 <section id="H77CE8E34C0624509974352AB8ACF2D0F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maritime Border Security Review Act</short-title></quote>.</text> </section><section id="H4BB232AA082A480E9672934B63527876"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H460FCAD665B249DF9C28A01F20386965"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text> <subparagraph id="HB145751EBA1F4CA9ABF335A994D50549"><enum>(A)</enum><text>the Committee on Homeland Security of the House of Representatives;</text>
 </subparagraph><subparagraph id="H37D0AC60BB5B4EDC9D39E2464340B369"><enum>(B)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives;</text> </subparagraph><subparagraph id="H9C045A6172094928A41F9A5B7812E2D0"><enum>(C)</enum><text>the Committee on Homeland Security and Government Affairs of the Senate; and</text>
 </subparagraph><subparagraph id="HDA6B6BB489CE45E297785C4733A70B35"><enum>(D)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate.</text> </subparagraph></paragraph><paragraph id="H6DDB4CFC233B4086BA08DED4F5B952F8"><enum>(2)</enum><header>Maritime border</header><text>The term <quote>maritime border</quote> means—</text>
 <subparagraph id="H59F09B8AB45B48DE95163111B39688C5"><enum>(A)</enum><text>the transit zone; and</text> </subparagraph><subparagraph id="HF7AE5D146E3C43D1938DF68F6081D1A3"><enum>(B)</enum><text>the borders and territorial waters of Puerto Rico and the United States Virgin Islands.</text>
 </subparagraph></paragraph><paragraph id="H9AFFEFFFEF1544E69ACFF8EC3999C869"><enum>(3)</enum><header>Transit zone</header><text display-inline="yes-display-inline">The term <quote>transit zone</quote> has the meaning given such term in section 1092(a)(8) of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="usc" parsable-cite="usc/6/223">6 U.S.C. 223(a)(8)</external-xref>).</text>
			</paragraph></section><section id="H8BF5B4D9F68A4D9FACE5680DACE7C5E4"><enum>3.</enum><header>Maritime border threat analysis</header>
 <subsection id="H733D83F44764464FBFF011955A08E35B"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall submit to the appropriate congressional committees a maritime border threat analysis that includes an identification and description of the following:</text>
 <paragraph id="H219A77D299BC40CF92F9B5E270D9CE0D"><enum>(1)</enum><text>Current and potential terrorism and criminal threats posed by individuals and groups seeking to—</text> <subparagraph id="H21483DA3F3224AD9A7EA61538D3B8A44"><enum>(A)</enum><text>enter the United States through the maritime border; or</text>
 </subparagraph><subparagraph id="H3A496B5D52CA43F8955A122CE2EAF189"><enum>(B)</enum><text>exploit border vulnerabilities on the maritime border.</text> </subparagraph></paragraph><paragraph id="HA1C562D5B602400C978A1A0AF58806EC"><enum>(2)</enum><text>Improvements needed at United States sea ports to—</text>
 <subparagraph id="HFE6A1D3CB12C4720B9932EDFE97CA8BE"><enum>(A)</enum><text>prevent terrorists and instruments of terror from entering the United States; and</text> </subparagraph><subparagraph id="HF0C4F82E5EFE47398AA45AFD19AE0989"><enum>(B)</enum><text>reduce criminal activity, as measured by the total flow of illegal goods and illicit drugs, related to the maritime border.</text>
 </subparagraph></paragraph><paragraph id="HD075DA9B99B445E18D74AAC10C6931E9"><enum>(3)</enum><text>Improvements needed with respect to the maritime border to—</text> <subparagraph id="H6CA61C169E1E4063BF3FBE8E537E18B7"><enum>(A)</enum><text>prevent terrorists and instruments of terror from entering the United States; and</text>
 </subparagraph><subparagraph id="HC6FADE18737642C3B1B971F00C62C244"><enum>(B)</enum><text>reduce criminal activity related to the maritime border.</text> </subparagraph></paragraph><paragraph id="H055E5B3E07DA4BDD965B03092552A2A5"><enum>(4)</enum><text>Vulnerabilities in law, policy, cooperation between State, territorial, and local law enforcement, or international agreements that hinder effective and efficient border security, counterterrorism, anti-human trafficking efforts, and the flow of legitimate trade with respect to the maritime border.</text>
 </paragraph><paragraph id="HBA614F7C917E40A5942B19EFD6754F29"><enum>(5)</enum><text>Metrics and performance parameters used by the Department of Homeland Security to evaluate maritime security effectiveness, as appropriate.</text>
 </paragraph></subsection><subsection id="H29F2EBB35E8A4F1BA3EA23A9FA3DB05F"><enum>(b)</enum><header>Analysis requirements</header><text>In preparing the threat analysis required under subsection (a), the Secretary of Homeland Security shall consider and examine the following:</text>
 <paragraph id="H756DE517F53B4429910D0B7B437B22DD"><enum>(1)</enum><text>Technology needs and challenges.</text> </paragraph><paragraph id="H953CCE68E0164BCF8FD1E91ECC823BF3"><enum>(2)</enum><text>Personnel needs and challenges.</text>
 </paragraph><paragraph id="HA4DB606F02C6450FB32A66503F592786"><enum>(3)</enum><text>The role of State, territorial, and local law enforcement in general border security activities.</text> </paragraph><paragraph id="H93066A2590CA4F1886BD61781064F5CA"><enum>(4)</enum><text>The need for cooperation among Federal, State, territorial, local, and appropriate international law enforcement entities relating to border security.</text>
 </paragraph><paragraph id="HAB3025D00FF34A04A775871FE0C8AFDF"><enum>(5)</enum><text>The geographic challenges of the maritime border.</text> </paragraph><paragraph id="H501E2DBEA2B74AA5AFE64CE7FAF54B02"><enum>(6)</enum><text>The impact and consequences of Hurricanes Harvey, Irma, Maria, and Nate on general border security activities with respect to the maritime border.</text>
 </paragraph></subsection><subsection id="H57089BC0BF174A5E9AB4FED20C9F3AAC"><enum>(c)</enum><header>Classified threat analysis</header><text>To the extent possible, the Secretary of Homeland Security shall submit the threat analysis required under subsection (a) in unclassified form. The Secretary may submit a portion of the threat analysis in classified form if the Secretary determines that such form is appropriate for such portion.</text>
