		<legis-type>A BILL</legis-type>
		<official-title display="yes">To amend the Homeland Security Act of 2002 to clarify that grants made pursuant to the Urban Area
			 Security Initiative and the State Homeland Security Grant Program may be
			 used to increase the preparedness of high-risk State, local, territorial,
			 and tribal governments against weapons of mass destruction and biological
			 and chemical attacks, and for other purposes.</official-title>

 <section id="H8190F26862154A8ABECED3AFD70E4437" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Defense Preparedness Act of 2018</short-title></quote>.</text> </section><section id="H9EE16756087942B787813F6C2308D462"><enum>2.</enum><header>WMD grants</header> <subsection id="H0C51CC9F19944FEF98C115F9492C9710"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title XX of the Homeland Security Act of 2002 is amended—</text>
 <paragraph id="H5B49D33861E54A45A21146875545EC36"><enum>(1)</enum><text>in section 2001 (<external-xref legal-doc="usc" parsable-cite="usc/6/601">6 U.S.C. 601</external-xref>)—</text> <subparagraph id="H2ED7375E3B424B6C82B66750932CAF62"><enum>(A)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), (6), (7), (8), (9), (10), (11), (12), (13), and (14) as paragraphs (2), (3), (4), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), and (16), respectively;</text>
 </subparagraph><subparagraph id="HF1834F7300564A20B1640961D708F99E"><enum>(B)</enum><text>by inserting before paragraph (2), as so redesignated, the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H2417068F67824C668524588D6356A15A" style="OLC"> <paragraph id="HA0934C368EF9412C984E71A4E84E7598"><enum>(1)</enum><header>Adversary country</header><text display-inline="yes-display-inline">The term <quote>adversary country</quote> means a country referred to or described as hostile or as an adversary country in the most recent National Security Strategy.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HFB8DF9D8A69243C3B052760545AA91EC"><enum>(C)</enum><text>by inserting after paragraph (4), as so redesignated, the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H178901821C6945BD8110B767B7C409DD" style="OLC"> <paragraph id="H5D21C5211D4F4F319876591F256D0914"><enum>(5)</enum><header>High-risk State</header><text>The term <quote>high-risk State</quote> means—</text>
 <subparagraph id="HBE541102DB614651A17F85032EAD17AD"><enum>(A)</enum><text>a State or territory that is geographically closest to known adversary countries; and</text> </subparagraph><subparagraph id="H6FF1EE6B53204EDC86B2C773C917D1EA"><enum>(B)</enum><text display-inline="yes-display-inline">a State or territory proven or determined by the Secretary, in consultation with the Secretary of Defense, to be highly susceptible to a rocket-propelled or other form of kinetically-delivered weapon of mass destruction from an adversary country.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="HB6504B744D7F480F904778D5AF87D084"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H3B7DD51B9A2C49BB8C7DEB0FDD7F977A" style="OLC"> <paragraph id="H3C71F2FE445544E491EA99DAE83B7244"><enum>(17)</enum><header>Weapon of mass destruction</header><text display-inline="yes-display-inline">The term <quote>weapon of mass destruction</quote> means—</text>
 <subparagraph id="HF0149C4BC9B548C09CC95E6FE4AC4138"><enum>(A)</enum><text display-inline="yes-display-inline">any explosive, incendiary, poison gas, or missile having an explosive or incendiary charge of more than one-quarter ounce; or</text>
 </subparagraph><subparagraph id="H6A9B400C03C34A359B00F018342040D8"><enum>(B)</enum><text>any weapon—</text> <clause id="HF55F71CEB4A94A1886F9CE482634CD90"><enum>(i)</enum><text>intended to cause widespread death or serious bodily injury through the release, dissemination, or impact of toxic chemicals or disease organisms; or</text>
 </clause><clause id="H475E95B562D54A2FA5B42091D4652EDD"><enum>(ii)</enum><text>that is designed to release radiation or radioactivity at a level dangerous to human life.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph commented="no" id="H16077D824AF3443E8A4B972468BB1F1D"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a) of section 2003 (<external-xref legal-doc="usc" parsable-cite="usc/6/604">6 U.S.C. 604</external-xref>), by inserting <quote>, including to assist high-risk urban areas to increase preparedness against rocket-propelled or other forms of kinetically-delivered weapons of mass destruction, including nuclear, biological, and chemical attacks</quote> before the period at the end;</text>
 </paragraph><paragraph id="H50EEA8A5EB7144A9A324CB2255062384"><enum>(3)</enum><text>in subsection (a) of section 2004 (<external-xref legal-doc="usc" parsable-cite="usc/6/605">6 U.S.C. 605</external-xref>), by inserting <quote>, including to assist high-risk States to increase preparedness against rocket-propelled or other forms of kinetically-delivered weapons of mass destruction, including nuclear, biological, and chemical attacks</quote> before the period at the end;</text>
 </paragraph><paragraph id="HCDCBBA92D5114F85B32BB9583EF816FA"><enum>(4)</enum><text>in subsection (b) of section 2007 (<external-xref legal-doc="usc" parsable-cite="usc/6/608">6 U.S.C. 608</external-xref>)—</text> <subparagraph id="HF7796DB100EA4D5B9064426A391DD63C"><enum>(A)</enum><text>by redesignating paragraph (9) as paragraph (10); and</text>
 </subparagraph><subparagraph id="H7DB183BB9E604AF4ACFAE1615334DB4A"><enum>(B)</enum><text>by inserting after paragraph (8) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H5FF0B776D42C4F30B814198695F980B0" style="OLC"> <paragraph commented="no" id="H96463707278B45E7B63F516F87646575"><enum>(9)</enum><text display-inline="yes-display-inline">Rocket-propelled or other form of kinetically-delivered weapon of mass destruction.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H62EB81069024450D8EB513242C706580"><enum>(5)</enum><text>in subsection (a) of section 2008 (<external-xref legal-doc="usc" parsable-cite="usc/6/609">6 U.S.C. 609</external-xref>)—</text> <subparagraph id="HDDE1EACC0E464D9FBF92534B5B12BFAA"><enum>(A)</enum><text>by redesignating paragraph (14) as paragraph (15); and</text>
 </subparagraph><subparagraph id="H3A8547A7192345F3AF39E6C77EC565D2"><enum>(B)</enum><text>by inserting after paragraph (13) the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H034323049C574D05903E2628BFD2AC69" style="OLC"> <paragraph id="HAF53581694984A4E830B702A6E0D1298"><enum>(14)</enum><text display-inline="yes-display-inline">joint projects with State, local, and tribal entities for the procurement of, building, and related training of biological weapons attack protective equipment, chemical weapons attack protective equipment, and nuclear weapons attack building reinforcement;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="HEA0CDFADECD240AEA4A5787337F844A5"><enum>(b)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Not later than December 31, 2018, and annually thereafter, the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate and make publically available on an internet website of the Department of Homeland Security a report on the number of grants made under sections 2003 and 2004 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/604">6 U.S.C. 604</external-xref> and 605) during the immediately preceding fiscal year, with specific information relating to the number of such grants that pertained to increasing preparedness against rocket-propelled or other forms of kinetically-delivered weapons of mass destruction (as such term is defined in section 2001 of the Homeland Security Act of 2002, as amended by subsection (a)(1)), including nuclear, biological, and chemical attacks.</text>
