			 Transition Administration and the Under Secretary for Veterans Economic
			 Opportunity and Transition of the Department of Veterans Affairs, to amend
			 the interest rate for certain loans guaranteed under the home loan program
			 of the Department of Veterans Affairs, and for other purposes.</official-title>

 <section id="HB3A9AE9352CD4EB8807B4BE4F5595EE6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Long-Term Care Veterans Choice Act</short-title></quote>.</text> </section><section id="H10CF5A7892834265A8C1B906B47E4E25" section-type="subsequent-section"><enum>2.</enum><header>Secretary of Veterans Affairs contract authority for placement of veterans in non-Department medical foster homes</header> <subsection id="H0F525123BDFB4CB48D10024BE162F931"><enum>(a)</enum><header>Authority</header><text>Section 1720 of title 38, United States Code, is amended by adding at the end the following new subsection:</text>
				<quoted-block id="H7372307AEC9049A5BEFF7A6D767266A9" style="OLC">
					<subsection id="H7C4E7B3417174ACB8B98F0A2D006BD48"><enum>(h)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="HA98B04BE6B654749ADFCFDBE01DD64CD"><enum>(1)</enum><text>During the three-year period beginning on October 1, 2019, and subject to paragraph (2), at the request of a veteran for whom the Secretary is required to provide nursing home care under section 1710A of this title, the Secretary may place the veteran in a medical foster home that meets Department standards, at the expense of the United States, pursuant to a contract, agreement, or other arrangement entered into between the Secretary and the medical foster home for such purpose. A veteran who is placed in a medical foster home under this subsection shall agree, as a condition of such placement, to accept home health services furnished by the Secretary under section 1717 of this title.</text>
 </paragraph><paragraph id="HC2FCF0FBCEB34A0E84D645B36552DBF1" indent="up1"><enum>(2)</enum><text>In any year, not more than a daily average of 900 veterans placed in a medical foster home, whether placed before or after the date of the enactment of this subsection, may have their care covered at the expense of the United States under subsection (a).</text>
 </paragraph><paragraph id="H8A984BB380D64CF39F121DF87136B17B" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>medical foster home</term> means a home designed to provide non-institutional, long-term, supportive care for veterans who are unable to live independently and prefer a family setting.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H5D071A2F89F7420AA464C2C4F2F52EBC"><enum>(b)</enum><header>Effective date</header><text>Subsection (h) of title 38, United States Code, as added by subsection (a), shall take effect on October 1, 2019.</text>
			</subsection></section><section display-inline="no-display-inline" id="H06857528B6AA442CAE43D4316B388776"><enum>3.</enum><header>Establishment of Veterans Economic Opportunity and Transition Administration</header>
			<subsection id="HD382140FDCEF4707864C4311B5D21323"><enum>(a)</enum><header>Veterans Economic Opportunity and Transition Administration</header>
 <paragraph id="H1C564292AA15465A80E21B193091C18C"><enum>(1)</enum><header>In general</header><text>Part V of title 38, United States Code, is amended by adding at the end the following new chapter:</text> <quoted-block display-inline="no-display-inline" id="HFCB4BC0D35C04910AFE9042365F9CA77" style="USC"> <chapter id="H29458DE7C15A4A2092E70DBC2348B074"><enum>80</enum><header>Veterans Economic Opportunity and Transition Administration</header> <toc container-level="chapter-container" idref="H29458DE7C15A4A2092E70DBC2348B074" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"> <toc-entry idref="HFF165CC30236464FBC3982173CB1C5B6" level="section">8001. Organization of Administration.</toc-entry> <toc-entry idref="H87EC421E74A045EBBC97F122B793A11D" level="section">8002. Annual report to Congress.</toc-entry></toc> <section id="HFF165CC30236464FBC3982173CB1C5B6"><enum>8001.</enum><header>Organization of Administration</header> <subsection id="H3D84B56226E240AAA383F45D7DD3E75F"><enum>(a)</enum><header>Veterans Economic Opportunity and Transition Administration</header><text display-inline="yes-display-inline">There is in the Department of Veterans Affairs a Veterans Economic Opportunity and Transition Administration. The primary function of the Veterans Economic Opportunity and Transition Administration is the administration of the programs of the Department that provide assistance related to economic opportunity to veterans and their dependents and survivors.</text>
 </subsection><subsection commented="no" id="H27E0529B6CB947BE8A23C3DD1B10FA71"><enum>(b)</enum><header>Under Secretary for Economic Opportunity and Transition</header><text display-inline="yes-display-inline">The Veterans Economic Opportunity and Transition Administration is under the Under Secretary for Veterans Economic Opportunity and Transition, who is directly responsible to the Secretary for the operations of the Administration.</text>
 </subsection></section><section id="H87EC421E74A045EBBC97F122B793A11D"><enum>8002.</enum><header>Functions of Administration</header><text display-inline="no-display-inline">The Veterans Economic Opportunity and Transition Administration is responsible for the administration of the following programs of the Department:</text>
 <paragraph id="HDC2F4B12F6AD445BBF31B039456501A0"><enum>(1)</enum><text>Vocational rehabilitation and employment programs.</text> </paragraph><paragraph id="H0F79AB3E6BB249938CDE4927F60B6F72"><enum>(2)</enum><text>Educational assistance programs.</text>
 </paragraph><paragraph id="HEAD76DF279B047FEA3BDBD320F0F6CB7"><enum>(3)</enum><text>Veterans’ housing loan and related programs.</text> </paragraph><paragraph commented="no" id="H47A5A2F7704B4496A82EE4161DD1CC6E"><enum>(4)</enum><text>The verification of small businesses owned and controlled by veterans pursuant to subsection (f) of section 8127 of this title, including the administration of the database of veteran-owned businesses described in such subsection.</text>
 </paragraph><paragraph id="H4AAFAB387BD2412EAD88A57E5925DB4C"><enum>(5)</enum><text>The Transition Assistance Program under section 1144 of title 10.</text> </paragraph><paragraph id="H8F3F2F44991A4FF5B127C214BC11B130"><enum>(6)</enum><text>Any other program of the Department that the Secretary determines appropriate.</text>
 </paragraph></section><section id="H043B4691AF434DA5857339459BC7A1A5"><enum>8003.</enum><header>Annual report to Congress</header><text display-inline="no-display-inline">The Secretary shall include in the annual report to the Congress required by section 529 of this title a report on the programs administered by the Under Secretary for Veterans Economic Opportunity and Transition. Each such report shall include the following with respect to each such program during the fiscal year covered by that report:</text>
 <paragraph commented="no" id="H45FAE116F94A405E8813AB8F09B3AB34"><enum>(1)</enum><text display-inline="yes-display-inline">The number of claims received.</text> </paragraph><paragraph commented="no" id="H2636793804EB45EB817D83F821560B2F"><enum>(2)</enum><text display-inline="yes-display-inline">The number of claims decided.</text>
 </paragraph><paragraph commented="no" id="H3F69746ABE954CD99193F27FABB43280"><enum>(3)</enum><text display-inline="yes-display-inline">The average processing time for a claim.</text> </paragraph><paragraph id="H36356A87F6DE415B9AAFC1202FC88E00"><enum>(4)</enum><text display-inline="yes-display-inline">The number of successful outcomes (as determined by the Secretary).</text>
 </paragraph><paragraph id="HC0C909BD8F1C48168CF9A4B3420DBC1E"><enum>(5)</enum><text display-inline="yes-display-inline">The number of full-time equivalent employees.</text> </paragraph><paragraph id="HFD89594397224CD98086AD2676941DA8"><enum>(6)</enum><text display-inline="yes-display-inline">The amounts expended for information technology.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HF95A6C7FE1D34F939B5386480D9F407F"><enum>(2)</enum><header>Clerical amendments</header><text>The tables of chapters at the beginning of title 38, United States Code, and of part V of title 38, United States Code, are each amended by inserting after the item relating to chapter 79 the following new item:</text>

 </paragraph></subsection><subsection id="H41142680E8574F92A270B11CBA3C9419"><enum>(b)</enum><header>Effective date</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/80">Chapter 80</external-xref> of title 38, United States Code, as added by subsection (a), shall take effect on October 1, 2019.</text>
 </subsection><subsection id="HF1F70F5BD2A9413383B993D5F8A9C411"><enum>(c)</enum><header>Full-Time employees</header><text display-inline="yes-display-inline">For fiscal years 2019 and 2020, the total number of full-time equivalent employees authorized for the Veterans Benefits Administration and the Veterans Economic Opportunity and Transition Administration, as established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/80">chapter 80</external-xref> of title 38, United States Code, as added by subsection (a), may not exceed 23,692.</text>
			</subsection></section><section id="H1B1D9EB624014DE9A53438C79FCF8B4C"><enum>4.</enum><header>Under Secretary for Veterans Economic Opportunity and Transition</header>
			<subsection id="H9F99A988FF0C4CE187B30FA89FCEAB00"><enum>(a)</enum><header>Under Secretary</header>
 <paragraph id="HD840B27108664DDAB729A1716A47D388"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/3">Chapter 3</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/306">section 306</external-xref> the following new section:</text>

						<section id="H2646D6A5DE7B474C935D3753765FB0C9"><enum>306A.</enum><header>Under Secretary for Veterans Economic Opportunity and Transition</header>
 <subsection id="HBCA91D9599984B3D85C8624A17F10B6D"><enum>(a)</enum><header>Under Secretary</header><text display-inline="yes-display-inline">There is in the Department an Under Secretary for Veterans Economic Opportunity and Transition, who is appointed by the President, by and with the advice and consent of the Senate. The Under Secretary for Veterans Economic Opportunity and Transition shall be appointed without regard to political affiliation or activity and solely on the basis of demonstrated ability in—</text>
 <paragraph id="H06A250BA1727403288679A4C62D27095"><enum>(1)</enum><text>information technology; and</text> </paragraph><paragraph id="H35DD3AA0CC6C489CA47343DF6EDCCCD1"><enum>(2)</enum><text>the administration of programs within the Veterans Economic Opportunity and Transition Administration or programs of similar content and scope.</text>
 </paragraph></subsection><subsection id="H79110BDF545441A48FEFBF197AB3A47C"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Under Secretary for Veterans Economic Opportunity and Transition is the head of, and is directly responsible to the Secretary for the operations of, the Veterans Economic Opportunity and Transition Administration.</text>
							</subsection><subsection id="HC6464B33C2864A69BE4518F4DA5968D6"><enum>(c)</enum><header>Vacancies</header>
 <paragraph commented="no" display-inline="yes-display-inline" id="HA21206A1CA1E451996AD4E65A98BA676"><enum>(1)</enum><text>Whenever a vacancy in the position of Under Secretary for Veterans Economic Opportunity and Transition occurs or is anticipated, the Secretary shall establish a commission to recommend individuals to the President for appointment to the position.</text>
 </paragraph><paragraph id="H69C9A0C88A4A40F2A0F095F7F8F56051" indent="up1"><enum>(2)</enum><text>A commission established under this subsection shall be composed of the following members appointed by the Secretary:</text>
 <subparagraph id="HB7B34E78587D46E789FE47EEF27A4E85"><enum>(A)</enum><text display-inline="yes-display-inline">Three persons representing education and training, vocational rehabilitation, employment, real estate, mortgage finance and related industries, and survivor benefits activities affected by the Veterans Economic Opportunity and Transition Administration.</text>
 </subparagraph><subparagraph id="H7B03A049ADC547BD90625EE6B5864240"><enum>(B)</enum><text>Two persons representing veterans served by the Veterans Economic Opportunity and Transition Administration.</text>
 </subparagraph><subparagraph id="H2575117EAAE446918F58413AA46CEDFE"><enum>(C)</enum><text>Two persons who have experience in the management of private sector benefits programs of similar content and scope to the economic opportunity and transition programs of the Department.</text>
 </subparagraph><subparagraph id="H029E2F4F44CB4A6787907EBC8DDE65BB"><enum>(D)</enum><text>The Deputy Secretary of Veterans Affairs.</text> </subparagraph><subparagraph commented="no" id="HF7E0B94D861D4673AC32AF23AF050377"><enum>(E)</enum><text>The chairman of the Veterans’ Advisory Committee on Education formed under section 3692 of this title.</text>
 </subparagraph><subparagraph id="HD061F7BCB1414D3BB3E92D98ACE6F08D"><enum>(F)</enum><text display-inline="yes-display-inline">One person who has held the position of Under Secretary for Veterans Economic Opportunity and Transition, if the Secretary determines that it is desirable for such person to be a member of the commission.</text>
 </subparagraph></paragraph><paragraph id="H35FC6C73AFCB40FFB4C33C0FAC417A0B" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A commission established under this subsection shall recommend at least three individuals for appointment to the position of Under Secretary for Veterans Economic Opportunity and Transition. The commission shall submit all recommendations to the Secretary. The Secretary shall forward the recommendations to the President and the Committees on Veterans’ Affairs of the Senate and House of Representatives with any comments the Secretary considers appropriate. Thereafter, the President may request the commission to recommend additional individuals for appointment.</text>
 </paragraph><paragraph id="H247B5563668B4C03B1C3410178951B9A" indent="up1"><enum>(4)</enum><text>The Assistant Secretary or Deputy Assistant Secretary of Veterans Affairs who performs personnel management and labor relations functions shall serve as the executive secretary of a commission established under this subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H2C9ADD9024684ABFB00780E85D5778BC"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 306 the following new item:</text>
