	<legis-body id="HE44B9AAB8E704246886214DD3E0519F6" style="OLC">
 <section id="H17B9A5A29B2240F79D49EA156A4CBE97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pathway to Parenting Act of 2018</short-title></quote>.</text> </section><section id="H469A5F3D7ECC4B90BB1599E8D34ECB04" section-type="subsequent-section"><enum>2.</enum><header>Treatment of primary caretaker parents and other individuals in Federal prisons</header> <subsection id="H39BA0E5520C347A5BF06E55D280D95E8"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/303">Chapter 303</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD390301DDEB040C9B4B9F165649C2D00" style="USC">
					<section id="HD53BFE8F0628406B8394B21A6BFCE6D0"><enum>4050.</enum><header>Treatment of primary caretaker parents and other individuals</header>
 <subsection id="H9F58926CCF3D47F0B623A3C93EDAF887"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H0031BC2200AF4496868CD3705EE4384B"><enum>(1)</enum><text>the term <term>correctional officer</term> means a correctional officer of the Bureau of Prisons;</text>
 </paragraph><paragraph id="HAC1CA7AD36CA430ABC118DEC5A1DC380"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Bureau of Prisons;</text> </paragraph><paragraph id="H6AE8E9971CE942499E73DAAE07F6A402"><enum>(3)</enum><text>the term <term>primary caretaker parent</term> has the meaning given the term in section 31903 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13882">42 U.S.C. 13882</external-xref>); and</text>
 </paragraph><paragraph id="H5BF7398302A4425CAD1B197D188E5020"><enum>(4)</enum><text>the term <term>prisoner</term> means an individual who is incarcerated in a Federal penal or correctional institution.</text> </paragraph></subsection><subsection id="H0867DC74AF70476E8F2120229D15086A"><enum>(b)</enum><header>Geographic placement</header> <paragraph id="HD382BC5BCE144F7EB9B9537968F131B2"><enum>(1)</enum><header>Establishment of office</header><text>The Director shall establish within the Bureau of Prisons an office that determines the placement of prisoners.</text>
 </paragraph><paragraph id="H30805C54C076422EB3B0DFB942005BF9"><enum>(2)</enum><header>Placement of prisoners</header><text>In determining the placement of a prisoner, the office established under paragraph (1) shall—</text> <subparagraph id="H7897F29B8C9042E297A2977934B407C3"><enum>(A)</enum><text>if the prisoner has children, place the prisoner as close to the children as possible; and</text>
 </subparagraph><subparagraph id="H74F82BE7CE27492689D384015B17CF1F"><enum>(B)</enum><text>consider any other factor that the office determines appropriate.</text> </subparagraph></paragraph></subsection><subsection id="H65181E0BA50047088809F6EB860F7F90"><enum>(c)</enum><header>Visitation rules</header><text>The Director shall promulgate regulations for visitation between prisoners who are primary caretaker parents and their family members under which—</text>
 <paragraph id="H4A0E43CEE31645C5B4D37A715EA29336"><enum>(1)</enum><text>a prisoner may receive visits not fewer than 6 days per week, which shall include Saturday and Sunday;</text>
 </paragraph><paragraph id="HC9C0B47A53E74A5CBDAEA01ECAE391FF"><enum>(2)</enum><text>a Federal penal or correctional institution shall be open for visitation for not fewer than 8 hours per day;</text>
 </paragraph><paragraph id="H0641B220109C4A76ADA47D35ABEF82B4"><enum>(3)</enum><text>a prisoner may have up to 3 adult visitors and an unlimited number of child visitors per visit; and</text> </paragraph><paragraph id="H8C6BEE27E2404DD080CA986068891987"><enum>(4)</enum><text>a prisoner may have physical contact with visitors unless the prisoner presents an immediate physical danger to the visitors.</text>
							</paragraph></subsection><subsection id="H93EAEA9331294A3687CD978B23EB02F9"><enum>(d)</enum><header>Placement in segregated housing units; prohibition on shackling</header>
							<paragraph id="H9130D61A51BD4631BEBF961A7DB3C5A1"><enum>(1)</enum><header>Placement in segregated housing units</header>
 <subparagraph id="HE0110177C4BA45AF815C9DADE64B0295"><enum>(A)</enum><header>In general</header><text>A Federal penal or correctional institution may not place a prisoner who is pregnant or in the first 8 weeks of postpartum recovery in a segregated housing unit unless the prisoner presents an immediate risk of harm to others or herself.</text>
 </subparagraph><subparagraph id="H0A499CFA9375488A80B13CB46C8380D9"><enum>(B)</enum><header>Restrictions</header><text>Any placement of a prisoner described in subparagraph (A) in a segregated housing unit shall be limited and temporary.</text>
 </subparagraph></paragraph><paragraph id="H4E931B6EDE1C460BA321E8C120A82AAE"><enum>(2)</enum><header>Prohibition on shackling</header><text>A Federal penal or correctional institution may not use instruments of restraint, including handcuffs, chains, irons, straitjackets, or similar items, on a prisoner who is pregnant.</text>
 </paragraph></subsection><subsection id="HA298861A380E4C69A00102863F8DD40D"><enum>(e)</enum><header>Parenting classes</header><text>The Director shall provide parenting classes to each prisoner who is a primary caretaker parent.</text> </subsection><subsection id="H3B63692B7616462FB7A1EE0F168C756F"><enum>(f)</enum><header>Trauma-Informed care</header> <paragraph id="HF738DC39F05E4EA890C79F8237DA1A2C"><enum>(1)</enum><header>In general</header><text>The Director shall provide trauma-informed care to each prisoner who is diagnosed with trauma.</text>
 </paragraph><paragraph id="H8C7F98569638450F887BD90D8B652773"><enum>(2)</enum><header>Identification and referral</header><text>The Director shall provide training to each correctional officer and each other employee of the Bureau of Prisons who regularly interacts with prisoners, including health care professionals and instructors, to enable the employees to identify prisoners with trauma and refer those prisoners to the proper health care professional for treatment.</text>
 </paragraph></subsection><subsection id="H5E8505492279477A8C6E261D1EC96816"><enum>(g)</enum><header>Mentoring by former prisoners</header><text>The Director shall promulgate regulations under which an individual who was formerly incarcerated in a Federal penal or correctional institution may access such an institution to—</text>
 <paragraph id="H6B5D777945404DC9A8CAE55051DCD694"><enum>(1)</enum><text>act as a mentor for prisoners; and</text> </paragraph><paragraph id="HAC3CD8409C1444DB90D88D47AA6ECDA4"><enum>(2)</enum><text>assist prisoners in reentry.</text>
 </paragraph></subsection><subsection id="HE478E86D913D41F18D03C2C442758C82"><enum>(h)</enum><header>Ombudsman</header><text>The Attorney General shall designate an ombudsman to oversee and monitor, with respect to Federal penal and correctional institutions—</text>
 <paragraph id="H2F5B7FA9FEBF4334B9870C2B9683FCFA"><enum>(1)</enum><text>prisoner transportation;</text> </paragraph><paragraph id="HFE1D0BF94BD74A21A5417BCD015A2072"><enum>(2)</enum><text>use of segregated housing;</text>
 </paragraph><paragraph id="HF1EEAA8D2BA04087AF182640B58C2934"><enum>(3)</enum><text>strip searches of prisoners; and</text> </paragraph><paragraph id="H9316CA9CCC1A49B582BCFA3198025165"><enum>(4)</enum><text>civil rights violations.</text>
							</paragraph></subsection><subsection id="HA88026458BA740328C2F11D9F88D5EF0"><enum>(i)</enum><header>Telecommunications</header>
 <paragraph id="H6DE90D0B1FEB46BBA3BC0A9EAB7C7CC6"><enum>(1)</enum><header>In general</header><text>The Director—</text> <subparagraph id="HEA0D463A90B94508AECD599CD358F252"><enum>(A)</enum><text>may not charge a fee for a telephone call made by a prisoner to their child; and</text>
 </subparagraph><subparagraph id="H7309E3DA72F6483296A0F33E0BB98FDF"><enum>(B)</enum><text>shall make videoconferencing available to prisoners in each Federal penal or correctional institution, which shall be free of charge in the case of videoconference between a prisoner and the prisoner’s child.</text>
 </subparagraph></paragraph><paragraph id="H34FC9C6298C541A7B819620A219897AC"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in paragraph (1)(B) shall be construed to authorize the Director to use videoconferencing as a substitute for in-person visits.</text>
 </paragraph></subsection><subsection id="H07376928B4BE4DB59A073ACF60F44BDE"><enum>(j)</enum><header>Gynecologist access</header><text>The Director shall ensure that female prisoners have access to a gynecologist.</text> </subsection><subsection id="H51FB6A057A5042CCA1E2A08534247BAA"><enum>(k)</enum><header>Use of sex-Appropriate correctional officers</header> <paragraph id="HA314D0537CF542AD8D57B9CC45658C3F"><enum>(1)</enum><header>Regulations</header><text>The Director shall promulgate regulations under which—</text>
 <subparagraph id="HD1A1ACC15F7F4507B39C6F5F9D061F94"><enum>(A)</enum><text>a correctional officer may not conduct a strip search of a prisoner of the opposite sex unless—</text> <clause id="H27A22F19F9054C6AA97031054917689C"><enum>(i)</enum><text>the prisoner presents a risk of immediate harm to herself or himself or others; and</text>
 </clause><clause id="H69DE1E88E16A436ABF1154E6A007CA28"><enum>(ii)</enum><text>no other correctional officer of the same sex as the prisoner is available to assist; and</text> </clause></subparagraph><subparagraph id="H3931FF0A6FB04DED90ABA965D417E7D0"><enum>(B)</enum><text>a correctional officer may not enter a restroom reserved for prisoners of the opposite sex unless—</text>
									<clause id="H7BE179D6C74A457D992D3636831D9CA0"><enum>(i)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="H59DAF0D4DCD54EDDA4109EB1060490FB"><enum>(I)</enum><text>a prisoner in the restroom presents a risk of immediate harm to herself or himself or others; or</text> </subclause><subclause id="H67A4827879F942C0A77CC62B6F584689" indent="up1"><enum>(II)</enum><text>there is a medical emergency in the restroom; and</text>
 </subclause></clause><clause id="H0B8B867EEA5A494996298551A1AC5E7C"><enum>(ii)</enum><text>no other correctional officer of the appropriate sex is available to assist.</text> </clause></subparagraph></paragraph><paragraph id="HCFDEAEF796D0456BA9B8817B6CD6270A"><enum>(2)</enum><header>Relation to other laws</header><text>Nothing in paragraph (1) shall be construed to affect the requirements under the Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/15601">42 U.S.C. 15601</external-xref> et seq.).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC948163EA6314F59883F3C3EFADF9C55"><enum>(b)</enum><header>Substance abuse treatment</header><text>Section 3621(e) of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H9E42F2EB96B04FB79E18475A071C0C52" style="OLC"> <paragraph id="HB555632B905E41D79613BEAC7086CF22"><enum>(7)</enum><header>Eligibility of primary caretaker parents and pregnant women</header><text>The Bureau of Prisons may not prohibit a prisoner who is a primary caretaker parent (as defined in section 4050) or pregnant from participating in a program of residential substance abuse treatment provided under paragraph (1) based on the failure of the individual, before being committed to the custody of the Bureau, to disclose to any official that the individual had a substance abuse problem.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HD7F9CFB577294A2EB4F654603BE04229"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/303">chapter 303</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="HCB74102066B74929B5C4CDE43C6E1C90"><enum>3.</enum><header>Overnight visit pilot program</header>
 <subsection id="H0DDC3C21E4F54A9EBDB7DFB2659D8C3D"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H2F37038EF3D4417C8923F9436133CED7"><enum>(1)</enum><text>the term <term>Director</term> means the Director of the Bureau of Prisons;</text>
 </paragraph><paragraph id="H183DDDF49C09400386D552293A12FD6C"><enum>(2)</enum><text>the term <term>primary caretaker parent</term> has the meaning given the term in section 31903 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13882">42 U.S.C. 13882</external-xref>); and</text>
 </paragraph><paragraph id="H6F1CF19DEBDF4452B424A0A7D612A186"><enum>(3)</enum><text>the term <term>prisoner</term> means an individual who is incarcerated in a Federal penal or correctional institution.</text> </paragraph></subsection><subsection id="HC304CDAFE1E34FC1B7FAA1F06382E3DE"><enum>(b)</enum><header>Pilot program</header><text display-inline="yes-display-inline">The Director shall carry out a pilot program under which prisoners who are primary caretaker parents and meet eligibility criteria established by the Director may receive overnight visits from family members.</text>
 </subsection><subsection id="H17A5347AF93F42F1B528B9E839D7A2BD"><enum>(c)</enum><header>Eligibility criteria</header><text>In establishing eligibility criteria for the pilot program under subsection (b), the Director shall—</text>
 <paragraph id="H77E3408461C3443C8AD482187ACFBBBE"><enum>(1)</enum><text>require that a prisoner have displayed good behavior; and</text> </paragraph><paragraph id="H30ACDF0116554DEC9817546C3F46C148"><enum>(2)</enum><text>prohibit participation by any prisoner who has been convicted of a crime of violence (as defined in section 16 of title 18, United States Code).</text>
				</paragraph></subsection></section><section id="H63955A7458864F8D829C614BE1F8653B"><enum>4.</enum><header>Prenatal pilot program</header>
 <subsection id="HC23C7E8B57A04AAF93448C49F52B1436"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Director of the Bureau of Prisons shall carry out a pilot program in which provides prenatal care to groups of not more than 12 pregnant female prisoners (as such term is defined in section 3) in accordance with this section.</text>
 </subsection><subsection id="H5AC5CBC158F643B8BF39FC5AE4CBB059"><enum>(b)</enum><header>Meeting</header><text>The groups of prisoners described in subsection (a) shall meet not less than 10 times during pregnancy and the early postpartum period. Each such meeting shall be for a period of not less than 90 minutes and not more than 120 minutes, and shall be led by a facilitator appointed by the Director, who shall facilitate discussions among the participants, and provide the services described in subsection (c).</text>
 </subsection><subsection id="H00A7918F4AD44AA1A68F8B665345140A"><enum>(c)</enum><header>Comprehensive approach to prenatal care</header><text display-inline="yes-display-inline">The pilot program under this section shall integrate health, physical assessment, education, childcare skills, and other appropriate support.</text>
 </subsection><subsection id="HF4D339A9DA2B4E6F856F5876F57BADA4"><enum>(d)</enum><header>Facilitator requirements</header><text>Each facilitator appointed by the Director under subsection (b) shall have experience providing a comprehensive approach to prenatal care in a group setting, and shall be a physician or nurse practitioner licensed or certified to provide services in the field of obstetrics and gynecology.</text>
 </subsection></section><section id="H4C4D59D506B747E5A1A9EF53FAC1074D"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out sections 3 and 4, and, in addition to amounts otherwise made available, section 4050 of title 18, United States Code, $10,000,000 for each of fiscal years 2019 through 2023.</text>
