<section id="H603A1F8A02B34D4DA893459A72DDF7E2" section-type="section-one"><enum>1.</enum><header>Limitation on transfer of F–35 aircraft to Turkey</header> 
<subsection id="HEEFF4B1AC3B2488B833E132285FE7A6A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), none of the funds authorized to be appropriated to the Department of Defense or any other Federal department or agency may be used to—</text> <paragraph id="HBFD93632ADD8485E8FEC9B1D2C04A579"><enum>(1)</enum><text display-inline="yes-display-inline">facilitate the transfer, or authorize the transfer of, an F–35 aircraft to Turkey; or</text></paragraph> 
<paragraph id="H0E88CCDE531C46D08AFEA0C7D1648405"><enum>(2)</enum><text>transfer intellectual property or technical data necessary for or related to any maintenance or support of such F–35 aircraft.</text></paragraph></subsection> <subsection id="H3144FF03E2F1465AABEB1AC9393DFDD0"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The President may waive the limitation under subsection (a) upon written certification to Congress that the Government of Turkey is not—</text> 
<paragraph id="H1FE48031C99544C59F9ABE13E95D148D"><enum>(1)</enum><text display-inline="yes-display-inline">taking steps to degrade NATO interoperability;</text></paragraph> <paragraph id="HD1551665B1914611A3EC9F1117C2FA29"><enum>(2)</enum><text>exposing NATO assets to hostile actors;</text></paragraph> 
<paragraph id="HFE200BDBAF1541CDAE5A6E98ADFE8FF8"><enum>(3)</enum><text>degrading the general security of NATO member states;</text></paragraph> <paragraph id="HE4D81B31144A4984B2FB5DFE86A3B388"><enum>(4)</enum><text>seeking to import or purchase defense articles from a foreign country with respect to which sanctions are imposed by the United States;</text></paragraph> 
<paragraph id="HD974A1C13D664C018C8B42B0D917EAEB"><enum>(5)</enum><text>wrongfully or unlawfully detaining one or more nationals of the United States or aliens lawfully admitted for permanent residence in the United States; or</text></paragraph> <paragraph id="H1B5080539D9A4CDF839D5EAC7CFF3CBA"><enum>(6)</enum><text>engaging in military action without taking proper steps to ensure that international legal norms are followed to prevent civilian deaths and suffering.</text></paragraph></subsection></section>
