF13690ACB"><enum>(B)</enum><header>Report</header><text>Not later than 90 days after the date of enactment of this subsection, the Secretary shall submit to Congress a report on—</text>
 <clause id="HE8331C2406104684B5B037F47AF1965B"><enum>(i)</enum><text>the results of the review conducted under subparagraph (A); and</text> </clause><clause id="HAF00C54055654741B2F62A31AF0651D3"><enum>(ii)</enum><text>the coordination and management of the Program to ensure an integrated research program across the Department.</text>
 </clause></subparagraph></paragraph><paragraph id="H3F470CF2A0E344BEAC6E1E0AD8C8B63C"><enum>(5)</enum><header>Annual reports</header><text>At the time of the budget submission of the Department for each fiscal year, the Secretary, in consultation with the members of the partnerships established pursuant to paragraph (2), shall submit to Congress a report that describes funding for the Program as a whole by functional element of the Department and critical milestones.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H0A67AB6206E94F6C8A809476F8B75393"><enum>(b)</enum><header>High-Performance computing and networking research</header><text>The Director shall support research in high-performance computing and networking relevant to energy applications, including modeling, simulation, and advanced data analytics for basic and applied energy research programs carried out by the Secretary.</text>
 </subsection><subsection commented="no" id="H0181F49527834AEB9BCCC4BB11C5EC35"><enum>(c)</enum><header>Applied mathematics and software development for high-End computing systems</header><text>The Director shall carry out activities to develop, test, and support—</text> <paragraph commented="no" id="H24832EA2F5844D23B796D886B9C9B52C"><enum>(1)</enum><text>mathematics, models, and algorithms for complex systems and programming environments; and</text>
 </paragraph><paragraph commented="no" id="H25088F4E58FD44D2ABC4243BDC9F6359"><enum>(2)</enum><text>tools, languages, and operating systems for high-end computing systems (as defined in section 2 of the American Super Computing Leadership Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/5541">15 U.S.C. 5541</external-xref>)).</text>
					</paragraph></subsection></section><section id="HB66DCA7804DC4DC68FF5F407DE2DE6F0"><enum>305.</enum><header>High-energy physics</header>
 <subsection id="H583612AC798643ECBF49E0D023142D5F"><enum>(a)</enum><header>Sense of congress</header><text>It is the sense of Congress that—</text> <paragraph id="H6DD9D2397A1143649B3D5CF9F43D3B91"><enum>(1)</enum><text>the Director should incorporate the findings and recommendations of the report of the Particle Physics Project Prioritization Panel entitled <quote>Building for Discovery: Strategic Plan for U.S. Particle Physics in the Global Context</quote> into the planning process of the Department; and</text>
 </paragraph><paragraph id="H2AF8BC283A6D41D688B33A8846BE111E"><enum>(2)</enum><text>the nations that lead in particle physics by hosting international teams dedicated to a common scientific goal attract the world’s best talent and inspire future generations of physicists and technologists.</text>
 </paragraph></subsection><subsection id="H5A45939F8A254A1CA639B3E98CFA3C5C"><enum>(b)</enum><header>International collaboration</header><text>The Director, as practicable and in coordination with other appropriate Federal agencies as necessary, shall ensure the access of United States researchers to the most advanced accelerator facilities and research capabilities in the world, including the Large Hadron Collider.</text>
 </subsection><subsection commented="no" id="H1E1F86DC8133487DB914641B99BB0BEF"><enum>(c)</enum><header>Neutrino research</header><text>The Director shall carry out research activities on rare decay processes and the nature of the neutrino, which may include collaborations with the National Science Foundation or international collaborations.</text>
 </subsection><subsection commented="no" id="HB328CE658C2C4C2AACBFD648CF7E8151"><enum>(d)</enum><header>Dark energy and dark matter research</header><text>The Director shall carry out research activities on the nature of dark energy and dark matter, which may include collaborations with the National Aeronautics and Space Administration or the National Science Foundation; or international collaborations.</text>
				</subsection></section><section id="H0489DDED260148FF94A50E47F7A37AAB"><enum>306.</enum><header>Biological and environmental research</header>
 <subsection id="HC183B8D7D66845288CEF021AB9853575"><enum>(a)</enum><header>Biological systems</header><text display-inline="yes-display-inline">The Director shall carry out research and development activities in fundamental, structural, computational, and systems biology to increase systems-level understanding of the complex biological systems, which may include activities—</text>
 <paragraph id="HD36827C5EECC49BD8FFD076D4EF29C41"><enum>(1)</enum><text>to accelerate breakthroughs and new knowledge that would enable the cost-effective, sustainable production of—</text>
 <subparagraph id="HC612D92FE7E14DC9A1AB279DBD476A19"><enum>(A)</enum><text>biomass-based liquid transportation fuels;</text> </subparagraph><subparagraph id="H385000A6A21243F9875154D662E25194"><enum>(B)</enum><text>bioenergy; and</text>
 </subparagraph><subparagraph id="HCEEA9155A3D4452BAC177311767D1B85"><enum>(C)</enum><text>biobased materials;</text> </subparagraph></paragraph><paragraph id="HD9CC374EA4394BBE8CA80F63284B3D29"><enum>(2)</enum><text>to improve understanding of the global carbon cycle, including processes for removing carbon dioxide from the atmosphere, through photosynthesis and other biological processes, for sequestration and storage; and</text>
 </paragraph><paragraph id="H1A2F781EA4A7489291C7659703C406D3"><enum>(3)</enum><text>to understand the biological mechanisms used to transform, immobilize, or remove contaminants from subsurface environments.</text>
 </paragraph></subsection><subsection id="HAF50BDBA81024ABAB7D24C8AC202515F"><enum>(b)</enum><header>Limitation for research funds</header><text>The Director shall not approve new climate science-related initiatives without making a determination that such work is well-coordinated with any relevant work carried out by other Federal agencies.</text>
				</subsection><subsection id="H6B0FCC56D93A421A9E2D06DFC2863AB9"><enum>(c)</enum><header>Low-Dose radiation research program</header>
 <paragraph id="H8DC3EC0090AB4E47A2F7A971660AD730"><enum>(1)</enum><header>In general</header><text>The Director shall carry out a research program on low-dose radiation.</text> </paragraph><paragraph id="HB63546A8B69E4FBC9BB39B16B1D3655B"><enum>(2)</enum><header>Purpose</header><text>The purpose of the program is to enhance the scientific understanding of, and reduce uncertainties associated with, the effects of exposure to low-dose radiation to inform improved risk-management methods.</text>
					</paragraph></subsection></section><section id="H9CA0175927B94F84A44515DAEA8B15AB"><enum>307.</enum><header>Fusion energy</header>
 <subsection id="H074F335F21CA4FC5BFD1A9A5E66F4868"><enum>(a)</enum><header>Fusion materials research and development</header><text>As part of the activities authorized in section 978 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16318">42 U.S.C. 16318</external-xref>)—</text>
 <paragraph id="H2D90928297A646CEA335717F4FEBE65C"><enum>(1)</enum><text>the Director, in coordination with the Assistant Secretary for Nuclear Energy of the Department, shall carry out research and development activities to identify, characterize, and demonstrate materials that can endure the neutron, plasma, and heat fluxes expected in a fusion power system; and</text>
 </paragraph><paragraph id="HB31A28C54A874687A937CD0C1674574C"><enum>(2)</enum><text>the Director shall provide an assessment of—</text> <subparagraph id="H20E5CABD536E445F802EF7C9FE3F027A"><enum>(A)</enum><text>the need for one or more facilities that can examine and test potential fusion and next generation fission materials and other enabling technologies relevant to the development of fusion power; and</text>
 </subparagraph><subparagraph id="HE119A9FDC3B846908ED30C4CA12F2E2A"><enum>(B)</enum><text>whether a single new facility that substantially addresses magnetic fusion and next generation fission materials research needs is feasible, in conjunction with the expected capabilities of facilities operational as of the date of enactment of this Act.</text>
 </subparagraph></paragraph></subsection><subsection id="H62C78051D20C452AB15FA498C1996800"><enum>(b)</enum><header>Tokamak research and development</header><text>The Director shall support research and development activities and facility operations to optimize the tokamak approach to fusion energy.</text>
 </subsection><subsection id="HECB35216423A4174B7794BE72436A253"><enum>(c)</enum><header>Inertial fusion energy research and development</header><text>The Director shall support research and development activities for inertial fusion for energy applications.</text>
 </subsection><subsection commented="no" id="H89496661648947EF835D44B2095491C4"><enum>(d)</enum><header>Alternative and enabling concepts</header><text>The Director shall support research and development activities and facility operations at institutions of higher education, National Laboratories, and private facilities in the United States for a portfolio of alternative and enabling fusion energy concepts that may provide solutions to significant challenges to the establishment of a commercial magnetic fusion power plant, prioritized based on the ability of the United States to play a leadership role in the international fusion research community.</text>
 </subsection><subsection id="HB5E2CB991A474D4E9E48B097F5E0C51A"><enum>(e)</enum><header>Coordination with ARPA–E</header><text>The Director shall coordinate with the Director of the Advanced Research Projects Agency-Energy (referred to in this subsection as <quote>ARPA–E</quote>) to—</text>
 <paragraph id="HE728BEA3F69D4E54981E84897D62669A"><enum>(1)</enum><text>assess the potential for any fusion energy project supported by ARPA–E to represent a promising approach to a commercially viable fusion power plant;</text>
 </paragraph><paragraph id="H7C87D095C667415DBE116976B12A9217"><enum>(2)</enum><text>determine whether the results of any fusion energy project supported by ARPA–E merit the support of follow-on research activities carried out by the Office of Science; and</text>
 </paragraph><paragraph id="H93B5071DD1734219AC9CC28E10B306F7"><enum>(3)</enum><text>avoid the unintentional duplication of activities.</text> </paragraph></subsection><subsection id="H5FFBFBCB53B54D4892534CEFF01AE01D"><enum>(f)</enum><header>Fairness in competition for solicitations for international project activities</header><text>Section 33 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2053">42 U.S.C. 2053</external-xref>) is amended by inserting before the first sentence the following: <quote>In this section, with respect to international research projects, the term <term>private facilities or laboratories</term> means facilities or laboratories located in the United States.</quote>.</text>
				</subsection><subsection id="H49145C85F5A54E8EB2A4E33478CE298C"><enum>(g)</enum><header>Identification of priorities</header>
					<paragraph id="HC2EA84643B134B5296C7341090E4611B"><enum>(1)</enum><header>Report</header>
 <subparagraph id="H03DA576124E4491CAD17356FADE61974"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to Congress a report on the fusion energy research and development activities that the Department proposes to carry out over the 10-year period following the date of the report under not fewer than 3 realistic budget scenarios, including a scenario based on 3-percent annual growth in the non-ITER portion of the budget for fusion energy research and development activities.</text>
 </subparagraph><subparagraph id="H9D5A6E02AA6349C79D0B0F857EB55F03"><enum>(B)</enum><header>Inclusions</header><text>The report required under subparagraph (A) shall—</text> <clause id="H1933D3D290114AF8B8D75A9779F501CE"><enum>(i)</enum><text>identify specific areas of fusion energy research and enabling technology development in which the United States can and should establish or solidify a lead in the global fusion energy development effort;</text>
 </clause><clause id="H4095EC3BA2904F93A3565D1D87078678"><enum>(ii)</enum><text>identify priorities for initiation of facility construction and facility decommissioning under each of the three budget scenarios described in subparagraph (A); and</text>
 </clause><clause id="HE5033E7987F145989C33513C6F40DBC7"><enum>(iii)</enum><text>assess the ability of the fusion workforce of the United States to carry out the activities identified under clauses (i) and (ii), including the adequacy of programs at institutions of higher education in the United States to train the leaders and workers of the next generation of fusion energy researchers.</text>
 </clause></subparagraph></paragraph><paragraph id="H9D87DB1B48EE4673AF44A62BC7082629"><enum>(2)</enum><header>Process</header><text>In order to develop the report required under paragraph (1)(A), the Secretary shall leverage best practices and lessons learned from the process used to develop the most recent report of the Particle Physics Project Prioritization Panel of the High Energy Physics Advisory Panel.</text>
 </paragraph><paragraph id="HC9A2A1B5E44B4B4B9FC0F37E61B40834"><enum>(3)</enum><header>Requirement</header><text>No member of the Fusion Energy Sciences Advisory Committee shall be excluded from participating in developing or voting on final approval of the report required under paragraph (1)(A).</text>
					</paragraph></subsection></section><section id="H8B453A8DCDDA44D5B0FDE80FA7CA0097"><enum>308.</enum><header>Nuclear physics</header>
 <subsection id="H09046BA0E70449D7AA4CF4CE99BCD115"><enum>(a)</enum><header>Isotope Development and Production for Research Applications</header><text>The Director—</text> <paragraph id="H9F374D5354F443368AEE7B0399185B30"><enum>(1)</enum><text>may carry out a program for the production of isotopes, including the development of techniques to produce isotopes, that the Secretary determines are needed for research, medical, industrial, or related purposes; and</text>
 </paragraph><paragraph id="HC38489CFD0EB4BD09A064014DF2FE7C0"><enum>(2)</enum><text>shall ensure that isotope production activities carried out under the program under this paragraph do not compete with private industry unless the Director determines that critical national interests require the involvement of the Federal Government.</text>
 </paragraph></subsection><subsection id="H1B7703C2701349469FAD3FF2EC2623A9"><enum>(b)</enum><header>Renaming of the Rare Isotope Accelerator</header><text>Section 981 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16321">42 U.S.C. 16321</external-xref>) is amended—</text> <paragraph id="H94C61545C8D446D9A28C07DE30B8A862"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">rare isotope accelerator</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">facility for rare isotope beams</header-in-text></quote>; and</text>
 </paragraph><paragraph id="H9A3FB1175D46481C8BB059EF8D280AC5"><enum>(2)</enum><text>by striking <quote>Rare Isotope Accelerator</quote> each place it appears and inserting <quote>Facility for Rare Isotope Beams</quote>.</text> </paragraph></subsection></section><section id="HE33F0795378645A39A62A25D62B392EB"><enum>309.</enum><header>Science laboratories infrastructure program</header> <subsection id="H3DB47A37D71D403D840FF846C2FDEFFC"><enum>(a)</enum><header>In general</header><text>The Director shall carry out a program to improve the safety, efficiency, and mission readiness of infrastructure at laboratories of the Office of Science.</text>

 </paragraph><paragraph id="HC8A01CC2194F4798B4225F6210D74B95"><enum>(2)</enum><text>to replace facilities that are no longer cost effective to renovate or operate;</text> </paragraph><paragraph id="H69C98AC39A7D432ABC5024024360EA36"><enum>(3)</enum><text>to modernize utility systems to prevent failures and ensure efficiency;</text>
 </paragraph><paragraph id="H33C785A7BB3345EC9B1ACDB1ADB27AD1"><enum>(4)</enum><text>to remove excess facilities to allow safe and efficient operations; and</text> </paragraph><paragraph id="H0B69BE8D8A3342ACB818F618BE9CCA06"><enum>(5)</enum><text>to construct modern facilities to conduct advanced research in controlled environmental conditions.</text>
					</paragraph></subsection></section></title><title id="H211AC568C211447099BC6E15885221AC"><enum>IV</enum><header>Nuclear Energy Innovation Capabilities</header>
 <section id="H195EEC303E7C4FB3B5409082B0548F96" section-type="subsequent-section"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Nuclear Energy Innovation Capabilities Act</short-title></quote>.</text> </section><section id="H97A7918CEA6B44859ECD6B7C5D2F364A"><enum>402.</enum><header>Nuclear energy innovation capabilities</header> <subsection id="HB1E63F84C20E43A1B2E72BE4D5841BD9"><enum>(a)</enum><header>Nuclear energy</header><text>Section 951 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271</external-xref>) is amended to read as follows:</text>

 <paragraph id="H98FEB97E51E94CC6B8D110158043E629"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out programs of civilian nuclear research, development, demonstration, and commercial application, including activities under this subtitle.</text>
 </paragraph><paragraph id="H744787304EB24D8A831C103EDAE06909"><enum>(2)</enum><header>Considerations</header><text>The programs carried out under paragraph (1) shall take into consideration the following objectives:</text>
 <subparagraph id="H1C98DB49FB2E4F35A6B96237A18A5CEA"><enum>(A)</enum><text>Providing research infrastructure to promote scientific progress and enable users from academia, the National Laboratories, and the private sector to make scientific discoveries relevant for nuclear, chemical, and materials science engineering.</text>
 </subparagraph><subparagraph id="H14E6C6FDAA744F5A8A3B804C0EAE16A0"><enum>(B)</enum><text>Maintaining nuclear energy research and development programs at the National Laboratories and institutions of higher education, including infrastructure at the National Laboratories and institutions of higher education.</text>
 </subparagraph><subparagraph id="H0FAA8C41A8E54D2EB5423F617B17369F"><enum>(C)</enum><text>Providing the technical means to reduce the likelihood of nuclear proliferation.</text> </subparagraph><subparagraph id="HFBB951FC772E473C9FC71B215BD155FE"><enum>(D)</enum><text>Increasing confidence margins for public safety of nuclear energy systems.</text>
 </subparagraph><subparagraph id="HAADB75A3B90049B2B4B3E522ACC95511"><enum>(E)</enum><text>Reducing the environmental impact of activities relating to nuclear energy.</text> </subparagraph><subparagraph id="HE2FC54B64CE34D06B75C2B5E45967C5C"><enum>(F)</enum><text>Supporting technology transfer from the National Laboratories to the private sector.</text>
 </subparagraph><subparagraph id="HDB2BD9C082444B65A2D04481CD2190CB"><enum>(G)</enum><text>Enabling the private sector to partner with the National Laboratories to demonstrate novel reactor concepts for the purpose of resolving technical uncertainty associated with the objectives described in subparagraphs (A) through (F).</text>
 </subparagraph></paragraph></subsection><subsection id="H3D9EF20ADA7544BF9EFC3C0F082587BB"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subtitle:</text> <paragraph commented="no" id="H26D3F735E76B4905ABFB7D903DC30C47"><enum>(1)</enum><header>Advanced nuclear reactor</header><text display-inline="yes-display-inline">The term <term>advanced nuclear reactor</term> means—</text>
 <subparagraph commented="no" id="H8C41254C8C294396AF17812679E11BE7"><enum>(A)</enum><text display-inline="yes-display-inline">a nuclear fission reactor with significant improvements over the most recent generation of nuclear fission reactors, which may include—</text>
 <clause commented="no" id="H6F2D44719FF94D46ABFABAED036D7690"><enum>(i)</enum><text display-inline="yes-display-inline">inherent safety features;</text> </clause><clause commented="no" id="H24BEF3FBBE5245D8A875E0500EAEFEB2"><enum>(ii)</enum><text display-inline="yes-display-inline">lower waste yields;</text>
 </clause><clause commented="no" id="H16638C88E10746C98BA1655E0F56377E"><enum>(iii)</enum><text display-inline="yes-display-inline">greater fuel utilization;</text> </clause><clause commented="no" id="HA376A909E9294D2FB9664B9ADE4D5534"><enum>(iv)</enum><text display-inline="yes-display-inline">superior reliability;</text>
 </clause><clause commented="no" id="HB8C211DA38DC478F891D0553AD822B1C"><enum>(v)</enum><text display-inline="yes-display-inline">resistance to proliferation;</text> </clause><clause commented="no" id="H2BB39A681FD54530B334C14958B2854F"><enum>(vi)</enum><text display-inline="yes-display-inline">increased thermal efficiency; and</text>
 </clause><clause commented="no" id="H608704A223B84270B2ECA841F4D3563F"><enum>(vii)</enum><text display-inline="yes-display-inline">the ability to integrate into electric and nonelectric applications; or</text> </clause></subparagraph><subparagraph commented="no" id="H23EAACE05B8F4A21B082BC5913B2F0B9"><enum>(B)</enum><text>a nuclear fusion reactor.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H8AE0CF6FCA9345C2B634A884B9E54F65"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text> </paragraph><paragraph id="HAB129EDA6EBD484881A78056F5B19517"><enum>(3)</enum><header>Fast neutron</header><text>The term <term>fast neutron</term> means a neutron with kinetic energy above 100 kiloelectron volts.</text>
								</paragraph><paragraph id="H4117D431D9D840EA97F46260959156D4"><enum>(4)</enum><header>National Laboratory</header>
 <subparagraph id="H3F3BEC9C535C46DA90C41D85D0472451"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>National Laboratory</term> has the meaning given the term in section 2.</text> </subparagraph><subparagraph id="HA79D571A5A774157A2B0E61C3D4DEBAF"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">With respect to the Lawrence Livermore National Laboratory, the Los Alamos National Laboratory, and the Sandia National Laboratories, the term <term>National Laboratory</term> means only the civilian activities of the laboratory.</text>
 </subparagraph></paragraph><paragraph id="H9E5F9D20C9AD46ADACC1539E0FA3DB9C"><enum>(5)</enum><header>Neutron flux</header><text>The term <term>neutron flux</term> means the intensity of neutron radiation measured as a rate of flow of neutrons applied over an area.</text>
 </paragraph><paragraph id="H9EDD10951A0545BB8F74A9810182B9A2"><enum>(6)</enum><header>Neutron source</header><text>The term <term>neutron source</term> means a research machine that provides neutron irradiation services for—</text> <subparagraph id="HA2D5C13B3D13412FA106E3F2C82DDF25"><enum>(A)</enum><text>research on materials sciences and nuclear physics; and</text>
 </subparagraph><subparagraph id="HF6900721270743008BE1976D75ADD18D"><enum>(B)</enum><text>testing of advanced materials, nuclear fuels, and other related components for reactor systems.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H9A76516CA2254AFE9AEED71756EDA2F2"><enum>(b)</enum><header>Nuclear energy research programs</header> <paragraph id="H35AB94B1DBE544ADB622872251C8E28E"><enum>(1)</enum><header>In general</header><text>Section 952 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16272">42 U.S.C. 16272</external-xref>) is amended—</text>
 <subparagraph id="HBDA39DD22EB646D59167326A728C0571"><enum>(A)</enum><text>by striking subsection (c); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E75BA084E5E479292369ADAF8FFF3CC"><enum>(B)</enum><text>by redesignating subsections (d) and (e) as subsections (c) and (d), respectively.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H15E752825D5A4C32A3CB869BE3D63BFA"><enum>(2)</enum><header>Conforming amendment</header><text>Section 641(b)(1) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16021">42 U.S.C. 16021(b)(1)</external-xref>) is amended by striking <quote>section 942(d)</quote> and inserting <quote>section 952(c)</quote>.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6ADAEB142EFE4CAC81EB41C32A346DF2"><enum>(c)</enum><header>Advanced fuel cycle initiative</header><text>Section 953(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16273">42 U.S.C. 16273(a)</external-xref>) is amended by striking <quote>, acting through the Director of the Office of Nuclear Energy, Science and Technology,</quote>.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H2F08186F77D145D790A6B82FCB4BD92E"><enum>(d)</enum><header>University nuclear science and engineering support</header><text>Section 954(d)(4) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16274">42 U.S.C. 16274(d)(4)</external-xref>) is amended by striking <quote>as part of a taking into consideration effort that emphasizes</quote> and inserting <quote>that emphasize</quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H11056C2F12AB4098AB92C2872A127576"><enum>(e)</enum><header>Department of Energy civilian nuclear infrastructure and facilities</header><text>Section 955 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16275">42 U.S.C. 16275</external-xref>) is amended—</text>
 <paragraph id="H8DEE229920F147F48EFE13661F510B6F"><enum>(1)</enum><text>by striking subsections (c) and (d); and</text> </paragraph><paragraph id="H351D5CFC415F4F4794359416903C4F34"><enum>(2)</enum><text>by adding at the end the following:</text>

							<subsection id="H029341616FA64267B00906EA40F73B9A"><enum>(c)</enum><header>Versatile neutron source</header>
								<paragraph id="H035A5297614949F39C977C2FBD9ABF7F"><enum>(1)</enum><header>Mission need</header>
 <subparagraph id="H579725F0532C4A47B0542E88C7C73ABA"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 31, 2017, the Secretary shall determine the mission need for a versatile reactor-based fast neutron source, which shall operate as a national user facility.</text>
 </subparagraph><subparagraph id="H870FA7CD81FA419996592D682D055F1C"><enum>(B)</enum><header>Consultations required</header><text display-inline="yes-display-inline">In carrying out subparagraph (A), the Secretary shall consult with the private sector, institutions of higher education, the National Laboratories, and relevant Federal agencies to ensure that the user facility described in subparagraph (A) will meet the research needs of the largest practicable majority of prospective users.</text>
 </subparagraph></paragraph><paragraph id="HAC0617C614AA41FE88D62A239CA9B727"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">As soon as practicable after determining the mission need under paragraph (1)(A), the Secretary shall submit to the appropriate committees of Congress a detailed plan for the establishment of the user facility.</text>
								</paragraph><paragraph id="H12F5A3DE8D0E4FABBCF5EFD266DFB3C3"><enum>(3)</enum><header>Facility requirements</header>
 <subparagraph id="HD0646950562147BB8D06654C22B19F96"><enum>(A)</enum><header>Capabilities</header><text display-inline="yes-display-inline">The Secretary shall ensure that the user facility will provide, at a minimum, the following capabilities:</text>
 <clause id="HAA601541C76A42E3B5AE9550AAA68F81"><enum>(i)</enum><text>Fast neutron spectrum irradiation capability.</text> </clause><clause id="HDFF96755C73A4FEFB0A6256267CF1272"><enum>(ii)</enum><text display-inline="yes-display-inline">Capacity for upgrades to accommodate new or expanded research needs.</text>
 </clause></subparagraph><subparagraph id="HE2F1AABC84CD4D20BE0AAD652489184A"><enum>(B)</enum><header>Considerations</header><text display-inline="yes-display-inline">In carrying out the plan submitted under paragraph (2), the Secretary shall consider the following:</text> <clause id="HE102172FB2C24507990F82CDBF1CEEF7"><enum>(i)</enum><text>Capabilities that support experimental high-temperature testing.</text>
 </clause><clause id="H40F4093B3C9342118674DA34356D5120"><enum>(ii)</enum><text display-inline="yes-display-inline">Providing a source of fast neutrons at a neutron flux, higher than that at which current research facilities operate, sufficient to enable research for an optimal base of prospective users.</text>
 </clause><clause id="H7C0A14F32379428F844462D28CA2591B"><enum>(iii)</enum><text display-inline="yes-display-inline">Maximizing irradiation flexibility and irradiation volume to accommodate as many concurrent users as possible.</text>
 </clause><clause id="H7C4C0CC2078349A1AAA3E6486FDDBA22"><enum>(iv)</enum><text>Capabilities for irradiation with neutrons of a lower energy spectrum.</text> </clause><clause id="H1DC6A63058FF476589940CD701F795F7"><enum>(v)</enum><text>Multiple loops for fuels and materials testing in different coolants.</text>
 </clause><clause id="HF36A8F9D653E400ABE7BC29420801EA9"><enum>(vi)</enum><text>Additional pre-irradiation and post-irradiation examination capabilities.</text> </clause><clause id="H3BB92AB5C80C4A5F908F285B9BB4EE67"><enum>(vii)</enum><text display-inline="yes-display-inline">Lifetime operating costs and lifecycle costs.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="HE3F08CB3494547E28F1F2D0D8A535E91"><enum>(4)</enum><header>Deadline for establishment</header><text display-inline="yes-display-inline">The Secretary shall, to the maximum extent practicable, complete construction of, and approve the start of operations for, the user facility by not later than December 31, 2025.</text>
 </paragraph><paragraph commented="no" id="H58CE8C56B9C542548765FFD9E5353816"><enum>(5)</enum><header>Reporting</header><text display-inline="yes-display-inline">The Secretary shall include in the annual budget request of the Department an explanation for any delay in the progress of the Department in completing the user facility by the deadline described in paragraph (4).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H90D9DB0FEAEC4B3FB9807AC5D15C2B3C"><enum>(6)</enum><header>Coordination</header><text>The Secretary shall leverage the best practices for management, construction, and operation of national user facilities from the Office of Science.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HC78506BE1E314EADB5BB55C9C8C24138"><enum>(f)</enum><header>Security of nuclear facilities</header><text>Section 956 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16276">42 U.S.C. 16276</external-xref>) is amended by striking <quote>, acting through the Director of the Office of Nuclear Energy, Science and Technology,</quote>.</text> </subsection><subsection id="H76185D3A49CC4FAFAD6E08CBF333C62E"><enum>(g)</enum><header>High-Performance computation and supportive research</header><text>Section 957 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16277">42 U.S.C. 16277</external-xref>) is amended to read as follows:</text>

						<section id="H09123C482D184AAF9C6F5D762FE6C369"><enum>957.</enum><header>High-performance computation and supportive research</header>
 <subsection id="HA4F3FAC5989645A8AC5724337A18847F"><enum>(a)</enum><header>Modeling and simulation</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to enhance the capabilities of the United States to develop new reactor technologies through high-performance computation modeling and simulation techniques.</text>
 </subsection><subsection id="H6A2F91ED79094193A3DE9C19BEE24F62"><enum>(b)</enum><header>Coordination</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Secretary shall coordinate with relevant Federal agencies as described by the National Strategic Computing Initiative established by Executive Order No. 13702 (80 Fed. Reg. 46177 (July 29, 2015)), while taking into account the following objectives:</text>
 <paragraph id="H803BDB0A7BE5452FB17BEE6F47B75273"><enum>(1)</enum><text display-inline="yes-display-inline">Using expertise from the private sector, institutions of higher education, and the National Laboratories to develop computational software and capabilities that prospective users may access to accelerate research and development of advanced nuclear reactor systems and reactor systems for space exploration.</text>
 </paragraph><paragraph id="H44A22464276B46AEBC23F864B0569DE7"><enum>(2)</enum><text>Developing computational tools to simulate and predict nuclear phenomena that may be validated through physical experimentation.</text>
 </paragraph><paragraph id="HA49517BDF8094AA594842324C4A0D0CE"><enum>(3)</enum><text>Increasing the utility of the research infrastructure of the Department by coordinating with the Advanced Scientific Computing Research program within the Office of Science.</text>
 </paragraph><paragraph id="H89F671734FE046F7B148538CA9E7E5F3"><enum>(4)</enum><text display-inline="yes-display-inline">Leveraging experience from the Energy Innovation Hub for Modeling and Simulation.</text> </paragraph><paragraph commented="no" id="HE9958D1E20EF4D0C8ED16FDC2FE69E8C"><enum>(5)</enum><text display-inline="yes-display-inline">Ensuring that new experimental and computational tools are accessible to relevant research communities, including private sector entities engaged in nuclear energy technology development.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA9578DFE2DA44809BE0F3B5583BE8BB6"><enum>(c)</enum><header>Supportive research activities</header><text>The Secretary shall consider support for additional research activities to maximize the utility of the research facilities of the Department, including physical processes—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H6D53510B27F94FDDA25548CFD34E22AA"><enum>(1)</enum><text>to simulate degradation of materials and behavior of fuel forms; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC34F4EF1DE2449B9AB1C5A70ED26FF0"><enum>(2)</enum><text>for validation of computational tools.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="HC6B5AE26AC0045F287C54E6726F00B95"><enum>(h)</enum><header>Enabling nuclear energy innovation</header><text>Subtitle E of title IX of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271</external-xref> et seq.) is amended by adding at the end the following:</text>

							<subsection commented="no" id="H656DF721D2FE42CE8CA52E671AC36320"><enum>(a)</enum><header>National reactor innovation center</header>
 <paragraph id="H30FDC1BC4BFA4185908848C0CFE528A9"><enum>(1)</enum><header>In general</header><text>There is authorized a program to enable the testing and demonstration of reactor concepts to be proposed and funded by the private sector.</text>
 </paragraph><paragraph id="HAABE94191EAC40F4A9F912EE77451B4D"><enum>(2)</enum><header>Participation</header><text>Nothing in this section shall prevent a private sector entity that has received Federal grants from participating in this program.</text>
 </paragraph></subsection><subsection commented="no" id="H51FCADEAF40343859E12C5419C3B22D6"><enum>(b)</enum><header>Technical expertise</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Secretary shall leverage the technical expertise of relevant Federal agencies and the National Laboratories in order to minimize the time required to enable construction and operation of privately funded experimental reactors at National Laboratories or other Department-owned sites.</text>
 </subsection><subsection commented="no" id="H69D274A6D67045369EFE80AFB26F6F8C"><enum>(c)</enum><header>Objectives</header><text display-inline="yes-display-inline">The reactors described in subsection (b) shall operate to meet the following objectives:</text> <paragraph commented="no" id="H6E17D9AB99A04BC6B4280ECD8EEF5B58"><enum>(1)</enum><text display-inline="yes-display-inline">Enabling physical validation of advanced nuclear reactor concepts.</text>
 </paragraph><paragraph commented="no" id="HCF0DFB7D37AF476FB088E9E83E9E063D"><enum>(2)</enum><text display-inline="yes-display-inline">Resolving technical uncertainty and increasing practical knowledge relevant to safety, resilience, security, and functionality of advanced nuclear reactor concepts.</text>
 </paragraph><paragraph commented="no" id="HF7636F6085994C2989E3141B1D77CBFE"><enum>(3)</enum><text>General research and development to improve nascent technologies.</text> </paragraph></subsection><subsection commented="no" id="H783CAAD8EA87497AA1002018E4B26EEB"><enum>(d)</enum><header>Sharing technical expertise</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Secretary may enter into a memorandum of understanding with the Chairman of the Commission in order to share technical expertise and knowledge through—</text>
 <paragraph commented="no" id="HBD01764D3BA64CB69FE6F24C3D0EB407"><enum>(1)</enum><text display-inline="yes-display-inline">enabling the testing and demonstration of advanced nuclear reactor concepts to be proposed and funded by the private sector;</text>
 </paragraph><paragraph commented="no" id="HF5ACB953BA944779B33A047EE3CF795A"><enum>(2)</enum><text>operating a database to store and share data and knowledge relevant to nuclear science and engineering between Federal agencies and the private sector;</text>
 </paragraph><paragraph commented="no" id="HE4B1194818F946ACAB1477D0BCEA2383"><enum>(3)</enum><text>developing and testing electric and nonelectric integration and energy conversion systems relevant to advanced nuclear reactors;</text>
 </paragraph><paragraph commented="no" id="H688E03D21D8A43D08C40E68B95BC7D85"><enum>(4)</enum><text>leveraging expertise from the Commission with respect to safety analysis; and</text> </paragraph><paragraph commented="no" id="HF871AAFCB2E34B619926D2CE742EA0E2"><enum>(5)</enum><text display-inline="yes-display-inline">enabling technical staff of the Commission to actively observe and learn about technologies developed under the program.</text>
 </paragraph></subsection><subsection commented="no" id="HFBCBBCB7FE414F17A6F314A443E3FA67"><enum>(e)</enum><header>Agency coordination</header><text>The Chairman of the Commission and the Secretary shall enter into a memorandum of understanding regarding the following:</text>
 <paragraph commented="no" id="H61E755BD0F6448089748F0551FFA8907"><enum>(1)</enum><text>Ensuring that—</text> <subparagraph commented="no" id="HB1FB30FA1CE545F0B16EE13B60C96540"><enum>(A)</enum><text>the Department has sufficient technical expertise to support the timely research, development, demonstration, and commercial application by the civilian nuclear industry of safe and innovative advanced nuclear reactor technology; and</text>
 </subparagraph><subparagraph commented="no" id="HAC4E4C21AECD4B13A6324A69B49DD721"><enum>(B)</enum><text>the Commission has sufficient technical expertise to support the evaluation of applications for licenses, permits, and design certifications and other requests for regulatory approval for advanced nuclear reactors.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H9EF520231C77484DBE74D48F85DC0CF1"><enum>(2)</enum><text>The use of computers and software codes to calculate the behavior and performance of advanced nuclear reactors based on mathematical models of the physical behavior of advanced nuclear reactors.</text>
 </paragraph><paragraph commented="no" id="HE60E608E0D2E43328AE427C6EB231A84"><enum>(3)</enum><text>Ensuring that—</text> <subparagraph commented="no" id="H63FA86C88BE34D4E81F5077D491A57AA"><enum>(A)</enum><text>the Department maintains and develops the facilities necessary to enable the timely research, development, demonstration, and commercial application by the civilian nuclear industry of safe and innovative reactor technology; and</text>
 </subparagraph><subparagraph commented="no" id="HDCE30A5D179346C8B4400E2294609E20"><enum>(B)</enum><text>the Commission has access to the facilities described in subparagraph (A), as needed.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="H817219C5733B460FAE883C3EE2D160CE"><enum>(f)</enum><header>Reporting requirements</header> <paragraph commented="no" id="H8C2E21EBFA6840B8B9F207E0704CA86D"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Nuclear Energy Innovation Capabilities Act of 2017</short-title>, the Secretary, in consultation with the National Laboratories, relevant Federal agencies, and other stakeholders, shall submit to the appropriate committees of Congress a report assessing the capabilities of the Department to authorize, host, and oversee privately funded experimental advanced nuclear reactors as described in subsection (b).</text>
 </paragraph><paragraph commented="no" id="HD3ACC5D074144B1EBE5F1937514BB634"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall address—</text> <subparagraph commented="no" id="H8015CCDBFE6740F9AB7AD314F739A5EE"><enum>(A)</enum><text>the safety review and oversight capabilities of the Department, including options to leverage expertise from the Commission and the National Laboratories;</text>
 </subparagraph><subparagraph commented="no" id="H0679D4C9B5F944B5BAB4A31138E1A4CB"><enum>(B)</enum><text>options to regulate privately proposed and funded experimental reactors hosted by the Department;</text> </subparagraph><subparagraph commented="no" id="H2A8478BA25DA442B98193FC905966F30"><enum>(C)</enum><text>potential sites capable of hosting privately funded experimental advanced nuclear reactors;</text>
 </subparagraph><subparagraph commented="no" id="H31860E4A00634F60A6FAB4FBC62DBA60"><enum>(D)</enum><text>the efficacy of the available contractual mechanisms of the Department to partner with the private sector and Federal agencies, including cooperative research and development agreements, strategic partnership projects, and agreements for commercializing technology;</text>
 </subparagraph><subparagraph commented="no" id="H3AC4C9C35D2B46B09040CE325A9F4DAD"><enum>(E)</enum><text>the liability of the Federal Government with respect to the disposal of low-level radioactive waste, spent nuclear fuel, or high-level radioactive waste (as those terms are defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>));</text>
 </subparagraph><subparagraph commented="no" id="H7E7BD6D2309C4478B0EF3BF73F12E12E"><enum>(F)</enum><text>the impact on the aggregate inventory in the United States of low-level radioactive waste, spent nuclear fuel, or high-level radioactive waste (as those terms are defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>));</text>
 </subparagraph><subparagraph commented="no" id="H80566A66C250495698EF14C7DEB748E4"><enum>(G)</enum><text>potential cost structures relating to physical security, decommissioning, liability, and other long-term project costs; and</text>
 </subparagraph><subparagraph commented="no" id="HDD7898B1E9BD49539B03B46507729FA8"><enum>(H)</enum><text>other challenges or considerations identified by the Secretary.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC3EB02F4964D465D8967AB3EBAA8E803"><enum>(3)</enum><header display-inline="yes-display-inline">Updates</header><text display-inline="yes-display-inline">Once every 2 years, the Secretary shall update relevant provisions of the report submitted under paragraph (1) and submit to the appropriate committees of Congress the update.</text>
								</paragraph></subsection><subsection id="HEDAF462DD9894E3CB8B86F73A71B30A5"><enum>(g)</enum><header>Savings clauses</header>
 <paragraph id="HD9041CEC078C4C9791A144CEF90B1901"><enum>(1)</enum><header>Licensing requirement</header><text>Nothing in this section authorizes the Secretary or any person to construct or operate a nuclear reactor for the purpose of demonstrating the suitability for commercial application of the nuclear reactor unless licensed by the Commission in accordance with section 202 of the Energy Reorganization Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5842">42 U.S.C. 5842</external-xref>).</text>
 </paragraph><paragraph id="HEA72C4FEA1F543C3A8EE7FD65AA9EC69"><enum>(2)</enum><header>Financial protection</header><text>Any activity carried out under this section that involves the risk of public liability shall be subject to the financial protection or indemnification requirements of section 170 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref>) (commonly known as the <quote>Price-Anderson Act</quote>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA4461358A8204243831998CDEE946E36"><enum>(i)</enum><header>Budget plan</header><text display-inline="yes-display-inline">Subtitle E of title IX of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271</external-xref> et seq.) (as amended by subsection (h)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H18EF97D400B548EDBE33982002161251" style="OLC">
						<section id="H476ECB05F25345A388BB3E5C44C08EB8"><enum>959.</enum><header>Budget plan</header>
 <subsection id="H330DC492E716447FBB61191AC039F63C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Nuclear Energy Innovation Capabilities Act of 2017</short-title>, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Science, Space, and Technology of the House of Representatives 2 alternative 10-year budget plans for civilian nuclear energy research and development by the Secretary, as described in subsections (b) through (d).</text>
 </subsection><subsection id="HB46FBD70B16E48A6AF07671DF99B6FE8"><enum>(b)</enum><header>Budget plan alternative 1</header><text display-inline="yes-display-inline">One of the budget plans submitted under subsection (a) shall assume constant annual funding for 10 years at the appropriated level for the civilian nuclear energy research and development of the Department for fiscal year 2016.</text>
 </subsection><subsection id="H1CB200C588984D718D91368A343DF47F"><enum>(c)</enum><header>Budget plan alternative 2</header><text display-inline="yes-display-inline">One of the budget plans submitted under subsection (a) shall be an unconstrained budget.</text> </subsection><subsection id="HA2CFFCCF730E4C5D96568A6A5007C234"><enum>(d)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Each alternative budget plan submitted under subsection (a) shall include—</text>
 <paragraph id="H411C8C550F484ABFA693B64132127129"><enum>(1)</enum><text display-inline="yes-display-inline">a prioritized list of the programs, projects, and activities of the Department to best support the development of advanced nuclear reactor technologies;</text>
 </paragraph><paragraph id="H9448C80F7C3B4A98B26C3E66746BECA5"><enum>(2)</enum><text>realistic budget requirements for the Department to implement sections 955(c), 957, and 958; and</text> </paragraph><paragraph id="HA6848B14BDE648F68A9DDD3160CD7020"><enum>(3)</enum><text>the justification of the Department for continuing or terminating existing civilian nuclear energy research and development programs.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H3EF0D571AEBA4160B06D4D431B744EE2"><enum>(j)</enum><header>Conforming amendments</header><text>The table of contents for the Energy Policy Act of 2005 is amended by striking the item relating to section 957 and inserting the following:</text>
