<section id="H7D4C8F0D60DB40A79D0DFFD69030C6CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commercial Space Support Vehicle Act</short-title></quote>.</text></section> <section id="H378DC61912074EB48232A5B2F13010E3" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 50902 of title 51, United States Code, is amended—</text> 
<paragraph id="H5ADDE349B0F740D6B6A5C6A10BEFCD51"><enum>(1)</enum><text>by redesignating paragraphs (21) through (25) as paragraphs (23) through (27), respectively; and</text></paragraph> <paragraph id="H7AC04E10DAB34123A2BAB7B93AD58E52"><enum>(2)</enum><text>by inserting after paragraph (20) the following:</text>

<paragraph id="H3B7583BFA02C4E09B6CD3F2B4D638000" indent="down1"><enum>(21)</enum><text display-inline="yes-display-inline"><quote>space support flight</quote> means a flight in the air that is—</text> <subparagraph id="HC2D903141080412C918A2FFF9A0F716B"><enum>(A)</enum><text>not a launch or reentry; but</text></subparagraph> 
<subparagraph id="HA0AC16743DE644BCA5F1C2D37D36C897"><enum>(B)</enum><text display-inline="yes-display-inline">related to launch or reentry services.</text> </subparagraph></paragraph> <paragraph id="H659F2A0ABE7F4F14A1EC267930622606" indent="down1"><enum>(22)</enum><text><quote>space support vehicle</quote> means a vehicle that is—</text> 
<subparagraph id="HB66C8A989B454A78BDF275962DEE39A7"><enum>(A)</enum><text>a launch vehicle;</text></subparagraph> <subparagraph id="H7537712CD30F494E83B32BAF132395E4"><enum>(B)</enum><text>a reentry vehicle; or</text></subparagraph> 
<subparagraph id="H68FDE84B36AF4274BF4891CFAAD482CC"><enum>(C)</enum><text>a component of a launch or reentry vehicle.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H3D20C4D3AF9A4D2DB513939385DEFA63"><enum>3.</enum><header>Licensing of space support flights</header> <subsection id="H980E8DC1BFEF4EBBB797384DA412980B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 50904 of title 51, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HD0760497E627481CB397042C1BF1C8B6" display-inline="no-display-inline"> 
<subsection id="HD7CA519F806345A2B27904451DA8CA91"><enum>(e)</enum><header>Space support flights</header> 
<paragraph id="H2B8D6CA0724E47E5AEEB403F787B1803"><enum>(1)</enum><text>The Secretary of Transportation may issue or transfer a license for multiple space support flights of a space support vehicle to a citizen of the United States, but only if such citizen holds an operator license issued under this chapter for launch or reentry of such space support vehicle as, or included as a component of, a launch vehicle or reentry vehicle.</text> </paragraph> <paragraph id="H262CFF2915A9498C9385C90B82C67D9A"><enum>(2)</enum><text>A licensee may only carry out a space support flight of a space support vehicle under a license for carrying a person or property for compensation or hire if such flight lands at the same site from which the vehicle took flight.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H7CD3F4FFC45C488097ED7734BF4FAB6F"><enum>(b)</enum><header>Limitation on wavier of requirements</header><text>Section 50905(b)(3) of title 51, United States Code, is amended by inserting <quote>, or the operation of a space support vehicle,</quote> after <quote>or a reentry vehicle</quote>. </text></subsection></section> <section id="H22FCF654380540B49C4516100C3C1049"><enum>4.</enum><header>Experimental permits for space support flights</header><text display-inline="no-display-inline">Section 50906 of title 51, United States Code, is amended—</text> 
<paragraph id="H2C9940B21D994B09B9604BB8114DA5B2"><enum>(1)</enum><text>by striking subsection (d) and inserting the following: </text> <quoted-block style="OLC" id="HC538E19345774D8F80CF7D1AFD0C069B" display-inline="no-display-inline"> <subsection id="H7DFA8784DC6945E484C175D6EFA477F0"><enum>(d)</enum><text>The Secretary may issue a permit only for—</text> 
<paragraph id="HBD5331D67A4847B489453D6561FE4AE3"><enum>(1)</enum><text>reusable suborbital rockets or reusable launch vehicles that will be launched into a suborbital trajectory or reentered under that permit solely for—</text> <subparagraph id="H103730E90FBC4FBA9885FA022F275D03"><enum>(A)</enum><text>research and development to test design concepts, equipment, or operating techniques;</text></subparagraph> 
<subparagraph id="HBA17344A0B774883BD0B7953BEC440B6"><enum>(B)</enum><text>showing compliance with requirements as part of the process for obtaining a license for launch or reentry under this chapter; or</text></subparagraph> <subparagraph id="HB07A6F3DD459412FB531EEEDE44C1CAC"><enum>(C)</enum><text>crew training for a launch or reentry using the design of the rocket or vehicle for which the permit would be issued; or</text></subparagraph></paragraph> 
<paragraph id="H4996875BF979487F8AB24946B3EDE7F4"><enum>(2)</enum><text>a space support vehicle, or a vehicle that is in development to become a space support vehicle, operated by a citizen of the United States for space support flights that will be conducted under the permit for, or in support of, the purposes described in subparagraphs (A) through (C) of paragraph (1).</text> </paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H9D8B012030F048E3939E0F714B1A98A0"><enum>(2)</enum><text>by striking subsection (h) and inserting the following:</text> 
<quoted-block style="OLC" id="H14A2EC4DC15A4B0EAB6EEF73E0067B6B" display-inline="no-display-inline"> 
<subsection id="HBEA8F61574EA4402ABEC7305851AE797"><enum>(h)</enum><text>No person may, under a permit, operate a reusable suborbital rocket, reusable launch vehicle, or space support vehicle for carrying any property or human being for compensation or hire.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H6D9FC68AFA7742AEA884042C69EDF9F2"><enum>5.</enum><header>Communication and transparency</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to limit the authority of the Secretary of Transportation to discuss potential regulatory approaches, potential performance standards, or any other topic related to this Act and the amendments made by this Act with the commercial space industry prior to the issuance of a notice of proposed rulemaking. </text></section> 
<section id="HF1EA6BB3DCBC4775824B49124ABE5169"><enum>6.</enum><header>Applicability</header> 
<subsection id="H0955B717D41D4913B99E7045D142178A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on March 1, 2019.</text></subsection> <subsection id="HDDE6769A01E043B088636D3825E70EDB"><enum>(b)</enum><header>Regulations</header><text>The Secretary of Transportation may issue such regulations as are necessary to carry out the amendments made by this Act beginning on the date of enactment of this Act. </text> </subsection></section>
