 <section id="HF4FD6B479ED742E1AF5CAD08C2082D51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Give Useful Information to Define Effective Compliance Act</short-title></quote> or the <quote><short-title>GUIDE Compliance Act</short-title></quote>.</text> </section><section id="HF23EE64BAFDC4D638E5BC75C6535AA43"><enum>2.</enum><header>Procedures for Bureau guidance</header><text display-inline="no-display-inline">Section 1022(b) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(b)</external-xref>) is amended by adding at the end the following:</text>

				<paragraph id="H6130063837914B219D902DA84189A897"><enum>(5)</enum><header>Procedures for Bureau guidance</header>
 <subparagraph id="H92F77322811C4E049A6ED4BD09FDE27F"><enum>(A)</enum><header>Definitions</header><text>In this paragraph—</text> <clause id="H70A7F65234AA4787854845B822DD6197"><enum>(i)</enum><text>the term <term>Bureau</term> means—</text>
 <subclause id="HF4861A626C3F4D6CB938619FDA1CC022"><enum>(I)</enum><text>the Director of the Bureau;</text> </subclause><subclause id="H25508D90DC34493FBF7E057290B2D9B1"><enum>(II)</enum><text>the Deputy Director of the Bureau; and</text>
 </subclause><subclause id="HF14C83DAE9974E2393ED3CA17B7A75E7"><enum>(III)</enum><text>any employee of the Bureau described in section 1013(a)(1)(B); and</text> </subclause></clause><clause id="HDE471E571DD24D238808DBC61F09F1F3"><enum>(ii)</enum><text>the term <term>guidance</term>—</text>
 <subclause id="H87E804A30A2545EAAB294C0FA583766D"><enum>(I)</enum><text display-inline="yes-display-inline">means—</text> <item id="HB86EFD935A7843C89B30795F321E541F"><enum>(aa)</enum><text>an agency statement of general applicability and future effect, other than a regulatory action, that sets forth a policy on a statutory, regulatory, or technical issue or an interpretation of a statutory or regulatory issue; and</text>
 </item><item id="H273BC48E78B741F092A95B10B8CFE9DC"><enum>(bb)</enum><text display-inline="yes-display-inline">any written interpretive rule, bulletin, statement of policy, letter, examination manual, frequently asked question, notice, directive, news release, blog post, small entity compliance guide, or other authoritative document issued by the Bureau regarding compliance with a Federal consumer financial law; and</text>
 </item></subclause><subclause id="H38A5ADA958644797BD49684B59210167"><enum>(II)</enum><text>does not include—</text> <item id="H786483C032444AEC95BFF084A8CBE405"><enum>(aa)</enum><text>a purely internal Bureau policy;</text>
 </item><item id="H3F0EC5358B3843FC961F2EC6B3379EDF"><enum>(bb)</enum><text>a law enforcement communication such as a complaint, consent order, judgment, legal opinion, warning letter, investigatory letter, notice of hearing, civil investigative demand, subpoena, no-action letter, advisory opinion, or any request in lieu of the foregoing;</text>
 </item><item id="H3667875250CA45B3A8A591430C3CF240"><enum>(cc)</enum><text>an individualized supervisory communication such as a supervisory letter, report of examination, memorandum of understanding, board resolution, matter requiring attention, or individualized communication or agreement pursuant to the supervisory authority of the Bureau; or</text>
 </item><item id="H10624BD977AB43348E09B9AB9E1E3B8F"><enum>(dd)</enum><text>a decision issued under subtitle E.</text> </item></subclause></clause></subparagraph><subparagraph id="H0573841C4C344127862F7B8370030673"><enum>(B)</enum><header>Guidance requirements</header><text display-inline="yes-display-inline">The Director shall issue guidance that is necessary or appropriate to enable the Bureau to carry out Federal consumer financial law, including facilitating compliance with such law.</text>
					</subparagraph><subparagraph id="HBE16CE342F844D77A0C4E9773CD3EFE1"><enum>(C)</enum><header>Rulemaking</header>
 <clause id="H544A96E207664DAAB90E5A7348BEFD29"><enum>(i)</enum><header>Proposed rule</header><text>Not later than 18 months after the date of enactment of this paragraph, the Bureau shall publish in the Federal Register and on the website of the Bureau a proposed rule defining—</text>
 <subclause id="H3C1B4F1E0F1C4C4A9BF16EEE5AB8D0B5"><enum>(I)</enum><text>each type of guidance the Bureau shall provide;</text> </subclause><subclause id="H582D86657E064422B8EE028A28F02993"><enum>(II)</enum><text>the criteria the Bureau shall use for selecting each type of guidance;</text>
 </subclause><subclause commented="no" id="H635B1A1785214D6B862F6658B4673073"><enum>(III)</enum><text>the process and timelines for requests for guidance;</text> </subclause><subclause commented="no" id="HB3BED0BB96F442E1B7334BE8E3288DA6"><enum>(IV)</enum><text>the time periods for the response of the Bureau to a request for each type of guidance; and</text>
 </subclause><subclause commented="no" id="HD12E9A4C935043E5858EC86490179BD0"><enum>(V)</enum><text>a process for amending or revoking guidance issued under the rule, including a process for public input on any proposal to amend or revoke guidance, unless the Bureau determines public input is not required due to public exigency.</text>
 </subclause></clause><clause id="HA37B08EC28BF4C0C8680F9FE1F7C60A5"><enum>(ii)</enum><header>Final rule</header><text>Not later than 1 year after the date on which the proposed rule described in clause (i) is published, the Bureau shall publish a final rule based on the proposed rule.</text>
 </clause></subparagraph><subparagraph commented="no" id="H79D3323F28604880A9256CE296D41901"><enum>(D)</enum><header>Reliance on Bureau guidance</header><text display-inline="yes-display-inline">No person shall be held liable for any act done or omitted in good faith in conformity with any applicable guidance from the Bureau or any predecessor agency that was in effect at the time of the act or omission, even if the guidance is later revoked, amended, or rendered inconsistent by guidance or action by the Bureau or a determination by a court of competent jurisdiction.</text>
					</subparagraph><subparagraph commented="no" id="H13D7676289504CDA964543A32DC49CA3"><enum>(E)</enum><header>Development of a penalty matrix</header>
 <clause commented="no" id="H7EC988FE5F024F678D2FE1DFC284C490"><enum>(i)</enum><header>Proposed rule</header><text>Not later than 18 months after the date of the enactment of this subparagraph, the Bureau shall publish in the Federal Register and on the website of the Bureau a proposed rule establishing guidelines for determining the size of any civil monetary penalties issued by the Bureau based on the severity of the actionable conduct in violation of a Federal consumer financial law and the level of culpability. The regulations prescribed under this paragraph shall, to the extent possible, align with any chart, matrix, rule, or guideline published by the Office of the Comptroller of the Currency, the Corporation, or the Board of Governors.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H673269805B6843589E716E2B010763A7"><enum>(ii)</enum><header display-inline="yes-display-inline">Final rule</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the proposed rule described in clause (i) is published, the Bureau shall publish a final rule based on the proposed rule.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
