			 geothermal leases be paid to States for use to supplement the education of
			 students in kindergarten through grade 12 and public support of
			 institutions of higher education, and for other purposes.<pagebreak></pagebreak></official-title>

 <section id="H5706E266B2F54423846168229276B2C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Education and Energy Act of 2018</short-title></quote>.</text> </section><section id="HACD0DD7A1DAC41F5A626AF212467A25D"><enum>2.</enum><header>Use of revenues from new Federal mineral and geothermal leases for payments to State for education</header><text display-inline="no-display-inline">Section 35(a) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) is amended by inserting <quote>(1)</quote> before the first sentence, and by adding at the end the following new paragraph:</text>

				<paragraph id="H5688325F566E49A799A4195C09C7D113" indent="up1"><enum>(2)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H74AE56CC9B074ADBA923EAB2DD8A26B6"><enum>(A)</enum><text display-inline="yes-display-inline">Of amounts otherwise required under paragraph (1) to be deposited into the general fund of the Treasury each fiscal year that are derived from leases for tracts located in a State, the Secretary shall pay to the county from which the mineral or geothermal royalties were generated 33 percent for use to supplement the education of students in kindergarten through grade 12 and to supplement public support of institutions of higher education.</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="H6A5D4BD8629D42FB90D65D186DBF411E" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Of the amounts otherwise required under paragraph (1) to be deposited into the general fund of the Treasury each fiscal year that are not required to be used for payments under subparagraph (A) of this paragraph, the Secretary shall pay to States, in equal amounts, 17 percent for use to supplement the education of students in kindergarten through grade 12 and to supplement public support of institutions of higher education.</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="H63DD6EEE4AD5411FAE9471D0BD23AB6C" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>Subparagraphs (A) and (B) shall apply only with respect to amounts that—</text> <clause id="HC87C909111A446EEBEA12BAA531FB3F8"><enum>(i)</enum><text>are received by the United States under leases entered into under this Act or the Geothermal Steam Act of 1970 after the date of enactment of the <short-title>Education and Energy Act of 2018</short-title>; and</text>
 </clause><clause id="H292001CDF2F54DFCB2984AC27838E15F"><enum>(ii)</enum><text>exceed the amount of revenues that the Congressional Budget Office previously estimated would be received under such leases in the fiscal year.</text>
 </clause></subparagraph><subparagraph changed="added" committee-id="HII00" id="HDA3BDF96BE254163ACD1D16A15977F93" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>Subparagraphs (A) and (B) shall not apply with respect to amounts required by paragraph (1) to be paid into, reserved, or appropriated as part of the reclamation fund.</text>
 </subparagraph><subparagraph changed="added" committee-id="HII00" id="HAC6FDB12F994449381B755613000981D" indent="up1" reported-display-style="italic"><enum>(E)</enum><text display-inline="yes-display-inline">Any amounts received by a county under subparagraph (A) shall not be considered when calculating payments to that county under the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7101">16 U.S.C. 7101</external-xref> et seq.) or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
