		<official-title display="yes">To amend the Rehabilitation Act of 1973 to clarify the definition of competitive integrated
			 employment.</official-title>

 <section id="H25C58613836C43C5A9D533E8CC267D67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workplace Choice and Flexibility for Individuals with Disabilities Act</short-title></quote>.</text> </section><section id="H80165BFE731E48A1B3A50FE4156E0612"><enum>2.</enum><header>Clarification of definition of competitive integrated employment</header><text display-inline="no-display-inline">Section 7(5) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705</external-xref>) is amended—</text>
 <paragraph id="HEE22EE95C5B6413B8317F7A1FAEF1F3A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text> <subparagraph id="H54E5AE1A2D63462489F4D210D6597B1B"><enum>(A)</enum><text>by striking <quote>not including</quote> and inserting <quote>including social and interpersonal interactions with colleagues, vendors, customers, superiors, or other such persons who the employee may come into contact with during the work day and across workplace settings, other than</quote>;</text>
 </subparagraph><subparagraph id="H258A9A30C75A44D6803A9A960B96156A"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, except that such interactions shall not be considered solely at the work unit level</quote>; and</text> </subparagraph><subparagraph id="H7934223881FE418B895A8D1B1CD3929A"><enum>(C)</enum><text>by striking <quote>and</quote> at the end;</text>
 </subparagraph></paragraph><paragraph id="H6EA6B3273C4849DDB69D0FE75CE5A81E"><enum>(2)</enum><text>by striking the period at the end of subparagraph (C) and inserting <quote>; and</quote>; and</text> </paragraph><paragraph id="H607010A462454943961D333F773B4752"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H00315D2A7EA24C37932B418A46478A21" style="OLC">
 <subparagraph id="H9B5AAD858DCE484A9D121B953A0DEBDC"><enum>(D)</enum><text display-inline="yes-display-inline">for which an individual may have been hired through—</text> <clause id="H7356648EC5D54AECBB1796D55C78D2D8"><enum>(i)</enum><text display-inline="yes-display-inline">contracts and subcontracts awarded pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/85">chapter 85</external-xref> of title 41, United States Code;</text>
 </clause><clause id="H5912B107475B46D8853E9D7ABF0095EC"><enum>(ii)</enum><text>State set-aside contracts intended to support employment for individuals with disabilities; or</text> </clause><clause id="H7DA5F14B8E424BFBAC539040FE0C6C20"><enum>(iii)</enum><text>other contracts subject to mandated direct labor-hour ratio of persons with disabilities.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section commented="no" id="H3AEAEE6418134FE2A366D00094E95C36"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in the amendments made by this Act shall be construed to reduce the number of jobs available for referral by a State agency or other entity.</text>
 </section><section commented="no" id="HF1DEB2C788784E88A1D2A5A22C8FD90B"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that individuals who are hired pursuant to community rehabilitation programs, <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/85">chapter 85</external-xref> of title 41, United States Code, State set-aside contracts, or mandated direct-labor hour ratio programs, should be considered—</text>
 <paragraph id="HD2977EB368774B858F88C39422F10B9E"><enum>(1)</enum><text>part of the competitive labor market; and</text> </paragraph><paragraph id="H8930C2CC14F8415A8F75A3CB27FC3D96"><enum>(2)</enum><text>an employment outcome for State vocational rehabilitation purposes.</text>
