<official-title display="yes">To provide for the transfer of certain Federal land in the State of Minnesota for the benefit of the Leech Lake Band of Ojibwe.</official-title>

<section id="H457E091D42134AE88BCAFF2DBEEF8A9A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leech Lake Band of Ojibwe Reservation Restoration Act</short-title></quote>.</text></section> <section id="HDA5E4EB981184B898D2C696F9C0144A7"><enum>2.</enum><header>Leech Lake Band of Ojibwe reservation restoration</header> <subsection id="H83451F269039433990AFB8061A110368"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H8DDB849D11054A9CA2BEF469DA3D2770"><enum>(1)</enum><text>the Federal land described in subsection (b)(1) was taken from members of the Leech Lake Band of Ojibwe during a period—</text> <subparagraph id="H801C8B9D2CF642BC845A8BB8DE4EE2EA"><enum>(A)</enum><text>beginning in 1948;</text></subparagraph> 
<subparagraph id="H016ABFF1869A4A269BF73797FD22F39A"><enum>(B)</enum><text>during which the Bureau of Indian Affairs incorrectly interpreted an order of the Secretary of the Interior to mean that the Department of the Interior had the authority to sell tribal allotments without the consent of a majority of the rightful landowners; and</text></subparagraph> <subparagraph id="HDA12F47C566348E29F2F84031A2F0083"><enum>(C)</enum><text>ending in 1959, when the Secretary of the Interior was—</text> 
<clause id="H5BC9969C9DE546D28CC69497ECEF9859"><enum>(i)</enum><text>advised that sales described in subparagraph (B) were illegal; and</text></clause> <clause id="HD7771CEF14AC4666B5A979890D28DB49"><enum>(ii)</enum><text>ordered to cease conducting those sales;</text></clause></subparagraph></paragraph> 
<paragraph id="H772C397F8FF947F48F73E5EA6B30E8C3"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HA8A0D03DBF0C4EF3A1661E9119AAC8DA"><enum>(A)</enum><text>the applicable statute of limitations prohibits individuals from pursuing through litigation the return of the land taken as described in paragraph (1); but</text></subparagraph> <subparagraph id="HEF451F3E6E6748FEA9AF06317F43BF1E" indent="up1"><enum>(B)</enum><text>a Federal judge ruled that the land could be restored to the affected individuals through the legislative process;</text></subparagraph></paragraph> 
<paragraph id="H91EDE080C6A141E786F95D014387C5F6"><enum>(3)</enum><text>a comprehensive review of the Federal land demonstrated that—</text> <subparagraph id="HCACA3D117454459880261B3F53C3B850"><enum>(A)</enum><text>a large portion of the Federal land is overloaded with—</text> 
<clause id="H1F6860E8F81947ACBA7588C62DBFEA23"><enum>(i)</enum><text>utility easements;</text></clause> <clause id="H4CAFEA0ABEC044AE972BB40B1513F931"><enum>(ii)</enum><text>rights-of-way for roads; and</text></clause> 
<clause id="HEA35695798394868B6B105FFDA7C760B"><enum>(iii)</enum><text>flowage and reservoir rights; and</text></clause></subparagraph> <subparagraph id="H555F6904A3A5493BA3547636C205ED82"><enum>(B)</enum><text>there are no cabins, campgrounds, lodges, or resorts located on any portion of the Federal land; and</text></subparagraph></paragraph> 
<paragraph id="HA7709B82679F4DBDA787562894685250"><enum>(4)</enum><text>on reacquisition by the Tribe of the Federal land, the Tribe—</text> <subparagraph id="H847F8A5EBCD549E4B145D0435717D5FD"><enum>(A)</enum><text>has pledged to respect the easements, rights-of-way, and other rights described in paragraph (3)(A); and</text></subparagraph> 
<subparagraph id="H93ECE2FDE326428DB7AFDC9B73E93985"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HAEC68FA53E9845A08B7166135A5FCE3D"><enum>(i)</enum><text>does not intend immediately to modify the use of the Federal land; but</text></clause> <clause id="H3C4D72E83FCE45A39241F047814040AE" indent="up1"><enum>(ii)</enum><text>will keep the Federal land in tax-exempt fee status as part of the Chippewa National Forest until the Tribe develops a plan that allows for a gradual subdivision of some tracts for economic and residential development by the Tribe.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HDEEA0F2FE3C943F5B11666B80B9EC6D0"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HAE288893FE134A0AAD7E72A428F55CFA"><enum>(1)</enum><header>Federal land</header> <subparagraph id="H7757DD1785024FEF9B6B3D13089C7D6C"><enum>(A)</enum><header>In general</header><text>The term <term>Federal land</term> means the approximately 11,760 acres of Federal land located in the Chippewa National Forest in Cass County, Minnesota, the boundaries of which shall be depicted on the map, and described in the legal description, submitted under subsection (d)(1)(B).</text></subparagraph> 
<subparagraph id="H049C5E5A0130462588634FBC89533227"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Federal land</term> includes—</text> <clause id="HA28B05191419409EAA310C901C87CE5C"><enum>(i)</enum><text>any improvement located on the Federal land described in subparagraph (A); and</text></clause> 
<clause id="HE1F54651DEFE4A0D801016C5FD91E250"><enum>(ii)</enum><text>any appurtenance to the Federal land.</text></clause></subparagraph></paragraph> <paragraph id="H7308A91699EB477DAF36F44C97D3C7A5"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph> 
<paragraph id="HC1B75D5044B94D83940B1A996F7F869D"><enum>(3)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Leech Lake Band of Ojibwe.</text></paragraph></subsection> <subsection id="H67B83733A0464E63AB9C48BB6ACA1068"><enum>(c)</enum><header>Transfer to reservation</header> <paragraph id="HCC1277A2E17B4FC18FB376F733B50FC9"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and paragraph (2), the Secretary shall transfer to the administrative jurisdiction of the Secretary of the Interior all right, title, and interest of the United States in and to the Federal land.</text></paragraph> 
<paragraph id="H15FFA52199454244A280330DF41D7F44"><enum>(2)</enum><header>Treatment</header><text>Effective immediately on the transfer under paragraph (1), the Federal land shall be—</text> <subparagraph id="H85AA996E873F456F9E12D0A36CD51525"><enum>(A)</enum><text>held in trust by the United States for the benefit of the Tribe; and</text></subparagraph> 
<subparagraph id="H2DF3831939E7490F9E3918B7B4008C96"><enum>(B)</enum><text>considered to be a part of the reservation of the Tribe.</text></subparagraph></paragraph></subsection> <subsection id="H8E2C8E81CA8B4E218C3F694D45F8D6A1"><enum>(d)</enum><header>Survey, map, and legal description</header> <paragraph id="H81ACFEFADD4C43F0B4407589EB01786A"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text> 
<subparagraph id="H5A146E3B1C4143F0887880340A64A878"><enum>(A)</enum><text>not later than 180 days after the date of enactment of this Act, complete a plan of survey to establish the boundaries of the Federal land; and</text></subparagraph> <subparagraph id="HB8BB2162FD6E4345BE55623FDBD30A0D"><enum>(B)</enum><text>as soon as practicable after the date of enactment of this Act, submit a map and legal description of the Federal land to—</text> 
<clause id="H22918BF81B6D4688A984E02AD17BAEAF"><enum>(i)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></clause> <clause id="H19C423A5DCEE4DB48D4FD442C2DE13E3"><enum>(ii)</enum><text>the Committee on Indian Affairs of the Senate.</text></clause></subparagraph></paragraph> 
<paragraph id="HAB4B73C3A38A46048AE0FBA2CB7263F9"><enum>(2)</enum><header>Force and effect</header><text>The map and legal description submitted under paragraph (1)(B) shall have the same force and effect as if included in this Act, except that the Secretary may correct any clerical or typographical error in the map or legal description.</text></paragraph> <paragraph id="H65A99312F7E4477A96CD00E651AEA6E1"><enum>(3)</enum><header>Public availability</header><text>The map and legal description submitted under paragraph (1)(B) shall be on file and available for public inspection in the office of the Secretary.</text></paragraph></subsection> 
<subsection id="HAFA83F1F05804A4DB690FD52A38CDA9C"><enum>(e)</enum><header>Administration</header> 
<paragraph id="H7996A6A1C08843738492301E10685EF5"><enum>(1)</enum><header>In general</header><text>Except as otherwise expressly provided in this section, nothing in this section affects any right or claim of the Tribe, as in existence on the date of enactment of this Act, to any land or interest in land.</text></paragraph> <paragraph id="H4FA3C4D5CDCE4AAF934A27DE7AB51D1B"><enum>(2)</enum><header>Prohibitions</header> <subparagraph id="HFF7717E26C3A44CAB7C8CF29AA84C187"><enum>(A)</enum><header>Exports of unprocessed logs</header><text>Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Federal land.</text></subparagraph> 
<subparagraph id="H9CF2DD0D611B4F4DAD7B96DAB7D9A19F"><enum>(B)</enum><header>Non-permissible use of land</header><text>The Federal land shall not be eligible or used for any gaming activity carried out under the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701</external-xref> et seq.).</text></subparagraph></paragraph> <paragraph id="H758587D443CA485AAA39AFAFF750AB51"><enum>(3)</enum><header>Forest management</header><text display-inline="yes-display-inline">Any commercial forestry activity carried out on the Federal land shall be managed in accordance with applicable Federal law.</text></paragraph></subsection></section>
